In October 2000, about 3.9 lakh DOT staff joined BSNL, nowknown as BSNL absorbees. 1.25 lakh of them have alreadyretired. 2.65 lakh are in service. Before 2025, another 2.6will retire. They should also get pension revision in future.Because the ‘retired’ and ‘to be retired’ absorbees as wellare governed by CCS (Pension) Rule 1972. Hence whenAIBSNLPWA demands a sustainable system for periodicpension revision it is a demand for the serving BSNL/MTNLabsorbees also. They should understand it.

Can we depend upon the affordability of BSNL in 2026 or2027? Government has already declared BSNL and MTNLas “incipient sick”, means beginning to be sick. It may becomereally sick before 2025. Because those at the top, who havenot joined BSNL, are not interested to save the company.Many employees at the lower level behave as if they areunaware of the danger. Government is not at all ready to saveBSNL and MTNL. Repeated sincere efforts made by theService Unions do not bear the desired results.

Serving staff must wake up to the reality. In 2026, when manyof them are pensioners, we cannot talk of PRC which maynot be applicable to BSNL even if the company survives thestorms of attacks. All of us have to depend upon CPC reportsand pension revision formula applicable to central servicepensioners who are also covered by CCS (Pension) Rule 1972.

The plight of Directly Recruited (DR) BSNL staff is morepathetic. A lady employee complains that she is getting Rs1311 as EPF pension while her last salary was Rs 45000. ADR Accounts Officer retired recently says that his monthlyincome has come down from Rs 78000 to Rs 1000. BecauseBSNL did not credit to EPF entire amount collected from him.Even after 18 years, BSNL Management failed to prepare apension scheme for the DR staff. The Staff Unions also failedto get it.

We think of the future. We have a clear vision. We want adecision by Government to introduce a permanent systemfor periodic revision of pension of BSNL absorbees along withthe central government pensioners, who are all covered bysame rule. The staff and their unions in BSNL/MTNL shouldsupport this correct demand. It is a demand for their future.

1. Delegates: Number of delegates is regulated according to the CHQQuota for membership received up to 31-3-2018. It was calculated andcirculated to Circle Secretaries during Chennai CWC last. Still, some branchesare sending more delegates, in excess of quota paid.2. It is decided that duly elected Delegates shall be accommodated in threeBhakta Niwas - Gundicha Bhakta Niwas, Nilachal Bhakta Niwas and NiladriBhakta Niwas. Four people have to share one Double-bed room. CircleSecretaries have been requested to send the list of delegates and visitorsdistrict-wise well in advance to avoid last minute rush.3. Each Delegate/Visitor has to pay Rs 1000 to Reception Committee. It isfor food.4. Accommodation shall be FREE for Delegates ONLY.5. Accommodation for Visitors shall be arranged, subsequent to receipt ofremittance by Reception Committee CA No 37632997819 at SBI IFS CodeSBIN0010928 PAN AADAA5034E. Non-AC room rent is around Rs 1000 perday for 2 persons. In case of non-availability of Non- AC rooms nearby, visitorsare to be accommodated in AC Rooms, the rent is around Rs 2000 per roomper day for 2 persons. Accommodation charges remitted after 31-08-2018can not be entertained.6. Districts/Delegates remitting accommodation charges are treated asADVANCE and NOT the total rent. The actual rent shall be paid to the Hotelwhile leaving the room.7. Those visitors coming without paying the rent in advance can NOT beguaranteed room accommodation.8. Delegates and CWC members coming with their spouses can beaccommodated in Puri Hotel or any available Hotel nearby, but NOT in BhaktaNiwas. They should intimate in advance.9. Some branches have sent the money but not intimated the details. Itshould be done.10. Food will be served at Kalyan Mandap, just opposite to Railway TouristComplex (Conference Hall), near Puri Railway Station.11. Food will be served to only those who pay Rs. 1000 per head for thepurpose.12. Bus will be arranged from Conference Hall to the Bhakta Niwas, PuriHotel, and Trimurthy Height which is within 2 KMs.

Draft report on the activities from November 2015 to August2018

Dear comrades, I am happy to present this report on theactivities of our CHQ from November 2015 toAugust 2018 for your kind approval please.

Our HomageDuring this report period we lost many Leadersfrom all over world, in our country, some leadersand members of our Association.

Fidel Castro, the legendary Revolutionary, whosaid “Revolution cannot be imported. You haveto wage your battle yourself. It does not matterhow small you are if you have faith and plan ofaction” expired on 25-11-2016 at the age of90. Mr. Stephen Hawking, the brilliant Britishtheoretical physicist who overcame adebilitating disease to publish many popularbooks probing the mysteries of the universe,expired on 20-3-2018. He was 76. The only oneAir Chief Marshal of India Mr. Arjan Singh,retired from life on 16-9-2017 at the age of 96.Com A. B. Bardhan, former General Secretaryof CPI expired on 2-1-16. Though he was bornin Bangladesh became active in studentmovement while he was at Nagpur. He rose tobecome the G/S of AITUC and then the CPI.Shri Somnath Chatterjee, one of the eminentparliamentarians of India expired in Kolkata on13th August 2018. He was 89. As a distinguishedLok Sabha Speaker, Somnath Chatterjeeplayed an important role in defending thefoundations of the Indian Constitution,particularly its secular democratic foundationsand federalism. . He was the speaker who

introduced live telecast of Lok Sabhaproceedings, which brought some transparencyand sense of responsibil i ty amongparliamentarians of our country. As a verysuccessful lawyer by profession, he also tookup the cause of the working class and thedeprived to ensure justice is delivered to them.Throughout his life he stood for principleschallenging any authority and dogmatismunmindful of consequences. Com. R K Kohli,one of the tallest leaders of Indian Telecomworkers expired on 25-11-2017 in New Delhi.He was 84. Com Surya Narayana a long timecircle Secretary of NFTE Andhra and seniorleader left us on 2-2-2018.

Com. B K Brahmbhatt, our All IndiaOrganizing Secretary and Circle President ofGujarat expired on 17-4-2018. The newsreached us soon after the CWC meeting wasover in Chennai. Immediately all the availableCWC members assembled again and paid richtributes to Com. Brahmbhatt. He was a verydedicated and dynamic leader of our GujaratCircle Unit. On 28th May 2018 night, Com. NP Jaiswal expired in Bhopal. Com. Jaiswal wasthe founder Circle Secretary of our Associationin MP. He travelled all over MP Circle, organizedmembership with dedication and placed thisorganization on a strong base. Com R.B.Ramafrom Allahabad U.P.East and former All IndiaVice President of our Association since itsformation departed on July 8th 2016 from usafter long sickness. Com Prahald MohantyDistrict Secretary of Rourkela district passed

away on 22-1-2018. Com D.Hariharan adedicated worker of our Association in ChennaiTD Circle left us on 1-2-2018. Com. SampathSingh, Rajasthan Circle President expired on29-9-2017. Com. Amrithalingam, Presidentof Salem West SSA Unit who was instrumentalof merger of a separate organizat ionfunctioning there along with more than 300members with our Association expired on 25-9-2017. Com. Harikrishnan, former All IndiaOrganizing Secretary of our Associationexpired in Chennai on 22-4-2018. He was 76years old.

Com. R N Pada Nair, our former CircleSecretary/President of Kerala lost his son inan accident. The renowned Carnatic musicianDr Balamuralikrishna expired 22-11-2016and Ms. Mrinalini Sarabhai, the great Artistand Social Activist expired on 21-1-2017. Wecondemn the brutal murder of Ms GauriLankesh, a f ree thinker and a mediapersonality in Bengaluru. We express our griefon the sad demise of dozens of small childrenin the hospital at Gorakhpur.

