• Each section presents a statement of the law as derived from state case law, trend setting judicial opinions, state statutes, the Accreditation Manual for Hospitals of the Joint Commission on Accreditation of Healthcare Organizations, and the Health Insurance Portability and Accountability Act of 1996. Many of the case studies and test questions are based on actual cases.
• This course is not meant to be an exhaustive treatment of the subject of legal medicine and medical malpractice. Many of the relevant legal doctrines are complex and are introduced but not discussed in great depth.
• When reading the material, try not to evaluate and compare the mode of treatment used with what you, as an individual physician or student-physician, would have prescribed or done for the patient. Instead, focus on the medical/legal concepts that are illustrated by specific cases.
• Physicians must remain aware that the law is not static but is constantly evolving. Many important medical/legal issues have yet to be resolved by the courts, by the legislature or by society as a whole. For all the above reasons, physicians and student-physicians are advised to consult with an attorney who is well versed in the field of health law or medical malpractice if a medical/ legal problem arises.
