The meeting was called to order by President Krueger at 6:30 P.M.
I. ROLL CALL
Present: President Carl Krueger; Trustees: Tim Schilz, Jeff Baker; Commissioners: Rob Guilbert, Ryan
Schmitz, Al Walters
Also Present: Nate Piotrowski, Community Development Director; Rebecca Boyle, Village Attorney

III. CONSIDERATION OF MINUTES: June 12, 2017 – Regular Meeting
It was moved by Commissioner Schmitz and seconded by Trustee Baker to approve the regular meeting minutes of
June 12, 2017. The motion carried unanimously.
IV. REPORT OF STAFF/COMMISSION MEMBERS
Mr. Piotrowski provided an update on the construction schedule of the BP gas station at 9051 N. Green Bay Road and
the proposed coffee shop tenant at 51st and Brown Deer Road.
V. UNFINISHED BUSINESS
None.
VI. NEW BUSINESS
A) Public Hearing and Recommendation on the rezoning of three parcels of land at the former
Celebrations Banquet Hall in the 4800 block of W. Goodrich Lane from PD – Planned
Development to R3 – Single Family Residential
Mr. Piotrowski reviewed the proposed rezoning.
President Krueger opened the public hearing at 6:33p.m.
Commissioner Guilbert asked about future residential development on Lot 4. Mr. Piotrowski explained that the
Village was going to list the lot for sale with the desire to have a commercial use located there. He explained a
commercial use was more desirable because the lot fronts on Bradley Road and would likely return more value to the
Village and the associated Tax Incremental Financing District. He added that it was possible that the lot would not
attract commercial interest but rather residential interest and this would be something the Village could consider at a
later date.
Trustee Baker asked if the lot could be top soiled and seeded so that it would have better curb appeal. Mr. Piotrowski
explained this was possible but there would be costs and benefits of doing that. Trustee Schilz indicated that he was in
support of improving the look of the lot.
President Krueger closed the public hearing at 6:43p.m.

It was moved by Commissioner Schmitz and seconded by Commissioner Walters to recommend approval of the
rezoning to the Village Board. The motion carried unanimously.
B) Review and Recommendation of a permanent Conditional Use Permit for an outdoor beer
garden and recreational activities at 7651 N. Teutonia Ave.
Mr. Piotrowski reviewed the item and indicated the extensive history of this conditional use.
Trustee Baker asked if the beer garden and recreational equipment was in use. Mr. Piotrowski replied that he was not
certain of its use but noted that there have been no complaints and the police department did not identify any issues.
Commissioner Schmitz asked if the permit review was officially delayed by the Commission in 2016. Mr. Piotrowski
replied that it was not and noted that the lack of review was purely coincidental and it provided for a larger sample
size to determine compatibility with the neighborhood. Commissioner Schmitz asked if it would make sense to
continue to delay the review given the past history. Attorney Boyle stated that this essentially occurred and suggested
that action be taken.
Trustee Schilz asked if the permit could be made permanent only for a set number of years or upon condition that
ownership remained the same. Attorney Boyle stated that the conditional use would go with the property and could
not be restricted to certain owners and suggested that a time frame for permanency was not appropriate.
President Krueger stated that it had been 2 years and there have been no identified issues. He added that he was
comfortable granting permanent status for the conditional use.
C) Review and Recommendation of a permanent Conditional Use Permit for a dry cleaning
establishment at 9055 N. 51st Street, Unit A.
Mr. Piotrowski reviewed the proposal and indicated that Staff did not have any issues with the use and recommended
its permanency.
D) Review and Recommendation of a permanent Conditional Use Permit for a transportation
company at 6051 W. Brown Deer Road
Mr. Piotrowski reviewed the proposal and indicated that Staff did not have any issues with the use and recommended
its permanency.
It was moved by Commissioner Schmitz and seconded by President Krueger to recommend approval of the
permanency of all three of the above conditional use permits to the Village Board. The motion carried unanimously.
VII. ADJOURNMENT
It was moved by Commissioner Schmitz and seconded by Commissioner Jaroczynski to adjourn at 7:03 P.M. The
motion carried unanimously.

