CALL TO ORDER The meeting of the Personnel Commission of the Hacienda La Puente Unified School District was called to order by Ms. Anita Ford, Vice Chair, at 4:31 p.m., in the Board Room, 15959 East Gale Avenue, City of Industry, California. Ms. Gooch on her appointment to the Personnel Commission. She welcomed and introduced Khrynston Samreth, Personnel Analyst to the Personnel Commission department.

93. Ms. Hannon provided the following information to the

Commission.

Current recruitments: Adult School Office Manager, Bus Driver, Cafeteria Worker I, Instructional Aide – Auto Mechanics, Instructional Aide I – Special Education, and Senior Accounting Technician was reopened as Open and Promotional due to lack of qualified applicants.

Upcoming recruitments: Instructional Aide – Bilingual (Mandarin), Language Assessment Technician (Mandarin), Media Center Clerk, Special Education Liaison, Technology Services Technician, Rehabilitation Program Assistant, Warehouse Delivery Worker (Substitutes).

Classifications: o Food Services: Discussions with District Administration

and Bargaining Units anticipated to resume in January 2017.

o Instructional Aide III-Special/Medical Circumstances Education recommendation included in the agenda as a discussion item.

o School Office Manager report included in the agenda as a discussion item.

o Technology Services job family study has been moved up in the priority list, based on changes in the industry.

Training:

o A survey will be sent to all classified employees on December 9, 2016, to gather interest for future training.

COMMUNICATIONS 94. Ms. Margaret Caldera, CSEA President, welcomed Ms. Gooch, Commissioner and Khrynston Samreth, Personnel Analyst, to the Personnel Commission.

95. Ms. Caldera thanked Ms. Hannon for completing the

classification studies for the Instructional Aide II – Special Education and School Office Manager. She questioned why

the School Office Manager study did not include a recommendation to address the issue of equal pay for equal work, for members of the two bargaining units.

V. CHARGES AND HEARINGS 102. None. VI. OTHER REPORT: INSTRUCTIONAL AIDE II – 103. Ms. Diane Ortiz, Instructional Aide II- Special Education, SPECIAL EDUCATION was disappointed with the delay in possibly creating a new

class description, and the recommendation to conduct a study of the Instructional Support job family.

Ms. Hannon discussed the report for Instructional Aide II – Special Education. She reviewed the initial purpose of the study was to determine the appropriateness of the duties being performed by IA II-Special Education positions. The initial recommendation was to create a new class in the job family that combined special medical/circumstances in one class. During the review of duties, staff and the District discovered there was duplication of duties across the classes within the series that created difficulty in defining a clear distinction among classes. She recommended that a review of the Instructional Support job family be conducted in order to accurately identify appropriate duties for all Instructional Support classifications. Ms. Hannon committed to making the study a priority and upon approval will begin the study in January with an anticipated completion of May 2017. The Commission commended Ms. Hannon for her work on the study, and agreed that a complete study of the Instructional Support job family needed to be done in order to appropriately classify the positions. They requested that it be made a priority, while taking the time needed to appropriately classify all positions within the job family.

REPORT: SCHOOL OFFICE MANAGER 104. Ms. Hannon reviewed the report for the School Office CLASSIFICATION Manager Classification (SOM), and clarified that the District

determines the duties and responsibilities for positions while the Personnel Commission classifies employees and positions. The review of duties being performed by incumbents show that SOMs at both Elementary and Middle schools are performing high level duties, using independent judgement and exercising supervision over other classified employees, though some of the duties being performed are not captured in the class description.

Based on the additional review of duties and appropriateness of class, Ms. Hannon recommended the following actions:

A) Work with District Administration to update the duties in the class description that reflect the needs of the sites;

B) Work with District Administration and site Administrators on creating a training module for clerical members at the school sites.

Ms. Hannon responded to answer the question regarding the

issue of like pay for like work, and reviewed the next steps. Staff and District Administration will discuss the duties and classification. The District will determine the essential duties required, so that the Personnel Commission can appropriately classify the position. The final step will be to determine the level of work and level of pay.

on her appointment to the Commission. She thanked Ms. Hannon for conducting the school site visits and making the classification studies a priority.

Training Survey Results

We received over 128 responses to the training survey. Over 60% of respondents have been employed at

HLPUSD for over ten years.

The types of training respondents are interested in receiving are included below

(they were asked to select up to three):

Preferred availability varied for each day. Almost 70% of respondents selected online/internet trainings as

an option. Morning and afternoon trainings were almost tied at 50%.

Education Code Sections on Provisional Assignment

45287. When no eligibility list exists for a position in the classified service, an employee may receive provisional appointments which may accumulate to a total of 90 working days. A 90- calendar-day interval shall then elapse during which the person will be ineligible to serve in any full-time provisional capacity. No person shall be employed in provisional capacities under a given governing board for a total of more than 126 working days in any one fiscal year, except that when no one is available on an appropriate eligibility list for a part-time position, as defined in Section 45256, successive 90 working days provisional appointments may be made to the part-time position for a total of more than 126 working days in any one fiscal year.

