LETTER TO OUR MEMBERSBeth McConnell, State Director

In his inaugural address 20 years ago, President Jimmy Carter remarked: “We must adjust to changing times

and still hold to unchanging principles”—a statement that still rings true today. Our state and nation are cer-

tainly changing, and the issues being debated in Harrisburg and Washington, D.C. change with them. Yet when

it comes to public policy, the need for someone to balance the scales against powerful special interests is a

constant. For example:

• With the expansion of the Internet, information has become an increasingly valuable commodity. When corpo-

rations abuse their access to personal information, PennPIRG takes action for consumer privacy. (See page 2.)

• The Bush administration and current Congress are widely perceived to be less friendly to the environment than

their predecessors. When oil companies and others have aggressively pushed their agenda in Washington to

weaken environmental safeguards, PennPIRG stood up for clean air, clean water and our natural heritage. (See

pages 5-6, 8.)

• On the state level, the vigor with which our environmental laws are enforced varies depending on who holds

power. Yet when the state looks the other way, PennPIRG attorneys have taken action to bring illegal polluters

to justice. (See page 9.)

The changing times—and PennPIRG’s 15th anniversary, which we celebrated this year—prompted us to look

back on the work we’ve done and examine how we must adjust in order to rise to future challenges. Recognizing

the increasing necessity of defending the public interest—from the environment to consumer issues—PennPIRG

made an important decision. We separated our environmental program into a new organization, PennEnvironment,

which will allow for a sharper focus on environmental issues. PennEnvironment is off to a great start with a

victory protecting our state public lands from oil and gas drilling.

Knowing that PennEnvironment will effectively carry the torch on environmental issues, PennPIRG is able to

make an even greater impact on the consumer and good government issues about which we’ve always cared.

PennPIRG’s commitment to advocating for the public interest remains unchanged. We’re looking forward to

another 15 years of concrete results, and hope for your continuing support.

The Pennsylvania House of Represen-tatives passed three bills in 2002 thatwill make it harder for identity thievesto get away with stealing informationabout unsuspecting victims, thanks inpart to PennPIRG.

The new laws will make it easier forlaw enforcement to catch and penalizecriminals who steal a consumer’s per-sonal information. They also make iteasier for victims of identity theft toclear their records of false informationas a result of the crime.

PennPIRG staff testified before theHouse Consumer Affairs Committee inApril 2002 to support these and otherbills, and also testified in Sept. 2001before the Senate Communications andHigh Technology committee on simi-lar bills.

PennPIRG worked with the bill spon-sors, including Rep. Michael McGeehan(Phila.), who is also a victim of iden-tity theft. PennPIRG identified othervictims of the crime, and solicited theirtestimony as to how their personal in-formation was stolen and used againstthem. Identity theft is one of the

PROMOTING A NEW ENERGY FUTUREDecision-makers debated energy plans in Harrisburg and Washington, D.C.

PennPIRG State Director Beth McConnell criticized the special interest deals,and built support for smarter energy policies in Harrisburg

PennPIRG’s promotion of smart energypolicy that’s good for consumer pock-etbooks and public health was as im-portant as ever last year.

In 2001-2002, state legislators in Har-risburg considered a package of pro-consumer energy bills that are alsogood for public health and the environ-ment. Meanwhile, the Bush adminis-tration released its proposed energypolicy, which included drilling in theArctic National Wildlife Refuge, bigsubsidies for polluters, and a heavy fo-cus on increasing the use of dangerousand dirty energy sources such as coal,oil and nuclear power—all at the ex-pense of energy efficiency and renew-able energy sources like solar and windpower.

Promoting Smart Energy In Penn.In 2001-2002, PennPIRG was hard atwork to promote forward-thinking en-ergy policy in Harrisburg.

With towering wind turbines visiblefrom the Pennsylvania Turnpike, andmore solar technology in use in the statethan ever before, the Commonwealthhas made significant progress in devel-oping clean energy. Unfortunately, it’sjust not enough—even with these ad-

vancements, less than two percent of thestate’s energy comes from alternativesources. The remaining 98 percentcomes from dirty coal and dangerous,expensive nuclear power.

