Informationabout Acts ofterrorism.

I (C) attends a meeting, which he knows is to support a proscribed

2 organisation, or to further the objectives of a proscribed organisation,

3 commits an offence.

4 4.-(1) Any person who knowingly, in any manner, solicits or renders a

5 support for-

6 (a) an act of terrorism, or

7 (b) a proscribed organiSation or an international suspected terrorist group,

8 commits an offence.

9 (2)For the purposes of subsection (I) ofthis section, 'support" includes

10

II (a) incitement to commit a terrorist act;

12 (b) offer ofmaterlal assistance, weapons including biological, chemical

13 or nuclear weapons, explosives, trammg, transportation, false documentation

14 or idemification;

15 (c) offer or provision of moral assistance, including invitation to adhere

16 to a proscribed organisation; and

17 (d) the provision of, or making available, such financial or other related

18 services as may be prescribed.

19 5. Any person who harbours, conceals, or causes to be harboured or

:!l concealed, a person whom he knew to have committed, or to have been convicted

21 of, an act of terrorism, or against whom he kneW that a warrant of arrest or

22 imprisonment for such an act had been issued, commits an offence.

23 6.-(1) Subject to subseetions (2)and (3)of this section where a person

24 . has information which he knows or believes might be of material assistance

25 in-

26 (a) preventing the Conunission by another person or an organization of an

27 act of terrorism, or

28 (b) securing the apprehension, prosecution or conviction of another person

29 for an offence under this Act,

:ll and that person fails to disclose to a law enforcement officer the ioformation as

31 soon as reasonably practicable, he commits an offence.

(ii) is a member of, or belongs 10 'an international terrorist group; or

(iii) has a link with an internationaI tenurist group, and be reasonably,

(b) he is listed as a person involved in lenurist acts in any Resolution of

the United Nations Seeurity Councilor in any instrument of the African

Union and Economic Community of West African Stales.

II (2) Where the President makes a declaration uDder subsection (I) (a) of

15 (3) Where a person declared as a suspected inlemational terronst under

16 subsection (I) of this section possesses the Nigerian citizenship other than by

19 (4) The President may, on the recommendation Of the National Security

(b) do any other act intended to cause death or serious bodily injury to a

civilian or any person nol taking an active part in the hostilities in a sitoation

of armed conflict, when the purpose of such act, by its natore or context, is

to intimidate a group of people, or to compel a government or an international

organisation to do or abstain from doing any act,

8(2) For an act to constitote an offence under subsection (l) of this section,

it shall not be necessary that the funds were actually used to commit the said9 offence.

PART 11- TERRORIST FuNDs AND TERRORIST PROPERTY

11.-(1) The Director-General may seize cash where he has reasonable

grounds to suspect that !he cash-

(a) is intended to be used for the purposes of terrorism;

(b) belongs to, or is held on trust for, a proscribed organization;

(c) is or represents property obtained through acts or terrorism,

(2) The Director-General or anyauthorlzed officer may seize cash If-

(a) the seizure is incidenl:li to an arrest or search; or

(b) the property is liable to forfeitore iIpori process issued by the court

folIowing an applicationmade by the Director-General 'or anv authorized

officer in accordance with the prescribed rules.

(3) The Director-General may exercise his powers under subsection (I)

of this section, whether or not any proceeding bas been brought for an offence in

connection with the terrorist cash.

11 (2) A financial institution or designated noDfinancial insCution is not

12 .' liabiefor violatiOllof the confidentiality rules for every lawful action taken in

13 furtherance of its obligations under suiJse!::tion(I) of this section.

14 (3) The details of report sent by the financial institution or designated non

IS financial institution shall not be disclosed by the institution or any of their

16 officers to any other person.

17 (4) A breach of subsection (3) of this section is an offence under this Act

18 punishable with a minimum fintofN5,OOO,OOO.OOor a temi ofirnprisonment

19 not exeeeding 5years.

:xl (5) Where a breach of sub section (I) of this section occurs and it is

21 shown that the breach is not deliberate, the Financiallntelligence Unit shall

22 impose such administrative sanctions as it may deem necessary .

