Executive Summary

This presents the salient points of the report and should not be referred to in isolation.

All recommendations are subject to Regulatory Authority approval.

Site Location, Description & History

Location: The site is located off South Road, within the small

market town of Bourne, Lincolnshire at NGR 509600mE,

319700mN (approximate site centre), about 22km north-west of

Peterborough city centre.

Description: The site occupies an irregular shaped parcel of land, which comprises three distinct areas, the combined overall

size being approximately 2.7 ha (about 7 Acres):

- an area of mixed surfacing towards the north-eastern end

of the site which allows access to the ‘Jewson’ builders

merchant outlet, buildings associated with the ‘Head

Start’ day nursery and the ‘Wherry’ site beyond;

- the ‘Wherry’ site, which largely consists of tarmac

hardstanding, office space and the main

processing/warehouse complex;

- unsurfaced, largely derelict and overgrown land to the far

south-western end of the site, which is also part of the

main ‘Wherry’ operational area.

The eastern area comprises a mixture of tarmac hardstanding

and hardcore carparking, soft landscaping and the existing day

nursery buildings. The eastern-most building was observed to be

of portal frame and brick construction with a pitched corrugated

metal and glass roof. The second day nursery building, situated

further into the site appeared to occupy part of the former

railway station building, and was of brick construction with a

slate roof. Tarmac carparking and soft landscaped garden/play

areas were observed to be associated with the property.

The main ‘operational area’, which occupies the central part of

the site was accessed via the weighbridge. Tarmac hardstanding

covers the majority of the operational area, with the exception of

an area immediately to the north-west of the weighbridge, where

part of the former railway station building was recently

demolished. This area comprises cobbles and hardcore (used to

infill pits and create a workable surface for heavy goods

vehicles). Formal landscaping borders the majority of the

southern site boundary.

The processing plant (for the shelling and processing of peas and

other pulses) and warehouses are located towards the north-west

and were of portal frame construction with a concrete ground-

slab. At least two thirds of the building was given over to

storage, whilst loading and unloading hoppers as well as the

main machinery were located in the western third of the building.

To the west of the processing plant there is an above-ground

diesel storage tank (AST) and an electricity transformer.

Localised staining was observed on the ground at this location.

Beyond the AST tarmac hardstanding was used to provide

vehicular access to the plant and for the storage of articulated

trailer units. Against the north-western boundary many pieces of

derelict machinery and other scrap metal items were observed.

In the far south-west of the site the ground was unsurfaced and

comprised rough, overgrown scrub with many poor quality trees.

Soft, boggy ground was observed at this location.

The southern boundary to the site comprises a mixture of mature

cypress trees and wooden panel fencing along two thirds of the

boundary, beyond which lies a residential housing estate. The

remainder of the boundary borders pasture, which lies beyond

poor quality trees and a wooden fence. To the east is South

Road. Palisade fencing and the ‘Jewson’ site borders the

northern boundary at this location, although the remainder of the

northern/north-western boundary is formed largely by trees and

a post and wire fence, beyond which lies pasture and the grounds

of Red Hall.

History: The Historical Ordnance Survey plans dating back to 1888 indicate that the site has been occupied by railway land,

comprising Bourne Station and its associated marshalling yards.

Anecdotal evidence indicates that livestock and other agricultural

produce, coal and other materials were transported into Bourne

Station.

With the exception of expansion to the railway infrastructure, no

significant change to the usage of the site is shown until the 1969

OS plan, which indicates that the railway had been dismantled.

From 1969 a granary is shown to be present towards the centre

of the site, with a coal yard adjacent to the south-eastern

boundary. Immediately adjacent to the site is a saw mill (to the

south) and a builder’s yard and fire station to the north.

Agricultural land surrounds the remainder of the site.

From at least 1978, buildings at the site are shown to be in

positions similar to those at present, although expansion of the

works has occurred. Two buildings, shown on the 1989 plan as

warehouses, are currently occupied by the day nursery and

Jewson. No significant change to the layout of the site is shown

to the current 2000 OS plan.

Geology & Mining, Hydrogeology and Hydrology

Geology & Mining: The site is shown on BGS Sheet 143, Bourne, Drift Edition (1:50,000 scale series) to be underlain by

strata of the Jurassic age (Oxford Clay). The base of the Oxford

Clay is reported to comprise the Kellaways Sand and the

Kellaways Clay, which may be present locally/discontinuously in

the area and on the site. The Cornbrash (limestone) may also be

present locally at shallow depth.

The solid strata are indicated to dip gently towards the

east/south-east. No drift deposits are reported to underlie the

site, although glacial deposits are reported to be ‘sporadic’ within

the South Kesteven district, and may therefore be present at the

site.

From a review of available geological information, the site lies in

an area which is unlikely to be affected by shallow mining

activity. Risk from broken or voided ground is therefore not

expected. There are also no faults or lines of weakness shown to

be on, or within the vicinity of the site.

Hydrogeology: The site is shown on the groundwater

vulnerability map for the area (Sheet 24, Northamptonshire,

Scale 1:100,000) to be situated on a non-aquifer, with overlying

soils of negligible permeability. Hydrology: The nearest surface watercourse is Bourne Eau, which lies approximately 30m to the north/north-east of the site.

Floodplains: Information provided by the Environment Agency

and that contained in the Envirocheck report indicates that the

site does not lie in an area which is at risk from flooding.

Environmental Data Summary

Waste Management: Based on information given in the

Envirocheck report, there appears to be one active waste

management facility within 500m of the site. This is reported to

be a household/commercial and industrial transfer station located

on Manning Road, being licensed to Anglian Water Services Ltd.

Between 500m and 1km there are a further fourteen licensed

waste management facilities, waste transfer stations, local

authority recorded landfill/registered landfill or waste

transfer/disposal sites. Of these, some may still be active or

have had their license revoked/surrendered. The location of

these sites are however unlikely to have affected the site, or

present a risk to future development.

Pollution Incidents: There are twelve pollution incidents to controlled waters within 500m of the site and a further twenty-

nine incidents between 500m and 1km of the site. The majority

of the incidents less than 500m of the site are reported to be

Category 3, minor incidents, involving the release of natural

(miscellaneous) pollutants, or small releases of oil/chemicals,

although there are a number of Category 2, significant incidents,

involving the release of cattle slurry, oils and unknown pollutants.

The receiving water in most instances is reported to be Bourne

Eau, or a tributary of it.

Between 500m and 1km of the site, the pollution incidents are

reported to be principally Category 3, involving the release of

pollutants including miscellaneous substances, unknown

pollutants, surface run-off, oils and cattle slurry. A number of

Category 2 incidents are also reported, principally involving the

release of unknown materials, oils or sewage. These incidents

are however unlikely to have affected the site, or present a risk

to future development.