According to a Feb. 2002 report byPennPIRG’s Beth McConnell, “Blue-print for Pennsylvania’s Energy Fu-ture,” the state can meet 40 percent ofits electricity needs with wind, solar andenergy-efficient technologies. But asenergy demands continued to rise, elec-

tricity companies proposed buildingdozens of new fossil-fuel power plants,rather than investing in energy effi-ciency. These same utilities also spenta fraction of what they did a decade agoon energy efficiency programs that saveconsumers money and reduce pollu-tion. That’s a problem for public health,the environment and consumer pock-etbooks.

PennPIRG worked to build support fora package of bills in the PennsylvaniaLegislature, aiming to push the statetoward cleaner energy sources. Thesebipartisan bills, sponsored by Reps.Frank Tulli (Dauphin), Ellen Bard(Montgomery), Carole Rubley(Chester) and Edward Wojnaroski(Cambria), would:

• Give incentives to businesses andfamilies to purchase “personal power”technologies such as fuel cells,microturbines, solar photovoltaic pan-els and small wind turbines.

• Provide tax credits for the purchaseof energy-efficient equipment and theconstruction of “green” energy-effi-cient, environmentally friendly build-ings.

• Give tax exemptions and credits forthe development of commercial wind

• Require that the Commonwealth pur-chase 20 percent of its electricity fromrenewable sources by 2010, and provide$50 million for a Renewable ElectricityGeneration Fund to distribute grants todevelopers of renewable energy.

Battling Special Interests In D.C.PennPIRG also stood up to powerfulopposition from the oil, coal andnuclear industries in opposition to theBush administration’s energy policy.The U.S. House version included morethan $27 billion in tax breaks, directsubsidies and grants to the energy in-dustries that are responsible for sootyskies, global warming, and nucleardangers. The plan included little sup-port for renewable energy or energy ef-ficiency measures, despite overwhelm-ing public support for such solutions.

Additionally, the version of the BushEnergy Plan that passed the Housecalled for oil and gas drilling in theArctic National Wildlife Refuge in

Alaska—a pristine area that has beenoff limits to oil companies.

When President Bush and Vice Presi-dent Cheney visited Pennsylvania topromote the administration’s plan dur-ing the summer of 2001, PennPIRGwas there. Over the course of the sum-mer, the organization turned out hun-

dreds of activists and concerned citi-zens to rally for clean energy and en-ergy efficiency. PennPIRG built coa-litions with dozens of organizationsrepresenting consumers, religiousgroups, public health organizations,businesses and environmental groups.While the oil and auto industries lob-bied members of the state congres-sional delegation to support the bill,PennPIRG’s Beth McConnell lobbiedon behalf of the public interest—urg-ing members to oppose the bill.

Although a harmful energy plan passedthe U.S. Congress, PennPIRG andother state PIRGs stopped the bill fromreaching the president’s desk at presstime—a victory for consumers and theenvironment.

PennPIRG called for protection of the Clean Air Act,tighter air emission standards, and cleaner energy sources.

EXAMINING SPRAWLNew research cast a light on the state’s role in overdevelopment

PennPIRG research found that new highway construction and changes toplanning rules have encouraged sprawl

PennPIRG released two hard-hitting re-ports in Aug. 2001 outlining severalroot causes of sprawl in Pennsylvania.Both reports raised awareness of theissues and garnered significant atten-tion across the Commonwealth.

“Highway Hold-Ups” revealed howhighway construction threatens the en-vironment and health, and leads to traf-fic problems and taxpayer rip-offs.

“New roads attract new development.That’s why they tend to worsen traffic,and encourage sprawl,” said AdamLioz, preservation advocate and authorof the report. PennPIRG’s researchshowed that congestion alone has costPennsylvanians $20 billion over thepast 20 years.

PennPIRG called on PennDOT to de-velop sound land use practices that cutauto-dependency and to shift the focusof transportation policy toward mass-transit and pedestrian-oriented projects.The report also bolstered local effortsagainst highway projects such as theproposed Route 41 expansion inChester County, and the Blair MillRoad expansion in MontgomeryCounty.

In “Pennsylvania Land Use Law,”PennPIRG analyzed recent changesmade to the Municipalities PlanningCode (MPC), which regulates localzoning and can be used to curb sprawl.

The report revealed how legislationaimed at improving the MPC ulti-mately took us a step backward in landuse policies. Along with amendmentsthat weakened the bill, special interestssuch as the timber and mining indus-

tries and agribusinesses managed to in-clude provisions that threatenPennsylvania’s environment and pub-lic health. PennPIRG Preservation As-sociate Casey Hildreth called this acase of special interest handouts, notlegislative compromise.