23 (6) Where the institutioncontinueswith the breach, it shall, on conviction,

24 be liable to a minimum fine ofN5,OOO,OOO.OOor a term of irnprisonmentnot

25 exceeding 5 years for the principal officers of .the institution or a defaulting

26 officer.

n 14.--(1) A person who enters into;OT is involved in, an arrangement

28 which facilitates the retentionurcontroi by, oronbehalfof, another person, of

29 terrorist property in any manner, including by -

(c) transfer to any other person,

2 commits an offence.

3 (2) It is a defence for a personcbarged under subsection(I) of this section

4 to prove that he did not know and had no reasonable cause to suspect that the

5 arrangement is related to a terrorist property .

6 15.-(1) Where a person is chargedor aboutto be charged withan offence

7 under this Act, the Director-General or any of hisofficers not below the rank of

8 a Principal Security Intelligence Officer may apply to a Judge in Chambers for

9 a provisional order to attach all monies and other property belonging to, or held

10 on behalf of the suspect.

11 (2) An order made under subsection (I)may-

12 (a) prohibit a person from making money or property available to, or for

I3 the benefit of the suspect;

14 (b) provide for the granting of authority to make moneyor other property

IS available to such persons and on such conditions as may be specified in the

16 order;

17 (c) require the suspect to provide such information or produce such

18 document as may be required or reasonably needed for an investigation

19 under this Act;

Xl (d) include such other condition as the Judge may impose.

21 (3) The Judge in Chambers may, on the recommendationof the Director-

22 General, appoint an official receiver or any other suitableperson to manage the

23 property of the suspect during the period of operation of an Order made under

24 this section.

25 (4) The Director-General shall-

26 (a) cause notice of the order to be published in the next issue of the

27 Gazette and in two daily newspapers;

28 (b) give notice of the order to-

29 -(J) banks, financial institntions and cash dealers;

30 (it) any otherperson who mayholdofbe vestedwithpropertybelonging

31 to or held on behalf of the suspect.

(5)An order under this sectionshall remain in force until the determination

2 of any charge or intended charge under subsection (1)of this section and, in the

3 event of a conviction, until an order for forfeiture is made by the Court or

4 proceedings relating thereto are concluded.

5 (6) Where an order under this section ceases to have effect, the Director-

6 General shall cause notice to be published in the Gazette and two daily

7 newspapers.

8 (7) Any payment, transfer, pledge or other disposition of property made

<) in contravention of an order under this section shall be void.

10 16.-(1) Where the Director-General has reasonable grounds to suspect

II that a person has committed, is committing or is likely to commit an act of

12 terrorism or is in possession of terrorist property, he may, for the purposes of

13 an investigation under this Act, apply to a Judge in Chambers for an order-

14 (a) compelling the suspect to deliver to him any document relevant to

15 identifying, locating or quantifying any property belonging to, or in the

16 possession or control of that person;

17 (b) requiring a bank or any other financial institution, trustee, cash dealer

18 or custodian, to produce to him all information and deliver to him all

19 documents regarding any business transaction conducted by or on behalf of

20 the suspect.

21 (2) Where a person fails to comply with, is delaying or is otherwise

22 obstructing an order made under subsection (1) (a) of this section, the Judge in

23 Chambers may, upon information sworn to that effect by the Director-General,

24 authorise the Director-General or any officer authorised by him to enter any

25 premises, including a bank or other financial institution and search ..he premises

26 and remove any document.for the purposes of executing such order.

Y1 PART III - MUTUAL ASSISTANCE AND EXTRADITION

28 17.-(1) Where a foreign State makes a request for assistance in the

29 investigation or prosecution of an offence related to terrorism, the Attorney-

30 General shall-

31 (a) execute the request; or

2 (I) not executing the request forthwith;

3 (il) delayirig 'the execution of the request.

4 (2) Where the Atrorrey-Generat decides to execute a request for assistance

5 under subsection (1), he may apply to a Judge inChambersfor"--

6 (a) au-order in writing for-i-

7 (i) search and entry of specified premises;

8 (iz) search of any specified person;

9 (iii) removal of any relevant document or material;

10 (b) an attachment order";

II (c) a property tracking order;

12 (d) an order forfreezing or forfeiture of property, in such manner as may

13 be prescribed.

14 (3) The Judgein Chambers may make an order under this section imposing

15 such conditions as to payment of debts, sale, transfer or disposal of any property

16 as he deems fit

17 18.-(1) The Attorney-General may make a request to any foreign State-

18 (a) to provide evidence or information relevant to an offence under this

19 Act;

3l (b) forthe restraint and forfeiture of property located in that State and

21 which is liable to be forfeited for being a terrorist property.

