Don’t Ask At First? Council may vote today on removing criminalhistory from start of hiring process Supporters say ex-offenders wouldget a fair chance Foes suggest anti-discrimination lawsuits could resultEver since a drunken-dri-ving arrest in 2002, RodneyByrd has been trying to getemployers to judge him onhis qualifications of work-ing more than 15 years inthe health care industry.“It’s like I try to seek em-ployment and I get onlineand fill out application andthey ask ‘Have you ever beenarrested’ and I gotta tell thetruth,” the 55-year-old said.“That’s a mark against you.”

Byrd and thousands ofex-offenders in Philadel-phia are hoping that markwill be removed or at leastcovered today. City Councilis expected to vote on a billreferred to as “Ban the

Box,” referring to the boxon job applications askingwhether a person has everbeen convicted of a crime.

Employers would be pro-hibited from asking aboutan applicant’s criminal his-tory until after the first in-terview unless otherwise re-quired by state or federallaw, such as those whichmandate backgroundchecks for law-enforcementand child-care jobs. Not on-ly would the ban apply topublic employers, butPhiladelphia would becomethe first city in the U.S. toinclude private employers— following the lead ofHawaii and Massachusetts.

Satirical skit aboutdwarves leads to lawsuit

A photograph for a story about genetic testing was reused for comedyA South Jersey couple says it was defamation Comcast is a defendant

A married Collingswood,N.J., couple, both achon-droplastic dwarves, recent-ly filed a defamation suitagainst Comcast, E! Enter-tainment Television andthe host of the “The Soup”for misrepresenting themin a skit on the satiricalprogram.

In 2006, Cara and Gib-son Reynolds were pho-tographed by the Associat-ed Press for a story aboutthe controversies sur-rounding genetic screen-ing.

The photo caption stat-ed their “newborn diedfrom a genetic conditionlinked to dwarfism.” Threeyears later, a doctored ver-sion of the photograph was

used, without AP permis-sion, in a “Soup” skit abouta fake reality show called“Fertile Little Tattooed Pag-eant Parents Who EnjoyBaking.”

“The piece depicted awoman purported to beCara Reynolds in labor, inthe process of giving birthin a bathroom,” the suitfiled March 24 in Philadel-phia Common Pleas Courtstates.

The Reynolds’ were inthe process of adopting achild from China, also anachondroplastic dwarf, and were concerned the“false and misleading in-formation … would jeop-ardize the adoptionprocess.”

The Reynolds also suf-fered “anxiety, depression, insomnia … and feelingsof shame and degrada-tion.” They are suing for atleast $50,000 on eachcount of defamation, mis-appropriation of likeness, false light, intentional andnegligent infliction ofemotional distress and un-just enrichment.

Comcast referred allquestions yesterday to E!Entertainment Television;a vice president of corpo-rate communications de-clined to answer ques-tions about pending litiga-tion.

Not for laughs

Excerpts from the

Reynolds’ lawsuit:

Plaintiffs were never asked

to consent, nor did they

ever consent, to any use of

their photo other than for

the article for which they

were interviewed.

[The photograph] was al-tered to show a crown anda beauty pageant sash onMrs. Reynolds and tattooson both Mr. and Mrs.

Reynolds. Dozens of chil-dren were added to thefront yard in front of Mr.and Mrs. Reynolds to makegood on the promotionthat these are “happydwarves … that can’t stopprocreating.”The description of the cou-

ple as “fertile little people”

caused them to relive the

pain and grief they experi-

enced with the loss of their

newborn daughter Tracy

Reynolds in 2005 and their

ongoing fertility issues.

It reminded me of BritneySpears, when she debuted ina schoolgirl outfit posing suggestively.Yes, she set a template for alot of the confusion thatcame after and was ironi-cally a direct outgrowth ofthe Girl Power movement— she had an impact onthe way Girl Power wascommodified and changed. On the one hand, she was abreakthrough because shewas a girl who was a starfor girls, as opposed to, say,David Cassidy or BobbySherman or the JonasBrothers today. But as such, she had this whole differ-ent approach. She was atonce selling chastity andsex and combining them inthis really weird way.

And she was doing this for real-ly little girls when she started. It’s hard to remembernow, but one of her centralfan bases was 6-year-oldgirls, who would go to herconcerts and scream andshout. She always talkedabout being a virgin. Andshe’d say, if you see me as aLolita, that’s your problem. But everything she didcompletely contradictedthat. It’s this weird thingwhere she was sexualizinginnocence and fetishizing

it. So it was an ultimatelyincredibly disempoweringstance for girls to see.

