Continuing Education Liaison Report James Lee will sign the updated Memorandum of Understanding with Ohio Physical Therapy Association. Assistant Attorney General’s Report Melissa L. Wilburn, AAG, had no formal report for the Section. Ms. Wilburn notified the Section that she has been reassigned. Ms. Wilburn will continue to represent the Board until October 2017. The Section thanked Melissa L. Wilburn for her service. Case Review Liaison Report Chad Miller reported that the Enforcement Division closed nine and opened eight new cases since the July 20, 2017, meeting. There are seventeen cases currently open. There are eight disciplinary consent agreements and two adjudication order being monitored. Chad Miller informed the Section that Brian Riffe, PTA, complied with all the terms and conditions and was released from his disciplinary consent agreement. Enforcement Actions Chad Miller recommended that the Section issue a notice of opportunity for hearing for case number PT-FY18-003 for conviction of misdemeanor in the course of practice. Action: Ronald Kleinman moved that the Section issue a notice of opportunity for hearing for case number PT- FY18-003 for conviction of misdemeanor in the course of practice. Lynn Busdeker seconded the motion. James Lee and Chad Miller abstained from voting. The motion carried. Affidavit Hearing Good afternoon. My name is James Lee, Chairperson of the Physical Therapy Section of the Ohio Occupational Therapy, Physical Therapy and Athletic Trainers Board. Let the record show that these proceedings were called to order at 1:04 pm on July 20, 2017, at the Vern Riffe Center, 77 South High Street, Columbus, Ohio, 43215. Members of the Board present for the proceedings are: The Executive Assistant called roll: Lynn Busdeker Present Matthew Creed Present Erin Hofmeyer Present Ronald Kleinman Present James Lee Present Paul McGhee Present Timothy McIntire Absent Chad Miller Present Jennifer Wissinger Present It will be noted for the record that a majority of the members of the Board are present. There will be three adjudication proceedings today. The proceeding is in the matter of case number LD-PT-17-001, Lakshmi Krishnan. This proceeding shall be an affidavit–based adjudication relative to a Notice of Opportunity for Hearing mailed to the respondent in the aforementioned case and believed to have been properly serviced according to the Administrative Procedures Act (Chapter 119. of the Ohio Revised Code). As the respondent did not properly request a hearing in the case, this proceeding will be held before the board pursuant to Goldman v. State Medical Board of Ohio. The individual named does not have the ability to present written or oral testimony today, but may be present to hear the proceeding and outcome. You have already received sworn affidavit from the Board’s Enforcement Division Supervisor and Enforcement Division Investigator and accompanying exhibits for the Goldman Proceeding in your board packet. The affidavit contain the evidence and testimony upon which you will deliberate. Please take a few moments to review the evidence and testimony. In lieu of a stenographic record being made, let the minutes reflect the original sworn affidavits and exhibits shall be kept as the official record of the proceedings in the aforementioned matter in the Board office. I will now recognize Assistant Attorney General, Melissa Wilburn, for the purpose of providing a brief synopsis of the case. Ms. Wilburn reviewed the case for the Board. In the matter of case number LD-PT-17-001, Lakshmi Krishnan, after review of the evidence the Board makes the following findings of fact:
1. The Board had jurisdiction to conduct the hearing in this matter pursuant to Goldman v. State Medical Board of Ohio, 110 Ohio App. 3d 124, 673 N .E. 2d 677 ( 1996).
2. Krishnan did not request an R.C. 119 hearing on the aforementioned charge.
3. All the facts as stated in the affidavit are verified and true.
4. Krishnan lacks the educational qualifications to be licensed as a physical therapist assistant in the state of Ohio.
In the matter of case number LD-PT-17-001, Lakshmi Krishnan, after review of the evidence the Board makes the following conclusions of law:
1. Krishnan was properly served with the Notice of Opportunity for Hearing pursuant to R.C. 119.07.
2. R.C. 119.07 required Krishnan to request a hearing within thirty (30) days of the mailing of the Notice.
3. A preponderance of the evidence establishes that Krishnan lacks the educational qualifications to be licensed as a physical therapist assistant in the state of Ohio, as detailed in the Findings ofFacts, are grounds for license denial under Ohio Rev. Code§ 4755.47(A)(28), Ohio Rev. Code§ 4755.42l(A)(4), and Ohio Administrative Code §§ 4755-23-02(B).