Discharge Consents: There are three discharge consents within 500m of the site and an additional thirteen recorded within 1km

of the site. The type of discharge these consents are for is

unknown, although it appears the discharge is to land rather

than to surface water.

The remaining consents are for the discharge of substances

including surface water, trade effluent and storm sewage

overflow to tributary’s of Carr Dyke and Tunnel Bank Drain,

unnamed Fen Drains or groundwater. The discharge of these

waters are however unlikely to have affected the site, or present

a risk to future development.

Radon: Information given in the Envirocheck report indicates

that the site lies within an area where no radon precautions are required in the construction of new dwellings or extensions.

Geotechnical Assessment Made ground was encountered in all exploratory boreholes to

approximately 1.0m below ground level and typically comprised a

dark brown slightly clayey/sandy soil matrix with brick

fragments, cinder, ash, gravel and hardcore. Slightly deeper

made ground materials were proven within the vicinity of the

main manufacturing buildings and towards the south-west, where

made ground to approximately 1.5m bgl was encountered. An

obstruction was encountered at the position of WS18, at a depth

of 0.5m bgl, which resulted in the borehole being abandoned.

The underlying natural soils typically comprise firm to stiff,

slightly sandy/gravelly clay overlying limestone (Cornbrash). All

boreholes were driven to refusal. Localised areas of softer clay

were encountered within the near surface soils in a number of

boreholes, being typically between about 0.5m and 1.0m thick.

The deepest areas of softer clay (to approximately 2.0m thick)

were largely encountered across the eastern half of the site.

Beneath the central part of the site (i.e. beneath the footprint of

the main processing works) a firm sandy, very gravelly ‘boulder’

clay was encountered. It is anticipated that this clay is glacial in

origin (such materials are reported to be ‘sporadic’ within the

South Kesteven district). A discrete layer of clayey sand is also

present at approximately 3.5m bgl, towards the far eastern part

of the site (South Road end).

On the basis of the ground investigation, the natural undisturbed

firm to stiff clay soils will have a safe bearing capacity of

120kN/m2, although a reduced bearing capacity, of

approximately 70kN/m2, should be assumed where softer clay

deposits are encountered.

No groundwater was encountered during the ground investigation

works.

Environmental Assessment No obvious signs of contamination were observed during the

recent ground investigation works. On the basis of the chemical

test results and risk assessment (CLEA), there appears to be no

elevated concentrations of ‘general’ contaminants of concern

within the underlying soils. However, elevated concentrations in

excess of the non-validated SGV of 1.5mg/kg for Total PAH have

been identified within the near surface made ground soils across

the site. Concentrations of between 3.4mg/kg and 135mg/kg

were measured, most probably associated with the ash and

cinder content of the made ground. No elevated Benzo(a)pyrene

(B-a-P) concentrations were detected within the samples tested.

Speciated TPH analysis conducted as part of the investigation

indicates that site-wide TPH concentrations are typically low (i.e.

below the Tier 1 threshold concentration of 500mg/kg). TPH is

not considered likely to be a contaminant of concern at the site.

Development & Construction Proposals

Enabling Works: Existing buildings and hardstanding cover a large proportion of the site and it is anticipated that a significant

quantity of rubble will arise from their demolition/removal.

It may be possible to crush and re-use some on-site materials

below roads and areas of hard-standing (subject to planning

layout and levels) but it may be that much of the demolition

material will require removal from site, particularly if levels are

to remain similar to those at present.

In addition to the former railway building that has been

demolished at the position of WS14, it is possible that other

former buildings had basements or pits that have since been

infilled. Foundations are evident on the surface and deep

obstructions may also be present. The removal of all floor slabs,

old foundations/substructures and any underground obstructions

should be carried out as part of the demolition works. Further

localised excavations may be required during or after demolition

to check for buried obstructions/sources of additional

contamination.

An appropriate (level 3) asbestos survey of the existing buildings

must be carried out prior to demolition works being undertaken,

since the presence of asbestos may significantly influence the

suitability of material for retention/cost of removal from site.

There may also be asbestos containing materials beneath the

floor slab.

Foundations: Made ground materials would not be suitable to

found in. Instability may also be encountered during excavation,

particularly during prolonged periods of wet weather.

On the basis of the ground investigation, the natural undisturbed

soils will be suitable for traditional strip/trench fill foundations

(subject to confirmation of the size and type of proposed

buildings).

Soil classification testing of the clay samples taken from the site

indicates that the clay has a plasticity index of between 25% and

50%. In accordance with the recommendations given in NHBC

Standards Chapter 4.2, the clay has a high Volume Change

Potential (VCP). On this basis, foundations will need to be

founded at a minimum depth of 1000mm when in clay. This is

the depth to the underside of the footing from original or

finished/proposed level, whichever is the lower. Localised

thickening, reinforcing and/or deepening of foundations may be

required where softer clay materials, or strata of different type,

are encountered at founding depth.

Where three storey or larger properties are proposed, widening

of the footings would be required, where softer clay materials are

encountered. Should unforeseen areas of deep made ground or

very soft ground be encountered, it is anticipated that piled

foundations would be required.

Confirmation of the most appropriate foundation solution would

be given following completion of a plot specific foundation

schedule, subject to receipt of the proposed layout.

Building Near Trees: Precautions will need to be taken when building near trees/hedges, with foundations being constructed in

accordance with the recommendations prescribed in NHBC

Standards Chapter 4.2. Founding depths and any requirement

for heave precautions would be confirmed following completion of

a tree survey and the plot specific foundation schedule.

Floor Slabs: In situ suspended or fully suspended floors should be assumed, subject to proposed finished levels.

Sulphate Precautions: In accordance with BRE Special Digest 1 (2005), it is considered that Class DS2/ACEC-AC1s conditions

may be assumed.

Road Construction: At this stage a CBR of between 2% and 3%

at road formation may generally be assumed for pavement

design on the natural strata. A CBR of 1% should be assumed on

made ground materials. This would be subject to Local Authority

approval prior to finalising design.

Radon: Information given in the Envirocheck report indicates

that the site lies within an area where no radon precautions are required in the construction of new dwellings or extensions.

Potable Water Supply: The protection of potable water supply pipes may be required should significant hydrocarbon

contamination be present within the underlying soils.

Ground Gas Precautions: On the basis of the ground

investigation, it is considered that gas precautions will not be

required.

Soakaways and Site Drainage: Soakaways are unlikely to work at the site, given the nature of the underlying clays.

Groundwater: No groundwater was encountered during the ground investigation.

Excavations: Excavation for sewers and other deep excavations are expected to be unstable in the made ground, particularly

during prolonged periods of wet weather. All excavations will

require support to maintain safe working conditions, if man entry

is required. Given the presence of hard rock at relatively shallow

depth, difficulties may also be encountered with deeper

excavations.

Flooding: Information provided by the Environment Agency and

that contained in the Envirocheck report indicates that the site

does not lie in an area which is at risk from flooding.