And what’s been the falloutall these years later? The culture has taken upthat message. It plays intothe diva culture of littlegirls right now, that acceler-ated makeup and hot dancemoves, with Miley Cyrusand the like. I want to beclear: I don’t come at thisfrom a perspective to benegative about sexuality. It’s just that when little girlshave inappropriate sexuali-ty — however it’s imposed,by pop culture or adultsthey love — they don’t un-derstand it. The risk is thatthey never connect it andsexiness becomes a per-formance for them ratherthan something that in-volves intimacy. Insteadthey see sexiness as some-thing they do for the pleas-ure and entertainment forothers. As if self-objectifica-tion was a rite of passage.

You see that today: Young girls“sext” naked photos of them-selves to their boyfriends. With sexting, there’s also an

issue of sexual entitlement.Girls are feeling like theyhave to perform the ideathat they’re comfortablewith their sexuality. Andyou have to wonder, what isit that they’re getting? Theydon’t have pleasure or con-trol. What is the reality ofwhat that act gives them? It’s not anything healthy.

So what are parents supposedto do?First, it’s about limitingtheir access to media andsuch, when they’re reallylittle. And also trying to ex-pand their ideas of whothey are and what they canbe, that’s not linked con-stantly to playing at prettyor sassy (which is sexywith training wheels). Edu-cate them and yourself.

Who is your daughter Daisyidolizing these days?Well, this is going to soundpolitically correct but it’strue. We went to a dinnerthe other night where this99-year-old judo championwas being honored. Shewas talking about how oneshould be gentle, strongand beautiful. To illustrate“gentle” and “strong,” shesaid she could walk up to aman twice her size (whichwouldn’t be hard, she wasabout 4-foot-9) and touchhim with her index fingerand he would collapse. And by beautiful, shemeant not the externalsbut a beautiful heart. I toldDaisy, “Look at her, isn’tshe amazing!” She was tak-en. She was into it.

The fallout of Britney’s

sexualityAs pop star releases new album,

author takes a look at how Britney’s past actions are affecting young girls Fears that girls see sexuality

as a performance and not intimacy

“When little girlshave inappropriatesexuality —however it’simposed, by popculture or adultsthey love — theydon’t understand it.The risk is that theynever connect it andsexiness becomes aperformance forthem rather thansomething thatinvolves intimacy.”ORENSTEIN

JANUVIA works to lower blood sugar in 2 ways. Talk to your doctor about JANUVIA today.

• JANUVIA is a once-daily prescription pill that helps your body increase the insulin made in your pancreas and decrease the sugar made in your liver.

• Along with diet and exercise, JANUVIA helps lower blood sugar levels in adults with type 2 diabetes.• JANUVIA is not likely to cause weight gain or low blood sugar (hypoglycemia).

Having trouble paying for your Merck medicine?Merck may be able to help. www.merck.com/merckhelps

Please see the Medication Guide on the next page and discuss it with your doctor.

JANUVIA (jah-NEW-vee-ah) should not be used in patients with type 1 diabetes or with diabetic ketoacidosis (increased ketones in the blood or urine). If you have had pancreatitis (inflammation of the pancreas), it is not known if you have a higher chance of getting it while taking JANUVIA.

Selected Risk Information About JANUVIA: Serious side effects can happen in people who take JANUVIA, including pancreatitis, which may be severe and lead to death. Before you start taking JANUVIA, tell your doctor if you’ve ever had pancreatitis. Stop taking JANUVIA and call your doctor right away if you have pain in your stomach area (abdomen) that is severe and will not go away. The pain may be felt going from your abdomen through to your back. The pain may happen with or without vomiting. These may be symptoms of pancreatitis.

Do not take JANUVIA if you are allergic to any of its ingredients, including sitagliptin. Symptoms of serious allergic reactions to JANUVIA, including rash, hives, and swelling of the face, lips, tongue, and throat that may cause difficulty breathing or swallowing, can occur. If you have any symptoms of a serious allergic reaction, stop taking JANUVIA and call your doctor right away.

If you take JANUVIA with another medicine that can cause low blood sugar (hypoglycemia), such as a sulfonylurea or insulin, your risk of getting low blood sugar is higher. The dose of your sulfonylurea medicine or insulin may need to be lowered while you use JANUVIA. Signs and symptoms of low blood sugar may include headache, drowsiness, weakness, dizziness, confusion, irritability, hunger, fast heart beat, sweating, and feeling jittery.

