Indeed, it has been established that following the explosive growth of e- commerce in the private sector to the tune of USD 12.8 trillion in 2006, governments all over the world have began to gravitate towards the application of e-GP as a tool to modernize and improve their procurement systems. As a way of aligning the e-GP system to match the elements of good governance, the system is designed to enhance transparency and com- pliance, provide a common platform for effec- tive competition and ensure increased partici- pation of all service providers in procurement. Thus, Ghana’s e-GP system is expected to be conducted not only in accordance with ap- proved annual procurement plans but also in compliance with rules, regulations and pro- cesses as defined by Act 663. Various definitions have beengiven to the term good govern-ance. The World Bank, for in-stance has described it as “the

manner in which power isexercised in the management of a

country’s economic and socialresources for development”.

According to the United Nations,its essential characteristics

include Transparency,Accountability, Effectiveness,

Efficiency and Rule of law.Considering the fact that public procure-ment constitutes one of the prime businessactivities of every government, any effort atautomating the process using ICT applica-tions (in the form of e- government pro-curement (e-GP)) should be a welcome in-tervention. Indeed, it has been establishedthat following the explosive growth of e-commerce in the private sector to the tuneof USD 12.8 trillion in 2006, governmentsall over the world have began to gravitatetowards the application of e-GP as a tool tomodernize and improve their procurementsystems.

What is E-Procurement

E-Procurement in general, is the electronic implemen-tation of the Procurement Cycle. It is using ICT specif-ically the internet platform to acquire goods, works andservices at the best value obtainable.

Adding ‘G’ to the procurement (E-GP), makes it astrictly Government to business process (G-to-B).

Stakeholders in this e-Gp system include ;

Public Procurement Regulators Government Procurement Entities Private Service Providers (Suppliers, Contractors

and Consultants) Civil Society General Public including media and oversight bod-

ies.

Advantages/Benefits of e-GProcurement

The use of ICT to conduct government procurement isexpected to generate benefits for both government andall the stakeholders listed above.

These benefits can be grouped in three broad areas,namely:

Government procurement is often identified with ten-sions between public expectations of high standards ofgovernance, management requirements for perfor-mance, overt political influence and broader stakehold-er interests particularly from the private sector. Tech-nology offers the potential to substantially strengthentransparency of government procurement, addressingan area of sometimes intense public interest. E-gProcurement will enhance governance in terms oftransparency and accountability.

INTRODUCTIONGhana’s vision to improve efficiency of government’s

dealings with the public through the use of Informationand Communication Technology (ICT) resulted in theinitiation ofthe eGhana Project in 2006 with funding fromthe International Development Association through theWorld Bank. The project consists of three main compo-nents which seek to1;

Create the enabling environment necessary for thegrowth of the ICT sector

Support local ICT Businesses and IT enabled services(ITES); and

Promote e-Government applications and GovernmentCommunications.

Under the third component, a number of e-Governmentapplications are being developed. Current applicationsbeing developed at various stages of deployment includethe following;

e-Justice

e-Immigration

e-Government Procurement

e-ParliamentE-GovernmentProcurement(E-GP)The e-Government Procurement (e-GP) implementation

began in June 2011. After a competitive tendering pro-cess, Pricewaterhouse Coopers (PwC) was engaged asconsultants for the Systematic Development of ElectronicGovernment Procurement (e-GP) in Ghana.

As defined by the Terms of Reference, PwC has todate;

Assisted with the developing of a clear national E-GPvision

Conducted a comprehensive assessment with base-line indicators for E-GP in Ghana

Assessed Public Procurement Act, (Act 663), andrelevant Laws which have an impact on the introduc-tion of an E-GP system

GHANA’S READINESS FORELECTRONIC GOVERNMENT PROCUREMENT

Developed an E-GP Communication Strategy

Developed an E-GP Strategy and Action Plan

A multi-disciplinary project implementation committeehas been constituted as a steering committee for the pro-ject.

The project currently is at stage where a firm is going tobe chosen through a competitive tendering process topartner the government in providing an application soft-ware with full end-to-end eGP functionalities. This applica-tion software will be piloted among six selected entities.