Remediation & Environmental Management: Chemical

testing indicates that in general the majority of the potential

contaminants of concern pose no significant risk to human

health. However, on the basis of the testing, Total PAH

concentrations are typically elevated within the made ground

soils, which are site wide at shallow depth.

Although the test data and risk assessment indicate that the

Benzo(a)Pyrene component of the PAH is below the non-validated

SGV of 1.5mg/kg, Total PAH concentrations present an

unacceptable risk to human health.

On this basis, it is considered likely that a 600mm inert soil

capping will be required in private gardens and soft landscaped

areas. However, it may be possible to reduce the thickness of

the capping, subject to discussion with the Environmental Health

Officer.

Given that there is no source of topsoil at the site, importation

will be required. The topsoil should be tested at source and

confirmed as suitable in agreement with the EHO/NHBC.

Further Work

Given the active nature of the site and the necessarily limited

ground investigation, further site investigation works may be

required following/during demolition works, to investigate the

inaccessible parts of the site (e.g. within trafficked areas and

inside buildings etc).

A suitable (level 3) asbestos survey of the existing buildings must

also be carried out, prior to demolition. A tree survey and plot

specific foundation schedule will also be required.

1.1 Preamble

Abatech International Ltd. were appointed by Stamford Homes Ltd to undertake a

Phase I/II Geo-Environmental investigation of a piece of land located off South

Road, Bourne, Lincolnshire.

1.2 Report Status

This report provides factual and interpretive geotechnical and environmental

information, together with provisional construction proposals and

recommendations, in relation to the proposed redevelopment of the site. The

report has been prepared for the sole use and reliance of Stamford Homes Ltd.

1.3 Sources and Conditions

The findings and recommendations made in this report are based on published

information, a ‘walkover’ carried out on 10 February 2006 and site investigation

works carried out between 10 and 14 February 2006. Abatech International Ltd.

2.0 SITE LOCATION AND DESCRIPTION

2.1 Location

The site is located off South Road, within the small market town of Bourne,

Lincolnshire at NGR 509600mE, 319700mN (approximate site centre), about

22km north-west of Peterborough city centre. The location of the site is shown on

the appended site location plan (S6/005/001, Appendix I).

2.2 Description

The site occupies an irregular shaped parcel of land, which comprises three

distinct areas, the combined overall size being approximately 2.7 ha (about 7

Acres):

• an area of mixed surfacing towards the north-eastern end of the site which

allows access to the ‘Jewson’ builders merchant outlet, buildings

associated with the ‘Head Start’ day nursery and the ‘Wherry’ site beyond;

• the ‘Wherry’ site, which largely consists of tarmac hardstanding, office

space and the main processing/warehouse complex;

• unsurfaced, largely derelict and overgrown land to the far south-western

end of the site, which is also part of the main ‘Wherry’ operational area.

The eastern area comprises a mixture of tarmac hardstanding and hardcore

carparking, soft landscaping and the existing day nursery buildings. The eastern-

most building was observed to be of portal frame and brick construction with a

pitched corrugated metal and glass roof. The second day nursery building,

situated further into the site, appeared to occupy part of the former railway

station building, and was of brick construction with a slate roof. Tarmac

carparking and soft landscaped garden/play areas were observed to be associated

with the property.

The main ‘operational area’, which occupies the central part of the site, was

operational area, with the exception of an area immediately to the north-west of

the weighbridge, where part of the former railway station building was recently

given over to storage, whilst loading and unloading hoppers as well as the main

machinery were located in the western third of the building. To the west of the

processing plant there is an above-ground diesel storage tank (AST) and an

electricity transformer. Localised staining was observed on the ground at this

location. Beyond the AST tarmac hardstanding was used to provide vehicular

access to the plant and for the storage of articulated trailer units. Against the

north-western boundary many pieces of derelict machinery and other scrap metal

items were observed.

In the far south-west of the site the ground was unsurfaced and comprised rough,

overgrown scrub with many poor quality trees. Soft, boggy ground was observed

at this location.

The southern boundary to the site comprises a mixture of mature cypress trees

3.0 GEO-ENVIRONMENTAL SETTNG

3.1 Geology, Hydrogeology, Hydrology and Mining

Table 3.1 – Geological Information

Superficial Deposits There are no drift deposits shown to be present on the site,

although glacial deposits and boulder clay are indicated to be

present locally, as well as across the region. It is possible

therefore that drift deposits, most probably comprising gravelly

clays and/or fine to medium grained silty sand, will be present

across the site.

Solid Geology The site is shown to be underlain by strata of the Jurassic age

(Oxford Clay). The base of the Oxford Clay is reported to

comprise the Kellaways Sand and the Kellaways Clay, which may

be present locally/discontinuously in the area and on the site.

The Cornbrash (limestone) may also be present locally at shallow

depth. The solid strata are indicated to dip gently towards the

east/south-east.

Discontinuities There are no faults or lines of weakness shown to be on, or

within the vicinity of, the site.

Hydrogeology The site is shown on the groundwater vulnerability map for the

area to be situated on a non-aquifer, with overlying soils of

negligible permeability.

Hydrology The nearest surface watercourse is Bourne Eau, which lies

approximately 30m to the north/north-east of the site.

Mining From a review of available geological information, the site lies in

an area which is unlikely to be affected by shallow mining

activity. Risk from broken or voided ground is therefore not

3.2 Environmental Data Search

The principal considerations of immediate relevance are given below. For a

comprehensive list of environmental data, refer to the appended Envirocheck

Report (Appendix II).

of discharge these consents are for is unknown, although it

appears the discharge is to land rather than to surface water.

Station.

With the exception of expansion to the railway infrastructure, no significant

change to the usage of the site is shown until the 1969 OS plan, which indicates

that the railway had been dismantled. From 1969 a granary is shown to be

present towards the centre of the site, with a coal yard adjacent to the south-

eastern boundary. Immediately adjacent to the site is a saw mill (to the south)

and a builder’s yard and fire station to the north. Agricultural land surrounds the

remainder of the site.

From at least 1978, buildings at the site are shown to be in positions similar to

those at present, although expansion of the works has occurred. Two buildings,

shown on the 1989 plan as warehouses, are currently occupied by the day

nursery and Jewson. No significant change to the layout of the site is shown to

the current 2000 OS plan.

5.0 PHASE I GEOTECHNICAL ASSESSMENT

5.1 Ground Conditions

5.1.1 Soils

It is anticipated that the site will be underlain by made ground of variable

thickness and quality, which will contain materials associated with the demolition

of historic railway buildings/infrastructure as well as those from the local vicinity.

Deep areas of made ground, of unknown origin, may also exist at the site.

It is possible that old foundations, chambers and pits may be present beneath the

existing tarmac hardstanding. Evidence of infilling (imported hardcore) is visible

at the position of recent demolition works. Foundation obstructions and drainage

associated with the current processing works will be encountered.