COMPREHENSIVE PLAN REVIEW: X Staff has reviewed request for consistency with the Comprehensive Plan.
ANALYSIS:
When the Cousins was constructed in 1993 a development agreement authorized its use and contained the following language: “Any use of an outside loudspeaker system that is used as a means of placing/ordering food in conjunction with the operation of the drive-thru pick up window is prohibited” Staff and the current operator were unaware of this prohibition and as part of a recent remodeling, full drive-thru capabilities were added. Plans showing the new menu board and speaker system are included for your information (see the bubbled areas on plans for changes). It is assumed that as part of the initial Cousins approval there was concern about noise and traffic adversely impacting residential property to the south. At this time staff does not believe there is a significant traffic concern to the south and the impact of the outdoor ordering system is minimal. An amendment to the 1993 agreement, which would fully permit the new system, is included in the packet.
RECOMMENDATION:
Staff believes that allowing ordering (menu board and speaker) from the drive-thru will not adversely affect surrounding properties and suggests the amendment be recommended to the Village Board. Please feel free to contact Nate Piotrowski at (414) 371-3061, if you have any questions.

AMENDMENT TO COUSINS SUBS
DEVELOPMENT AGREEMENT
THIS DEVELOPMENT AGREEMENT entered into this _____ day of ______________, 2018 (hereinafter
referred to as the "Agreement"), by and between LEGACY SUBS LLC, a Wisconsin Company, hereinafter referred to
collectively or individually as “Developer”, and the VILLAGE OF BROWN DEER, a municipal corporation,
Milwaukee County, Wisconsin, hereinafter referred to as “Village”.
WITNESSETH:
WHEREAS, on June 11, 1993 WILLIAM SPECHT AND JAMES SHEPPARD AND COUSINS
SUMARINES SANDWICH SHOP SYSTEMS, INC, and the VILLAGE OF BROWN DEER entered into an
agreement for the development of retail sandwich shop, said Agreement being recorded in the office of the Register of
Deeds, Milwaukee County, Wisconsin on June24, 1993, as Document #6784724, in Reel 3062, Images 516-532,
inclusive, said Agreement appertaining to the following described real estate:

WHEREAS, a request has been made to the Village Board of The Village of Brown Deer, Milwaukee County,
Wisconsin, by the Developer for approval of an Amendment to said Development Agreement authorizing the
establishment of an drive-thru window and associated menu board plus equipment; and
WHEREAS, said Property is located in the B3 Commercial Zoning District and the aforementioned use is
considered conditional and was not permitted in the original agreement; and
WHEREAS, the Developer has submitted this document and plans as the Development Plan required pursuant to
the Zoning Code; and
WHEREAS, the covenants contained herein are necessary to provide for the harmonious, orderly and consistent
development of the neighborhood involved; and
WHEREAS, this Development Agreement shall be the plan of operations and shall be deemed to be in
compliance with Sec.121 of the Brown Deer Village Code if favorably approved by the Village Board; and
NOW, THEREFORE, the parties in consideration of the mutual covenants herein contained agree as follows:
1. The Village grants approval of a drive-thru pick up window, associated menu board and ordering
equipment as depicted on Exhibit 2.
2. The developer agrees that all permits/licenses/approvals shall be obtained with respect to this plan
modification.
3. If there are any code, law, ordinance or regulation violations, deficiencies, or any hazardous conditions
with respect to any use of the Development, or any Building or site improvements on the Development, the
Developer shall correct any hazardous conditions promptly after becoming aware of such hazardous conditions
and shall correct any other deficiencies or violations within thirty (30) days of written notification, to the extent
such deficiencies or violations can reasonably be corrected within such time period. In the event the deficiencies
or violations cannot be corrected within thirty (30) days of written notification, then such violations or
deficiencies shall be corrected as soon as reasonably practicable. This provision does not limit the Village from
taking any other action to enforce any provisions of the Village ordinances or this Agreement.
4. The covenants, agreements, restrictions and provisions herein contained constitute covenants
running with the land and shall be binding on all parties, their heirs, assigns and successors having an
interest in the land affected hereby for a period of twenty-five (25) years from the date this instrument is
recorded, after which time this instrument shall automatically be extended for successive periods of ten
(10) years. However, upon a showing of reasonable cause, the Board of the Village may relieve the
Developer from such covenants, agreements, restrictions, or any of them, before the expiration of twenty-
five (25) years or thereafter by the adoption of a resolution so doing. The covenants herein contained may
be enforced by proceedings at law or in equity by the Village against any person or persons violating or
attempting to violate the same. At such time as Developer transfer or conveys any interest in the
Development (after completion thereof and issuance of a final certificate of occupancy), any transferee
shall then be liable for all obligations hereunder that arise after the date of such transfer.
5. The invalidity of any of the covenants herein contained declared by any judgment or court order
shall in no way affect any of the other provisions herein contained which shall remain in full force and
effect.
6. This Development Agreement is hereby approved, including the attached Exhibits “1 and 2”, and
is accepted as meeting the criteria set forth in the Village of Brown Deer Village Code for the regulation
of the B3- Commercial District.
7. All notices hereunder must be in writing and shall be deemed validly given if sent via fax to the
number listed below, delivered personally, or is sent by certified mail, return receipt requested, addressed
as follows:

ANALYSIS:
Jewish Family Services completed the construction of Phase Two of their apartment project in 2015. As a part of this development they proposed to construct their own community center on a remnant piece in the center of the development (Lot 2 of 8614). The Community Center was never built and the land remains vacant (see included aerial) due to cost and overlap with the Village’s own Dolan Community Center. JFS is now proposing to utilize the vacant land for a park like green space that would feature a play area, community gardens and a shelter. There are two development agreements that were recorded in 2014 that previously authorized only the construction of a community center building and gardens on this parcel. Since this plan deviates from the initial proposal an amendment is required and a draft is included in the packet. Staff has reviewed the plans and finds no issues with the design. The landscape plan would necessitate Beautification Committee approval and building permits would be required for the shelter and fencing.
RECOMMENDATION:
Staff believes this amendment to the development agreement makes sense given that a Community Center building was not forthcoming and would duplicate Dolan Center features. Please feel free to contact Nate Piotrowski at (414) 371-3061, if you have any questions.

AMENDED BRADLEY CROSSING 54, LLC.
BRADLEY CROSSING APARTMENT COMPLEX PHASE 2,
OPERATIONAL DEVELOPMENT AGREEMENT
This AMENDED DEVELOPMENT AGREEMENT entered into this _____ day of ____________, 2018
(hereinafter referred to as the “Development Agreement” or in the alternative the “Agreement”), by and between
BRADLEY CROSSING 54, LLC, a Wisconsin Limited Liability Company (hereinafter referred to as the
“Developer”), and the VILLAGE OF BROWN DEER, a municipal corporation, Milwaukee County, Wisconsin
(hereinafter referred to as “Brown Deer” or the “Village”).
WITNESSETH:
WHEREAS, the Developer owns and operates a multiple family residential development on Lot 1 of
Certified Survey Map 8614 and Lot 3 of Certified Survey Map 8613, collectively known as the “Development”(see
attached Exhibit 1, the "Lots"); and
WHEREAS, the Developer previously intended to construct a community center building on Lot 2 of CSM
8614 for the benefit of the development; and
WHEREAS, plans for said community center and the build out of Lot 2 of CSM 8614 were covenanted in
two development agreements with the Village of Brown Deer, recorded with the Register of Deeds in Milwaukee
County, Wisconsin on July 22, 2014 as Document Numbers 10378793 and 10378789; and
WHEREAS, the Developer seeks to amend those plans and create a green space with gardens, open play
areas and equipment, a shelter, paths and benches on Lot 2 of CSM 8614, collectively known as “Green Space”; and
WHEREAS, an application has been made to the Village by the Developer for approval of this Agreement
authorizing and governing the operation of the Development; and
WHEREAS, said Development is located in the PD Planned Development District and the covenants
contained herein are necessary to provide for the harmonious, orderly and consistent development of the
neighborhood in which the Development is located; and
WHEREAS, this Operational Development Agreement shall be the Plan of Operations and shall be deemed
to be in compliance with Sec.121-247 and 121-251 of the Brown Deer Village Code if favorably recommended by
the Plan Commission and approved by the Village Board; and
NOW, THEREFORE, the parties in consideration of the mutual covenants herein contained agree as
follows:
1. Except for the construction of the improvements constituting the Green Space as specifically permitted
herein, no other buildings shall be constructed and no additions thereto shall be made on the above-described Green
Sapce without prior written approval of the Board of the Village.
2. Developer is hereby authorized to construct the Green Space in strict conformity with plans submitted to
and approved by the Village, said plans attached hereto, made a part hereof and marked as follows:

The Developer agrees that all plans shall require final approval of construction details by Village Staff, Village
Board or appropriate Village reviewing authority, before such plans can be implemented. Implicit in this covenant is
the right of the Village to require plan revisions, not inconsistent with applicable ordinances, or requests of required
boards and committees. Such approval is not to be unreasonably withheld, conditioned, or delayed.
3. Lot 2 of CSM 8614 shall be utilized as green space with, but not limited to, gardens, open play areas
and equipment, a shelter, paths and benches. All other uses beyond those described above shall be reviewed and
approved by the Village of Brown Deer.
4. The Developer agrees that all plans for public and private improvements to serve the Development shall be
approved by the Village and/or Building Inspector as applicable before such plans can be implemented. The
Developer shall bear all costs of said improvements.
5. The Developer shall promptly pay the costs of work undertaken by Developer and does hereby indemnify
the Village from any loss and hold it harmless from any liability for any debts or claims alleged to be due from the
Developer to any person, including any agent, contractor, employee or subcontractor employed by, or under,
Developer.
6. The Developer shall provide waste and recycling containers as a part of the Green Space.
7. Developer shall abide by applicable provisions of any Brown Deer ordinances.
8. Building permits for the construction of the proposed new improvements associated with the Green Space
may be issued upon execution of this Agreement.
9. All landscaping on the premises shall be maintained by the Developer in a state of good maintenance and
repair as determined by the Village. The Village will provide written notice to Developer of any defect, and if
Developer fails to correct the default within no less than thirty (30) days (weather permitting) after such notice is
delivered to Developer, the Village may do so and assess the cost against the Developer, to be collected as a special
tax. Landscaping for this purpose shall mean bushes, shrubbery, trees, grass and other items or appurtenances
necessary to maintain a pleasing and attractive appearance. Dead trees, bushes, vines and shrubbery shall be
immediately replaced in accordance with the approved landscape plan on file with the Village.
a) Vegetation shall be kept trimmed back from around lighting fixtures, fire hydrants and any other
utilities that extend from the ground or buildings.
b) Grass of a variety typical of sod and not to include that of a native prairie style or decorative grasses
designed for greater lengths shall be kept cut to a height of not more than six (6) inches.
c) A professionally prepared Landscaping Plan (Exhibit 3) shall be submitted for review and approval
by the Village of Brown Deer Beautification Committee. This document does not grant approval of
the landscape plan.
d) The Development must be kept clear of litter and debris.
e) The community gardens, if any, shall be maintained in good repair and free of defect.

