EXECUTIVE SUMMARY Application: To review the City of Bayswater Community Events Program. Key Issues:

• The City provides a broad range of Community events throughout the year. • The current suite of events have been delivered year on year for a number of years

without major strategic review. • Officers are currently undertaking a review of the City's events program. • Council has the option to review and modify the City's events program. BACKGROUND

Council at its Ordinary meeting of 8 March 2016 considered the current suite of Civic and Community Events and resolved the following: "Council requests a review of the current suite of Community and Civic Events with a view to considering a revised program of events for the 2016/2017 year". The Community Events Advisory Committee met on 11 May 2016 and considered and discussed the review. A number of suggested changes to the City's current suite of Civic and Community events were suggested at this meeting. The following options were recommended following the desktop review presented as Attachment 1.

No formal community or stakeholder consultation has been conducted. Council may wish to engage the broader community in considering any future community events program. ANALYSIS

Community events are provided in order to deliver 'Our Community' Aspiration - A resilient community with a strong sense of purpose that is able to celebrate its diversity in numerous ways, and compliment the City ethos of 'The Garden City - Quality Lifestyle'. The purpose of the City's events and identified outcomes may be considered as follows:

• Connecting our community;

• Attracting visitors to the City;

• Enhancing City image; and

• Developing economic growth. Objectives for Community Events may be considered as:

• To encourage and promote community wellbeing;

• To celebrate cultural diversity;

• To appeal to families;

• To celebrate history and heritage;

• To promote arts and culture;

• To support community organisations; and

• To activate places and spaces throughout the City. The City provides a broad range of events throughout the year. The current suite of events have been delivered year on year for a number of years without major strategic review. The purpose of the Community Events Review is to ensure the City of Bayswater is responding to community demand and expectation, moving forward with technology and economic changes and maximising community benefit.

The City currently delivers 20 significant community events per year. The current 2015/16 budget to deliver the event component only (venue hire, infrastructure, marketing, catering, entertainment etc.) is $471,000. The City employs 2.5 full time equivalent staff to deliver community events. The 2015/16 staffing cost is $220,320. The total cost of delivering community events across the City, including the event component and staffing is $691,320. Officers have conducted an event by event analysis to include a summary overview of:

• Event purpose

• Event background

• Event time and location

• Uptake and attendance

• Marketing

• Community feedback/benefit

• Future options for consideration

• Future recommendations per event - No change, Modify event, Delete event.

The above summary analysis is provided as Attachment 1. In response to Councillor and community comment a range of new events such as, but not limited to the following suggestions may be considered. Potential New Event Concepts for Consideration

• Community Art Expo

• Olive Festival

• Kite Festival

• Councillor Corner at events

• Consider events rotating around the City and especially including Houghton Park, Bayswater and Shearn Park, Maylands as potential new venues

• Increase multi-culturalism or develop a specific multi-cultural event

• Increase community driven events in addition to City promoted events

• Undertake community consultation

• Consider external sponsorship/funding Any potential new event at this stage is un-costed and not listed for consideration in the 2016/17 budget.

OPTIONS The event options as proposed by the Community Events Advisory Committee are outlined in the above table.

CONCLUSION The City provides a broad range of events throughout the year. The current suite of events have been delivered year on year for a number of years without major strategic review.

A range of modifications and deletions are recommended. Council has the option to endorse, modify or request and consider further information in relation to the recommendations.

FINANCIAL IMPLICATIONS Council has the option to review and modify the City's events program and consider appropriate event budgets in the 2016/17 budget.

Council may wish to consider a request for financial support from the North of Perth Music Festival Committee for the 2016/17 budget.

12.1 Request for Vegetation Removal

Location: 23 Ingles Place, Bayswater Applicant: Ms Alyssa Hayden, MLC Officer: Director of Technical Services

EXECUTIVE SUMMARY Application: For Council to consider a request to remove vegetation at Ingles Reserve, to allow rear property pedestrian access for residents located at 19, 21, 23 and 25 Ingles Place, Bayswater. Key Issues:

• The applicant is requesting on behalf of herself and her neighbours to work with the City to remove and thin vegetation adjacent to their properties at Ingles Reserve to permit access from their properties to the River.

• The vegetation at Ingles Reserve is protected as part of the Swan and Canning Rivers Regional Park.

• Permit approval would be required from the Department of Parks and Wildlife (DPAW) as part of the Swan and Canning River Management Act should vegetation removal be supported by Council.

BACKGROUND

The City has received a request from the property owner of 23 Ingles Place (Attachment 1) to work with her neighbours at 19, 21, 23 and 25 to:

(a) Thin vegetation adjacent to their boundary fences; and (b) Clear small pathways from property boundaries to the reserve as depicted in the

plan below.