We pay respectful homage and condolenceson the demise of above personalities and alsoon the demise of many of our members invarious Circles as well as the common peoplewho lost their lives due to various naturalcalamities, communal violence and socialdisturbances

The Changing WorldA lot of changes had happened world wide withthe election of Trump as U.S. President. Hehad not only made drastic changes inside thecountry like withdrawing Healthcare policiesand visa restrictions he had started changingthe international scene also. He had meetingswith North Korean and Russian Presidents toreduce the nuclear arms which had raised

some hopes. But his recent orders to NATOcountries to increase Defence spending ringsan alarm bell. He has issued sanctions againstIran and has warned other countries havingtrade relationship with that country also. Hehas also started a trade war. All these thingsindicate the return of old hegemony of theimperialism affecting our country India too.Many countries continue their attack s on thepension system and healthcare of thepensioners. The attempt by Brazil to pensionreform has been stopped because of theupsurge of the people. Briton is sufferingbecause of the Brexit policies of its own. Inother countries in the South America andEurope some political changes favouringpeoples policies have taken place.These changes have reflection in our countryalso. A policy of fixed Term Employment hadbeen introduced in MP and Rajsthan States andby the Central Government. It is nothing butcontract employment with a new attractivename. The NPS introduced in 2004 had notbeen withdrawn as demanded or any changeshave been introduced. A talk of ConsolidatedPay Revision once in five years has beenfloated for CG Employees instead of PayCommission. It is nothing but denial of periodicDearness allowance for 5 years. Attempts arebeing made to change the hard-won rights ofthe working people. Even in our case we couldexperience a policy of tight financial control onpension expenditure after the annulment of60:40 issue. DOT has issued instructions toBSNL that benefits that have implications inpension should not be sanctioned withoutspecific approval of DOT. Because of this someof our issues have to go to court.

BANGALORE AICThe 2nd Triennial All India conference held inBangalore city on 21st and 22nd November2015 was really a milestone in the history of

AIBSNLPWA, the largest organization ofTelecom pensioners in India. It commenced inan atmosphere of some uncertainty but endedwith great hope and inspirat ion to allparticipants. The entire Tamilnadu, especiallythe Chennai city, was flooded due to incessantrains. Bangalore too had unusual heavy rainsthen which created some unexpecteddifficulties. 155 trains touching Chennai werecancelled. As a result, more than 100 delegatesfrom various circles could not reach Bangalore.Some others reached late. Entire Bihar teamwas absent in the conference as their train wascancelled. 41 comrades from Jabalpur bookedin a particular train which was also cancelled.Similarly, number of comrades from Jharkhand,Assam, West Bengal, UP East and Andhra alsocould not reach Bangalore.

CHQ had restricted the number of delegatesto the AIC based on the quota received fromSSA Units, taking into account the difficultiesexperienced in the previous AIC at Jaipur. 900comrades from circles other than Karnatakawere expected to attend the AIC. Out of them,787 comrades only registered and attended.Adding the elected delegates from Karnataka,a total of 945 delegates attended theConference. In the Open Session on 21-11-2015, there was a large gathering of more than1600. The prestigious Ambedkar Bhavana ofBengaluru city with 1400 seats could notaccommodate all.

Chhidu Singh HallAmbedkar Bhavana Auditorium was named“Chhidu Singh Hall”, as a tribute to our lateComrade Chhidu Singh.

CWC meetingThe CWC meeting was held on the evening of20th with the available comrades. The Reportof the Secretary and the accounts were

approved by the meeting. Various committeeswere formed to help in conducting theconference.

Open SessionOpen Session commenced with flag hoisting. OurNational Flag was hoisted by ReceptionCommittee Chairman Com G. Babu and ourAssociation flag was hoisted by Our PresidentCom P.S.Raman Kutty amid slogans shouting.Though we had rescheduled our Open Sessionto enable Shri Anantha Kumar to participate hecould not be present due to other importantengagements. We had invited Com K.C.MohanBahadur Vice President (Asia) TUI P&R, ComRamcharan Wagle Secretary, and Com LekhNath Gautam Treasurer, REAN, Nepal. ComBahadur inaugurated the conference. Coms S.C. Maheswari, S.Genl BPS, ComsBalasubramanian SG, AIFPA, Krishna Rao, Secy,Karnataka P&T Pensioners’ Association, ShriGnanasekaran, CCA Karnataka, Shri Nagaraju,CGM, Karnataka, participated and spoke in theopen session. Keynote addressed by Com D.Gopalakrishnan was appreciated by all.

A Fantastic PerformanceTelecom Colony Residents’ Association’scultural troupe presented a cultural programmeof dance items giving a noble call to maintainthe secular fabric of Indian nation and Indiansociety. This cultural extravaganza wasappreciated and enjoyed by the ent ireaudience.

Subjects committeeThe subjects Committee started by 2:00 PM. Apresidium comprising Coms, Ramankutty,D.G., A.P.Saraswathi, J.K.Tripathy andR.Ramachandra Rao conducted theproceedings. The report on the activities of theAssociation since the AIC at Jaipur andAccounts for the said period were submitted.

The Accounts and the Activities report wereapproved and the discussion on Organizationwas initiated by Com Muthialu and all CircleSecretaries, Off ice bearers and activecomrades participated. On 22-11-15 subjectscommittee was continued and proceeded asper Agenda. Constitutional Amendments withchanges suggested and resolutions on issuesof pensioners were adopted.

Shri Anathakumar AddressesShri Ananthkumar, Minister for Chemicalsand Fertilizers reached the venue at 5.45PM. Com. D.Gopalakrishnan presented veryeffectively 3-4 major issues like 78.2%,future Pension revision, Pension anomalyand allotment a staff quarter to ourAssociation in Delhi, on which we needeffective intervention of Shri Ananthkumarjiagain. The Minister while addressing theconference declared that “I am with you.” Thedeclaration was received by the delegateswith great ovation. Shri Ananthkumar saidthat he was aware of the significance of ourdemand for 78.2% because he had seen hisfather (a retired Railway employee) fightingfor the rights of pensioners, howsoever smallit was. He asked our leaders to reach Delhion 30th November 2015 and meet him. Hewould arrange meetings with DoT Secretary,DoE Secretary and Shri Nrupendra Mishraji,Principal Secretary to Prime Minister. Hecreated an impression in the minds of alldelegates that he is a leader with adifference. Thus the conference that startedwith some anxiety and apprehension endedin jubilance and euphoria. It was a grand,fantastic finale of an event to remember forlong.

FelicitationsCHQ honoured some branches foroutstanding achievements. Madurai SSA unitwas honoured being the largest branch with1536 members. Bangalore SSA unit washonoured for having the largest number of1100 Life members. Ernakulam SSA unit wasfelicitated for being the second largest branchwith more than 1000 life members. WestGodavari branch was honoured for having100 % life membership. The ReceptionCommittee was honoured for thewonderful work done by it. Similarly, someof the outgoing office-bearers and themembers of Magazine Committee were alsohonoured by CHQ. At 7 PM the conferencecame to a conclusion

SPECIAL CONFERENCEThe Special Conference held in the prestigiousPalace Grounds in Bengaluru city on 12thNovember 2016 was an event to be

remembered always by us. It was wellarranged, well-disciplined and well attended.In fact, we wanted to celebrate the victory on78.2% and annulment of 60% limit, on 18thSeptember 2016 at the same venue. More than1000 BSNL pensioners from different parts ofIndia had booked the t ickets to reachBengaluru for that. But, due to the disturbancesin Bengaluru we had to postpone theprogramme. This time we did not get sufficienttime to book railway tickets. Comrades camedown from nearby Circles like Andhra, Keralaand Tamilnadu only. Still the Sheesh Mahal inPalace grounds was full. Comrades from 16circles felicitated Shri Ananthkumar based onthe culture of their areas. Shri Ananthkumar,moved by this rare show of affection and love,remarked “ AIBSNLPWA is the only trueorganization of BSNL Pensioners.” The teamled by Comrades Babu, Chengappa ,Murthy,Gururajan, Ranganayukulu, Krishna Murthy,Sreenath and others made very goodarrangements for the function. They deserveall congratulation and appreciation. Only Com.P Gandhara Rao, our Dy GS could not attendit as he was in USA. He was the man behindthe proposal to have the Celebrat ionconference in Bangalore and almost daily hewas anxiously contacting us over phone fromCalifornia. We arranged a live broadcast of theentire event; perhaps for the first time in thehistory of Pensioners’ Associations in India.Thousands of people sitting in different partsof the world, in UK, USA, Australia, Japan,Singapore, Sweden etc. could watch it.Karnataka comrades also released a CD of thefunction. Our Vice-president Com DG, afterthanking Hon. Minister Shri Ananthkumar forhis sincere efforts to get the 78.2 benefit butalso for annulment of 60% condition, explainedthe demand of “Future Pension Revision”. Inresponse, Shri Ananthkumar said that ourAssociation has made a deep study and

research on the issue and that is very muchrequired. He also said that the ball of FuturePension Revision shall also be taken to the goal.The hall-mark of the special conference wasthe speech of Shri Ananthkumar.

