PART I.—RECOMMENDATIONS.

RECOMMENDATION I.—Central Middlesex Joint Planning Committee : Conditions of Delegation.

By resolution 3227 (6th October, 19-J5), the Council approved and adopted amended conditions of delegation to the Central Middlesex Joint Planning Committee, paragraph 1 (a) of which now reads :—

To prepare, adopt and submit to the Ministry for approval, a comprehensive planning scheme or schemes for the whole of the planning district, varying where necessary a planning scheme relating to the area of any of- the constituent authorities or any part thereof or supplementary thereto.

In regard to the recently expressed desire of the Wembley Town Council that the Wembley (Kingsbury) Planning Scheme should be varied in certain particulars, the Joint Committee has, however, experi­ enced some difficulty as to the proper interpretation of the condition quoted above, and the Ministry of Town and Country Planning is desirous that it should be unequivocally the duty of the Joint Committee to be responsible for the making of the varying scheme.

The Central Middlesex Joint Planning Committee has accordingly expressed the view that the clause in question should be amended, as set out below and asks that the constituent authorities should pass formal resolutions giving effect thereto.

Your Committee sees no objection to the Council being asked to concur in this matter, and recommends accordingly.

Resolved to RECOMMEND :

That a resolution in the following terms be passed by the Council :

That so much of Council resolution 3227 (6th October, 1945) as relates to paragraph (1) (a) of the conditions of delegation in respect of the Central Middlesex Joint Planning Com­ mittee be hereby rescinded ; and that the following paragraph be approved and adopted in substitution there­ of :—

(1) (a) From time to time to prepare, adopt and submit to the Minister for approval, a planning scheme, or planning schemes, for the whole or any part of the joint planning district, including a scheme or schemes varying or revoking any existing planning scheme relating to the whole or any part of the area of any of the constituent authorities.

RECOMMENDATION II.—Town and Country Planning (General IK* January, Interim Development) Order, 1946 : Rebuilding, etc., of l— War Damaged Properties. "23"vSSSS

By virtue of the provisions of the Town and Country Planning Committee. (General Interim Development) Order, 1946, the rebuilding, restoration or replacement of buildings and plant (within an area subject to interim development control), which have sustained war damage, can, with certain exceptions, which are not relevant to this report, be effected without the necessity of obtaining permission of the interim development authority. Article 6 of the Order provides, however, that, if, in any particular case, the interim development authority is satisfied that it is expedient, having regard to the provisions proposed to be included in the appropriate planning scheme, that any development, of the type referred to above, should not be undertaken unless permission therefor is granted on application made under the Order, it may direct that the provisions of the Order, which dispense with the necessity for consent, shall not apply. Such a direction becomes operative on the day after notice thereof has been served upon the persons concerned.

Your Committee has had particular regard to the provisions of the Order referred to above in relation to an application to develop, by the erection of flats, the site of a block of four dwelling houses (Nos. 4, 6, 8 and 10, Marlborough Road, Wealdstone) which were demolished as a direct result of enemy action and, in accordance with the advice given by the Central Middlesex Joint Planning Committee, considers that it is appropriate that the development of the site (which is within the area of the Harrow No. 3 Planning Scheme) should be subject to interim development permission b}' the Council, and that flats should not be permitted to be built thereon.

It may be mentioned that, in regard to " the provisions proposed to be included in the appropriate planning scheme " mentioned above, your Committee suggests that it is appropriate that the land referred to below, and adjoining land, should be zoned as residential.

The following recommendation is, therefore, submitted.Resolved to RECOMMEND :

That a resolution in the following terms be passed by the Council:(1) That, whereas the Council, as the interim development

authority, is satisfied that, having regard to the pro­ visions proposed to be included in the appropriate planning scheme, the development of the land, forming the site of the dwelling houses known as Nos. 4, 6, 8 and 10, Marl- borough Road (being development of Class III within the meaning of article 4 of the Town and Country Planning (General Interim Development) Order, 1946), should not be undertaken, unless permission therefor is granted upon an application made under the said Order, hereby directs that the provisions of article 4 (permitted development) of the said Order shall not apply to such land.

(2) That the Council hereby recommends the Central Middlesex Joint Planning Committee to zone for residential purposes the land comprised in the Harrow (Marlborough Road Area) Compulsory Purchase Orders (Nos. 1-4) 1939 (and shown upon the plan now produced, signed by the Surveyor

nth January, and dated 9th December, 1946), to the intent that the only ' buildings which may be erected and used thereon without

the consent of the responsible authority shall be dwelling committee houses, being houses designed for use as dwelling houses

for single families, together with such out-buildings as are ordinarily used therewith. 9

(3) That, in order to give effect to the matters referred to in paragraph (1) above, the Clerk of the Council be hereby authorised to comply with the provisions of article 6 of the Town and Country Planning (General Interim Develop­ ment) Order, 1946, in regard to the giving of notice to the persons concerned, and to inform the Central Middlesex Joint Planning Committee accordingly.

PART II.— MINUTES.459. Minutes : RESOLVED : That the minutes of the meeting of the

Committee held on llth November, 1946, having been circulated, be taken as read and signed as a true record.

