PARTICULAR VEHICLES805.010 Antique vehicles. (1) A vehicle

that is an antique vehicle may be registeredfor a permanent registration period as de-scribed under ORS 803.400 by doing the fol-lowing:

(a) Making application for permanentregistration of the vehicle in the mannerprovided for application for registration ofvehicles.

(b) Paying the fee for permanent regis-tration of antique vehicles under ORS803.420.

(2) Once a vehicle is permanently regis-tered as an antique vehicle under this sec-tion, the vehicle is subject to the limitationson use of the vehicle under ORS 805.030.[1983 c.338 §238; 2003 c.122 §3]

805.020 Special interest vehicles. (1) Avehicle that is a vehicle of special interestmay be registered for a permanent registra-tion period as described under ORS 803.400by doing the following:

(a) Making application for permanentregistration of the vehicle in the mannerprovided for application for registration ofvehicles.

(b) Paying the fee for permanent regis-tration of vehicles of special interest estab-lished under ORS 803.420.

(2) Once a vehicle is permanently regis-tered as a vehicle of special interest underthis section, the vehicle is subject to thelimitations on use of the vehicle under ORS805.030. [1983 c.338 §239; 2003 c.122 §4]

805.030 Violation of registration limitson antique or special interest vehicle;penalty. (1) A person commits the offense ofviolation of registration limits on antiquevehicle or vehicle of special interest if a ve-hicle is permanently registered under ORS805.010 or 805.020 and the person uses thevehicle:

(a) Other than for exhibitions, parades,club activities and similar uses; or

(b) Primarily for the transportation ofpersons or property.

(2) The offense described in this section,violation of registration limits on antiquevehicle or vehicle of special interest, is aClass D traffic violation. [1983 c.338 §240]

805.035 Racing activity vehicles. (1) Avehicle that is a racing activity vehicle maybe registered only under this section.

(2) A racing activity vehicle shall beregistered for a permanent registration pe-riod as described under ORS 803.400. To reg-ister a racing activity vehicle the ownershall:

(a) Apply for permanent registration ofthe vehicle in the same manner provided forapplication for registration of vehicles; and

(b) Pay the fee for permanent registrationof racing activity vehicles established underORS 803.420.

(3) A racing activity vehicle may be is-sued special interest registration plates.

(4) Once a vehicle is permanently regis-tered as a racing activity vehicle under thissection, the vehicle is subject to the limita-tions on use of the vehicle under ORS805.037. [2007 c.693 §3a]

805.037 Violation of registration limitson racing activity vehicles; penalty. (1) Aperson commits the offense of violation ofregistration limits on a racing activity vehi-cle if a vehicle is permanently registered un-der ORS 805.035 and the person uses thevehicle other than for:

(a) Exhibitions, parades or club activities;(b) Driving the vehicle from the person’s

home to a race track that is within a 90-mileradius of the person’s home; or

(c) Test driving the vehicle for mainte-nance or repair purposes within a 30-mileradius of where the vehicle is maintained orrepaired.

(2) The offense described in this section,violation of registration limits on a racingactivity vehicle, is a Class B traffic violation.[2007 c.693 §3b]

805.040 Registration of government-owned vehicles. Except as otherwise pro-vided by this section, ORS 805.045 and805.060, vehicles that are owned and oper-ated by this state, cities, counties or otherpolitical subdivisions of this state or by thegovernment of a federally recognized Indiantribe in this state are subject to the samerequirements and provisions for registrationas are other vehicles. For purposes of thissection, a vehicle that is operated under alease or lease-purchase agreement by any ofthe governments specified in this section isa government-owned vehicle. The followingrequirements and provisions apply togovernment-owned vehicles:

(1) The registration period for vehiclessubject to this section shall be an ownershipregistration period as described under ORS803.400 except that the registration shallcontinue to be valid if ownership of the ve-hicle is transferred to another governmentagency.

(2) The fee for registration of the vehiclesshall be the fee for registration ofgovernment-owned vehicles established underORS 803.420, and no other registration feeshall be required.