5.1.2 Groundwater

Problems associated with shallow groundwater, or the need for dewatering

excavations is not anticipated.

5.1.3 Stability Issues

From a review of available geological information, the site lies in an area which is

unlikely to be affected by shallow mining activity. Risk from broken or voided

ground is therefore not expected.

6.0 PHASE I ENVIRONMENTAL ASSESSMENT

6.1 Phase I Conceptual Model

The following is based on the desk study information and information gathered

during the recent ‘walkover’.

6.1.1 Site Summary

From a review of available historical information, it is possible that that there may

be a number of potential contamination sources present at the site, being derived

from the historic railway land.

Made ground materials associated with railway infrastructure often yield elevated

concentrations of metals/metalloids and organic contaminants, being derived

from coal storage, the storage of fuels and oils in above and below ground

tanks/structures, as well as leakage from machinery/trains etc.

Based on the site walkover, contamination associated with more recent industrial

activities are expected to be limited to localised spillages of fuel (diesel), within

the vicinity of above ground storage tanks/dispenser.

No significant off-site sources of contamination are expected.

6.1.2 S-P-R Characterisation

A potential source is defined as, ‘a contaminant, which is in, or under the land

and has the potential to cause harm or to cause pollution of controlled waters’.

Review of available desk study information has revealed the potential on- and off-

site sources of contamination, listed in Tables 6.1 and 6.2 below. Where possible,

associated potential contaminants have been identified with reference to the

Environment Agency (EA) and the Department for Environment, Food and Rural

Affairs (DEFRA) R & D Publication CLR8: Potential Contaminants for the

Assessment of Land and the relevant Department of the Environment Industry

Profiles.

6.1.3 Potential Significant Pollutant Linkages:

A potential pollutant linkage is defined as ‘the relationship between a

contaminant, a pathway and a receptor’ where the pollutant is the contaminant in

the pollutant linkage. For land to be identified as contaminated under the current

UK guidance all three elements of the pollutant linkage must be present. In

many cases there may be more than one pollutant linkage on any given site.

A review of the desk study information, the features noted in the site walkover

and the potential sources, pathways and receptors listed above has led to the

following potential significant pollutant linkages (SPL) being considered (Table 6.3

below):

6.2 Model Status and Uncertainty

The potential significant linkages listed above are based on the available data

listed above and the features noted during the ‘walkover’. Therefore, the linkages

identified are tentative in nature, and are subject to the following uncertainties:

• Actual distribution of contaminants in soils;

• Actual distribution of contaminants in groundwater;

• Water levels below the site and the direction of groundwater flow.

7.0 RATIONALE FOR PHASE II INVESTIGATION

The desk study and Phase II ground investigation were carried out to identify

environmental and geotechnical liabilities in relation to the proposed

redevelopment of the site. The works were carried out to:

• facilitate the collection of soil samples from within the made ground and

underlying natural strata to assess the degree of chemical contamination;

• assess the thickness and nature of made ground materials across the site;

• assess the geotechnical properties of the made ground and underlying

natural strata (including any drift deposits where encountered).

8.0 SITE WORKS

Given the constraints placed on the ground investigation, site works were carried

out in accessible areas between 10 and 14 February 2006. The works comprised

the following:

• Twenty one window sampler boreholes (WS1 to W21).

The positions of the investigation locations are shown on the appended Site

Investigation Plan (S6/005/002). A copy of the investigation logs are presented

in Appendix III.

9.0 LABORATORY ANALYSIS

9.1 Chemical Analyses

The environmental analyses were scheduled by Abatech and carried out by

ALcontrol, Chester. Samples of made ground were collected and tested for

metals, non-metal inorganics and organics in order to assess the degree and

nature of contamination within the soil. A summary of the test results is given in

the following table, whilst a copy of the individual test results is presented in

Appendix IV. Risk assessment data sheets are presented in Appendix V for those

contaminants which were considered to pose a risk to human health.

In accordance with CLEA guidance (DEFRA and EA, R&D Publication CLR 7, 2002)

soil analysis results were subject to statistical analysis (for the determinands

outlined in the CLEA guidance) to assess soil contamination issues at the site.

Statistical analysis provides more accurate results the greater the data set

available, in this case, number of samples. The statistics have been designed to

review an entire data set, as opposed to comparing individual results to a given

SGV. The CLEA statistical methodology produces two key outputs:

• The Mean Value Test calculates the Upper Bound Value (UBV) or 95th percentile of

the mean. This enables a set of contamination results to be compared against a

relevant Soil Guideline Value (SGV). If the UBV is less than the SGV, then the

mean value test is passed and the site may be considered not to present a

significant possibility of significant harm, in the context of Part 2A of the

Environmental Protection Act 1990. Conversely, if the test is failed, further

sampling, analysis, assessment and possibly remediation may be required;

• The Maximum Value Test calculates the Outlier Critical Value (OCV). This enables

an assessment to be made as to whether the highest value in a set of results

belongs to the general ‘population’, or whether it represents a statistical outlier,

i.e. a contamination ‘hot-spot’, not truly representative of the data collected.

The above statistical analyses indicate that the determinands pass the mean

value test. This is because the SGV (or equivalent) was not exceeded by the

Upper Bound Value (UBV).

10.0 PHASE II GEOTECHNICAL ASSESSMENT

10.1 Ground Conditions

10.1.1 Soils – Made Ground

Made ground was encountered in all exploratory boreholes to approximately 1.0m

below ground level and typically comprised a dark brown slightly clayey/sandy

soil matrix with brick fragments, cinder, ash, gravel and hardcore.

Slightly deeper made ground materials were proven within the vicinity of the

main manufacturing buildings and towards the south-west, where made ground

to approximately 1.5m bgl was encountered. An obstruction was encountered at

the position of WS18, at a depth of 0.5m bgl, which resulted in the borehole

being abandoned.

10.1.2 Soils – Natural Ground

The underlying natural soils typically comprise firm to stiff, slightly sandy/gravelly

clay overlying limestone (Cornbrash). All boreholes were driven to refusal.

Localised areas of softer clay were encountered within the near surface soils in a

number of boreholes, being typically between about 0.5m and 1.0m thick. The

deepest areas of softer clay (to approximately 2.0m thick) were largely

encountered across the eastern half of the site.

Beneath the central part of the site (i.e. beneath the footprint of the main

processing works) a firm sandy, very gravelly ‘boulder’ clay was encountered. It

is anticipated that this clay is glacial in origin (such materials are reported to be

‘sporadic’ within the South Kesteven district). A discrete layer of clayey sand is

also present at approximately 3.5m bgl, towards the far eastern part of the site

(South Road end).

On the basis of the ground investigation, the natural undisturbed firm to stiff clay

soils will have a safe bearing capacity of 120kN/m2, although a reduced bearing

capacity, of approximately 70kN/m2, should be assumed where softer clay

deposits are encountered.