To enable Ghana enjoy the full benefits of the e-GP it isimportant that we continually assess the readiness of thecountry for the establishment of an eGP system. This pa-per seeks to assess Ghana’s readiness three main areas,namely;

IT Infrastructure

Legal Framework

Capacity DevelopmentITINFRASTRUCTUREA major requirement for the establishing of an e-GP

system is the availability of IT infrastructure. IT infrastruc-

ture covering Internet Connectivity, Data Center and itscorresponding Disaster Recovery site, Local and WideArea networks, Security, Desktop Computers, Uninter-rupted Power Supply (UPS), Multi-Functional Devices(MFDs) must be in place.

The National Information Technology Agency (NITA),the government agency responsible for providing ITinfrastructure for use by government agencies has aspart of its mandate to provide a national backbone infra-structure to all districts in the country, provide a nationaldata centre and a secondary data centre facility for dis-aster recovery capability, connect all public institutions,MDAs and MMDAs to a single shared communicationsand computing infrastructure to facilitate effective deliv-ery of government services to citizens, businesses andothers. NITA has achieved a lot as per it mandate.

According to NITA, in a recent response to PPA on thissubject, an Interim Data and Disaster Recovery centers areavailable for use for all eGhana applications (e-GP includ-ed) since December, 2011, however the substantial Nation-al Data and Disaster Recovery centers will be available byAugust, 2013. In addition NITA has designed an E-Government Infrastructure Network to reach 1050 sitesaround the country, based on Fibre Optic, VSAT and ter-restrial networks, using wireless and other means for lastmile connectivity access. NITA is also deploying 8000 LANports in addition to existing 6500 LAN ports in the offices ofvarious MDAs and MMDAs. This is deployment which willcover 120 MDAs and MMDAs is expected to be completedin June 2013.

Another requirement of the IT Infrastructure is the pro-vision of a Public Key Infrastructure (PKI). A PKI is acomputerised form of message encryption using twokeys (small files); one is public and used by the senderto encrypt the message, the other is private and usedby the recipient to decrypt the message. This will en-sure that the tender submission and opening processon the eGP system are secured and transparent. NITAand the Ministry of Communication is implementing anational PKI project which will cover the establishmentof a Registration Authority and a Certificate Authority.Feasibility studies on this project will commence inMarch, 2013 and full implementation is expected byDecember, 2013.LEGALFRAMEWORK

A comprehensive legal framework is required for theestablishment of e-GP. This has largely been taken careof by the Electronic Transactions Act, 2008 Act 772.

More so the Public Procurement Act, 2003 Act 663, isalso being amended to include electronic tenderingwhich was previously not taken care of by the Act. Theamended Act is currently with the Minister of Finance foronward submission to Parliament.CAPACITYDEVELOPMENT

Service providers (Suppliers, Contractors, Consultants)and Procurement Officers are critical stakeholders in thewhole e-GP process, hence as part of the process to en-hance Ghana’s readiness, capacity building programmeshave been planned for the service providers to ensurethat they are ready to prepare and respond to tenderswhich will be launched on the e-GP platform.

Sensitisation and training of Service providers(Suppliers, Contractors, Consultants) as well Procure-ment Officers in MDAs, and MMDAs forms a major com-ponent of the implementation of the e-GP system.

This sensitisation exercise is expected to begin inMarch 2013, by Pricewaterhouse Coopers, the consult-ants to the project.CONCLUSION

Government has under the wider eGhana project hasdisplayed enormous commitment to the E-Governmentinitiatives, while PPA and the entities who are involved inthe pilot phase of the e-GP implementation are ensuringthat the pilot phase succeeds to inform a nationwiderollout. The engagement of a consultant to assist the PPAwith the implementation and the recent study tour to Indiaand Portugal has confirmed the commitment to learn andadopt best practices as far as the eGP is concerned.

Benefits of an e-GP system cannot be over-emphasised. Complimenting government’s efforts to en-sure good governance, the PPA is fully committed to seeto the implementation of this project and continues tocollaborate with all stakeholders to ensure its success.

IntroductionA nine (9) member delegation from various stakeholderentities on the establishment of eGovernment Procure-ment (eGP) project undertook a study tour of some in-stitutions in India and Portugal. The tour was organ-ised by PriceWaterHouse Coopers (PwC), consultants tothe project, with sponsorship from the World Bank. Thetour took place from January 12 - January 24 of 2013.

The tour was to enable members gain first-handknowledge and information on how eGP has been es-tablished in these countries. On return members areto use the experience and knowledge gained to makeinputs into the ongoing eGP establishment project inGhana, especially in area of E-GP relating to featuresof the system and business model(s).

