ESPC Task Order - Legislation Requirement:– Notify all contract holders– Select 2 or more to engage in discussions– Select 1 or more to:• study the site, and• submit a firm fixed price proposal

– Debrief unsuccessful offerors– Negotiate and issue TO to selected ESCO

This process satisfies the “fair opportunity” requirement for ESPC task orders