The land in question was historically one private land title which was subsequently subdivided and in March 2008, as part of the subdivision of the land, the developer was required to undertake the following:

"16. Preparation and implementation of a landscape and vegetation rehabilitation plan for the 'Parks and Recreation' reserve to the specifications of the Swan River Trust. (Swan River Trust)."

As detailed above, the subdivision was approved subject to the Developer undertaking revegetation works and other conditions. The developer prepared a landscape plan, however, did not implement the works. Subsequently, the City engaged an environmental restoration company to implement the plan using the developers bond. It should be noted that the reserve was also recently subject to tree poisoning and in response the Council resolved to install a 3m x 3m metre sign at the location indicating the tree vandalism. This sign has subsequently been installed. The land is owned by the State of Western Australia, with the responsible agent being the Department of Lands and a management order to the City of Bayswater. CONSULTATION Officers have met on site with the applicant to discuss the request and advised that:

(a) The City has a strong greening ethos and is not generally supportive of clearing native vegetation;

(b) Officers cannot approve such a request and it would subsequently need to be

considered by Council; and (c) Should Council support the proposal in full or in part, that before any clearing

works could be undertaken, an application would need to be made to the DPAW for permission to clear the vegetation.

Officers also worked with the applicant to identify an option that would result in the smallest amount of vegetation to be cleared, allowing access to the properties. Accordingly, this is the proposal that has been submitted by the applicant which limits the clearing to three access paths for the four properties involved. From the site meeting, it appears that the applicant was unaware that as part of the subdivisional approval, the revegetation was a requirement which occurred prior to the sale of the lots. Consequently, for the current landholders, this meant that there was a gap in their expectations of Ingles Reserve at the time of purchase, and the landscaping that was required as part of the subdivisional approval. The City has contacted the DPAW (formerly Swan River Trust), who have advised that should Council approve the vegetation clearing, a permit application would also need to be applied for by the applicant as a requirement under the Swan Canning Rivers Management Act.

ANALYSIS

The impact of new subdivisions on the river park is an emerging issue for the City, which has been catalysed due to changes in zoning and the value of river front land so close to the City. Officers have recently observed an increase in requests from new home builders adjacent to river reserves to increase the service level (and increase resource allocation) for works in bushlands adjacent to their development or requests to remove vegetation. Large lot subdivisions, such as these, are assessed and approved by the WAPC and, as such, the City can only make recommendations on the subdivision conditions. The residents have noted a number of reasons supporting the vegetation thinning and removal which have been summarised with officers comments provided as follows:

APPLICANTS RATIONAL OFFICER'S COMMENTS Public access to foreshore Officers have liaised with DPAW and confirmed that the

intent of the policy referred to was to encourage linear access, not access from the private domain (Attachment 2).

Emergency access for residents Although two access points are ideal, this is not a requirement for the City to provide.

Reduce fire risk of vegetation The vegetation is not currently considered to be a fire risk. Maintain area from weeds Currently, the weeds invading the reserve appear to be

coming from the residents' properties. Reduce snake risk The clearing works requested are unlikely to reduce the

likelihood of snakes entering the properties. In this case, direct foreshore access was not considered as part of the subdivision of the original property. Additionally, the revegetation plan commissioned by the developer at the subdivision stage highlighted the purpose of the vegetation which was to screen the wall. This requirement is often stipulated by the DPAW to soften the visual impact of manmade structures like walls for the amenity of other river users. It should also be noted that the revegetation of the reserve has been considered to be very successful as indicated by the Friends of Claughton Reserve (Attachment 3). The Public Reserves - Management of Vegetation Adjacent to Private Property Policy indicates that in relation to the cost of the works that:

"c) The Council will consider the application provided the following requirements have been adhered to:

(iv) The cost of the initial pruning, removal and/or replacement of vegetation, unless otherwise specified by Council, shall be borne by the applicant;"

The removal of the vegetation benefits the four private land owners. As such, Council could consider funding the works (approximately. $1,800), or as the benefit is received only by the existing private landholders, Council could support the works at the applicant's expense.

OPTIONS The following options have been identified for Council:

CONCLUSION As an emerging issue for Council, this is a difficult decision to make and may set a precedent for future developments. The restoration works at Ingles Reserve have been successful and the vegetation is covering the reserve. Equally, the lack of access from the development to the river was also a weakness in the original development proposal and did not accommodate the residents enjoying the direct benefit of living on the river. However, it is not uncommon for adjacent properties to have direct access to the foreshore reserve throughout the City. The proposed balance between the competing social and environmental issues is to support a small amount of clearing to allow access but to not support vegetation thinning for other purposes. Given the strong growth of the vegetation in this instance and vegetation type, the limited clearing proposed is not considered to have a significant detrimental environmental impact on the area. Accordingly, Option 2 is recommended to clear the vegetation pathways, subject to DPAW approval, however, it should be noted that this will still not enable other residents in the subdivision that do not border the foreshore reserve to have direct access to the river.