Your doctor may do blood tests before and during treatment with JANUVIA to see how well your kidneys are working. Based on these results, your doctor may change your dose of JANUVIA. The most common side effects of JANUVIA are upper respiratory tract infection, stuffy or runny nose and sore throat, and headache.

Cut Copy are more thanmastermind Dan Whitford.

Though the native ofMelbourne, Australia, start-ed the band as a solo proj-ect, the success of CutCopy’s first two albums —2004’s “Bright Like NeonLove” and 2008’s “In GhostColours” — has resulted inthe disco-funk outfit’s num-ber swelling to four, includ-ing bassist Ben Browning.

We caught up with a sleepy,jet-lagged Browning whilein the midst of Cut Copy’sworld tour.

The latest album, “Zono-scope,” was largely devel-oped through jam sessions,he explains.

“We flesh some of it outas a band. It’s a jam-and-see-where-things-fall kind of ap-proach,” Browning says.“Then Dan does a bit of re-

fining and then we putthings together in a morefinished way.”

Then, to add to thespacey, dreamlike tones, they brought in Ben Allen ofAnimal Collective to put thefinal flourishes on “Zono-scope.”

“The album was sound-ing how we thought itshould sound to some de-gree when we took it to At-

lanta, but we wanted him towork on it because of thework he’s done with Ani-mal Collective,” Browningexplains. “And he had thisslightly strange backgroundof having done hip-hop andstuff like that.”

1Roy Halladay, RHP

2011 projections:24 wins, 2.12 ERA

What he throws: Fastball (93 mph range),curveball, changeup andcutter with unparalleledcontrol.

Scouting report:Halladay will go after hit-ters, pound the plate andprobably lead the leaguein complete games. “He’sthe best pitcher inbaseball,” Yankees GMBrian Cashman said.

Halladay is perhaps themost intense hurler sinceSteve Carlton. He treatsspring training like theplayoffs, as evidenced byhis 0.42 ERA in the Grapefruit League.

2Cliff Lee, LHP

2011 projections:19 wins, 2.37 ERA

What he throws: Fastball (89-92 mph range),cutter, curveball, two- andfour-seam fastball, sliderand changeup.

Scouting report:Not a power pitcher, buthas exceptional control ofall six pitches. Lee is a fastworker, pounds the plateand is capable of finishinggames, just like Halladay.

“Cliff Lee is a greatpitcher,” Jayson Werthsaid. “He’s one of the bestin the game. He’s the kindof guy you pay to seepitch. He’s that good.”

Especially in theplayoffs, where he’s gone7-2 with a 2.13 ERA.

3Roy Oswalt, RHP

2011 projections:13 wins, 3.33 ERA

What he throws: Fastball (93 mph), slider, changeup, curveball.

Scouting report: Yet another Phillies ace,who challenges hitters. His curve — a beautiful12-6 hook that arrives atabout 69 mph, is devas-tating after a heater.

“You know what youget from Roy Oswaltevery year,” JimmyRollins said. “He’s anelite starter.”

Oswalt is the mostconsistent pitcher in thepast decade — without alosing season in hiscareer (since 2001).

4Cole Hamels, LHP

2011 projections:17 wins, 2.86 ERA

What he throws: Devastating changeup, complemented by fastballthat can hit 94 mph.Added nasty cutter lastseason.

Scouting report:Sometimes Hamels mixesin occasional curve, whichhe has never fully trusted.Hamels, 27, is theyoungest of the four aces.

“The thing that’s scaryabout Hamels is that hecould become much betterthan he is right now,” Roy-als OF Jeff Francoeur said. “I played in the minorsagainst him. He was toughthen. He’s very good now. He’s a special pitcher.”

Meet the Phab Four (+ Joe)

5Joe Blanton, RHP

2011 projections:12 wins, 4.25 ERA

What he throws: Fastball (87-91 mphrange), curveball, cutter, slider and changeup.

Scouting report:Gets by with deceptionover power. Big questionis: Can Blanton get outof the first without giv-ing up runs? Whenhealthy, he eats innings.

“If Joe Blanton is yourfifth starter, you have areally good rotation,”Yanks skipper Joe Girar-di said. “And the Philliesdo have a really good ro-tation. Blanton is tough. He’s a competitor.”