(3) Any vehicle registered under thissection and not exempted under ORS 815.300must meet the requirements for certificationof compliance with pollution control underORS 815.310.

(4) Vehicles described in this section thatare school buses or activity vehicles may beregistered as provided in ORS 805.050 in lieuof registration under this section, if the ve-hicles qualify for registration under ORS805.050.

(5) For purposes of this section, vehiclesowned by the government of a federally re-cognized Indian tribe in this state aregovernment-owned vehicles. [1983 c.338 §243; 1985c.16 §91; 1985 c.148 §1; 1985 c.547 §14; 1987 c.440 §5; 1993c.741 §123]

805.045 Registration for certain state-owned vehicles. (1) If approval is grantedunder ORS 283.390, the Department ofTransportation may issue:

(a) Registration plates or other evidenceof registration from any regular series ratherthan from any specially designed governmentseries for a vehicle owned or operated by anystate department or institution; or

(b) Wine country registration plates fora vehicle operated by a member of the Ore-gon Wine Board in discharging the board’sduties if requested to do so by the board.

(2) The registration period for a vehicledescribed under this section shall be thesame as the regular registration period forthe type of vehicle registered.

(3)(a) The fee for registration or renewalof a regular series registration plate for avehicle under subsection (1)(a) of this sectionis the fee established under ORS 803.420 forregistration or renewal of a state-owned ve-hicle registered under this section.

(b) The fee for registration or renewal ofa wine country registration plate for a vehi-cle under subsection (1)(b) of this section isthe fee established under ORS 803.420 forthat type of vehicle, and not for renewal ofa state-owned vehicle registered under thissection. Additionally, the applicant shall paythe surcharge described under ORS 805.266.

(4) Any vehicle registered under thissection and not exempted under ORS 815.300must meet the requirements for certificationof compliance with pollution control underORS 815.310. [1987 c.440 §2; 1993 c.741 §124; 2016c.124 §2; 2018 c.93 §3]

805.047 Regular registration forcounty-owned vehicles. (1) Upon request ofany county, the Department of Transporta-tion may issue registration plates or otherevidence of registration from any regular se-ries rather than from any specially designedgovernment series for a vehicle owned or

operated by the county. The registration pe-riod for a vehicle described under this sec-tion shall be the same as the regularregistration period for the type of vehicleregistered. The fee for registration or re-newal of registration of a vehicle under thissection shall be the fee established underORS 803.420 (6)(a).

(2) Any vehicle registered under thissection and not exempted under ORS 815.300must meet the requirements for certificationof compliance with pollution control underORS 815.310. [2015 c.540 §2; 2017 c.750 §39g]

805.050 School buses and school activ-ity vehicles; exceptions. (1) The Depart-ment of Transportation shall provide forregistration of vehicles that qualify underthis section in a manner that is consistentwith this section. A vehicle qualifies for reg-istration under this section if the vehiclemeets the following qualifications and is nota vehicle that is described under subsection(2) of this section:

(a) The vehicle must be a motor vehicle.(b) Except as provided under ORS

803.600, the vehicle must be used exclusivelyin transporting students to or from anyschool or authorized school activity or func-tion, including extracurricular activities, andto or from points designated by a school.

(c) The vehicle must meet the require-ments for school buses under ORS 820.100 to820.120, or activity vehicles under ORS820.110 and 820.120.

(d) The vehicle may be owned, operatedor leased by the state, a city or county orany other political subdivision or otherwiseprovided to such government body for pur-poses described in this subsection or may beprivately or otherwise owned and leased byor provided to a school for purposes de-scribed in this subsection.

(2) The following vehicles may not beregistered under this section:

(a) A vehicle subject to regulation underORS chapter 825.

(b) A vehicle regulated by a city underORS 221.420.

(3) Except as otherwise provided by thissection, vehicles registered under this sec-tion are subject to the same requirementsand provisions for registration as are othervehicles. The following requirements andprovisions are different from those otherwiseprovided for registration:

(a) The registration period for vehiclessubject to this section shall be an ownershipregistration period as described under ORS803.400, except that the registration contin-ues valid if the ownership of the vehicle istransferred to another who continues to use

the vehicle for purposes allowed under theregistration.