VALUATION MATTERS.460. Monthly Report of Valuation Officer : RESOLVED : That the

monthly report of the Valuation Officer, dated 4th December, 1946, be received.

461. Assessment of Post-War Permanent Houses : The Valuation Officer reported that a letter had been received from the Middlesex County Valuation Committee relating to the standard or level of value to be adopted as to newly erected houses, and had approved the following resolution, passed at a conference between the County Valuer and the valuation officers of Middlesex rating authorities :

That, in valuing, for the assessment of post-war permanent houses, the same standard or level of value should be adopted as that employed in assessing the pre-war houses (i.e., built between 1919 and 1939) now appearing in the valuation lists.

RESOLVED : That the Committee hereby concurs in the above- mentioned resolution, and authorises the Valuation Officer to act accordingly.

TOWN PLANNING AND BUILDING BYELAWS MATTERS.462. L.C.C. Housing Estate : Headstone Lane : Arising out of

resolution 437 (llth November, 1946), the Clerk of the Council reported that counsel's opinion had been received, and that further information was being sought in the matter.

RESOLVED : That the report be received ; and that further con­ sideration of the matter be deferred.

463. Greater London Plan, 1944 : RESOLVED : That the Committee receives the report of the Advisory Committee for London Regional Planning, together with a letter dated 27th November, 1946, from

Town and Country Planning General (Interim Develop­ ment) Direction, 1946 : RESOLVED : That the report of the Clerk of the Council that the Minister of Town and Country Planning had issued the Town and Country Planning General (Interim Develop­ ment) Direction, 191(1 (dated 30th September, 1946) be received; and that the Surveyor be hereby authorised to furnish the Minister with the information desired in accordance therewith.

465. Land : Brockley Hill Estate, Stanmore : Arising out of resolution 417 (7th October, 1946), the Clerk of the Council reported that the Central Middlesex Joint Planning Committee had expressed the view that the proposals contained in the Greater London Plan, 1911, whereby certain land in the ownership of Geo. \Yimpey & Co., Ltd., situate at Brockley Hill, Stanmore (approximately 10 acres in extent), was proposed to be reserved for open space purposes, should be adhered to.RESOLVED : That the Committee hereby concurs in the views expressed by the Central Middlesex Joint Planning Committee.

466. Advertisement Hoardings : The Broadway, Stanmore :Arising out of resolution 443 (llth November, 1946), the Clerk of the Council reported that the justices had dismissed the appeal by Solosigns, Ltd., against the action of the Council requiring the removal of two advertisement hoardings erected on land fronting The Broadway, Stanmore ; and that the company had given notice of appeal to Quarter Sessions.RESOLVED : That the Clerk of the Council be hereby authorised to take such steps as may be necessary to respond to the appeal, including the briefing of counsel.

467. Advertisements : Stanmore Hill : RESOLVED : That the Committee, being of opinion that the same seriously injure the amenity of land protected by Harrow No. 1 Planning Scheme, the Clerk of the Council be hereby authorised to serve notices, pursuant to section 47 of the Town and Country Planning Act, 1932, requiring the removal of two advertisements exhibited on the premises known as Northampton House, Stanmore Hill, and numbered 1 and 2 on the plan now produced, signed by the Surveyor and dated 9th December, 1946.

468. Advertisement Hoardings : Junction of London Road and Edgware Road : More O'Ferrall, Ltd. : Arising out of resolu­ tion 408 (2nd September, 1946), the Clerk of the Council reported that, upon the re-hearing of the appeal by More O'Ferrall, Ltd., relating to the proposed removal of an advertisement hoarding set up at the junction of London Road and Edgware Road, the Appeal Committee of Middlesex Quarter Sessions had allowed the appeal.RESOLVED : That the report be received.

\m January, 469. Advertisement Hoardings : Junction of London Road and Edgware Road : Willings Billposting Dept., Ltd. : Arisingout of resolution 351 (25th February, 19-1(5), which relates to the

committee. dismissal by the justices of an appeal by Willings Billposting Depart­ ment, Ltd., against the action of the Council requiring the removal of three advertisement hoardings set up at the junction of London Road and Edgware Road, Stanmore, the Committee considered, in the light of the decision upon the appeal of More O'Ferrall, Ltd. (referred to in resolution 468 above) an offer by the Company to remove the hoarding marked " C " on the plan now produced by the Surveyor. The offer was conditional upon the Council taking no further action to secure the removal of the remaining hoardings marked "A" and " B " on the plan referred to above.RESOLVED : That the offer of Willings Billposting Department, Ltd., be accepted ; that, subject to the immediate removal of the hoarding marked " C " on the plan, now produced signed by the Surveyor and dated 9th December, 1946, no further action be taken to secure the removal of hoardings marked "A" and "B" on the plan submitted by the Surveyor ; and that the Clerk of the Council be authorised to abandon further action in respect of the appeal by way of case stated to the Divisional Court in the matter.