Action: Jennifer Wissinger moved that the Section deny Lakshmi Krishnan’s application to be licensed as a physical therapist assistant by examination. Lynn Busdeker seconded the motion. Ohio Physical Therapy Practice Act does not vary with practice setting. Section 4755.481 of the Revised Code authorizes physical therapists to evaluate and treat without a physician’s referral. The physical therapist must, upon consent of the patient, parent, or legal guardian, inform the patient’s medical health professional of the physical therapy evaluation within five (5) business days of the evaluation having taken place. These laws and rules apply to all settings, and have been in effect since 2004. As section 4755.481(A) (2) (b) states that physician notification, within five business days with patient consent, is not necessary if the patient previously was diagnosed with chronic, neuromuscular, or developmental conditions and the evaluation, treatment, or services are being provided for problems or symptoms associated with one or more of those previously diagnosed conditions, physician notification would not be necessary for ongoing treatment of students with established developmental conditions in schools. In addition, there is nothing in the law that requires the physical therapist to see a patient without a physician’s referral. The physical therapist does have the discretion to request a prescription. Insert response It is the position of the PT Section that pursuant to section 4755.47 (A)(5) of the Ohio Revised Code, all licensed physical therapists must follow the code of ethical conduct for physical therapists and physical therapist assistants established in rule 4755-27-05 of the Ohio Administrative Code. PT5 November 2017 Kathleen Johnson, PT PT001588 [email protected] Dear Ms. Johnson: This letter is in response to your correspondence regarding supervising and cosigning notes for physical therapist assistants. Insert response Rule 4755-27-03(E)(6) of the Ohio Administrative Code states that “All documentation shall be co-signed by the supervising physical therapist” but does not specify time requirements for co-signing the physical therapist assistant’s notes. It is the position of the physical therapy section that the urgency of reviewing and co-signing notes may vary with the patient population and with the acuity of the patient’s condition. The physical therapist should be able to demonstrate that effective supervision was provided for the particular patient care delegated to the physical therapist assistant. To the extent that the co-signing of the note(s) in question represents providing timely documentation in the case of non-availability of the evaluating PT due to vacation or unforeseen absence, the PT section concurs with signature of that documentation performed by a PTA by a "covering" PT. The signing PT then assumes responsibility for that treatment encounter as the ultimate responsibility for care of the patient lies with the physical therapist. If the original evaluating PT will no longer be involved in the care of that patient, that evaluating PT must document transfer of care to an alternate competent PT. Abandonment is the inappropriate termination of a physical therapist/patient relationship by the physical therapist. Abandonment is generally alleged when the relationship is severed without reasonable notice at a time when the patient continues to require care. It is the position of the Physical Therapy Section that physical therapists have a legal and ethical obligation to make every effort to follow through with the plan of care established for the patients. Pursuant to section 4755.47 (A)(5) of the Ohio Revised Code, all licensed physical therapists must follow the code of ethical conduct for physical therapists and physical therapist assistants established in rule 4755-27-05 of the Administrative Code. Paragraph (B)(5) of this rule states that “a licensee shall adhere to the minimal standards of acceptable prevailing practice. Failure to adhere to minimal standards of practice, whether or not actual injury to a patient occurred, includes, but is not limited to: (h) Abandoning the patient by inappropriately terminating the patient practitioner relationship by the licensee.” Paragraph (B)(12) of this rule states “a licensee shall transfer the continuum of care of the patient, as appropriate, to another health care provider in the event of elective termination of physical therapy services by the licensee.” Section 4755.47 (A)(5) of the Revised Code authorizes the Physical Therapy Section to take disciplinary action against a physical therapist who violates any of the provisions contained in rule 4755-27-05 of the Administrative Code.