22 (2) The Attorney-General may, in respect of any proceedings for an offence

23 under this Act, apply to a Judge in Chambers for an order directed to any

24 person resident in a foreign State to deliver himself or any document or material

25 in his possession or under his control to the jurisdiction of the Court or, subject

26 to the approval of the foreign State to the jurisdiction of the Court of the foreign

27 state for the purpose of giving evidence in relation to those proceedings.

28 19.-(1) The evidence taken, pursuant to a request under section 17 of

29 this Act, in any proceedings in a court of a foreign State may, if it is

31 evidence relates.

(2) For the purpose of subsection (1) of this section a document is

authenticated if it purports to be-

(a) signed or certified by a Judge or Magistrate of a foreign State; and

(b) authenticated by the oath or affirmation of a witness or to be sealed

with an official or public seal-

(I) of a Ministry or Department of the Government of the Foreign

State, or

(ii) in the case of a territory, protectorate or colony, of the person

administering the Government of the foreign territory, protectorate or

colony or of a person administering a department of that territory,

protectorate or colony.

20.-(1) A request under section 17or 18 shall be in writing, dated and

signed by or on behalf of the person making the request.

(2) The request may be transmitted by facsimile or by any other electronic

device or means.

(3) The request shall-

(a) confirm either that an investigation or prosecution is being conducted

in respect of a suspected offence related to terrorism or that a person has

been convicted of an offence related to terrorism;

(b) state the ground on which any person is being investigated or prosecuted

for an offence related to terrorism or detail of the conviction of the person;

(c) give sufficient particulars of the identity of the person;

(d) give particulars sufficient to identify any bank, financial institution,

cash dealer or other person believed to have information, documents or

materials which may be of assistance to the investigation or prosecution;

(e) to obtain from a bank, financial institution, cash dealer or any other

person any information, document or material which may of assist the

investigation or prosecution;

or material obtained pursuant to the request is to be produced;

I (l).a freezing order or forfeiture order is required, or

2 (it) the property 10 be the subject of such an order; and

3 (h) contain such other information as may assist the execution of the request.

4 (4)A request shall not be i~validated for the purposes of this Act or any

5 legal proceedings by failure 10 comply with subsection (3) of this section where

6 the Attorney-General is satisfied that there is sufficient compliance to enable

7 . him to execute the request.

8 (5)Where the Minister of Finance considers it appropriate, either because

9 an international arrangement so requires or permits or it is in the public interest,

10 he may order that the whole or any part of any property forfeited under sections

11 17 and 18 of this Act, or the value thereof, be returned or remitted to the

12 requesting State.

13 21. Any offence under sections 1,2,3,4,5,9, 10, 12 and 13 of this Act are

14 considered to be an extradition crime for which extradition may be granted or

15 obtained under the Extradition Act.

16 PART IV - INVESTIGATION

17 22.-(1) A law enforcement officer not below the rank of Senior Security

18 Intelligence Officer or its equivalent may apply to the court for the issue of a

19 warrant for the purposes of a terrorist investigation.

::D (2)The court may issue a warrant authorising the law enforcement officer

21 to-

22 (a) enter the premises specified in the warrant;

23 (b) search the premises and any person found therein; and

24 (c) seize and retain any relevant material found therein

25 (3) The court shall not issue a warrant under subsection (2) of this section

26 unless the court is satisfied that-

27 (a) the warrant is sought for the purpose of a terrorist investigation; and

28 (b) there are reasonable grounds for believing that there is material on

29 the premises which may be relevant to the terrorist investigation.

30 23.-(1) Where, in a caseof urgency, a communication with the Judge in

31 Chambers to obtain a warrant would cause delay that may be prejudicial to the

maintenance of public safety or order, a law enforcement officer not below the

2 rank of Principal SecurityIntelligence Officer or his 'equivalent may, without

3 prejudice to the provisions of any other enactment or Act, with the assistance

4 of such other officers as maybe necessary-

5 (a) enter and search any premises or place, if he has reason to suspect

6 that, within those premises or that place-

7 (I) an offence under this Act is being committed; and

8 (il) there is evidence of the commission of an offence under-this Act;

9 (b) search any person or vehicle found on any premises or place which he

10 is empowered to enter and search under paragraph (a) of this subsection;

11 (e) stop, board and search any vessel, aircraft or vehicle ithe has reason

12 to suspect that there is in it evidence of the commission or likelihood of

13 commission of an offence under this Act;

14 (d) seize, remove and detain anything which is, or contains or appears to

15 him to beor to contain or to be likely to contain, evidence of the commission

16 of an offence under this Act; or

17 (e) arrest search and detain any person whom he reasonably suspects of

18 having committed or likely to commit an offence under this Act.