The CHQ met the entire expenses from itsfunds.

CWC meeting at BangaloreWe had planned to conduct the CWC at Rajpurain the month of November 2016 and specialconference to celebrate the victory of 78.2%pension revision in September at Bengaluru.But due to unforeseen developments, theprogramme was changed. So we had refixedthe CWC and the special conference on 12thand 13th of November at Bengaluru itself. Dueto this sudden development, among the CHQoffice-bearers, Comrades P Gangadhara Rao,M R Das, R C Malhotra, Gyan Singh, M D Saraf,B K Brahmbhatt and Chandrika Singh could notattend it. Similarly Circles Secretaries ofAssam, Gujarat, Kolkata Telecom Factory,Punjab and Rajasthan also could not attend themeeting. Com Raman Kutty presided over themeeting. CWC Members participating in thedebate explained the position regarding workon revision of pension with 78.2% IDR benefit.At that point of time there was smallimprovement in Kerala and Tamilnadu Circlesbut in other Circles nobody had got the benefit.

Decisions: Some of the decisions taken by themeeting are:

1. In addition to Com. D. Gopalakrishnan, Com.G Natarajan, GS will attend the proposed AsiaRegional Conference of Trade UnionInternational (P&R) at Kathmandu, Nepal on 3-12-2016. In addition, the nearby Circles of Biharand Jharkhand may explore possibilities ofsending one delegate each in addition.

2. Next CWC meeting will be held in 2017 atPatna. CHQ will decide the date and announceat the appropriate time.3. Next AIC: Odisha Circle invited thenext AIC to Puri in 2018. CWC accepted theinvitation. As done last time, CHQ shall issuea call for special AIC Fund @ Rs. 50 permember and the same shall be remitted bybranches to CHQ only; not directly to ReceptionCommittee.4. NTR Circle: The meeting consideredvarious letters sent by Shri R L Kapoor,President of newly formed Headquarter branchin NTR Circle. Meeting directed the NTR CircleUnit to hold its Circle Conference before 15-3-2017. Before that, the SSA units in NTR Circleshall be re-organized. Detailed instructionshave been f inalized to be issued to allconcerned.5. We have not yet formed Units in someof the SSAs in some circles. Efforts shall bemade to form Units in all the remaining SSAs.6. We shall continue efforts to form unitsin few Circles left out.7. Units shall take all efforts to enrollmaximum Life members when the arrears arepaid on account of 78.2% benefit.8. Comrades D Gopalakrishnan, GNatarajan, G. Babu and R. Changappa will goto New Delhi after 21-11-2016, meet ShriAnanthkumar and pursue the case of futurepension revision. During the visit our leaderswill take up the case of delinking 33 years ofqualifying service for full pension and othercases as well.

Patna CWC 11 & 12th November, 2017Our CWC was held at Patna on 11th and 12thNovember, 2017. Bihar Circle comrades underthe captainship of Com A.K.Singh had madevery good arrangements for comfortable stayand excellent food arrangements. On behalfof CHQ we convey our heartfelt thanks and

appreciation for the Bihar circle and ComA.K.Singh. The CWC discussed and decided.

1. To co-opt Com Anupam Kaul of Delhi circle asAGS of CHQ.

2. Appointed an adhoc committee with Com.P.C.Kaushik of NTR branch as convener toreorganize NTR Branch as the erstwhile officebearers switched over to another organization.

3. About the organizational problem ofU.P.(WEST), it advised the Circle Secretary tohold a CEC to sort out the differences

4. Advised WB circle to hold the adjournedconference by ensuring participation of alldistricts.

5. It was decided that the Delegate fee for theensuing AIC at Puri shall be Rs 1000/= and Rs50 shall be collected from each member as AICdonation and remitted to CHQ before April 3018.

6. To file legal case in CAT for getting the pensionarrears of 78.2 benefit from 1-1-2007 and anothercase for getting pension at 50% of notional LPDfor pre 2006 BSNL retirees on par with C.Gpensioners.

An open Session was held in which Com C Singh,GS of NFTE participated. At the initiative of ComMuthialu Com C Singh and the retired PGM ofPatna enrolled themselves as Life members ofour Association during the Open Session itself.

Chennai CWC meetingWe had to call for an urgent CWC meeting todiscuss about the Income Tax problem and PANcard problem of Association. Tamilnadu Circlereadily accepted to hold it at Chennai and CWCwas on 16th and 17th April 2018 at RTTCChennai. It discussed about AIC at Puri on Sept22 & 23 and the preparations of the Reception

committee in making the stay comfortableand memorable. The main decisions are

Resolution Committee: Comrades KMuthialu, V V S Murthy, R A Sharma and GS Bajwa.

Credential Committee: Coms. V Rama Rao,T P George, A K Singh and R N Singh.

Minutes Committee: Coms. R H Mitkary, J SDahya, V Varaprasad and R N Padanair.

Resolutions and amendment to constitutionshould reach CHQ before 15-6-2018.

AIC FUND: Though Patna CWC decisionswere conveyed, only some branches haveremitted the amount. All are requested toremit the amount to CHQ account before 30-6-2018 itself.

PAN and IT Returns: Circles and DistrictUnits who have already obtained PAN shouldfile IT returns. CHQ will issue detailed circularto all circles soon in consultation with newauditor. Xerox copy of PAN may be suppliedto CHQ by all Circles and District Units whohave it.

Auditor: M/s RCS and Co, Chennai areappointed as new auditor.

organizations, agreeing with the demand, fora joint programme.

OUR ISSUES

SETTLEMENT OF 78.2 PENSION REVISIONAND 60:40 ANNULMENTThe benefit of 50% IDA merger was extendedto employees from 10-6-2013. A clause in theagreement that i t wil l be extended topensioners also was removed on theinstructions of DOT. Despite this someAssociations wrote that it will be extendedautomatically to Pensioners also. But it tookmore than three years for extending this benefitto the pensioners. There were two factors thatmany people forgot. One is that the extensionof the benefit is to be approved by the cabinetand a cabinet note has to prepared andapproved by the nodal departments beforeputting up to the cabinet for approval. Thesecond factor that came is the order issued byDot in 2006 limiting the pension expenditureto 60% of what the BSNL pays to the govt inthe form of Service Tax, Dividend, Corporatetax etc. The expenditure incurred for DOTretirees was also included. Hence there wasa considerable delay in DOT. Some peoplepleaded for payment of 78.2 benefit firstbypassing this order. But DOT was notprepared. We took the correct stand that it isa subsequent clause introduced in violation ofthe agreement in 2000 and should be annulled.At this time the immense help came from ShriAnanthakumar Hon. Minister for Petroleumand Chemicals. The Hon. Minister whoattended our AIC at Bangalore assured all thehelp and said it is our right to get pensionrevision. Our Karnataka comradesGangadhara Rao, Babu and Changappapursued with the Minister. On his advice wewent to Delhi where he spoke to then DOTSecretary Shri R.K.Garg and arranged ameeting in which it was agreed by the

Administration to put up cabinet note forannulment of 60:40 also. Finally the Cabinetmeeting held on 5-7-2016 approved the 78.2benefit and more importantly annulment of60:40 clause. The order for revision was issuedby DOT on 18-7-2016 and annulment order on20-7-16. Thus, with our correct stand andapproach we could achieve the demand andsecured pension payment from Govt of Indiafor future retirees also.[We have published inour Patrika more than once all the details ofefforts made by us, especially by our Karnatakacomrades, for getting the cabinet decision for78.2% benefit. Hence, those details are notrepeated here.]