Among other recommendations,PennPIRG called on state legislators toremove special interest provisions, aswell as to amend the MPC so that stateagencies must fully respect local plans,not just “consider” them, when issuingpermits and extending infrastructure.

Investigative ResearchEvery PennPIRG project begins with anexamination of the facts. Staff reviewexisting data collected by governmentagencies and non-profit groups, analyzethat data in ways that may lead to newconclusions, or conduct independentinvestigations. For example:

• PennPIRG’s report, “Seeing The Con-nection,” helped convince state senatorsto support an urban revitalization bill.

• In Feb. 2002, “Blueprint ForPennsylvania’s Energy Future” challengedlegislators to support renewable energy,despite opposition from polluting indus-tries that claimed clean energy wouldn’twork in Pennsylvania.

“When I battle strong special interestslike big developers, the most powerfultool I have on my side is the thousands ofcitizens that PennPIRG represents acrossthe state.”

During the 1990s, Pennsylvania devel-oped open space faster than almost ev-ery other state, while ranking nearly lastin population growth. Rather than ac-commodating new growth, the Com-monwealth has been spreading out aspeople leave older, depressed commu-nities for sprawling developments. Leftunchecked, the deterioration of oldercommunities leads to the loss of moreopen space and a lower quality of lifefor all Pennsylvanians.

In order to redirect resources towardexisting communities, PennPIRGworked throughout the fall and springof 2001-2002 to pass bills aimed at re-vitalizing Pennsylvania’s downtowns.Working with a coalition of anti-sprawland affordable housing groups,PennPIRG successfully lobbied for thepassage of two of these bills.

One bill makes it easier for non-profithousing groups to rehabilitate aban-doned properties, while the other bol-sters and solidifies one of the state’smost successful revitalization pro-grams, The Main Street Program.

“These common-sense bills will, overtime, help facilitate solid reinvest-ment,” said Casey Hildreth, preserva-

tion associate. “And during a periodwhen the state isn’t really growing, re-investment equals saved open spaces.”

To promote these bills, PennPIRG re-leased “Seeing the Connection” inApril 2002, which highlighted the linkbetween urban blight and suburbansprawl. A copy of the report was givento every state senator one week beforeone of the bills passed.

LOWERING HEATING BILLSPooling their buying power, Pennsylvanians saved on home heating oil

PIRG Fuel Buyers saved the average member in Pennsylvania up to $200 on oilheating costs in 2001

PennPIRG continued to provide Penn-sylvanians with affordable home heat-ing oil in 2001 and 2002.

PIRG Fuel Buyers, a project ofPennPIRG, collectively saved consum-ers in the Delaware Valley thousandsof dollars in the winter of 2001, pro-viding residents throughout the state af-fordable winter warmth.

PIRG Fuel Buyers is a consumer oilbuyers’ group that allows the citizensof Philadelphia and the surroundingarea to join together and demand fairprices for heating oil.

By using the collective buying powerof its 1,100 members, Fuel Buyers ne-gotiates prices based on the dailywholesale price of oil, and saves eachmember up to $200 annually.

PIRG Fuel Buyers provides consum-ers with an alternative to “business asusual” and increases the power of in-dividuals within the marketplace.

Alone, consumers are unable to de-mand lower oil prices, but by joiningwith other Fuel Buyers members, the

group has the leverage and buying powerto demand lower prices on heating oil, avital winter necessity.

“PIRG Fuel Buyers has been helpingDelaware Valley residents save money ontheir heating bills for years now,” saysLevana Layendecker, director of the FuelBuyers program. “This project is a testa-ment to the power of consumers whenthey come together; they are now able to

get fairer prices and fairer treatment inthe marketplace.”

In the past year PIRG Fuel Buyers hasbeen working to educate its membersabout energy efficiency and governmentprograms that are available for house-holds in need.

With the generous support of the 1957Foundation, PIRG Fuel Buyers pro-vided members with the tools theyneeded to affordably heat their homesin the winter.

This report was the 16th annual PIRG toy safety survey.PIRG uses results from its survey to educate parents abouttoy hazards and to advocate passage of stronger laws andregulations to protect children. Since 1986, the surveyshave led to over 100 enforcement actions againstdangerous toys.