19 (2) The law enforcement officer shall take and record, for the purposes of

aJ identification, the measurements, samples, photographs and fingerprint

21 impressions of all persons who may, from time to time, be in lawful custody for

22 any offence under this Act.

23 (3) A person who refuses to submit to the taking and recording of his

24 measurements, photographs or fingerprint impressions shall be taken before the

25 Judge in Chambers who, on being satisfied that such a person is in lawful

26 custody, shalI make such order as he thinks fit authorizing a law enforcement

27 officer to take measurements, photographs and fingerprint impressions of such

28 a person,

29 (4) The Judge in Chambers may, pursuant to an expert application, grant

30 an order for the detention of a suspect under this Act for a period not exceeding

31 2 months.

(5) A law enforcement officer may use such force as may be necessary

for fbe exercise of the power conferred on bim by subsection (1) of fbis section.

(6) A person found on any premises or place or in any vessel, aircraft or

vehicle may he detained by a law enforcement officer until fbe completion of

the search undersubsection (1) of fbis section.

(7) Where a seizure is effected under this section, a list of all fbe articles,

documents and other matters seized shall he delivered to fbe-

(a) person on whom fbe search is made;

(b) owner of the premises, place, vessel, aircraft or vehicle seized.

(8) Notwithstanding fbe provisions of suction (I) of fbis section, a woman

shall only he searched by a fellow woman.

(9) Nofbing in this section shall he construed as derogation from fbe

lawful right of any person in defence of person or property.

(10) A law enforcement officer who uses such force as may he necessary

for any purpose, in accordance wifb fbis Act, shall not he liable in any criminal

or civil proceedings, for having, by fbe use of force caused injury or death to

any person or damage to or loss of, any property.

24.-(1) Wifbout prejudice to any other Act or enactment, the Director

General or an authorised officer may, for the purposes of the prevention or

detection of offences or fbe prosecution of offenders, under fbis Act, give such

directions as appear to him to he necessary to any communication service

providers.

. (2) Before giving a direction under this section, the National Security

Adviser may consult with any communication service provider he.d~ems. .

(3) A direction under this section shall specify the maximum period for

which a communication service provider may be required to, retain• ...., - ' .••• I

25.-(1) Any authorised officer may issue a detention order m respect of

3 a conveyance if he is of opinion that-

4 (a) a threat has been made to commit an act of violence against the

5 conveyance or against any person or property on board the conveyance; or

6 (b) an act of violence is likely to be committed against the conveyance,

7 or against any person or property on board the conveyance.

8 (2) Where the operator of a conveyance fails to comply wit', a detention

9 order under subsection (I), the authorised person may-

10 (a) enter, or authorise any other person to enter, the conveyance; or

11 (b) arrange for a person or thing to be removed from the conveyance,

12 (3) The authorised officer shall give written notice to the operator of the

13 conveyance of any detention order issued under this section.

14 (4) Where the operator of a conveyance objects to a detention order, the

15 Attorney-General may after hearing the parties confirm, vary or cancel the

16 order.

17 (5) In this section-

18 "conveyance" means an aircraft, train, vehicle, other mode of

19 transportation.

al (6)Any person who-

21 (a) without reasonable excuse, fails to comply with the requirement of a

22 detention order;

23 (b) intentionally obstructs or hinders any person acting In accordance

24 with subsection (2)ofthis section, commits an offence.

25 (7) For the purpose of this section, "an authorised person" means the

26 Head of an agency involved In an anti-terrorism initiative.

27 26.-(1) where a person is arrested under reasonable suspicion of having

28. committed any offenceunder sections 1,2,3,4,5,8,9, 10, IZ orB of this Bill,

29 a law enforcement officer not below the rank -ofSenior Security Intelligence

30 Officer may, subject to this section, direct that the person arrested be detained

31 in a custody for a period not exceeding 48 hours from his arrest, without having