BSNL MRS: MEDICAL ALLOWANCE W/OVOUCHER FOR PENSIONERS.Medical Reimbursement scheme wasintroduced by BSNL for its employees andPensioners in the year 2003. It had provisionfor Outdoor treatment and Inpatient treatment.It had also an option for Medical allowancewithout voucher Scheme which is 50% ofannual eligible amount for O/D treatment.

This was a very great help to the pensionerswhich obviated the difficulty of submission ofbills to the office and tracking the bills. BSNLMRS was the best in the entire PSUs andalmost all the people opted for it. But due tothe financial difficulties faced by BSNL, thewithout voucher scheme was withdrawn in theyear 2011. We discussed with theAdministration and it was informed that if theworking employees accept it can be extendedto pensioners. We wrote to all the BSNL StaffUnions requesting for support. But one of thetallest leaders of the Employees Union said thatthis cannot be extended to pensioners aloneand prevented others also from supporting. Butwe continued our efforts with the Director (HR)Smt. Sujata Ray who was sympathetic to ourdemand. We met CMD, BSNL when he visited

Chennai and submitted a memorandum to himexplaining various difficulties faced by thepensioners. Though option to switch over toCGHS faci l i ty was extended to BSNLpensioners there was not much enthusiasm toswitch over due to the contributions to avail thefacility and limitations in it.

Finally BSNL corporate office vide its orderdated 11-4-2017 extended w/o voucher facilityto pensioners alone for Six months. It alsomentioned that the order will be reviewed aftersix months. Review took many months andfinally in April 2018 it was extended for the twomore instalments in 2017-18. Though it wasextended complaints of non-paymentcontinued. We have written many letters toCorporate office requesting continuation of thescheme. Finally the Corporate Office vide itsorders dt 13th July 18 had extended without anytime limit. But it has reduced the eligibleamount under without voucher scheme to 23days and 25% instead of 50%. One goodaspect of the order is that minimum will be Rs.12,000 per year. We have taken it up with theAdministration requesting to restore 50% ofeligible amount. Though BSNBL accepted ourdemand and issued orders there is difficulty ingetting the money. We thank Dir (HR) andCMD of BSNL who have taken a sympatheticand helping attitude towards pensioners.

PENSION REVISION FROM 1-1-2017We started discussing future pension revisionof BSNL pensioners from in 2014 . Wediscussed in Ernakulam CWC and decided tosubmit a memorandum to 7 th CPC. Thememorandum was finalised in Chennai CWCand submitted to 7th CPC. We demanded ourpension should be revised as per fitment formulasuggested by CPC for the CG pensioners aswe are also governed by the same CCS(PENSION) RULES 1972. Com GangadharaRao and other Karnataka comrades presented

oral evidence before the CPC when it visitedBangalore. The Chairman of the CPC afterhearing our submission remarked that there isprima facie in the demand. When we visited PayCommission office in Delhi and discussed withsenior officials it was learnt that the Commissionhad sent some questionnaire to DOT and noreply has been received. We met the then DOTSecretary Shri R K Garg and requested him tosend the reply. But before the reply from DOTreached CPC, it has finalised the report. Thuswe missed the bus. We discussed our demandin CWCs and in Bangalore Conference also.

We demanded 7TH CPC f itment formulabecause PRC is only for Executives. For Non-executives wage settlement is throughnegotiations. No PRC has recommendedPension revision as there is no uniform pensionsystem in PSUs. CPC the only mechanism thatrecommends Pension revision for those whoare covered by CCS (PENSION) RULES 1972.We are also covered by the same Rules andpaid by the Govt. But unfortunately some otherBSNL pensioners associations wanted to referit to PRC and wanted to include Pensionrevision in the terms of reference. Though DOTrecommended DPE sternly refused to includein the Terms of reference saying its job is onlyExecutive Pay Revision.But even after this they have not learnt. The 3rd

PRC report for Executives pay revision wassubmitted to the Govt in 2016. The PRC linkedWage revision with the profit earned by thePSUs. It introduced an Affordability Clausefor wage revision. Unfortunately the PSUUnions failed to oppose the affordability clause.Some of the BSNL pensioners associationsstarted demanding 15% fitment formula forpension revision forgetting the contradictionsin the demand. On our part we have beenpursuing with our reasonable demand. Withthe help of Shri Ananthakumarji we could meetthe DOT secretaries. Shri R.K. Garg assured

us that after submission of 7th CPC he wouldtake up the pension revision of BSNLpensioners with Nodal depts. Shri J.S. Deepakalso assured action but said will have to wait.We have met Shri Manoj Sinha, Hon. Ministerof communication and briefed him. He alsoassured to refer it to Secretary DOT. We metSmt. Aruna Sundararajan, present secretarytwice. In the first meeting she remarked that itis not a good demand to recommend. In thesecond meeting held in March 2018 wediscussed with officers of DOT. DDG (Estt)raised the point of Anomaly that will be createdby this for pensioners retiring after 1-1-2017if there is no pay revision. We clarified that it isone time problem and can be solved by fixingthe pay of the post 2017 retirees by raising thepay with the same fitment formula and fixingthe pension. We discussed with officers ofDOP&PW who said that if DOT asAdministrative Dept. puts up the proposal withdue justification there may not be any problem.

AGITATION PROGRAMMEOur CWC meeting held in April 2018 at Chennaidiscussed this issue in detail and called uponthe Branches and Circles to observeDemonstration on 20-6-2018 and Dharna on18-7-2018 and to adopt resolution for “pensionrevision from 1-1-2017 on the basis of 7th CPCfitment formula” and send it to MOC andSecretary DOT. In this Com Nanda of MTNLcoordinated with our Dy G/S and expressedthe willingness of MTNL Pensioners to join ourprogramme. We advised Haryana and UPWest comrades also to join in Demonstrationin Delhi. Because of this the programme raisedto a higher degree. The response to this callwas tremendous. We modified the resolutionas “BSNL/MTNL”. The e response was so goodthat a DOT officer whom we met later remarkedof receiving letters from every district of thecountry. On 18-7-2018 programme receivedanother good response from all over country.

This time CHQ directed to address resolutionto PMO OFFICE and to Hon Min in charge ofDOP&PW Shri Jithedra Singh. In Delhi over1500 MTNL/BSNL Pensioners gathered wenton a procession from Corporate office to JantarMantar where they were stopped by Police, asusual. Then 4 comrades lead by our AGSAnupam Kaul were taken to PMO office andthey submitted a memorandum to PM and theHon Min Shri Jitendra Singh. CHQcongratulates all our members and MTNLcomrades for the tremendous response andCom Nanda and AGS Anupam Kaul forexcellent coordination and making theprogramme a grand success in Delhi andBombay.

Further DevelopmentsOur G.S was in Delhi on July 4 to 7th. He hadan appointment with Member(S) on 5-7-18.Member Services who is retiring on 31-7-2018informed that the case is being referred toDOP&PW and asked to discuss with Director(Estt) the next day and find out details. On 6-7-18 G/S,AGS Com Dahiya and Com R.L.Kapoormet director Shri Agarwal and discussed thematter. The Director informed that the matterof pension revision is being referred toDOP&PW along with our points for the opinionof the pensions dept. He made the stand ofthe DOT is “Rule 37A guarantees Govt.Pension and Ensures continued payment.It does not tell about Pension Revision.When Pay revision was done in BSNLPension revision was also given from 1-1-2007” Hence they are referring to DOP&PWfor its opinion. On that day itself we metdirector of Pension dept and he said it is forDOT to put up a proposal. If DOT puts up aproposal they will study and give their opinion.It is a good development that our demand isbeing referred. It is learnt that DOP&PW hasreturned the file for a specific proposal fromDOT. Let us wait. In the meantime our hard

work had not gone in vain. Other pensionersAssociations have also demanded “Delinkingof Pension revision from Pay revision”We have formulated the demand which willdelink our pension revision from pay revision.We have to break the convention whichrequires patience and have to pursue it. Thisconference can discuss and give guidelines.