In July, Staff Attorney Rebecca Stanfield spoke at arally to urge Congress to approve strong clean airlegislation.

Building CoalitionsWhen decision-makers consider a pro-posal, they want to know what the ex-perts say about it, who agrees with theidea, and who disagrees. That’s whyPennPIRG seeks opportunities to build acoalition around each campaign. The or-ganization builds broad support from alltypes of groups, including labor, reli-gious, public health, consumer and busi-ness organizations.

For example, in 2001 and 2002,PennPIRG worked with the ConsumerFederation of America, the PennsylvaniaCouncil of Churches and other organiza-tions to show broad support forproposals.

Throughout 2001 and 2002, PennPIRGworked to protect the health of Pennsyl-vania residents by urging state and fed-eral lawmakers to support the CleanPower Act. This legislation is the lead-ing plan to clean up the oldest and dirti-est power plants across the nation.

In June 2002, PennPIRG celebrated theSenate Committee on Environment andPublic Works’ vote to move ahead withthe Act, but criticized Sen. Specter forvoting against the plan.

The Clean Power Act would clean uppower plants that are responsible forover 30,000 deaths nationwide eachyear, and 38,000 asthma attacks inPennsylvania alone. By forcing theplants to comply with the law, 24,200of these attacks would be avoided.

“More Pennsylvanians lose their livesdue to power plant pollution than anyother state,” said PennPIRG’s BethMcConnell. “That’s why PennPIRGworked hard to move this legislationthrough Congress.”

The bill, if passed by the full U.S. Sen-ate, would reduce power plant emis-sions of toxic mercury, carbon dioxideand smog-forming nitrogen oxides that

lead to health problems and create sootyskies. The bill would also add toPennPIRG’s victory at the state levellast year, where a measure was adoptedthat will cut smog pollution.

This report analyzes the performance of federal and stategovernments with respect to enforcement of the Clean WaterAct. It examines the government’s listing of facilities that arein “Significant Non-Compliance” with their Clean Water Actpermits. BRINGING A POLLUTER TO JUSTICEYork area’s P.H. Glatfelter Co. will pay $32 million for violating the Clean Water Act

The settlement came as a result of PennPIRG’s suit against the firm forpolluting the Codorus Creek

When the Pennsylvania Department ofEnvironmental Protection failed to takeaction against a big water polluter in thestate, PennPIRG stepped in to make surethe polluter cleaned up its act.

And in 2001, PennPIRG was successfulin settling a lawsuit against P.H. Glatfelter,a paper mill in the York area. The facility,located on the Codorus Creek, was releas-ing more than 14 million gallons of darkwastewater into the stream, damaging theenvironment, and causing significant odorin the community.

A federal judge declared the emissionsillegal in Feb. 2001. In August,Glatfelter signed a consent decree inwhich it agreed to pay $30 million toclean up the facility’s discharges, aswell as a $2 million penalty, to be givento an endowment for environmentalprojects in the Codorus Creek water-shed. The settlement is believed to bethe largest of its kind in state history.

Meanwhile, PennPIRG staff workedvigilantly against the rollback of exist-ing clean water laws. Special interestsand their allies in the PennsylvaniaLegislature had taken steps to dramati-cally weaken state programs that pro-

tect waterways from dangerous toxicpollution. PennPIRG’s David Masurconvinced several sponsors to removetheir names from the bill by demon-strating strong public support for cleanwater, and stopped the rollback deadin its tracks.

PennPIRG remained watchful of theserollback efforts, ensuring that pollut-ers didn’t attempt to pull one over onthe people of Pennsylvania.

PennPIRG’s research was integral inuncovering the state’s worst water pol-luters. Using the Freedom of Informa-tion Act, PennPIRG obtained recordson industrial facilities in violation ofthe Clean Water Act. In May 2001,PennPIRG compiled a list of these fa-cilities, the types of violations occur-ring, and what steps must be taken tocurb illegal pollution. “Polluters’ Play-ground: How the Government PermitsPollution” was covered by media out-lets around the state.

Environmentally harmful pollution was discharged from the P.H. Glatfelter paper mill in York for more than12 years. In 2001, PennPIRG won the largest clean water settlement of its kind in Pennsylvania historyagainst the plant. Glatfelter will pay nearly $30 million for facility upgrades.