45288. The personnel commission may authorize the extension of a provisional employee's assignment for a period not to exceed 36 working days provided the following requirements are met:

(a) An examination for the class was completed during the first 90 working days of his provisional assignment. (b) Evidence satisfactory to the personnel commission is presented indicating:

(1) That an adequate recruitment effort has been and is being made. (2) That extension of the provisional assignment is necessary to carry on vital functions of the district. (3) That the position cannot be satisfactorily filled by use of other employment lists or procedures.

Education Code Sections on Substitutes 45286. Whenever the appointing power shall require the appointment of a person to a position, the duration of which is not to exceed six months, or, in case of an appointment in lieu of

an absent employee, is not to exceed the authorized absence of said employee, the appointing power shall submit a request in which the probable duration of the appointment is stated. Eligibles shall be certified in accordance with their position on the appropriate employment list and their willingness to accept appointment to such position as limited-term employees. Limited-term employees shall be subject to conditions affecting status and tenure during and after employment that the commission may by rule determine. Notwithstanding these limitations on the duration of these positions, the commission may, based on a declaration of an emergency by the President of the United

SCHOOL OFFICE MANAGER CLASSIFICATION

February 7, 2017

I. Background

In 2014, a classification study was completed on the District’s clerical classifications. The purpose of a

classification study is to ensure positions are classed appropriately, arranged in an occupational hierarchy

and to review the written class specifications. As a result of this study, the Personnel Commission

determined that the School Office Managers (SOM) were working within the scope of the classification. The

remaining concern has been the two bargaining units that represent members in the same class. SEIU

represents members who work at Middle Schools and Alternative High Schools while CSEA represents

members who work at Elementary Schools (with the exception of Stimson Learning Center). Under the rules

of merit, members who perform the same duties should be paid equally. The classification study determined

the duties being performed by SOMs at all sites were the same.

At the April 7, 2015 Personnel Commission meeting, CSEA made a request to discuss the salaries of

employees in the SOM classification and review the discrepancies in pay between those on the SEIU

schedule and those on the CSEA schedule. After discussion in May 2015, the Personnel Commission

recommended two solutions: discuss the issue at the bargaining table with both CSEA and SEIU or through a

petitioning to the Public Employee Relations Board (PERB) for a unit modification.

Meetings were held with District Administration in the subsequent months to determine a course of action.

In October of 2016 staff requested time to conduct a new study, review data and study positions at the sites.

During subsequent interviews, observations and surveys it was discovered the majority of SOMs were

performing duties that were outside of their scope and not disclosed during prior studies.

II. Fact Finding and Analysis

The position of SOM (Formerly School Secretaries) was established in 1978. This classification was created

with two salary schedules: “B” for bargaining unit and “S” for supervisory, which did not have any

representation until 1997. Once supervisory employees unionized in 1997, CSEA and SEIU contracts were

revised in order to determine which positions would be assigned to which bargaining unit, however the class

description remained the same. SOMs at Middle Schools were assigned to SEIU while SOMs at Elementary

Schools remained on CSEA.

In 1978 when the classification was established, two salary schedules existed based on the needs of the

district. It is inferred that the supervisory group (S) performed supervisory duties while the “B” group did

not. This difference was sustained in 1997 when the “S” members were then represented by SEIU. The class

description remained the same for all SOM employees. Supervision was not included the class description.

PERB case law defines supervision below:

(g) “Supervisory employee” means any individual, regardless of the job description or title, having

authority, in the interest of the employer, to hire, transfer, suspend, lay off, recall, promote, discharge,

assign, reward, or discipline other employees, or responsibility to direct them, or to adjust their

grievances, or effectively to recommend this action, if, in connection with the foregoing, the exercise of

this authority is not of a merely routine or clerical nature, but requires the use of independent

judgement. Employees whose duties are substantially similar to those of their subordinates shall not be

considered to be supervisory employees.

PERB certified all SEIU positions in 1998, per SEIU contract. Those positions included Personnel Assistant, Police

Officer, School Office Manager (excluding elementary schools) and Senior Custodian, positions that do not

directly supervise employees but meet the class concept of supervisory. The Collective Bargaining Identifier

Code (CBID) is a three-digit code that is assigned to each job classification and designates classification (rank in

file, supervisory, exempt, etc) for state employees. CBID E-48 is identified as an excluded supervisory position

that meets class concepts, but do not supervise staff. The use of the identifier code is repeated in PERB case law

and some districts have adopted the same codes to designate classifications.

P.C. Rule 3.3.3 Effects of Reclassification on Incumbents

A. In order for an employee to be reclassified upward with his position, the reclassification must

have been occasioned by a gradual accretion of duties and not be a sudden change resulting

from reorganization or change of duties by the governing board.

The original intent of the classification was to have a supervisory and a non-supervisory class. The middle school

SOMs remained unrepresented until 1998 when SEIU joined the district. At that time the classification should have

been reviewed and reflective of the duties required at the school sites. This was a misclassification from inception.