Pension AnomalyA peculiar anomaly had come to the pensionerswho retired between October2000 and June2001. It was found that they are receiving lesspension than people retired after that. First itwas taken up in Tamilnadu and subsequentlyfound that there are cases throughout India. Ittook considerable time to analyse and find outthe reason. Com D. Gopalakrishnan did a deepstudy and found out that it was due to the mixingup of CDA and IDA pay for calculation of 10months average for fixing the pension. Wediscussed this problem for rectification withDOT and DOP&PW. We argued that theaverage pension should have been arrived onthe basis of IDA pay only or the CDA pay shouldbe treated as notional IDA pay for arriving at10 months average pay. Though DOT acceptedour contention DOP&PW did not accept torectify the mistake taking the stand thatbecause of switch over to IDA the pensionersare getting more pension than they weregetting. After exhausting all the channels wedecided to approach the court for legal solution.Our legal committee member Com R L Kapoorand Com Chiddu Singh engaged Delhi LawyerShri Kaushik and filed a case in Delhi PrincipalCAT. After going through the legal proceduresf inal verdict was delivered by PCAT inDecember 2016 upholding our stand and gavethe dept 90 days to implement it. We discussedwith DOT. But DOP&PW did not accept andadvised DOT to go on appeal. We filed acontempt petition in PCAT and a Caveat in HighCourt. The contempt petition was reserved as

the Govt filed an appeal. The Case came upfor hearing in January 2018 and postponed toOctober 2018. As it is legal we have to waitdespite the fact that all the pensioners affectedby this are 77 years or more and many haveleft the world. Now our legal committee hasdecided to engage Shri Ranvir Singh RetiredCGM NTP, who is practicing as lawyer in DelhiHigh court as he is well aware of the rules ofDepartment. It is to be mentioned here thatthe Entire legal expenses are borne by theassociation without collecting any donation forthis.

Other Court CasesWe have filed two cases in Ernakulam CAT(i) Pension on the basis of Last Pay Drawn forthe pensioners retired between 1-10-2000 and31-12-2005(ii) 78.2% pension revision from 1-1-2007

The pension revision on the basis of 78.2% IDAwas extended to the pensioners from 10-6-2013 only. The Order of extending 78.2%envisages Pay revision from 1-1-2007 on thebasis of 78.2% IDA and treating the pay upto10-6-2013 as Notional. We are filing the caseon the basis that pay can be notional andpension cannot be notional. As we could notfind a dependable lawyer at Delhi we havedecided to f i le the case at Ernakulamconsidering other advantages. ComradesRaman Kutty, DG and Pada Nair fixed anexperienced and known lawyer Shri Shreeraj.The cases had been filed and unfortunatelybecause there is no judicial member in the CATit has not come for hearing.

Extra Increment CasesOne extra increment was sanctioned by BSNLin 2003 for those who got BCR but could notget 10% one year before retirement, through adecision in the National council. This incrementwas not taken into account for pension fixation

by DOT. After our taking up the case andpursuing it relentlessly the DOT issued ordersin 2009 to take that increment for pensionfixation. In Kerala Circle the CCA refused totake the extra increment sanctioned foremployees who were stagnating. Our KeralaCircle Association filed a case in CAT. The CATgave a judgement in favour of us. We hadwritten to DOT requesting for issuance oforders extending it pan India. But DOT issuedorders for implementing it in only Kerala.

In Tamilnadu while revising the pension on thebasis of 78.2% quoting the reply to the OrissaCCA on Extra increment. It was proposed toreduce the pension by the CCA since there wasno reply from the DOT to the reference madeby the CCA, TN. The BSNL created theconfusion in 2013 by issuing an order that thebenefit of extra increment sanctioned in 2003as withdrawn from 1-10-2000. Though this wascorrected by BSNL later the CCA TN was notprepared to change his stance. We had givenall the clarifications DOT wanted in a letter in2017. But unfortunately DOT has not acted.To stop the CCA from reducing the pensionTamilnadu Circle Association and Chennai TDCircle Units have gone to the CAT and nearly78.2% not extended to nearly 650 pensioners.

Disturbing TrendComrades a peculiar trend has been observed.Some of the grievances of the pensioners arenot settled and they have to approach thecourts for justice. This trend is catching up afterthe annulment of 60:40. We have to discussand find methods to eliminate this.

PATRIKAPatrika which was Quarterly had been madeBi-monthly after Bangalore Conference. ComRaman Kutty is the Editor. So far40 issues ofthe journal have been brought out on due dateswithout fail. We thought of bringing out a Hindi

version also. But the exorbitant cost preventedus from it. So some of the important articleswere translated in Hindi and publishedseparately. Com K S Jat who was helping intranslations is not able to carry out of late dueto health reasons. Finding a good translator isdifficult in south India. We have to find outsome volunteer who can do this and CHQ willbe extremely thankful if someone volunteer forthis job. A dedicated team of Coms. Gowrishanker, Sundar, Sampathkumar and Kalidassfrom Chennai are doing a tremendous job fromprinting to posting it despite their age. CHQand this conference appreciate these dedicatedcomrades.

RNI RegistrationAs our Patrika was not registered with Registrarof Newspapers India, we could not get anypostal concession. We took steps to register itwith RNI and could complete it in 2017 Marchwith Com Raman Kutty as Editor and G.Natarajan as Publisher. After that the postagecame down from Rs 4.00 to Rs 2.00 per copy.As our Patrika is bimonthly we cannot post inPatrika channel and get that concession of 50paise in postal charges. Despite paying somuch for postage there are complaints of non-receipt and returns without delivery. Despiteour hard and dedicated work complaints comein and we post again. The best way is todistribute Branchwise through Bulk post. OurBranch/dist Secretaries should consider.

WEBSITEOur website www.bsnlpensioner.in has becomethe best tool of communication. It is visited bymany pensioners for reliable news. ComRaman Kutty is maintaining it with dedicationand imagination presenting the newsattractively. IN addition to Andhra, Chennai TDand Tamilnadu circle Units Chennai STR,Coimbatore, Cuddalore, Madurai, Pondicherry,Tirunelveli, Tuticorin districts in Tamilnadu and

Mathura in UP West also have launched theirown websites. Other Circles and districts trythis modern communication system.

Another form of faster and easiercommunication is to create Whatsapp groups.Comrade Ramankutty has created a whatsappgroup for CHQ. Punjab, UP East and UP Westalso have started it. We have to adopt modernmethods of communication for faster spreadingof News as we are retired from Telecom.

ACCOUNTS AND FINANCE:The audited accounts of our Association for thepast three years are attached herewith for yourapproval. Thanks to the overwhelming supportfrom the members, the Association is in asatisfactory financial position.

Reserve FundAs was decided in CWC, Patna in November2017 that a sum of Rs. One Crore would bekept as reserve, action was taken in a phasedmanner and on 4.8.2018 as many as 11 FDReceipts that matured during the period from1.8.18 to 4.8.18 were consolidated into fourFDRs of Rs. 25 Lakhs each. While the interestearned from these FDRs will be utilised for theworking expenditure of the Association andpublication of Patrika, the utilisation from thePrincipal amount of ONE Crore will require thespecific approval of CWC.

Income Tax And PANWe faced a serious problem with regard toincome tax. Our CHQ has a PAN. When Circleand District Units approached banks foropening accounts and Fixed Deposits, thebanks wanted PAN. CHQ PAN was given insuch cases. Our auditor cautioned that in thenew situation, all incomes shown in thoseaccounts where same CHQ PAN was inkedwith, will be pooled together and taxed. Entire

balance with CHQ had to be spent for payingincome tax !. We consulted some other taxpractitioners also. Some of them concurredwith our Auditor. Some others said that interestsaccrued on all such FDs, where CHQ PAN waslinked with, would be shown as income of CHQ.Even in that case we have to pay huge incometax every year. Whereas, Ms. CRS & Co ofChennai suggested a new method of preparingaccounts and balance sheet without violatingthe rules. We entrusted the work to the Firm.Accordingly, the Balance sheets were recastfor five years, showing same Opening balanceand Closing balance. With this, without anyviolation of rules, we could escape from thehuge tax liability. We had to incur someadditional expenditure on fees to the charteredaccountants. We appreciate the efforts madeby Com. T S Vittoban (Treasurer) and Com. VRama Rao (Asst Treasurer) in resolving theproblem with timely action. In future also wehave to be careful in this matter. Circles andDistrict Units should obtain separate PAN andthey should not link their accounts with CHQPAN. This AIC may take a decision in thisregard.

