Introduction to the IRS Examination Proc-ess Gain knowledge about the examination process and your role in the process as a taxpayer representative. Non-Filers Learn how to secure IRS information documents, defend against substitutes for returns, and the best practices for filing delinquent returns. Introduction to IRS Criminal Investigation What you need to know about the IRS Criminal Investigation Division – the IRS police force. Introduction to the IRS Appeals Process Learn about IRS Appeal opportunities for resolving collection and examination disputes without litigation . Collection Resolutions Learn all about extensions of time to pay, installment agreements, Offers in Compromise and uncollectible tax determinations. Learn how to accu-rately complete Form 433A – Collec-tion Information Statement. Taxpayer Representation Series Level II Level Two students use a series of challenging case studies to experience the ins and outs of the examination, collection, and appeals processes as well as the IRS criminal investigation program. Taxpayer Rights Protecting your client’s rights under the law is the fundamental of taxpayers representation. Collection Case Analyzing your client's situation, deter-mining the client's best option for set-tling their taxes and representing that plan before the IRS with enforcement mitigation (liens, levy, seizure) consid-erations. Examination Case This class will provide practical experi-ence in representing taxpayers in field or remote audits. Learn the procedural differences between remote and field exam, handling a complex field exam, when to approach a group manager, routine field exams (including financial status techniques and use of indirect methods), when to close the case or seek appeal, negotiation techniques and strategies. Appeals Case Experience the difference between docketed and non-docketed cases as
well as actually preparing a protest, preparing your case for conference, handling conference negotiations and making your settlement proposals. Criminal Investigation Case Experience the difference between a negligent taxpayer and a taxpayer who has engaged in fraudulent activity. Un-derstand the steps in the IRS investiga-tory process as this case unfolds and you convince the IRS that no criminal prosecution potential exists. Penalty Cases The IRS has a wide array of penalties that are assessed against taxpayers. This case will give practical experience in contesting these penalties, reducing amounts and determining client liability. Taxpayer Representation Series Level III Level III is your crowning accomplish-ment: Level Three Graduates earn the Specialties in Tax Controversies cre-dential. Level III is a code based, ad-vanced consideration of: IRS Authority To Investigate The awesome power of the IRS admin-istrative summons and the rights of a summoned person. Trust Fund Recovery Penalty The Trust Fund Recovery Penalty cov-ered in depth and the methods available to mitigate it. Employee vs. Independent Contractor Determinations The IRS has targeted certain industries that have traditionally used independent contractors (such as trucking, messen-ger and construction firms) and reclassi-fied the workers as employees. You consider the intricacies of the determi-nations and the settlement opportuni-ties. Methods of Proving Income This section gives participants an under-standing of IRS indirect methods of proof in criminal and financial status audits. How should the practitioner handle such audits and defend against IRS indirect methods of proving income. Ethical Dilemmas Learn how to recognize ethical dilem-mas and what your responsibilities are as a representative. Bankruptcy The opportunities to discharge tax liabilities in bankruptcy and the role of non attorney practitioners in the process. Statute of Limitations This section reviews the statute of limitations on examination, collection and refund claims.