Six institutions were visited, three in each country

In both countries the delegation was met on arrival byrepresentatives of PwC.

Mr. Amit Das, PwC India and Tiago Silva Abade withLuzia Pontes both of PwC Portugal accompanied thedelegation in visiting institutions in their respectivecountries.

The delegation also had welcome meetings and brief-ings by country managers of PwC in both countries.IndiaA welcome meeting was held at PwC Gurgaon officesin the morning. In attendance were the country man-ager of PwC India, and an eGovernance expert fromPwC

They briefed the delegation on developments of eGov-ernment initiatives in India and in particulareGoverment Procurement (eGP).

It was indicated that there has been a lot of changeson the electronic landscape in the last 10 years inIndia. Due to this the Indian government initiated aneGovernment plan in 2006 and identified eGP as oneof the key projects. Indian states then started imple-menting eGP at the state level, the state of Karna-taka being far advanced with the establishment ofeGP followed by the state of Andra Pradesh.The major aims of Indian Government establishingeGP are;

Transparency Efficiency in government procurementThe delegation also visited the Department of Infor-mation Technology of the Ministry of Communica-tions and Information Technology at New Delhi. Atthe department, the delegation was briefed by it Sen-ior Director in the person of Renu Budhiraja.

The director briefed them on various online servicesthe Indian government offers through different de-mands. Regarding implementation, she stated theremust be a proper implementation direction and gov-ernment buy-in. There must also be capacity buildingwithin the agencies.The government through her department has setstandards and architecture for e-governance applica-tions as well as guidelines to be adopted by eachstate. Based on these standards the department as part ofits responsibility has set up Certification Authoritiesto offer digital security services for eGovernment ap-plications and transactions. (http://cca.gov.in)

The director also added that the government is es-tablishing a national data center, after which it willmigrate all current satellite data centers to the na-tional data center.BangaloreThe delegation spent two days at Bangalore, the cap-ital of the Karnataka state.

At Bangalore the delegation was at the Centre for e-Governance for most of the period where it heldmeetings with various stakeholders. At the centrethe team was received by the head of the depart-ment.

He made a presentation of eGovernance initiativesin the State of Karnataka.

The goal of the eGovernance for the State is to Offer a Single Window for all services Anywhere anytime device services Ensure Total transparency and Faster decision makingIn all 19 projects has been undertaken by the Cen-tre. Applications developed under these projects cov-ered Government-to-Government, Government-to-Citizen, Government-to-Employees and Government-to-Business.After his presentation, Head of SeMT for the State,Mrs. Gunjan Krishna, made a presentation on theState’s eProcurement system. In her presentation,the following were noted;

The amend-ment made it compulsory for all government pro-curement entities to conduct all its procurement ac-tivities on the e-GP platform.Her presentation also addressed areas of security,scalability and overall benefits of the system sinceits implementation.During her presentation members of the delegationasked a number of questions covering such areas ascontract management, refunds, and other paymentsetc, for which she duly explained how the systemaddressed the issues raised.

There were presentations by two entities, whichwere instrumental in the development of the e-GPsystem for the State. These were Hewlett Packard(HP) and the Public Works Department (PWD).

HewlettPackard(HP)HP is the current private partners providing e-GPservices in the state of Kanartaka.

A Program Manager by name Guru Prasad madepresentation.

He explained the terms of HPs contract with theState in which HP provided the Hardware andSoftware for the E-GP system. The contract he ex-plained is a performance based contract, highlightsof which are;

The training covered submissionand evaluation of tenders by suppliers.PublicWorksDepartmentOne of the main stakeholders, PWD was involvedin the development of the e-GP system, since it isthe highest procuring entity in the state both interms of volume and value. He traced the involve-ment of PWD in the development of the eProcure-ment system. Being the biggest user of the system,they made input in design of forms, contract man-agement etcA presentation was made by a representative fromthe Public Works Department (PWD) of the Stateof Kanartaka, the biggest government departmentin the State.He indicated benefits of the system to the depart-ment as tabulated below

Hon. Samuel Sallas-Mensah thanked them for theirtime and the knowledge and experience shared withthe members of the Ghanaian delegation.

The delegation finally paid a courtesy call on thePrincipal Secretary to the Government in charge ofthe Department of eGovernance, in the person of I. S.N. Prasad to complete their stay at Bangalore. Heinteracted with the team, and reiterated the benefitsof eProcurement, and the implementation stagesadopted by the state. He added that it was importantfor government and political buy-in for a successfulimplementation.