UNITY OF TELECOM PENSIONERS

Our Association strongly feels that the Unity ofPensioners, is the need of the hours. BangaloreAll India Conference has decided unanimouslyto take all efforts for farming coordinationcommittee or Federation not only among theBSNL Pensioners organization but also withMTNL Pensioners organizations since they arepaid pension by Govt as per rule 37A,Sameefforts were made for uniting variousorganization of BSNL Pensioners.

Com. Kishan Singh of AIRBSNLEWA, Mr. D.D.Mistry of BDPA and Com. Nanda MTNLPensioners Association supported the idea.

Coms. Ramankutty, Muthiyalu andG.Natarajan were at Ahamadabad inconnection with Gujarat Circle Conference, metShri D.D. Distry on 21.02.2016 and discussed.He agreed for coordinated activities on 78.2IDA benefit to pensioners to start with. ShriMistry supported our call for demonstration andrepresentation on 24.03.2016. Though ShriKishan Singh also agreed, he gave a differentProgramme of action on different dates.

There was a meeting with the leaders of MTNLpensioners (Executive) Association. We metSri. M K Bagchi, S S Nanda, Mudgil andKaushik and discussed about the formation ofCo-ordinating Committee or Federation as perthe AIC resolution. They were responsive andpositive. They have 3 demands: Second optionfor combined services pension, 78.2% IDAMerger Benefit for Both Serving employees andPensioners, future Pension revision. As forfuture pension they had an opinion of 3rd PRC.After hearing our arguments they wereconvinced to pursue the same fitment formulathrough Government and the issue can bejointly taken up with respective departments.Sri. Bagchi assured that he would talk to otherPensioners Association also. They wanted thatthey should be involved in decision making,negotiating body and there should not be anybig brother atti tude. We explained ourorganizational position and the way offunctioning. He said that he has seen our web-site and read our previous journals also. Wesaid that we shall take care of their view pointsas future revision of pension our CWC held atChennai decided to give a call fordemonstration on 20th June and Dharna on18th July 2018. We conveyed our decision toShri. D.D. Mistry and other BSNL PensionersAssociations. Com. Nanda, MTNL PensionersAssociation joined with us on both days. Theresult was about 800 pensioners gathered forDemonstration and about 1500 pensioners

participated in the Dharna. Our Sincere thanksto Com. Nanda and other comrades of MTNL.

SOME ORGANISATIONAL PROBLEMSDelhi CircleBangalore CWC considered various letters sentby R.L. Kapoor, President of the Head QuartersBranch in NTR Circle. Meeting directed theNTR circle unit to hold its conference before15-3-2017. It also directed that the SSA unitsshall be reorganised. Though the Circleconference was held instruction given as perthe decision of the Bangalore executive wasnot followed. Moreover the office bearersstarted talking against the earlier decision ofthe ABISNLPWA. The conference wasadjourned since it was not in proper form.

In the meantime some of the office bearersswitched over to another organization. PatnaWorking Committee after hearing the detailsdecided and appointed an adhoc committeewith Com. P.C. Kowshik of NTR Branch asconvenor. Accordingly, Delhi circle conferencewas held on 7-7-18 and Comrades Munshi Lal,Anupam Kaul and S.C.Jain were electedPresident, Secretary, Treasurer.

U.P. WestThe developments that took place in UP (West)circle were decided separately during the Patnaworking committee. The Patna CWC directedthe UP West Circle Secretary to hold the circleworking committee and sort out differences.Accordingly the Circle Executive was held on28.1.2008 under the Presidentship of ShriVipin Sharma.. The CEC meeting ended withgood results sorting out the differencesbetween office-bearers..

West BengalWest Bengal circle conference was held withoutproper intimation to branches and so all the

branches could not participate. Hence advisedto adjourn. Patna working committee directedthe WB circle to hold the adjourned conferenceby ensuring participation of all districts.Accordingly the conference was held on04.01.2018 and a new office bearer elected.

MEMBERSHIPWe can proudly say that we are the largest,well organized, Pan India, democraticallyworking organisation among the pensioners inIndia - an Organisation consisting of RM toCGM. Our organisation has gained theconfidence of Telecom Pensioners ParticularlyBSNL Pensioners by the achievements and theproblems solved. We are proud to say that ourtotal life members as per Quota received up toMarch 2018 is 35,177 and Annual Membershipis 3421. As on 31st July our Life Membershiphad crossed 37,150.

During the 3 years it is a commendableincrease. There is 60% increase in lifemembers. We presume that our realmembership must the more than 60,000. Butthe paid membership is less. Jaipur conferencehas fixed a target of one lakh members andthe Bangalore conference reiterated the sametarget and we are nearing 50,000 only. Todayabout 2,25,000 have retired as on 01.04.2018but our membership is yet to reach 1 Lakh.Other organizations have not made muchimpact in enrolment. It is our strong feeling thata number of Pensioners are not members ofany organization. We have to concentrate onenrolling those who remain non members.

We are proud that we have Branches in allcircles and our membership has increasedin all circles. We have formed a circle inCalcutta Telecom Factory. In CalcuttaTelephones we have formed 2 branches andalso an adhoc Circle Body on 30-7-2018.

We have formed an adhoc Circle Body inUttaranchal which will form district branchesand conduct Circle confernce.

In Gujarat in Bhavnagar a branch is formedwith 200 members is commendable and wehave good development in Gujarat due to ourlate Com Brahmbhatt. In U.P. West and Eastmore Branches have come. In Karnataka alsomore branches have came. Because of theefforts taken by our comrades some brancheshave came to us (from other camp). Duringthis period a new circle has came in Telenganaconsequent upon bifurcation of erstwhilecomposite Andhra Circle. Andhra circle hascrossed 5000 in membership and Telenganahas formed a branch in each District . Punjabcircle has increased its membership to 1500from 312. At the time of last conference M.P.Maharashtra circles were having Membershiparound 500 But today both have crossed 1000.

UP East and West were below 200 but nowthey have crossed 700 and 900.

Chennai Telephones in 2014-15 was havingonly 1416 today its membership has crossed3000.

Karnataka having a membership of 1900 in2014-15. It now has reached 4011 marking a110% increase.

Kerala having a membership of 2531 in 2014-15 today increased its membership to 4100despite severe attacks from BSNLEU.

Tamil Nadu having a members of 3359 in 2014-15 have increased to 8004 increase to about140% and stands first in the entire country.

Bihar has increased its membership to 610today. But it can improve.

In Bangalore conference we have directed theBraches to convert the Annual Members to LifeMembers.

Assam, Bihar, Rajasthan, up east, upwest, andW.Bengal circles have to concentrate onconverting the Annual Members to l ifemembers.

The Bangalore working Committee it wasdecided that each circle should hold its circleExecutive Committee meeting and discuss thepossibility of forming new branch and enrollingnew members.

This decision should have been carried outsincerely. Wherever it was done it wassuccessful and new branches formed.

CHQ has a close access to Tamil Nadu circleand their systematic functioning is laudable.When CHQ wanted to hold a central workingcommittee at Chennai within a short time TamilNadu circle responded and conducted theworking committee in an appreciable manner.Tirunelveli, Tanjore and Cuddalore having theirquarterly magazine. Tirunelveli, Tuticorin andCoimbatore are having rented accommodationfor the Association. District office bearers areattending regularly. Madurai District hadcrossed 1500 members and was awarded forstanding first in the entire country by the CHQin Jaipur and Banglore conferences. Our AllIndia organizing secretary Com. K. Muthiyaluhas taken pain to rally the pensionersin ourFold. Circle union releasing circulars veryfrequently explaining the demands, problemstaken and members grievances settlement andbranches news and important orders.As on31st March the life membership of Tamilnaduis 8004 and as on 31st July 8600. During thesubmission of medical allowance option form,CDA arrears, KYP form filing they enroll new

members. In the end of 2018 they hope to cross10,000 members.