10.1.3 Mining

On the basis of available geological information, there is not considered to be a

risk of shallow mining affecting the site.

10.1.4 Groundwater

No groundwater was encountered during the ground investigation.

10.2 Contamination and Performance of Building Materials

10.2.1 Sulphate

In accordance with BRE Special Digest 1 (2005), it is considered that Class

DS2/ACEC-AC1s conditions may be assumed.

10.2.2 Other Contaminants

On the basis of laboratory testing, the present chemical status of the on-site soils

does not include significant quantities of any other substances that are likely to

be detrimental to the performance of building materials during their expected

lifespan.

11.0 PHASE II ENVIORONMENTAL ASSESSMENT

11.1 Site Summary

Based on available information, it appears that the site has had limited use, with

the only significant activities being the railway station/sidings and the more

recent vegetable (pulses) processing works.

The made ground materials at the site are of unknown origin. The materials are

typical of those associated with former railway land, being derived from

demolition/combustion processes. Contamination associated with these materials

typically comprises heavy metals/metalloids, TPH and PAH (including B-a-P).

11.2 Risk Assessment

Current UK legislation on contaminated land is principally contained in Sections

78(A) to (YC) in Part IIA of the Environmental Protection Act 1990, which was

retrospectively inserted by Section 57 of the Environment Act 1995. This

legislation came into effect in April 2000 and is enacted by the Contaminated

Land (England) Regulations 2000.

The legislation adopts the principle of a 'suitable for use' approach for the

assessment of contaminated land, the rationale reflected in the site-specific risk

assessment and determination of remedial strategy. Action is only required if

unacceptable risks are posed to human health or to the environment, taking into

account the current land-use and geo-environmental setting.

The legislation places a responsibility on the Local Authority to determine whether

the land under its jurisdiction is contaminated by consideration of whether:

� Significant harm is being caused;

� There is a significant possibility of significant harm being caused;

� Significant pollution of controlled waters is being caused or is

likely to be caused.

The statutory guidance describes a risk assessment methodology in terms of

'significant pollutants' and 'pollutant linkages', using SOURCE-PATHWAY-

RECEPTOR' scenarios for the site.

On the basis of the available data and associated guidance (CLEA, Dutch and

USEPA), the site’s geo-environmental setting and proposed end-use, qualitative

and quantitative risk assessments have been carried out. A summary of the

Source-Pathway-Receptor risk assessment table is presented below.

No obvious signs of contamination were observed during the recent ground

investigation works. On the basis of the chemical test results and CLEA risk

assessment, there appears to be no elevated concentrations of ‘general’

contaminants of concern within the underlying soils.

However, speciated PAH testing, which provides a breakdown of the sixteen most

important aromatic hydrocarbons, indicated that Total PAH concentrations within

near surface, shallow, made ground materials at nine locations exceeded the

tentative non-validated SGV of 1.5mg/kg. Concentrations of between 3.4mg/kg

and 135mg/kg (WS6, 0.25m bgl) were measured, most probably being associated

with the ash and cinder content of the made ground. No elevated

Benzo(a)pyrene (B-a-P) concentrations were detected within the eleven soil

samples tested.

Speciated TPH analysis conducted as part of the investigation indicates that site-

wide TPH concentrations are typically low (i.e. below the Tier 1 threshold

concentration of 500mg/kg). TPH is not considered likely to be a contaminant of

concern at the site.

12.0 RECOMMENDATIONS

12.1 Enabling Works

Existing buildings and hardstanding cover a large proportion of the site and it is

anticipated that a significant quantity of rubble will arise from their

demolition/removal.

It may be possible to crush and re-use some on-site materials below roads and

areas of hard-standing (subject to planning layout and levels) but it may be that

much of the demolition material will require removal from site, particularly if

levels are to remain similar to those at present. These works will need to be

integrated with any remedial works, should further areas of contamination be

identified.

In addition to the former railway building that has been demolished at the

position of WS14, it is possible that other former buildings had basements or pits

that have since been infilled. Foundations are evident on the surface and deep

obstructions may also be present. The removal of all floor slabs, old

foundations/substructures and any underground obstructions should be carried

out as part of the demolition works. Further localised excavations may be

required during or after demolition to check for buried obstructions/sources of

additional contamination.

An appropriate (level 3) asbestos survey of the existing buildings must be carried

out prior to demolition works being undertaken, since the presence of asbestos

may significantly influence the suitability of material for retention/cost of removal

from site. There may also be asbestos containing materials beneath the floor

slab.

12.2 Foundations

Made ground materials would not be suitable to found in. Instability may also be

encountered during excavation, particularly during prolonged periods of wet

weather.

On the basis of the ground investigation, the natural undisturbed soils will be

suitable for traditional strip/trench fill foundations (subject to confirmation of the

size and type of proposed buildings).

Soil classification testing of the clay samples taken from the site indicates that

the clay has a plasticity index of between 25% and 50%. In accordance with the

recommendations given in NHBC Standards Chapter 4.2, the clay has a high

Volume Change Potential (VCP). On this basis, foundations will need to be

founded at a minimum depth of 1000mm when in clay. This is the depth to the

underside of the footing from original or finished/proposed level, whichever is the

lower. Localised thickening, reinforcing and/or deepening of foundations may be

required where softer clay materials, or strata of different type, are encountered

at founding depth.

Where three storey or larger properties are proposed, widening of the footings

would be required, where softer clay materials are encountered. Should

unforeseen areas of deep made ground or very soft ground be encountered, it is

anticipated that piled foundations would be required. Confirmation of the most

appropriate foundation solution would be given following completion of a plot

specific foundation schedule, subject to receipt of the proposed layout.

12.3 Building Near Trees

Precautions will need to be taken when building near trees/hedges, with

foundations being constructed in accordance with the recommendations

prescribed in NHBC Standards Chapter 4.2. Founding depths and any

requirement for heave precautions would be confirmed following completion of a

tree survey and the plot specific foundation schedule.

12.4 Floor Slabs

In situ suspended or fully suspended floors should be assumed, subject to

proposed finished levels.

12.5 Sulphate Precautions

In accordance with BRE Special Digest 1 (2005), it is considered that Class

DS2/ACEC-AC1s conditions may be assumed.

12.6 Road Construction

At this stage a CBR of between 2% and 3% at road formation may generally be

assumed for pavement design on the natural strata. A CBR of 1% should be

assumed on made ground materials. This would be subject to Local Authority

approval prior to finalising design.

12.7 Excavations

Excavation for sewers and other deep excavations are expected to be unstable in

the made ground, particularly during prolonged periods of wet weather. All

excavations will require support to maintain safe working conditions, if man entry

is required. Given the presence of hard rock at relatively shallow depth,

difficulties may also be encountered with deeper excavations.

12.8 Groundwater

No groundwater was encountered during the investigation.