Head of delegation, Hon. Samuel Sallas-Mensahthanked the Principal for the warm welcome re-ceived from members of his department. He addedGhana will very much learn from the example ofState of Kanartaka, and hopefully implement a pro-curement system akin to that of the State.HydrabadThe next stage of the tour took the delegation to Hy-drabad in the State of Andra Pradesh. Duration ofthe stay in Hydrabad was in the offices of the Infor-mation Technology and Communications Depart-ment of the Government of Andra Pradesh (GoAP).The Project Manager of eGP in the GoAP in the per-son of Vidyadhar Muthyala welcomed the team.

It then moved to Application Service Provider

The delegation returned to New Delhi late in theevening and departed for Portugal on Saturday Jan-uary 19 arriving in Portugal on Sunday January 20.PortugalThe delegation on the final stage of the tour visitedsome public institutions in Portugal.The delegation first met the PwC Portugal e-Government team at the PwC offices in Lisbon.

Presentation were made on the reforms of PublicProcurement in Portugal, highlights are as below; The National Public Procurement Agency is the

oversight body responsible for procurement. Procurement reforms started in 2007. There are 3800 public entities. Centralised procurement for common user

items.A legal officer and procurement specialist of PwCPortugal also gave a presentation on the legal re-forms and procurement procedures in Portugal.It was followed by a visit to the offices of eSPap for-merly known as the National Public ProcurementAgency.

Responsible for contracting Framework Agree-ments (eFramework).

Compulsory for all public entities to use eFrame-work

The eFramework covers all common user itemssuch as Cleaning Services, Vehicles, insurancefor all Government vehicles, Software, Hard-ware, Stationary, etc

Design and establish the framework for central-ised tender procedures

Aggregate demands with assistance from Minis-terial Purchasing Units (MPU) to reduce admin-istrative procedures

Manages and supervise IT and Infrastructureservices for the government

Manages call-off for entities Analysis public spending First generation Framework Agreement

in place which has 17 agreements covering ap-proximately 250 framework contracts.

Framework agreement averages 2 years, howev-er some agreements go as far as 4 years. (Forexample for IT, specifications of items can beupdated)

After the presentation members of the delegationinteracted and sought clarifications on issues relat-ing to framework agreements.

The delegation also visited the government’s datacenter at the agency. This data center host all gov-ernment data and applications.

Another institute visited by delegation was the Insti-

tute of Construction and Real Estate.

This institute is responsible for the management ofthe public contracts portal www.inci.pt

It assigns licenses to construction companies andreal estate agents. (Currently 60,000 constructioncompanies and 3,000 real estate agents)Proposes legislative bills and regulations (E-PublicContracts)

Observatory of all Public WorksA demonstration of the portal was given.

All 8 privately licensed eGP platforms are connect-ed to the portalThe last institution visited by the delegation wasSaphety, one of the eight privately licensed eGPplatform operators.

At Saphety the delegation was welcomed by itsChief of International Development – Joao Pereira.

An officer of Saphety gave a live demonstration ofhow the eGP system works for a government entityand a supplier. A dummy tender was created forwhich a supplier submitted its quotation. Closing,opening and evaluation process were also demon-strated.Some features of the system are;

many workflow processes, minimizes physical barri-ers such as space and time and allows more trans-parency and efficiency in information flow at rela-tively lower cost.Keeping in mind the fact that public procurement isflawed with perceptions of massive corruption, pro-active governments could invest in the adoption of e-GP which provides elements of traceability for auditsand therefore has the potential to reduce the oppor-tunities for corruptive, fraudulent, and collusivepractices as face-to-face contacts with public officersis largely reduced.

Good as the intentions of this initiative may be, ef-fective implementation of an e-GP project will callfor some essentials such as Political will to provideleadership, Change Management techniques to guidethe process and the need for Business Process Re-Engineering and the provision of the required ICTinfrastructure to make it a reality.

1) Given the inherent benefits that an e-GP systemaffords any country, the PPA through this e-publication would like to launch a campaign thatwill generate a national discourse on the possibleadoption of this system. Therefore contrary to theviews that it is as a mere technological add-on to analready laborious process, we believe that it ratherholds the potential to inject greater efficiency, ac-countability and transparency into Ghana’s publicprocurement processes.
