    Pursuant to subsection 222(4) of the Municipal Act, I hereby submit this appeal to By-Law No.3719-2016 being a By-law to Re-Divide The Corporation of the County of Prince Edward'sElectoral Ward Boundaries on the grounds that it is:

    In contravention of the Canadian Charter of Rights and Freedoms

    as expected in a free and democratic society

    And

    The process and the basis by which the Council of Prince Edward County

    made this decision was defective.

    That the Municipality of the County of Prince Edward decision:

     

    Violates Section 3 and 15 of the Canadian Charter of Rights and Freedoms

     

    Does not provide for effective representation  Lacks voter parity

      Fails to provide representative accountability and accessibility

      Creates an incoherent collection of communities.

      Fails to provide straight forward boundaries

      Fails to consider communities of interest

      Is based on a municipal and public process that was unfair

      Lacked informed criteria

      Failed to have proper advice

      Fails to consider population growth

      Failed to analyze that the decision to re-divide meets the tests of the Carter decision bythe Supreme Court of Canada

      Was created and relied on inaccurate and misleading data

    The matter of redistribution of Council Size and Ward boundaries has been ongoing since 2008and has been to the Board previously. The Council of Prince Edward County has proven it isincapable of making this decision in the best interest of the residents of Prince Edward Countyand within required parameters as outlined in law.     Ontario Municipal Board Decision include a remedy that will set the ward boundaries for theCounty of Prince Edward and may consequently affect the composition of Council

    Find attached the requisite filling fee in the form of a money order in the sum of $125 payable tothe Treasurer of Ontario.