12.9 Soakaways and Site Drainage

Soakaways are unlikely to work at the site, given the nature of the underlying

clay soils.

12.10 Radon

No radon precautions are required in the construction of new dwellings or

extensions at the site.

12.11 Potable Water Supplies

The protection of potable water supply pipes may be required should significant

hydrocarbon contamination be present within the underlying soils.

12.13 Remediation & Environmental Management

Chemical testing indicates that in general the majority of the potential

contaminants of concern pose no significant risk to human health. However, on

the basis of the testing, Total PAH concentrations are typically elevated within the

made ground soils, which are site wide at shallow depth.

Although the test data and risk assessment indicate that the Benzo(a)Pyrene

component of the PAH is below the non-validated SGV of 1.5mg/kg, Total PAH

concentrations present an unacceptable risk to human health.

On this basis, it is considered likely that a 600mm inert soil capping will be

required in private gardens and soft landscaped areas. However, it may be

possible to reduce the thickness of the capping, subject to discussion with the

Environmental Health Officer.

Given that there is no source of topsoil at the site, importation will be required.

The topsoil should be tested at source and confirmed as suitable in agreement

with the EHO/NHBC.

13.0 FURTHER WORK

Given the active nature of the site and the necessarily limited ground

investigation, further site investigation works may be required following/during

demolition works, to investigate the inaccessible parts of the site (e.g. within

trafficked areas and inside buildings etc).

A suitable (level 3) asbestos survey of the existing buildings must also be carried

out, prior to demolition. A tree survey and plot specific foundation schedule will

also be required.

Introduction

The Environment Act 1995 has made site sensitivity a key issue, as the legislation pays as much attention tothe pathways by which contamination could spread, and to the vulnerable targets of contamination, as it doesthe potential sources of contamination. For this reason, Landmark's Site Sensitivity Datasheet places greatemphasis on statutory data provided by the Environment Agency and the Scottish Environment ProtectionAgency; it also incorporates data from English Nature (and the Scottish and Welsh equivalents), theEnvironment Agency (and the Scottish equivalent) and Local Authorities; and highlights hydrogeologicalfeatures required by environmental and geotechnical consultants. It does not include any informationconcerning past uses of land. The datasheet is produced by querying the legend database to 1km from asingle point or a site boundary provided by the client

In the attached datasheet the National Grid References (NGRs) are rounded to the nearest 10m inaccordance with Landmark's agreements with a number of Data Suppliers

Whilst Landmark will use reasonable care and skill inproviding the Services to You the Services are provided onthe express basis that You acknowledge and agree to thefollowing:-

The information and data supplied in the Services arederived from publicly available records and other thirdparty sources and Landmark does not warrant theaccuracy or completeness of such information or data;andThe information and data supplied in the Services are

derived solely from those sources specifically cited in theReport Landmark does not claim that these sourcesrepresent an exhaustive or comprehensive list of all sourcesthat might be consulted; and

any person who purchases the whole of theProperty Site,any person who provides funding secured on thewhole of the Property Site,any person for whom You act in a professional orcommercial capacity, andany person who acts for You in a professional orcommercial capacity.

Accordingly Landmark shall have the same duties andobligations to those persons in respect of the Servicesas it has to You.Each of those persons referred to in Clause 3.b. shallhave the benefit and the burden of Your rights andobligations under these Terms. The limitations ofLandmark's liability as set out in Clause 6 shall apply.The Report is to be used solely for the benefit of Youand Your Client and such persons as are set out inClause 3.b, and Landmark excludes all liability to allother persons unless Landmark has expressly agreed inwriting to the assignment of the benefit of the Reportand has been paid Landmark's reasonable fees for sodoing.All parties given access to the Services agree that theywill treat as strictly private and confidential the Servicesand all information which they obtain from the Servicesand shall restrict any disclosure to employees orprofessional advisors to enable the relevant party toconduct its internal business The requirement in thisclause to treat the Services as confidential shall includea requirement to maintain adequate security measuresto safeguard the Services from unauthorised access,use or copying.Each recipient of the Services agrees (and agrees it willcause its employees, agents or contractors who mayfrom time to time have access to the Services to agree)it will not, except as permitted herein or by separateagreement with Landmark:-

Further copies may not be made in

whole or in part without the prior written permission ofLandmark who shall be entitled to make a charge for eachadditional copy.

You hereby agree to fully indemnify Landmark againstany claim losses or other damages suffered byLandmark as a result any breach by any recipient of theServices of these Terms.You agree that You will comply with any reasonableinstructions that We may give from time to time withregard to the use of the Intellectual Property Rights,including but not limited to acknowledging that theServices and Reports are confidential to You, YourClient or the persons set out in Clause 3.b.The mapping contained in any Services is protected byCrown Copyright and must not be used for any purposeoutside the context of the Services or as specificallyprovided by these Terms.

Landmark may grant You a credit limit in order to allowYou to transact with it or set up an Account andreserves the right to withdraw any such credit limit atany time without prior notice.You are fully responsible for all charges that accumulateon Your Account.VAT at the prevailing rate shall be payable in addition tothe Landmark Fees. You shall pay any other applicableindirect taxes related to Your use of the Services.An individual or a monthly invoice showing all Orderscreated will be generated subject to these Terms. Youwill pay the Landmark Fees at the rates set out inLandmark's or its Authorised Reseller's invoice. TheLandmark Fees are payable in full within 28 dayswithout deduction, counterclaim or set off. Youacknowledge that time is of the essence with respect tothe payment of such invoices. Non-payment ofLandmark Fees may, at Our sole discretion result inLandmark terminating or limiting the use of YourAccount and its provision of Services to You. Landmarkreserve the right to amend the Landmark Fees fromtime to time and the Services will be charged at theLandmark Fee applicable at the date on which theService is ordered.We may charge interest on late payment at a rate equalto 8% per annum above the base lending rate ofNational Westminster Bank plc.Landmark or its Authorised Reseller shall not be obligedto invoice any party other than You for the provision ofServices, but where Landmark or its AuthorisedReseller does so invoice any third party at Your request,and such invoice is not accepted or remains unpaid,Landmark or its Authorised Reseller shall have theoption at any time to cancel such invoice and invoiceYou direct for such Services. Where Your ordercomprises a number of Services or severable elementswithin any one or more Services, any failure byLandmark or its Authorised Reseller to provide anelement or elements of the Services shall not prejudiceLandmark's or its Authorised Reseller's ability to requirepayment in respect of the Services delivered to You

Landmark may suspend or terminate Your rights underthese Terms without any liability to You with immediateeffect if at any time:-

You fail to make any payment due in accordancewith Clause 4;You repeatedly breach or commit or cause to becommitted any material breach of these Terms; orYou commit a breach and You fail to remedy thebreach within 7 days of receipt of a written notice todo so Landmark may remedy the breach andrecover the costs thereof from You; orYou commit an act of bankruptcy or insolvency, areunable to pay Your debts as or when they fall due ormake any composition or arrangement with Yourcreditors, or go into liquidation whether voluntary orcompulsory, or if any order is made or a resolutionis passed for Your winding up (except for thepurpose of a solvent amalgamation orreconstruction), or if You cease or prepare to ceasetrading, or if You suffer the appointment of areceiver, administrative receiver, administrator orsimilar officer over the whole or part of any of Yourassets.