WELFARE ACTIVITIESTanjore District in Tamilnadu is the TrulyWelfare Branch. Holding Meeting everymonths, celebrating marriage day ofpensioners in the Association meeting everymonth, celebration of Birthdays by cutting cakewith spouse, helping for medical treatment etc.They collect money from members and otherswho are interested in welfare activities andspending for the cremation of orphan deadbodies, giving dresses to the orphanage on thePensioner day, education expenses for the poorchildren and necessary help to mentally retardpersons house. This year a separate toilet formentally retarded women was built and watersupply provided by the Tanjore AssociationMiss. S. Chandrakumari used to donateliberally to these activities and had donated herretirement month (April 2018) total salary ofRs. 1,50,000/- to the Association for theseactivities. One can visualize the activities fromthis.

In Punjab a school is conducted to imparttraining in Computer for poor children.

Calicut Branch in Kerala is carrying out visitingold age homes,orphanages during importantfestivals and is presenting the inmates withpresentations.

West and East Godavari districts are alsovisiting old age homes during festivals andpresent inmates with presentations.

During the unprecedented rains in Chennai in2015 donations were sent by our Circles. Thefunds collected were not only used to helpseverely affected pensioners but also gaveSchool Uniforms and Books to poor students.

Comrades, these activities are highlighted to indicate thatwe are not only looking after pensioners butalso do social service.

Kerala circle unit is bringing out a journal invernacular language regularly supplying to allmembers free of cost.

Bangalore had crossed a life membership of2000 and stands first in the entire country andErnakulam District had crossed 1000 lifemembers. West Godavari District of AP circleand Berhampur District of Orissa Circle arehaving cent present life members. Coonoor,Pondicherry, Salem East and West andVirudhunagar Nagar Districts in Tamilnaduhave all life members only.

Saroor district Branch of Hyderabad conducteda special drive to contact Family pensioners.They conducted areawise meetings and foundmany family members were not paid pensionarrears from 2016 and solved the problems.

We should concentrate on Family pensionerswho really needs our help. Because of ourAssociation help a number of pensioners havegot lacs of rupees as arrears and monthlypension.

Our Association really appreciates those whodoes this wonderful job.

We are thankful to all our office bearers andactivists of District and Circle who despite theirdifficulties due to age made this organisation aUnique and massive representing all shadesof opinion, cadres, regions and cadres.

Unity and strength of the pensioners is the realweapon to safeguard our pension and welfare.Let us keep it in mind and enroll everypensioner in our organization.

Kerala Floods Relief:Though people of Kerala are accustomed toheavy rains and floods often, they facedunusual torrential rains and heavy floods inAugust 2018 causing very severe damage tocrops, houses, human lives and infrastructure.The damage is estimated to be of more thanRs. 8300 crore. The silverlining was an efficientand quick distress management by the Stateauthorities. More than 65000 people weresheltered in Relief Camps and casualty wasreduced considerably. Our Kerala circle unitdonated Rupees ONE LAKH to the ChiefMinister’s Relief Fund. CHQ also donated Rs20000 as a token and issued a call to allbranches in the country to extend maximumhelp possible. Karnataka Circle Unti sent Rs25000. Shri Y Ananham, of Vizag sent Rs.10000. Many branches are transferringamounts to Kerala Association, while this reportis being drafted.

CONCLUSIONComrades,Over the years we have built a strong, unitedand dedicated organisation which will fightfor the BSNL pensioners. Though we havegrown still large number of pensioners aremembers of no organisation. Let us take apledge today that we will approach them andmake them our members. It has to be doneby every member. Only then it is possible.We need a strong organisation to protect usin future also as our bargaining capacity isbeing gradually reduced.

According to the 2011 census, there were 104million elderly persons (aged 60 and above) inIndia. The proportion of elderly was 8.6% in2011 and is rising. A United Nations PopulationFunds and Helpage report estimates that by 2026those over 60 years old in India will be 172million. Also, the average Indian can expect tolive 18 years beyond the age of 60, which meansthe dependency ration is also rising.

We the BSNL retirees due to hard struggles,while in service, assured a guaranteed pensionevery month and compensated by rise inDearness allowance due to price rise once in 3months though inadequate. Furthermore, due tothe strong organizational structure called AllIndia BSNL Pensioners Welfare Association, theneeds of our senior comrades are being raisednow and then with the authorities. Medicalfacilities, both indoor and outdoor, are madeavailable and we pay almost care for the healthof senior comrades. We also take particular carefor the widows of our seniors by preserving theFamily Pension system. If both are not alivetheir unmarried daughters or unemployed son areable to get pension.

But the condition of Senior citizens out of ourfold, in the country is very pathetic andalarming.

PATHETICCONDITION OFSENIOR CITIZENSIN INDIA

In January 2018, the Madras High Court‘apologized’ to a Freedom fighter by name VGandhi for the bureaucratic quibbling held upfreedom fighter’s pension for over three decades.The judgement delivered by Honourable HighCourt judge Justice Mr. K Ravi Chandrababusaid: “I can only say to you sir (V Gandhi) Sorrysir, you are made to suffer at the hands of ourpeople too (besides the British)as unfortunately this is how thebureaucratic dogmatism witha wooden approach works inthis country for which youfought to get freedom.”

Censuring the state officials (Tamilnadu) fordenying the freedom fighters pension justbecause of a discrepancy in his age in the rationcard and the voter ’s identify card, theHonoroubale judge said “hyper technicalobjections could not be raised when hisbonafides had been certified by none other thanCaptain Lakshmi Sahgal of the INA”.

In a personal knowledge certificate issued onApril 15, 1994, Sahgal said Mr. Gandhi was agenuine freedom fighter who joined IndianIndependence League (IIL) in 1943 at Rangoon,Burma. He was attached to Thenganjum branchof the IIL in the propaganda department under

the chairmanship of C S Naidu and played asignificant role. The Judge further said, “We willnot be here in such positions, without thesacrifice of persons like Mr. V Gandhi. ThisFreedom fighter should be treated with at mostdignity and they must be honoured.”

The Hon’ble Judge directed the Secretary, Public(Political Pension III) Department to ensure thatan order granting pension is passed within twoweeks and served at his home. The pensionarrears from 1980 should be disbursed withinfour weeks. But this Freedom fighter Mr. Gandhiliving with his extended family in penuriousconditions at Vyasarpadi learn about the court’sdecision only when the reporter of ‘The Hindu’visited his residence.

When we look at the national level, thecondition of Senior citizens the situation is nobetter. In a petition of behalf of the PensionParishad, a network of 100 civil societyorganizations that deal with pensioners to theprime minister Narendra Modi , Aruna Roy, aformer member of the United ProgressiveAlliance Govt’s National Advisory Council urgedhim to do something about the scandalously lowpension for which our senior citizens fareeligible. Roy pointed out that the Indira GandhiOld Age Pension Scheme has been paying Rs200 a month as old age pension, a sum whichhas remained unchanged since 2006, when it wasintroduced. Due to inflation, the value of thishas depreciated under to Rs. 100 over the past11 years, less than a day’s notified minimumwage. Aruna Roy, raised this issue now neitherfor the first time nor is Mr. Modi the first PrimeMinister she has petitioned in this regard. A fewyears ago she even led a demonstration ofpensioners outside the then PM ManmohanSingh’s house and got detained by the police.But the response from the government or thePM’s office now, as then, has been the same –silence.

To improve the conditions of senior citizensAruna Roy demanded a minimum universalmonthly pension of Rs. 2000 for month, housingfor the aged be made priority under the PradhanManthri Awas Yojana.

Today social structures are changing. Thejoint family system which sustained theelderly is virtually a thing of the past. Thisleaves a rising number of the elderly eventhose who were at least middle class in theirworking years in direct straits. There is noinstitutional support to speak of, the cost bothliving and Medicare is rising, eroding theirsavings and the old age pension.

With interest on bank deposits steadilyfalling, most middle class elderly actuallydepend on this to sustain themselves, asnobody in India other than the Governmentemployees actually get a pension afterretirement. The problems become quiet direeven among those considered affluent in ourocean of insecurity.

