PLAN AND ZONING COMMISSION MEETING MINUTES

March 5, 2019

CALL TO ORDER: The Plan and Zoning Commission called the meeting to order at 7 pm on Tuesday March 5, 2019.

ROLL CALL: Members Present: Jay Roloff, Steve Briney, Bob Buchanan, and Robert DeAtley.

Members Absent: Mike Buzicky, Damian Spencer, and Earl Seamands

Others Present: Planner Abby Heckman, and Administrative Assistant Teresa Karnes, and Village Attorney Joe Chamley (arrived at 7:14pm)

REVIEW/APPROVE MINUTES: December 4, 2018

Briney moved to approve both the December 4, 2018 minutes as submitted. DeAtley seconded the motion. ROLL CALL. ALL YES. Motion Passed.

ORDINANCES, RESOLUTIONS and MOTIONS (TO BE ACTED UPON):

2019 OFFICIAL ZONING MAP A RESOLUTION CONCERNING APPROVAL AND PUBLICATION OF THE 2019 OFFICIAL ZONING

Abby Heckman gave details of changes to the zoning map since the 2018 map was adopted.

Buchanan moved to recommend approval and adoption of the 2019 Official Zoning Map as presented. DeAtley seconded the motion. ROLL CALL. ALL YES. Motion Passed.

BE IT THEREFORE RESOLVED this 5th day of March, 2019 by the Plan and Zoning Commission of the Village of Mahomet, Illinois, that:

1. The Plan and Zoning Commission does hereby recommend the Board of Trustees approve and adopt themap, entitled, “2019 Official Zoning Map - Village of Mahomet, Illinois”, pursuant to Chapter 65, division5, Section 11-13-19 of the Illinois Municipal Code (65 ILCS 5/11-13-19) as the Official Zoning Map of theVillage of Mahomet.

2. The Plan and Zoning Commission does hereby recommend that Board of Trustees direct that the OfficialZoning Map be published and made available to the public, as required by statute.

DeAtley moved to approve MAP2018-01: PRAIRIE CROSSING FIFTH SUBDIVISION (FINAL PLAT) subject to the stated findings of fact and conditions as presented. Buchanan seconded the motion. ROLL CALL. ALL YES. Motion Passed. BE IT THEREFORE RESOLVED this 5th day of March, 2019, by the Plan and Zoning Commission of the Village of Mahomet, that: A. The Plan and Zoning Commission does hereby recommend APPROVAL / DENIAL of the Final Plat for the

Prairie Crossing Fifth Subdivision upon completion of modifications identified by the Village staff and does hereby authorize the Chairman to sign the Certificate of Approval of said Plat upon completion of said modifications.

B. The approval of the Final Plat recommended above is further subject to the following conditions:

1. Submission of all supporting documentation in proper form

2. The approval of the Final Plat recommended above is further subject to the review and approval of the Final Plat and supporting documents as applicable by other relevant agencies and utility service providers.

3. In the event that the modifications to the Final Plat are not completed, the outside agency reviews are

not completed, all supporting documents are not submitted in final form, or the conditions set forth above are not met within one hundred twenty (120) days from the date of approval by the Board of Trustees, the approvals recommended herein shall be null and void.

PUBLIC COMMENT: Colin Johnson and Tamara Johnson, 605 Orchard Drive, came forward to ask questions. Collin stated he was a boy scout and that he was doing a project where he needs to ask government officials questions relating to pools. Abby Heckman explained zoning regulations relating to pools. The PZC talked with Collin about what the PZC’s role would be if the community decided to put in a community pool. Tamera asked about the postcards that were sent out informing that they no longer need to use a pre-directional with their address. Abby Heckman explained addresses changed. COMMISSIONER COMMENTS: Mr. Buchanan explained challenges with the addressing change to his home address.

CASE: VAR2019-01: Circle K - 506 S Prairieview Road

PETITIONER: Municipal Resolutions (Karen Dodge, Representative) and Circle K (Owner)

REQUESTED ACTION: Two (2) variances are requested from the standards established by the Village of Mahomet Zoning Ordinance:

1. Allow a freestanding sign of 124.34± square feet remain, instead of the 50 square feet maximumallowed sign area (§ 152.072(D)(1)(b)),

2. Allow a sign directed toward users of an interstate highway to remain approximately 865 feet from theinterstate right-of-way, instead of the allowed 600-foot maximum distance from the interstate right of-way (§ 152.072(D)(7)(d)),

PUBLIC HEARING: Village Zoning Board of Appeals will conduct a public hearing at its regular meeting on April 17, 2019 at 7 p.m. Notice was published in the March 22, 2019 issue of the Mahomet Citizen.

LOCATION and SITE DESCRIPTION:

The subject property is located at 506 S Prairieview Road Mahomet, Illinois. It is located on Lot 100 of a Minor Replat of Parkhill Enterprises Subdivision. The lot is zoned C-2 General Commercial district. The lot has existing commercial structures located on it (convenience store, two (2) gas pump canopies, two (2) freestanding signs, and other accessory structures consistent with the principle use).

HISTORY:

The property was annexed into the Village July of 2017. All permits relating to zoning and structures on the site prior to annexation were handled by the Champaign County Planning and Zoning Department.

The current property owner has been issued sign permits relating to wall signage on the convenience store and the two (2) gas canopy structures. The permitted wall signage meets current Village zoning requirements.

CASE DETAILS:

The petitioner would like to change out the sign faces on the two (2) existing freestanding sign structures.

