NEW DELHI: Former NationalCommission for Minorities(NCM) chairman Tahir Mahmoodhas questioned the panel’s util-ity and suggested a “decentburial” for it.

In his book, MinoritiesCommission (1978-2015): MinorRole in Major Affairs, he said theNCM has failed to bring positivechanges in the lives of minoritiesin India.

Mahmood, who headed theNCM between 1996 and 1999, ques-tioned the panel’s contribution,saying the condition of Muslimsand Christians remained where itwas in 1978 when the commissionwas established — be it the issueof their educational rights, physi-

NEW DELHI:No court other than theSupreme Court and high courtscan direct the Central Bureau ofInvestigation (CBI) to inquire intoallegation of corruption by publicofficials the Delhi high court hasclarified.

Justice Siddharth Mridul camedown heavily on a Special CBIcourt here, which on two separateoccasions ordered CBI inquiry intoallegation of corruption againsttwo former Research and AnalysisWing (RAW) officers.

In February 2013, the special

CBI court ordered CBI probe intoalleged disproportionate assets offormer RAW chief AK Verma, who headed the intelligence agencyduring 1987-90. The special CBIcourt, on May 7, 2014, directed CBIto investigate allegation of corrup-tion against Dr AS Narayana Rao, a RAW scientist caught red-handedaccepting ̀ 1 lakh as bribe.

Rao was one of the members ofan inter-ministerial working group(IMWG) to monitor and control theexport licence of certain high riskcommodities whose export wouldadversely affect the security andeconomy of the country.

After an export company rep-

resentative lodged a complaintwith the CBI that Rao had beendemanding a bribe for clearanceof an export license, a trap was laidon February 02, 2009, at a hotel inDelhi where he was arrested.

In both the cases, CBI hadmoved the HC against the orders.

Setting aside the two orders,the HC, its 27-page verdict, said,“CBI is not an investigating agencyof the court presided over by thespecial judge under Prevention ofCorruption Act, 1988… The SC hasclearlydelineated that only the SCand the HCs in their inherent juris-diction can issue such a directionto CBI.”