10. Signs on the premises shall, at all times, conform to Village sign regulations as found in Section 121 of the
Brown Deer Village Code.
11. The Developer shall comply with Village Code performance standards relating to noise, vibration, odor,
smoke, dust, etc.
12. The Development shall be appropriately illuminated in order to protect public safety.
a) An exterior lighting plan shall be reviewed and approved by the Brown Deer Police Department.
b) Illumination of off-street parking and loading areas shall be arranged to shield the adjacent
properties and streets from direct rays of light and glare. No Development lighting shall trespass
more than 0.1 footcandles of horizontal illumination across adjoining or nearby residentially zoned
property lines and no more than 0.5 footcandles of horizontal illumination across adjoining or
nearby commercially zoned property lines as measured twelve (12) inches above grade.
c) All lighting fixtures shall be maintained in working order.
13. If there are any code, law, ordinance or regulation violations, deficiencies, or any hazardous conditions with
respect to any use of the Development, or any Building or site improvements on the Development, the Developer
shall correct any hazardous conditions immediately and shall correct any other deficiencies or violations within
thirty (30) days of written notification. This provision does not limit the Village from taking any other action to
enforce any provisions of the Village ordinances or this Agreement.
14. The covenants, agreements, restrictions and provisions herein contained constitute covenants running with
the land and shall be binding on all parties, their heirs, assigns and successors having an interest in the land affected
hereby for a period of twenty-five (25) years from the date this instrument is recorded, after which time this
instrument shall automatically be extended for successive periods of ten (10) years. However, upon a showing of
reasonable cause, the Board of the Village may relieve the Developer from such covenants, agreements, restrictions,
or any of them, before the expiration of twenty-five (25) years or thereafter by the adoption of a resolution so doing.
The covenants herein contained may be enforced by proceedings at law or in equity by the Village against any
person or persons violating or attempting to violate the same. At such time as Developer transfer or conveys any
interest in the Development (after completion thereof and issuance of a final certificate of occupancy), any
transferee shall then be liable for all obligations hereunder that arise after the date of such transfer.
15. The invalidity of any of the covenants herein contained declared by any judgment or court order shall in no
way affect any of the other provisions herein contained which shall remain in full force and effect.
16. This Development Agreement is hereby approved, including the attached Exhibits “1 through 4”, and is
accepted as meeting the criteria set forth in the Village of Brown Deer Zoning Code for the regulation of the PD-
Planned Development District.
17. All notices hereunder must be in writing and shall be deemed validly given if sent via fax to the number
listed below, delivered personally, or is sent by certified mail, return receipt requested, addressed as follows:

COMPREHENSIVE PLAN REVIEW: X Staff has reviewed request for consistency with the Comprehensive Plan.
ANALYSIS:
The Village is proposing to use all of the vacant parcel immediately south of Village Hall for a new Department of Public Works (DPW) office, garage and yard facility. The new facility would be approximately 51,000 square feet and include a new recycling center and salt dome. As part of this project the existing Police Department shooting range and garage (behind Village Hall) would be expanded for vehicle storage. The plan features the office building fronting on Arbon Drive with the garage and yard to the east. On the southern end there will be a publicly accessible recycling center for yard waste, mulch etc. The recycling center would be separate from the rest of the DPW yard and controlled by gated key card access. Public parking would be to the north of the new building, sharing a drive with the existing southern entrance to Village Hall. Per the Village’s settlement agreement with Rite Hite, the southern property will be bermed and heavily landscaped. The entire yard will be fenced and stormwater facilities will exist in the southeast corner of the site and to the west of the main garage building. The new facility is designed to accommodate all staff and existing equipment while allocating some space for modest growth. In the packet is a site plan and floor plans along with renderings and elevation details of the principal structure. To date the plans have been to the Building Board and Finance and Public Works for review and approval and will be vetted by the rest of the Village’s Boards and Committees prior to final approval at the Village Board. Once constructed, the current DPW site in the Original Village will be advertised for redevelopment.
RECOMMENDATION:
Staff believes this site plan accommodates the needs of the Department of Public Works, other Village departments and the community at large now and for the foreseeable future.