If Your rights are terminated under this Clause and Youhave made an advance payment We will refund You areasonable proportion of the balance as determined byUs in relation to the value of Services previouslypurchased.We may suspend the Agreement between You andLandmark for an indefinite period without notice and atany time if in Our opinion You are in breach of any of theprovisions of these Terms.

We provide warranties and accept liability only to theextent stated in this Clause 6.Nothing in these Terms excludes either party's liabilityfor death or personal injury caused by that party's

"Account" means the credit account established by a Member with Landmark."Agreement" means the agreement between Ourselves created by Your acceptance of these Terms."Authorised Reseller" means an agent or reseller of Landmark whom Landmark has duly appointed to resell its Reports and Services."Client" means the individual or organisation to whom You provide professional services and/or Your professional advisors where applicable."Content" means any data, computing and information services and software, and other content and documentationor support materials and updates included in and/or supplied by or through the Websites, in Reports or Services or in any other way by Landmark and shall include Landmark developed and Third Party Content."Designated Users" means individuals appointed by Members to transact across the Member's Account."Intellectual Property Rights" means all forms of intellectual property or protective rights recognised in law."Member" means the person, firm or organisation who establishes and/or uses the Account."Order" means the request for Services from Landmark by You."Property Site" means a land site on which a Member requests Landmark provide either a Report or any other Service.References to"We", "Us" and "Our" are references to Landmark Information Group Limited ("Landmark"), whose registered office is 7 Abbey Court, Eagle Way, Exeter, EX2 7HY. Where You are not ordering the Services directly fromLandmark, but from an Authorised Reseller, references to "Landmark" or "We", "Us" and "Our" shall be construed so as to mean either Landmark and/or the Authorised Reseller as the context shall indicate.References to "You/Your/Yourself" refer to the contracting party who places an Order with Landmark and for whom theServices are to be provided by Landmark."Report" includes any information that Landmark supplies to You including all reports, services, datasets, software or information contained in them."Services" means the provision of any service by Landmarkpursuant to these Terms which at the sole discretion of Landmark, may be time limited, for the purposes of evaluation only, offer reduced functionality, offer limited access to the Content, or be free of charge including but notlimited to the report(s), data, information or other services undertaken by Landmark."Landmark Fees" means any charges levied by Landmark for Services provided to You"Suppliers" means any organisation who provides data or information of any form to Landmark."Terms" means these Terms and Conditions."Third Party Content" means the services, software, information and other content or functionality provided by third parties and linked to or contained in the Services."Websites" means websites hosted by Landmark and includes the Content and any report, service, document, data-set, software or information contained therein, derived there from or thereby.

negligence or willful default.As most of the information contained in the Services isprovided to Landmark by others, Landmark cannotcontrol its accuracy or completeness, nor is it within thescope of Landmark's Services to check the informationon the ground. Accordingly, subject to clause 6b,Landmark will only be liable to You for any loss ordamage caused by its negligence or wilful default andneither Landmark nor any person providing informationcontained in any Services shall in any othercircumstances be liable for any inaccuracies, faults oromissions in the Services nor shall Landmark have anyliability if the Services are used otherwise than inaccordance with these Terms.Save as precluded by law, Landmark shall not be liablefor any indirect or consequential loss, damage orexpenses (including loss of profits, loss of contracts,business or goodwill) howsoever arising out of anyproblem, event, action or default by Landmark or anyindirect or consequential loss of any nature whatsoeveror for any physical damage to or loss of Your tangibleproperty, any other direct loss, damage, cost or expenseof any kind or any indirect or consequential loss,damage, cost or expense of any kind, whether any ofthe above arise under contract, tort (includingnegligence), an indemnity or contribution or otherwise.In any event, and notwithstanding anything contained inthese Terms, Landmark's liability in contract, tort(including negligence or breach of statutory duty) orotherwise howsoever arising by reason or in connectionwith this Contract (except in relation to death orpersonal injury) shall be limited to an aggregate amountnot exceeding £1 million if the complaint is in relation toa Report on residential property and an amount notexceeding £10 million in respect of any other Report orService purchased from Landmark except in so far asLandmark will not be liable for any defect, failure oromission relating to Services that is not notified toLandmark within six months of the date of the issuebecoming apparent and in any event, within one year ofthe date of the Report if the complaint is in relation to aReport on residential property and within six years ofthe date of the Report in respect of any other Report orService. Where any claim relates to either a part of theServices that is not chargeable or if You have been inbreach of any part of these Terms Landmark's liabilityshall be limited to £1,000No person may rely on the Report more than 12 monthsafter its original date.You acknowledge that:-

You shall have no claim or recourse against anyThird Party Content supplier nor any of our otherSuppliers. You will not in any way hold usresponsible for any selection or retention of, or theacts of omissions of Third Party Content suppliers orother Suppliers (including those with whom Wehave contracted to operate various aspects or partsof the Service) in connection with the Services (forthe avoidance of doubt Landmark is not a ThirdParty Content supplier). Landmark does not promisethat the supply of the Services will be uninterruptedor error free or provide any particular facilities orfunctions, or that the Content will always becomplete, accurate, precise, free from defects ofany other kind, computer viruses, software locks orother similar code although Landmark will usereasonable efforts to correct any inaccuracies withina reasonable period of them becoming known to us;Landmark's only obligation is to exercise thereasonable skill and care in providingenvironmental property risk information to personsacting in a professional or commercial capacity andYou hereby acknowledge that You are such aperson;no physical inspection of the Property Site reportedon is carried out as part of any Services offered byLandmark and as such We do not warrant that allland uses or features whether past or current will beidentified in the Services and the Services do notinclude any information relating to the actual state orcondition of any Property Site nor should they beused or taken to indicate or exclude actual fitness orunfitness of a Property Site for any particularpurpose nor should it be relied upon for determiningsaleability or value or used as a substitute for anyphysical investigation or inspection;You should carefully inspect the Property Site, andtake any other advice that would be reasonablyprudent to do prior to making any decision about theProperty Site to which any Report or Service relatesand not rely exclusively on the Report or any otherLandmark Services in terms of valuing the PropertySite;Landmark will not be held liable in any way if aReport on residential property is used forcommercial property or more than the oneresidential property for which it was ordered;