Prized southpaw came back to win the World Series Loves being a Phillie and playing atCitizens Bank Park Lee appreciates the hometown fans, even if they decide to boo him

Cliff Lee couldn’t help buthear the fan’s loud greet-ing. “Welcome back, CliffLee,” a Phillies followerbellowed just before theace southpaw threw thefirst pitch of his springtraining debut.

“Yeah, I heard him,” Leesaid. “But they’ve been say-ing welcome back everyday I walk outside. I’m notcomplaining. These fansare excited about me andthat’s great.”

The Arkansas native and

is Philadelphia’s most pop-ular athlete. That’s hard todebate after he led thePhils to the 2009 World Se-ries. Lee won two games inthat Fall Classic and utterlydominated the BronxBombers in a Game 1 win.

The topper is that theoffseason’s biggest freeagent rejected a more gen-erous offer from the Yan-kees to once again sportthe Phillies’ red pinstripes.

“I came back here be-cause I think this is the

best team for me to be on,”Lee said. “I think we have agreat chance to win aWorld Series and I loveplaying with these guys. Ilove being a Phillie and Ilove playing before thesesupportive crowds.”

Lee is aware that Phillyfans don’t back every ath-lete that comes throughtown.

“I understand and ap-preciate that the Philliesfans are so into it,” Leesaid. “If I continue to play

this way, hopefully theywill stay behind me. If Ipitch well, they’ll continueto cheer. If I do the oppo-site, they’ll boo me.”

For now, Lee continuesto get standing ovationswhether he steps on themound, walks into arestaurant or picks up hismorning paper.

“There are worse waysto live,” Lee said.

Have you looked backat the video of BrianWilson striking you outlooking? You have to turnthe page andthat’s what I’mdoing. There’sno need tolook back atthat. It was atough way to

Ben Francisco tends tospeak more with his batthan his tongue. That’s theway Charlie Manuel likesit. The successor to JaysonWerth is quiet and soft-spo-ken on the field.

However, the 29-year-old made considerablenoise at the plate thisspring as he won the start-ing right-field job.

Not only does Franciscolead the Phillies with a.377 batting average and.456 on-base percentage inspring training, he hit theball with authoritythroughout his audition.

“I like the way he hits,”Manuel said. “He hits theball hard. He looks good.”

Francisco makes realcontact, which wouldn’t

hurt the Phillies’ free-swinging lineup.

“I try to put the bat onthe ball,” Francisco said. “Itry to hit it hard some-where.”

Francisco’s old buddyWerth — the pair still textsregularly — wishes his for-mer teammate luck.

“He hopes for the bestfor me,” Francisco said. “Ilearned a lot from talkingwith Jayson and watchinghim play when he washere. We became verygood friends. He told me tobe patient and when thereis an opportunity to takeadvantage of that. That’swhat I’m doing.”

lineup

1 Jimmy Rollins, SSNot typical leadoff hitter, butJ-Roll isPhils’pulse. And he’sin a contract year.

2 Placido Polanco, 3BBest No. 2hitter inbaseball, but he iscomingoff elbow surgery.

3 Raul Ibanez, LFKeepingthe spotwarmuntilUtley getsback. Flashed alley-to-alley power in Florida.

4 Ryan Howard, 1BPressureis on faceof thefranchiseto returnto 50 HR, 150 RBI self.

5 Ben Francisco, RFWasspring(.377, 5HRs, 14RBIs) justa mirage?

6 Shane Victorino, CFPosted acareer-high 18homersin 2010.But batted just .259.

7 Carlos Ruiz, CBatted.293 withRISP in2010.WouldManuel move him upif Francisco struggles?

8 Wilson Valdez, 2BMore thanadequatein fill-induty. Butdon’t mis-take him for a starter.

Starting rotation is one for the ages, but can the Phillies score runs?Lack of Utley, Werth could stifle Howard’s power numbers

Even so, Rollins and Co. have to be considered team to beat in NL

Speak softly,carry

bigsticks

Ryan Howard isn’tworried about thePhillies’ offense orpotential protec-

tion. The slugging cleanuphitter isn’t concernedabout the five hole, whichis a big void since JaysonWerth left for a mountainof money with the Wash-ington Nationals.

Howard isn’t even in apanic over the uncertaintyof three-hole hitter ChaseUtley’s murky future.

