I' i 1 Violations 2 20. 3 The Accused admits that, by engaging in the conduct described in paragraphs 5 through 4 19, he violated RPC 1.3, RPC 1.4(a), RPC 8. 1(a)(2),and RPC 8.4(a)(3). 5 6 Sanction 7 21. 8 The Accused and the Bar agree that in fashioning an appropriate sanction in this case, the 9 Disciplinary Board should consider the ABA Standards for Imposing Lawyer Sanctions 10 (hereinafter, "Standards"). The Standards require that the Accused's conduct be analyzed by 11 considering the following factors: (1) the ethical duty violated; (2) the attorney's mental state; 12 (3) the actual or potential injury; and (4) the existence of aggravating and mitigating 13 circumstances. 14 n. Duties Violated. The Accused violated duties he owed to Hummasti to be candid 15 with him, to communicate with him, and to diligently pursue his legal matter. 16 17 18 Standards §§ 4.4 and 4.6. The Accused also violated a duty he owed to the profession to cooperate in the bar's investigation. Standards § 7.0. b. Mental State. The Accused acted knowingly. 19 c. Injury. Hummasti sustained actual injury in that he lost the opportunity to seek 20 re-consideration of or appeal from the court's decisions. in re Snyder, 348 Or 307, 21 232 P3d 952 (2010); in re Bourcier, 322 Or 561,569,909 P2d 1234 (1996); in re 22 Geurts, 290 Or 241,620 P2d 1373 (1980).