the Services have not been prepared to meet Youror anyone else's individual requirements; that Youassume the entire risk as to the suitability of theServices and waive any claim of detrimentalreliance upon the same; and You confirm You aresolely responsible for the selection or omission ofany specific part of the Content;You shall be solely responsible for maintaining theconfidentiality of Your passwords (including YourDesignated Users' password(s)) and You will notifyus immediately that You become aware of anyunauthorised access to, use or copying of any partof Services or document or report derived ordownloaded there from by anyone;You must observe and comply with all applicableregulations and legislation;We offer no warranty for the performance of anylinked internet service not operated by Us;You will on using the Services make a reasonableinspection of any results to satisfy Yourself thatthere are no defects or failures. In the event thatthere is a material defect You will notify us in writingof such defect within seven days of its discovery;without prejudice to any restrictions set out in theseTerms, if in the course of Your business orotherwise You use for the benefit of or convey toany third party any part of the Website, Content, orServices You must make such third parties aware ofthe limitations, obligations and acknowledgementscontained herein;any support or assistance provided to You inconnection with these Terms is at Your risk;the information contained in the Services has beenextracted from various Crown Copyright and otherpublished sources, and accordingly, Landmark doesnot accept any responsibility, and expresslydisclaims all liability, for any errors, omissions ormisstatements, or for any loss occasioned to anyperson acting, or refraining from action, as a resultof, or in reliance upon, the information contained inthese Services;

All liability for any insurance products purchased by Yourests solely with the insurer. Landmark does notendorse any particular product or insurer and noinformation contained within the Services should bedeemed to imply otherwise. You acknowledge that ifYou Order any such insurance Landmark will deemsuch as Your consent to forward a copy of the Report tothe insurers. Where such policy is purchased, all liabilityremains with the insurers and You are entirelyresponsible for ensuring that the insurance policyoffered is suitable for Your needs and should seekindependent advice. Landmark does not guarantee thatan insurance policy will be available on a Property Site.All decisions with regard to the offer of insurancepolicies for any premises will be made solely at thediscretion of the insurers and Landmark accepts noliability in this regard. The provision of a Report doesnot constitute any indication by Landmark that insurancewill be available on the property.If Landmark provides You with any additional serviceobtained from a third party, including but not limited toany professional opinion, interpretation or conclusion,risk assessment or environmental report or searchcarried out in relation to a Report on Your Property Site,Landmark will not be liable in any way for anyinformation contained therein or any issues arising outof the provision of those additional services to You orYour Client. Landmark will be deemed to have acted asan agent in these circumstances and the supply of theseadditional services will be governed by the terms andconditions of those Third Parties.For the avoidance of doubt, those parties providingassessments or professional opinions on Landmarkproducts include RPS Plc & Wilbourn AssociatesLimited. Copies of their terms and conditions areavailable on request from Landmark.

Landmark has undertaken the Services for use only bythe persons referred to at clause 3b and for no otherpurpose whatsoever and the Services should not berelied upon by any other third party. Landmark canaccept no responsibility and will not be liable to anythird party for any loss caused as a result of relianceupon the Services. Any third party relying on theServices does so entirely at its own risk, includingwithout limitation any insurers referred to in this clause6. Recipients of the Services are to rely on their ownskill and judgment in determining the suitability of theServices for their own purpose and use and are advisedto use the Services with caution and not base importantbusiness decisions solely on the same. LandmarkServices are merely one of the tools available for theassessment of environmental, geological or otherproperty or land-related risks and should be used inconjunction with other recognised methods ofevaluation.

Time shall not be of the essence with respect to theprovision of the Services.

You acknowledge that Landmark shall not be liable for anydelay, interruption or failure in the provision of the Serviceswhich are caused or contributed to by any circumstancewhich is outside our reasonable control including but notlimited to, lack of power, telecommunications failure oroverload, computer malfunction, inaccurate processing ofdata, or delays in receiving, loading or checking data,corruption of data whilst in the course of conversion, geo-coding, processing by computer in the course of electroniccommunication, or printing.

If any provision of these Terms are found by either a courtor other competent authority to be void, invalid, illegal orunenforceable, that provision shall be deemed to be deletedfrom these Terms and never to have formed part of theseTerms and the remaining provisions shall continue in fullforce and effect.

This Agreement shall be governed by and construed inaccordance with English law and each party agreesirrevocably submit to the exclusive jurisdiction of the Englishcourts as regards any claim or matter arising under thisAgreement. If any dispute arises out of or in connection withthis agreement (a "Dispute") the parties undertake that, priorto the commencement of Court proceedings, they will seekto have the Dispute resolved amicably by use of analternative dispute resolution procedure acceptable to bothparties with the assistance of the Centre for DisputeResolution (CEDR) if required, by written notice initiatingthat procedure. If the Dispute has not been resolved to thesatisfaction of either party within 60 days of initiation of theprocedure or if either party fails or refuses to participate inor withdraws from participating in the procedure then eitherparty may refer the Dispute to the Court.

These Terms, together with the prices and deliverydetails set out on our Websites and Your Ordercomprise the whole of our agreement relating to thesupply of Services to You by Landmark. No priorstipulation, agreement, promotional material orstatement whether written or oral made by any sales orother person or representative on our behalf should beunderstood as a variation of these Terms or as anauthorised representation about the nature or quality ofany Services offered for sale by us. Save for fraud ormisrepresentation, Landmark shall have no liability forany such representation being untrue or misleading.These Terms shall prevail at all times to the exclusion ofall other terms and conditions including any terms andconditions which You may purport to apply even if suchother provisions are submitted in a later document orpurport to exclude or override these Terms and neitherthe course of conduct between parties nor trade practiceshall act to modify these Terms.

You shall not without our prior written consent assign, ortransfer in any way the benefit of these Terms in wholeor in part or any of Your obligations under these Termssave as provided by Clause 3.b. Your right to use theServices, operate Your Account or to designate users isnot transferableLandmark may assign its rights and obligations underthese Terms without prior notice or any limitation.We may authorise or allow our contractors and otherthird parties to provide to Us and/or to You servicesnecessary or related to the Services and to perform Ourobligations and exercise Our rights under these Terms,which may include collecting payment on Our behalf.No waiver on our part to exercise, and no delay inexercising, any right, power or provision hereunder shalloperate as a waiver thereof, nor shall any single orpartial exercise of any right, power or provisionhereunder preclude the exercise of that or any otherright, power or provision.References in these Terms to any legislation shall beconstrued as references to the same as amended or re-enacted from time to time and shall include subordinatelegislation or regulations.Unless otherwise stated in these Terms, all notices fromYou to Landmark must be in writing and sent to theLandmark registered office (or in the case of anAuthorised Reseller, to its registered office address)and all notices from Us to You will be displayed on ourWebsites from time to time.A person who is not a party to any contract madepursuant to these Terms shall have no right under theContract (Right of Third Parties) Act 1999 to enforce anyterms of such contract and Landmark shall not be liableto any such third party in respect of any Servicessupplied.Landmark reserves the right to monitor or recordtelephone calls for training purposes.