470. Town and Country Planning Act, 1944 : Poets Corner, Area : RESOLVED : That the Clerk of the Council and the Surveyor be asked to submit, at the next meeting, a report upon the pro­ visions of section 9 of the Town and Country Planning Act, 1944, in regard to the application thereof to the area known as Poets Corner, Wealdstone.

471. Harrow No. 1 Planning Scheme : 58/60, High Street, Har- row-on-the-Hill : Arising out of resolution 444 (llth November, 1946), the Clerk of the Council submitted a letter, dated 20th November, 1946, from Mr. H. Douglas, K.C., objecting to the action of the Council in deferring, for a period of three months, action in connection with the contravention of the Harrow No. 1 Planning Scheme at 58/60, High Street, Harrow-on-the-Hill.RESOLVED : That the letter be received.

472. Building Restrictions (Wartime Contraventions) Act, 1946 : Scope of Notices : RESOLVED : That the Surveyor be hereby authorised to decide, for the purposes of section 2 (7) of the Building Restrictions (Wartime Contraventions) Act, 1946, on behalf of the Council, the persons considered to be specially affected by applications made under section 2 of the Act.

473. Building Restrictions (Wartime Contraventions) Act, 1946 : Applications under Section 2 : The Committee considered various applications, made pursuant to section 2 of the Building Restrictions (Wartime Contraventions) Act, 1946, for a determination (a) whether the work or user specified in the respective applications fails to comply with the Building Byelaws, or planning control, which the Council is responsible for enforcing, and (b) that, having regard to all relevant circumstances, the works or use shall, notwithstanding such failure, be deemed so to comply.

1947'RESOLVED : That, pursuant to section 2 of the Building Restrictions \m ]a**a*y, (Wartime Contraventions) Act, 1946, the Council hereby determines(a) that the works or user specified in column (5) of appendix I tothis report in respect of the premises referred to in column (6) fail commtttee.to comply with the planning control or building law specifiedrespectively in columns (2) and (3) of such appendix ; and (b) thatthe decisions entered in column (7) of appendix I to this report begiven in respect of such applications.

474. Contravention of Building Byelaws : Temporary WorkshopRear of 78/80, Station Road, Harrow : Arising out of resolution 420 (7th October, 1916), the Clerk of the Council reported that no application had been received, pursuant to section 2 of the Building Restrictions (Wartime Contraventions) Act, 1946, in respect of temporary buildings used as workshops at the rear of 78/80, Station Road, Harrow.RESOLVED : (1) That the Clerk of the Council be hereby authorised, pursuant to section 65 of the Public Health Act, 1936, to serve a notice upon the owner of the temporary buildings erected at the rear of the premises known as 78/80, Station Road, Harrow, and used as workshops, requiring him either to pull down or remove the works, or, if he so elects, to effect such alterations therein, as may be necessary to make the same comply with the Council's Building Byelaws.

(2) That, in the event of the notice referred to in paragraph (1) above not being complied with, the Surveyor be hereby authorised to enter upon the premises and to pull down or remove the buildings in question, or to effect such alterations therein as may be. necessary to ensure that the buildings comply with the Council's Building Byelaws.

475. Contravention of Building Byelaws : (a) Treve Avenue :(b) The Heights : Arising out of resolution 181 (9th December, 1946), whereby plans numbered 10309 and 10310 were rejected, the Surveyor reported that the buildings had already been erected.

RESOLVED : (1) That the Clerk of the Council be .hereby authorised, pursuant to section 65 of the Public Health Act, 1936, to serve notices upon the respective owners of the under-mentioned buildings requiring them either to pull down or remove the same, or, if they so elect, to effect such alterations therein as may be neces­ sary to make the buildings comply with the Council's Building Byelaws : —

Garage, 21, Treve Avenue.Garage, 5, The Heights.(2) That, in the event of the notices referred to in paragraph (1)

(3) That, in the case of each plan specified in Schedule B (appear­ ing in appendix III to this report), the decisions stated in columns (5) and (6) of that schedule opposite the description of the plan be made under the Public Health Act, 1936 ; Building Byelaws ; Byelaws with respect to New Streets ; Town Planning Schemes ; and under such other provisions as are shown in the footnotes to the said schedule.

9. MINUTES : Resolved : That the minutes of the meeting of the Sub- Committee held on 5th November, 1946, having been circulated, be taken as read and signed as a true record.

10. DEPOSITED PLANS : The Surveyor reported upon plans deposited (a) for approval under the Public Health Act, 1936, the Building Byelaws and the Byelaws with respect to New Streets ; (b) for consents under the" Harrow-on-the-Hill Town Planning Scheme, 1933, and Harrow No. 1 Planning Scheme, and (c) for interim development permissions under Harrow No. 3 Planning Scheme and the Town and Country Planning (General Interim Develop­ ment) Order, 1946, respectively.

Resolved to RECOMMEND :That decisions be made upon such plans and applications by

reference to the plan number in schedule I to this report.

11. BUILDING RESTRICTIONS (WARTIME CONTRAVENTIONS) ACT, 1946 : Your Sub-Committee has given consideration to the two applications (particulars of which appear on the list accompanying this report) made for a determination under section 2 of the Building Restric­ tions (Wartime Contraventions) Act, 1946.