The government has passed a Law in 2007(Maintenance and Welfare of Parents andSenior Citizens Act) to make maintenance ofparents/senior citizens by children/relativesobligatory and justiable through Tribunals.Like every attempt to legislate a solution tosocial problem, this Act has miserably failedto serve its purpose. The policy response tothis has been less adequate. The Ministry ofSocial Justice, the nodal ministry for elderly,also has a grand plan called the IntegratedProgramme for Older Persons which has beenoperational since 1992. But unfortunately, inpractice the policy response to this has lessthan adequate.

We as senior citizens well organized underthe banner of AIBSNLPWA should give outhelping hand , wherever possible.

“We are retired. Hereafter we have nothingto do. At this age we can’t do also. Let us eatand enjoy, spend the remaining dayshappily”. This is how our pensioners excepta few think and living so. That few only nowtaken responsibilities at various levels,District, Circle, All India Association andworking for the pensioner’s welfare,handling and solving their problems. Theyfeel hapy and healthy by looking at theirhappy faces of pensioners by solving theirproblems.

This thinking of the majority is not correctand absolute wrong.

We could not act independently while inservice. We have to work according to rulesand regulations. Today that is not thesituation. We can act independently. In fact,we have to. We are affected by number ofproblems. For example, de-monitisation.

De-monitisation has not served the purpose.But it has affected many a people andpensioners. All pensioners and senior citizensare not well off. Majority of the pensionerseagerly waiting for the last day of the month,draw pension from ATM or counters for theexpenses. During the de-monitisation day nomoney in the ATM to draw even whenpensioners went to bank / post office theywere not given full pension. They were givenonly paltry money. Per head it was Rs.4,000/-or Rs.6,000/-. Since Rs. 2,000 note only wasavailable. How can a pensioner manageexpenses for a month with Rs.4,000 orRs.6,000/- virtually they were forced to get aloan. Pensioners getting below Rs.20,000were really affected. No rich man affected bythis. In fact the Nakra Judgement says “Thepensioners shall lead a standard of life thatthey were having while in service”.

Whereas de-monitisation have madepensioners to get loan or to borrow loan andmiseries. If we don’t oppose such things andaccept all distress will not solve ourproblems. It would tantamount to supportingthe decision. No major movement has takenplace. The Government justifies its decision.But de-monitisation has taken away lives of300 poor men. No rich men affected by thede-monitisation. Who can compensate 300lives of poor men and who would look aftertheir families?.

Shortage of staff :Time and again orders issued and Ministermaking statements that pensioner’s problemshall be solved without delay. But what is thefact? Even those who retired on superannuation could not get the pension in thenext month. Not to say about VoluntaryRetirement Service. Hundreds ofauthorisation of family pension cases arepending for months together. The reasonattributed is shortage of staff in the CCAoffices. Every month the retirees number isincreasing. Whereas the staff strength ofthe CCA office is decreasing. No retirementvacancy is filled up. Not only in the CCAoffices, throughout India shortage of staffis order of the day. Lakhs of cases could notbe disposed for many years due to shortageof Judges and other staffs. CAT cases takestime for years to settle. Adequate doctorsand nurses are not available in the hospitals.Net result, the poorest of the poor could notget better treatment. In colleges and schoolsenough teachers and professors notavailable and students at a loss. In BSNLoffices thousands of working staff retiringevery year. But no new appointment. In thelast 18 years after the formation of BSNL,about 2 lakhs, executive and non-executivesretired. Customers at a loss. Could not get a

better service. How can BSNL compete withother private compnies? Even pensioner’spension paper could not be forwarded in time.

These are few examples. Today in each officethere is a shortage of staff. The reasonbehind is the Government of India orders.There is a ban on recruitment since 1984.Late Prime Minister Smt.Indira Gandhibrought this. Whereas the present rulingGovernment which has promised 2 lakhsjobs every year , could not do away with thisact and appoint enough and capable hands.About 20 crore youth in India without jobs.Because of unemployment some indulgingin inhuman acts. As a senior citizens, do wehave responsibilities to solve our problem aswell as to repeal the act of ban onrecruitment. We feel the problems. But notfinding the root-cause for that and fighting.

Reduction of interest rates :Majority of the fixed deposits at variousbanks are of pensioners and senior citizens.They deposit in F.D. all the retiral benefitsand make life comfortable by the interestaccrued from the F.D. Once it was 14%. Nowit has come to 6.5%. Other prices are goingup. But F.D. interest is reduced. Pensionersare in loss of income. This is a big loss forpensioners. This is because the monetarypolicy of the Government. The Governmentthrough its acts it should do good to people.Whereas the monetary policy has made thelife of pensioners tearful.

Pension :State and Central Government employeesgetting pension after the retirement. For

about 50 years the 50% of the last paydrawn is given as pension. But now theGovernment has introduced a new pensionscheme. The pension is on the basis ofemployer / employee contribution. Now canone say what will be his pension? But in NewPension. Scheme it is very meagre. Thereis no commutation, no family pension. TheGovernment - a model employer shouldbring an act to pay pension in the privateand public sector. But it has reduced thepension and other benefits to its ownemployees. If we take a stand that we aregetting a pension, we need not bother aboutothers, when a crisis for you, no one willcome to rescue. The present NPS is aprelude to a no pension of Government afterfew years. Our Government is a member ofWTO. WTO says that the Government shallgradually distance itself from pensionpaying burden.

So dear pensioners,I want to remind you what MinisterMr.Ananthakumar said in a meeting of ourAssociation “You are retired but not tired”.Let us react. Oppose anti-people actswithout hesitation. Number of peopleunware of many things. As a senior citizenwe can explain the good and evil. We canhave exchange of view with all knownpeople through media and news papers. Wecan convey our good views. Senior citizen’sword will be viewed seriously andrespectfully. Let us protect us by joining thesociety to protest and do away with anti-people acts.

Medical allowance without voucher facility, inlieu of reimbursement of outdoor medical claimswith voucher for retired employees was revivedvide this office OM of even no. dated 11th April2017. While extending the facility it was decidedthat the decision will be reviewed after sixmonths.

2. This issue was reviewed, there has been in-crease in expenditure on this account. As a mea-sure to control the expenditure and continue thefacility it is decided to reduce quantum of al-lowance from 50% to 25% of the annual ceilingw.e.f. 01-04-2018 subject to a minimum allow-ance (without voucher) payable would be Rs12000/- per annum payable in four equalinstalments. Retired employees can continue toopt this facility or switch over to reimbursementof outdoor claims with voucher facility. Theoption can be exercised in the beginning of thefinancial year and can not be changed during thatfinancial year. Retired employees who have notsought any outdoor claim with voucher duringthe financial year can exercise the option.

OUTDOOR TREATMENT CEILINGWITH 78.2% IDA

BSNL/admn.I/15-12/18 dated 11-7-2018Subsequent to the decision for raising the fitmentof IDA Basic Pay to 78.2% from 68.8% for thepurpose of calculating quantum of medical re-imbursement for outdoor treatments the annualceiling is now revised to 23 days salary (basicpay + DA). The orders conveying the decisionissued by Establishment branch is also applicableto retired employees. Copy enclosed for readyreference. The revised annual ceiling is appli-cable from 1st April 2018.

Subsequent to the implementation of benefit ofmerger of 50% IDA effectively amounting to 78.2%as on 1-1-2007, for the purpose of fitment and payfixation in the revised pay scales w.e.f. 10-6-2013,further instructions were issued by this office videletters No. 1-50/2008-PAT (BSNL) dated 13-6-2013and No 1-16/2010-PAT(BSNL) dated 13-6-2013wherein, it has been intimated that all allowances likeMedical reimbursement with voucher for outdoortreatment, Professional/Skill Upgradation Allow-ance, House Rent Allowance etc. shall continue tobe paid on IDA Basic Pay with 68.8% fitment tillfurther orders.

2. Now, it has been decided with the approval ofcompetent authority that the annual ceiling of medi-cal reimbursement with voucher for outdoor treat-ment in respect of Executives and Non-executivesshall be calculated on revised IDA Basic Pay with78.2% fixation upto 23 days w.e.f. 01.4.2018.

3. Accordingly, necessary action may be taken forreimbursement of medical vouchers in case of out-door treatment w.e.f. 01-04.2018.
