D R A F T

AN ORDINANCE TO AMEND THE PROTECTION OK CULTIVATORS ORDINANCE, 4933.

B E IT ENACTED by the High Commissioner for Palestine with the advice of the Advisory Council thereof:—

1. This Ordinance may be cited as the Protection of Cultivators Short title. (Amendment) Ordinance, 1935, and the Protection of Cultivators Ordinance, 1935, (hereinafter referred to as the principal No. 37 of 1933. Ordinance) the Protection of Cultivators (Amendment) Ordinance, No. 7 of 1934. 1934, and this Ordinance may together be cited as the Protec­tion of Cultivators Ordinances, Î933-1935.

2. Section 2 of the principal Ordinance shall 'be amended by the deletion of the definition of "Holding" contained therein and by the substitution therefor of the following definition: —

"Holding means a plot of miri land cultivated by a tenant, and where the land of a village or any portion of such land is held in undivided ownership or tenure, includes such land or portion of such land so cultivated within the area of the village:

Provided that where a tenant has been moved by a landlord from one or more plots of land to another plot or plots the plot or plots from which the tenant was moved and the plot or plots to which the tenant w־as moved shall together be deemed to be a holding."

3. Section 3 of the principal Ordinance shall be amended by the deletion of the words "has occupied and cultivated a holding lor a period of not less than one year" in sub-section (1) thereof and by the substitution therefor of the words k thas cultivated a holding for a period of one year or for a period necessary to raise two successive crops whichever be the lesser".

4. Section 4 of the principal Ordinance shall be amended by the deletion of the words "has occupied and cultivated a holding for a period of not less than one year" in sub-section (1) thereof and by the substitution, therefor of the words "has cultivated a holding for a period of one year or for a period necessary to raise two successive crops whichever be the lesser".

5. Section 6 of the principal Ordinance shall be amended by the deletion of the words "has occupied and cultivated a holding for a period of not less than one year" in sub-section (1) thereof, and by the substitution therefor of the words "has cultivated a holding for a period of one year or for a period necessary to raise two successive crops whichever is the lesser".

Amendment of 6. Section 7 of the principal Ordinance is hereby amended section 7 of the the deletion of the words "has occupied and cultivated a Ordinance. holding for not less than one year" in paragraph (a) thereof

Insertion of new sections in principal Ordinance.

8. The principal ordinance shall be amended by the insertion therein of the following sections as sections 49.A., 49.B. and 19.G. after section 19 as enacted by section 3 of the Protection of Cultivators (Amendment) Ordinance, 4934: —

,'Certified copies of decision of special commis­sion to be evidence.

19.A. Where by a decision of a special com­mission appointed under section 49 of this ordinance any person is declared to be a sta­tutory tenant of a holding, such statutory tenant shall be entitled to recover possession of the holding and may for this purpose institute pro­ceedings before a magistrate for an order for possession and a copy of a decision of the special commission purporting to be signed and certified by the chairman thereof shall be admissible as evidence of facts therein in any such proceedings. Provided that no order for possession shall be made by a magistrate pending the hearing; of any appeal from the - decision of the special commission. . .

19.B. Where any dispute as to Whether any person is a statutory tenant of a holding is referred to a special commission appointed under section of this Ordinance and it is proved to the 19׳satisfaction of such commission that the person who claims to be a statutory tenant already owns or cultivates an area elsewhere sufficient to en­able him to maintain his customary means of livelihood in an occupation with which he is familiar, the commission shall record such fact in their decision, and may dismiss the claim of of the person so claiming to be a statutory tenant.

19.c. Where any dispute as to whether any person is a statutory tenant of a holding is re­ferred to a special commission appointed under section 49 of this Ordinance and it is proved to the satisfaction of such commission that the person who claims to be a statutory tenant has cultivated a holding for a period of one year or for a period necessary to raise two successive crops at any time within two years preceding the date of the said dispute the commission shall record such fact in their decision and shall, subject to the provisions of section 19.B. of this Ordinance, allow the claim of the person so claiming to be a statutory tenant.
