TOWNSHIP OF SPRINGFIELD ORDINANCE NO. 2011-21 BE IT ORDAINED BY THE TOWN- SHIP COMMITTEE of the Township of Springfield, County of Union, State of New Jersey, as follows: SECTION I - AMENDMENT CHAPTER III, POLICE REGULA- TIONS, Section 3-12 DUMPSTERS, is hereby amended to read in full as fol- lows: 3-12 DUMPSTERS 3-12.1 Definition. Dumpster shall mean any waste or refuse container, commonly known as a roll-off dumpster or roll-off container. 3-12.2 Permit Required. No person shall park, leave, place or be in control of any dumpster on any street or highway, public property or private property within the Township without first obtaining a permit as set forth herein. 3-12.3 Permit Requirements. a. No permit will be issued for place- ment on a state or county highway, or on state or county property, without the prior written consent of the appro- priate county or state authority having jurisdiction over Ihe highway or public property. b. A complete Permit Application shall be filed with the Building Depart- ment. c. A permit shall be issued for a period of up to thirty (30) days, and may thereafter be renewed for up to two additional thirty (30) day periods. d. No permit shall exceed a total of NOTICE PUBLIC NOTICE PUBLIC NOTICE ninety (90) days, e. All permit fe permit fees must be paid in advance before issuance or extension of any permit. 3-12.4 Rules and Regulations. a. A dumpster may only be placed upon a public roadway if the location thereof is approved by the Traffic Safety Officer or other designee within the Springfield Police Department, who shall only approve such location if the dumpster can be so placed so as not to interfere with the public safety. b. Any dumpster placed on any pub- lic street or anywhere within Ihe public right of way, shall be equipped with and display markers consisting of all yellow reflective diamond-shaped pan- els having a minimum size of eighteen inches by eighteen (18" x 18") inches. These panels shall be mounted at the edge of the dumpster at both ends nearest the path of passing vehicles and facing the direction of oncoming traffic. These markers shall have a minimum mounting height of three (3) feet from the bottom ot the panels to the surface of the roadway. c. Any dumpster placed on any pub- lic street shall be placed so as to avoid damage to the street. The repair of any such damage shall be the responsibility of the permit holder and shall be done upon notice to and approval of the Township Engineer or a designee. d. Any dumpster placed on private property shall be placed no less than ten (10) feet from the curb line of any public street. e. No dumpster shall be placed so as to interfere with or be within any site triangle. f. All dumpsters shall appropriately maintained and covered so as to ensure that the contents will not spill out, overflow, be blown out by the wind, or in any other way be removed from the container. g. All dumpsters shall be maintained so as to ensure no liquid of any kind, other than clean water, shall leak or otherwise discharge from the contain- er. h. All dumpsters shall comply with any applicable state, county or local Jaw, including but not limited to zon- ing, health and building codes. 3-12.5 Permit Fees. Permit Application Fee for placement on public street $100.00 Permit Application Fee for placement on property 25.00 Each permit renewal (per thirty (30) days) 25.00 SECTION II - RATIFICATION Except as expressly modified herein, all other provisions and terms of the Code of the Township of Springfield shall remain in full force and effect SECTION III - SEVERABILITY In case any section, subsection, paragraph, subdivision, clause or pro- vision of this ordinance shall be judged invalid by a court of competent jurisdiction, such order or judgment shall not effect or invalidate the remainder of any section, paragraph, subdivision, clause or provision of this ordinance, and to this end, the provi- sions of each section, paragraph, sub- division, clause or provision of this ordinance are hereby declared to be severable. SECTION IV - REPEAL Any ordinance or portion of any ordi- nance which is inconsistent with the modifications of this ordinance is repealed to the extent of its inconsis- tency. SECTION V - EFFECTIVE DATE This ordinance shall take effect immediately upon passage and publi- cation according to law. Linda M. BE IT ORDAINED BY THE TOWN-SHIP COMMITTEE of the Township ofSpringfield, County of Union, State ofNew Jersey, as follows:

SECTION I - AMENDMENT

CHAPTER I I I , POLICE REGULA-TIONS, Section 3-12 DUMPSTERS, ishereby amended to read in full as fol-lows:

3-12 DUMPSTERS

3-12.1 Defini t ion.Dumpster shall mean any waste or

refuse container, commonly known asa roll-off dumpster or roll-off container.

3-12.2 Permit Required.No person shall park, leave, place or

be in control of any dumpster on anystreet or highway, public property orprivate property within the Townshipwithout first obtaining a permit as setforth herein.

3-12.3 Permit Requirements.a. No permit will be issued for place-

ment on a state or county highway, oron state or county property, withoutthe prior written consent of the appro-priate county or state authority havingjurisdiction over Ihe highway or publicproperty.

b. A complete Permit Applicationshall be filed with the Building Depart-ment.

c. A permit shall be issued for aperiod of up to thirty (30) days, andmay thereafter be renewed for up totwo additional thirty (30) day periods.

d. No permit shall exceed a total of

ninety (90) days,e. All permit fepermit fees must be paid in

advance before issuance or extensionof any permit.

3-12.4 Rules and Regulat ions.a. A dumpster may only be placed

upon a public roadway if the locationthereof is approved by the TrafficSafety Officer or other designee withinthe Springfield Police Department, whoshall only approve such location if thedumpster can be so placed so as notto interfere with the public safety.

b. Any dumpster placed on any pub-lic street or anywhere within Ihe publicright of way, shall be equipped withand display markers consisting of allyellow reflective diamond-shaped pan-els having a minimum size of eighteeninches by eighteen (18" x 18") inches.These panels shall be mounted at theedge of the dumpster at both endsnearest the path of passing vehiclesand facing the direction of oncomingtraffic. These markers shall have aminimum mounting height of three (3)feet from the bottom ot the panels tothe surface of the roadway.

c. Any dumpster placed on any pub-lic street shall be placed so as toavoid damage to the street. The repairof any such damage shall be theresponsibility of the permit holder andshall be done upon notice to andapproval of the Township Engineer ora designee.

d. Any dumpster placed on privateproperty shall be placed no less thanten (10) feet from the curb line of anypublic street.

e. No dumpster shall be placed soas to interfere with or be within anysite triangle.

f. All dumpsters shall appropriatelymaintained and covered so as toensure that the contents will not spillout, overflow, be blown out by thewind, or in any other way be removedfrom the container.

g. All dumpsters shall be maintainedso as to ensure no liquid of any kind,other than clean water, shall leak orotherwise discharge from the contain-er.

h. All dumpsters shall comply withany applicable state, county or localJaw, including but not limited to zon-ing, health and building codes.

SECTION II - RATIFICATIONExcept as expressly modified herein,

In case any section, subsection,paragraph, subdivision, clause or pro-vision of this ordinance shall bejudged invalid by a court of competentjurisdiction, such order or judgmentshall not effect or invalidate theremainder of any section, paragraph,subdivision, clause or provision of thisordinance, and to this end, the provi-sions of each section, paragraph, sub-division, clause or provision of thisordinance are hereby declared to beseverable.SECTION IV - REPEAL

Any ordinance or portion of any ordi-nance which is inconsistent with themodifications of this ordinance isrepealed to the extent of its inconsis-tency.SECTION V - EFFECTIVE DATE

This ordinance shall take effectimmediately upon passage and publi-cation according to law.