“We have guys that canfill in for players that haveleft or are injured,”Howard said. “Last year,we had an incredibleamount of injuries. Theimportant thing is thatthey know they don’t haveto be another RyanHoward, Chase Utley orJimmy Rollins. They justhave to play a role withthe team.”

Perhaps Ben Franciscoand John Mayberry cancome close to Werth’s pro-duction and maybe evenhit better with runners inscoring position. Maybe

Wilson Valdez can fill inadmirably again for Utley, just like he did last year

when he played like a su-per-utility player.

Still, it appears thePhillies might be offen-sively challenged. Can ateam that may not score alot of runs, but with excel-lent starting pitching winregularly?

San Francisco Giants ad-visor Lou Piniella livedthrough the up-and-downexperience as manager ofthe starter-rich ChicagoCubs. Piniella believes thePhillies can do it.

“They have a great start-ing rotation,” Piniella saidof the Phillies. [On of-fense], Werth is a loss ...he’ll be tough to replaceand their offense is gettingolder, so you might notbounce back as well frominjuries. But they still haveRyan Howard, who is justa great run producer.

“If [Jimmy] Rollins ishealthy and can play likehe’s capable and if[Placido] Polanco ishealthy and some of theirother guys play up to theircapability, I think the

Phillies will be just fine. The Phillies will scoreruns. I think a lot of teamswould trade their teamroster for the Phillies’ ros-ter.”

GETTY IMAGES

Big questions

1 When will Chase Utleyreturn? And when hedoes come back, will hebe a liability?

2 Will the Phillies’ offensehave enough pop/bal-ance without Werth?Who will bat in thethree- and five-holes?Who protects Howard?

3 Will the four aces live upto the hype? And howmuch can Joe Blantoncontribute? Assumingthe Phab Four can stayhealthy, we’ll find out ifpitching wins titles.

4 Which version of BradLidge will we see? Will itbe the perfect ’08 Lidge, the disaster of ’09 orsomething in between?

5 Is the bullpen goodenough? Lidge is on theDL. Chad Durbin is gone. And Danys Baez is the ul-timate wild card.

778Plate appearances forJimmy Rollins in hisMVP season (2007), themost in MLB history. Hehad 394 last year andrecorded a career-low48 runs as he battled injury and season-longslump. J-Roll tallied 100runs in 2009.

Predictions

Take it tothe Bank

Team MVP — RyanHoward. He was bangedup most of last year andstill hit 31 homers. Expect45 HRs and 140 RBIs.

Projected finish —100-62, first in NL East;World Series runner-up.

Why they could easilystumble — Injuries. It’s nosecret that this team hasmany questions in themiddle of its lineup and inthe back of the bullpen. And that’s assuming thatthe Phab Four can avoidthe DL this season.

“The Phillies willscore runs. I think alot of teams wouldtrade their teamroster for thePhillies’ roster.”LOU PINIELLA

Jimmy Rollins must bounce back from a dismal 2010 season, when he batted a career-worst .243.

Inside Vegas: Big arms don’t equal big money

Elite starting pitchers are met with huge money lines Oddsmakersknow bettors love power pitchers But don’t forget about no-decisionsThere aren’t many cardinalrules in sports betting. Notblindly betting on startingpitching is one of them.

To understand why, wemust first understandhow a baseball line works.Unlike basketball or foot-ball, there is no pointspread. Favorites are es-tablished by money lines. So if Roy Halladay is tak-ing on Clayton Richard, you would have to risksomewhere around $300just to win $100.

Halladay started 33games a year ago, compil-ing one of the best seasonsin recent memory. He hada 2.44 ERA, 1.04 WHIP andstruck out 219 batters. Butthe Phillies won just 22 ofthose games. So eventhough Halladay was domi-nant, bettors had to swal-low big losses 11 times.

If you bet on Halladayevery time last season, youonly turned a very smallprofit (see chart above).

Phillies show Castillo door

Castillo

GETTY IMAGES

First impressions areeverything.

The Phillies cut ties withLuis Castillo yesterday, af-ter just seven spring train-ing games. Castillo went 6-for-22 overall for thePhillies, but did go 2-for-4with an RBI on Tuesday. Itwas too little, too late.

“It’s a testament to thepeople that we have here,”GM Ruben Amaro Jr. said.“The personnel we have

here makes us confident.”Castillo fell out of favor

early when he failed to re-port on time. The 35-year-old was expected to fill-infor the injured Chase Ut-ley. Now, that onus falls onWilson Valdez and Rule 5pick Michael Martinez.