SIGN #1: Location - southwest corner of the property (along road frontage of Prairieview Road). Current / Proposed Sign Area - 124.34 SF Sign Area allowed by ZO - The maximum allowed sign area for properties zoned C-2 are 50 SF. Request to exceed ZO SF - Exceeds ZO allowance by 74.34 SF (a 149% increase).

SIGN #2: Location - southeast corner of the property approximately 865 feet from the Interstate 74 right-of-way.

Current / Proposed Sign Area – 145.9 SF Sign Area allowed by ZO – 220 SF, existing sign area meets sign area ZO requirement. Location allowed by ZO – The sign shall be directed primarily to users of an interstate highway and shall

be located within 600 feet of the interstate right-of-way and more than 150 feet from any residential use, school, park, church, hospital or nursing home.

Request to exceed ZO distance – Exceeds ZO allowance by 265 ft (a 44% increase). PROPOSED DEVELOPMENT’S CONFORMANCE TO ORDINANCES and COMPREHENSIVE PLAN:

The Village Comprehensive Plan designates the area which includes the subject property as part of the Northeast Mahomet Functional Framework Area. The character of this area can be described as disjointed due to the wide variety of density, character, and lack of connectivity. Many of the commercial businesses in this area were developed under County jurisdiction but have since been annexed into the Village. The Comp Plan specifically mentions encouraging existing commercial development in the area to provide site enhancement. A sign package was submitted to the Village for sign permit approval. All of the wall signs presented with the overall site signage package have been issued a permit in compliance with signage requirements in the Zoning Ordinance. The two (2) signs subject to the variance requests exceed the allowed sign area (Sign #1) and the maximum distance allowed for an interstate highway-oriented sign (Sign #2). The variance requests relating to freestanding signs have no proposed changes (other than changing existing sign faces) to the permanent freestanding signs currently existing on the site. Village staff recommended redesign of the freestanding sign along Prairieview Road (Sign #1) to attempt meeting zoning ordinance regulations or at least attempt to reduce the variance request. Nothing has been submitted by the applicant to attempt compliance or to reduce the impact of the non-conforming signage. The interstate-oriented sign (Sign #2) has minimal impact to the visual appeal along Prairieview Road because of the sign height and the placement of the sign at the southeast corner of the property. STANDARDS FOR VARIATIONS:

The Mahomet Zoning Ordinance sets forth the requirement that the Board of Appeals may grant a variance only when it is determined that all of the following conditions have been met. 1. There are special circumstances or conditions applying to the land or building for which the variance is sought; and, 2. The said special circumstances or conditions are peculiar to such land or buildings and do not apply generally to land

or buildings in this neighborhood; and, 3. The said special circumstances or conditions are such that the strict application of the provisions of the Zoning

Ordinance could deprive the applicant of the reasonable use of such land and building; and, 4. The granting of the requested variance is necessary for the reasonable use of the land and building; and, 5. The variance requested is the minimum variance that will accomplish this purpose; and, 6. The granting of the requested variance will be in harmony with the general purpose and intent of the Zoning

Ordinance; and, 7. The requested variance will not be injurious to the neighborhood or otherwise detrimental to the public welfare;

and, 8. The requested variance will not be in conflict with the Comprehensive Plan. DEVELOPMENT TEAM RECOMMENDATION:

The development team evaluated the case. A recommendation was made to the petitioner to attempt to redesign Sign #1 to reduce nonconformity with zoning regulations. No redesign was submitted by the applicant. The variance request for Sign #2 seems reasonable considering the sign has existed for many years and because of the minimal visual impact

along Prairieview Road. The PZC will need to determine any special circumstances as part of its recommendation and if the variance requests meet the eight (8) variance standards listed above. SUMMARY: A review of the factors and issues relevant to the requested variances are set forth above. The Plan and Zoning Commission acts in an advisory role to the Zoning Board of Appeals regarding variance requests. A draft resolution is attached for consideration by the PZC. RESOLUTION FOR PLAN AND ZONING COMMISSION

A Resolution Concerning a variance request from Circle K at 506 S Prairieview Road WHEREAS, the Board of Trustees of the Village of Mahomet, pursuant to the authority conferred by the Statutes of

the State of Illinois, has established certain standards and procedures, including Comprehensive Plan designations and policies for the use of land and for zoning establishment and amendment within the corporate Limits of the Village of Mahomet, Illinois; and,

WHEREAS, the Petitioner, Circle K, requested a variance for the property located at 506 S Prairieview Road; and, WHEREAS, the subject site is located on the east side of Prairieview Road approximately 300 feet north of the

intersection of S Prairieview Road and N Trailside Drive; and, WHEREAS, the legal description for the proposed variance is as follows:

Lot 100 of a Minor Replat of Parkhill Enterprises Subdivision, as per Plat recorded May 22, 2013 as Document Number 2013R11957, situated In Champaign County, Illinois.

WHEREAS, the two (2) requested variances are as follows:

WHEREAS, the Village staff reviewed the request and provided the technical background information to the Plan

and Zoning Commission; and, WHEREAS, the Plan and Zoning Commission met and reviewed the evidence and testimony submitted and

considered all of the available factual evidence concerning the requested action. BE IT THEREFORE RESOLVED this 2nd day of April, 2019 by the Plan and Zoning Commission of the Village of Mahomet that: 1) The Plan and Zoning Commission sets forth the following findings of fact concerning the requested variances;