After the 2014 study some changes occurred at multiple sites. Statewide reporting requirements created a shift

in technology, specifically at the high schools and middle schools. This change required a need for administrative

services to assist Principals with CalPads reporting and the maintenance of the master schedule. The results of

2016 study showed a number of SOMs gradually accreted additional higher level duties based on the needs of

the school site. Duties include:

Supervises, gives input and makes recommendation for other clerical staff to

Principal/Administrator.

Provides work direction to clerical personnel and student workers, monitors workflow, and may

adjust duties as needed.

Managing master schedule

At the December 6, 2016 Personnel Commission meeting, staff presented an analysis of data related to the

observations and surveys for all School Office Managers. The data showed there were no statistically significant

difference between the duties being performed at the Elementary and Middle Schools. At the inception of this

position, the needs at the Elementary and Middle schools have varied. The previous classification study of the

clerical series determined the positions were the same at both Elementary and Middle Schools. Since that time,

the needs of the school sites have changed and the duties have accreted over time to fit the needs of the site.

The results of the most recent study showed both middle school and elementary were performing the same

duties, however both groups were also performing duties not included in the classification. The PC has had to

determine if those additional duties warranted a change in classification or if they should be included in the

original class description. After discussion with the District, reviewing the individual responses from the survey

and looking at each individual site, staff determined a reclassification was warranted for middle schools,

alternative and special schools.

In an effort to remain compliant to Education code and to maintain the rules of merit, incumbents who have

gradually gained and performed (gradual accretion) higher level duties in order to meet the needs of the school

site and district, are eligible for a reclassification into a higher class.

III. Recommendation

The Personnel Commission approve the following:

1. Create School Office Manager II classification including higher level duties indicated below:

b. Manage master scheduling through attendance software

c. Operate as lead Cal Pads Data Entry and Reporting

Reclassify School Office Managers eligible under rule 3.3.1 (gradual accretion of duties) to new

classification School Office Manager II, for incumbents at middle, alternative and special schools.

Salary range 24-S on the current SEIU Salary Schedule. The effective date of this reclassification

would be February 8, 2017.

2. Create School Office Manager I classification. Additional duties being performed but not currently

listed will include:

a. Process timesheets for classified and certificated employees

b. May assist with Cal Pads Data Entry/Reporting

c. May operate in a lead role

Allocate School Office managers eligible under rule 3.2.5 to new classification School Office Manager

I, for incumbents at elementary schools. Salary range 24-B on the current CSEA salary schedule. The

effective date of this allocation is February 8, 2017.

The PC also recommends conducting a salary study on the clerical series to ensure internal alignment based on

these changes. PC Rule 17.1.1 states:

WAREHOUSE DELIVERY WORKER DEFINITION

Under the general supervision of the Warehouse Supervisor, performs manual and clerical functions related to receiving, inspecting, storing, distributing, and delivering equipment, materials, and supplies shipped to the District warehouse.

ESSENTIAL DUTIES

The classification specification does not describe all duties performed by all incumbents within the class. This summary provides examples of typical tasks performed in this classification.

Drives a bobtail truck or light motor vehicle to make deliveries to various schools and offices. Picks up and delivers mail, equipment, printed material, toners, surplus, and other miscellaneous supplies. Transports cafeteria money, payroll checks, school site money bags, and mail. Loads, unloads, and moves supplies and equipment. Lifts and moves stock by hand, hand cart, or warehouse equipment including forklifts and

pallet jacks, to shelf or floor storage locations. Pulls, checks, and packages stock for distribution to various departments according to requisitions. Checks, packs, wraps, and prepares parcels, letters, and food for shipment or delivery. Maintains shelves and goods in a clean and orderly condition. Receives materials, equipment, and supplies delivered on purchase orders. Inspects shipments for conformity to purchase order specifications. Checks stock status and prints requisitions using a computer. Processes first class mail using a postage meter machine. Sorts and prepares bulk mail. Performs other related duties as required.

DISTINGUISHING CHARACTERISTICS AMONG RELATED CLASSES

A Stock Delivery Worker performs stock, receiving, storage, delivery, and related clerical duties.

A Warehouse Delivery Worker performs receiving, inspecting, storing, distributing, and related clerical duties, and delivers equipment, materials, and supplies shipped to the District warehouse using a medium-sized truck. A Warehouse Supervisor is responsible for planning, directing, and coordinating the District warehouse operation and supervises warehouse personnel in performing a variety of warehouse and delivery activities.

MINIMUM QUALIFICATIONS

Education:

Graduation from high school or evidence of equivalent educational proficiency.

Experience:

Six months of experience in receiving, storing, and delivering stock in a warehouse environment, and six months of experience driving a medium-sized truck.

Special:

Possession of a valid California Class C Driver License.

Evidence of adequate insurance for a motor vehicle which meets the California legal liability insurance requirement and continual insurance coverage during employment.

Successfully complete a pre-employment physical examination. Valid Forklift Operator Certification within six months of employment. Certification will be

provided by the District.