(b) The fee for registration of the vehi-cles shall be the fee for registration of schoolvehicles established under ORS 803.420, andno other registration fee shall be required.

(c) Any vehicle registered under thissection and not exempted under ORS 815.300shall meet the requirements for certificationof compliance with pollution control underORS 815.310.

(4) The department shall suspend or re-voke registration under this section if thedepartment determines that:

(a) A vehicle registered under this sec-tion is being used for purposes other thanthose required for qualification for registra-tion under this section, and a trip permit asprovided under ORS 803.600 has not beenobtained.

(b) The vehicle does not comply with re-quirements under ORS 820.100 to 820.120.[1985 c.547 §11; 1987 c.158 §164; 1993 c.741 §125]

805.060 Law enforcement undercovervehicles. (1) The Department of Transporta-tion may issue registration plates or otherevidence of registration from any regular se-ries rather than from any specially designedgovernment series for a vehicle operated bya federal, state, county, city or Indian triballaw enforcement, parole or probation agencyin discharging its undercover criminal inves-tigation duties if requested to do so by theagency. The registration period for a vehicledescribed under this section shall be thesame as the regular registration period forthe type of vehicle registered. The fee forregistration or renewal of registration of avehicle under this section shall be the feeestablished for registration or renewal of po-lice undercover vehicles under ORS 803.420.

(2) Any vehicle registered under thissection and not exempt from the require-ments to comply with certificates of compli-ance for pollution control equipment by ORS815.300, must be certified as complying withthe requirements for pollution control equip-ment under ORS 815.310. 805.080 Campers. Except where specificprovisions are made for campers, campersare subject to the same provisions of the ve-hicle code relating to registration, titling,transfer, sale and dealer regulation as anyother vehicle. [1983 c.338 §250]

805.090 Nonfarm tractors. (1) Exceptwhere specific provisions are made for trac-tors described in this section, such tractorsare subject to the same provisions of the ve-hicle code relating to registration, titling,

transfer, sale and dealer regulation as a mo-tor truck.

(2) This section applies to vehicles thatwould be farm tractors if used primarily inagricultural operations and that are notwithin:

(a) The exemptions from registration forfarm tractors under ORS 803.305; or

(b) The classification of fixed load vehi-cle. [1983 c.338 §251; 1985 c.16 §96]

805.092 Low-speed vehicles andmedium-speed electric vehicles; rules. (1)The Department of Transportation shalladopt, by rule, minimum safety standards forlow-speed vehicles and medium-speed electricvehicles.

(2) The department may not issue regis-tration to a low-speed vehicle or medium-speed electric vehicle if the department hasreason to believe the vehicle does not meetthe safety standards adopted pursuant to thissection. [2009 c.865 §14; 2010 c.30 §6]

PARTICULAR PERSONS805.100 Disabled veterans. (1) In the

absence of just cause for refusal, the De-partment of Transportation shall provide forregistration of any vehicle required to beregistered by this state in a manner consist-ent with this section for persons who qualifyas disabled veterans under this section. Thespecial registration provisions under thissection are subject to all of the following:

(a) The fee is the one-time registrationfee established by ORS 803.420 for vehiclesregistered under this section.

(b) The department may issue registra-tions for vehicles in a household under thissection in a number equal to the number ofpersons in the household who qualify as dis-abled veterans under subsection (2) of thissection.

(c) The department shall not register anycommercial vehicle under this section.

(2) A person is a disabled veteran whoqualifies for registration of a vehicle underthis section if the person:

(a) Is a disabled veteran whose disabilityresults from causes connected with servicein the Armed Forces of the United States;and

(b) Has been a member of and dischargedor released under honorable conditions fromthe Armed Forces of the United States, andwhose service was for not less than 90 con-secutive days or who was discharged or re-leased on account of a service-connectedinjury or illness prior to the completion ofthe minimum period of service.

(3) A person qualifies as a disabled vet-eran under subsection (2) of this section ifthe person presents a letter from the UnitedStates Department of Veterans Affairs or anybranch of the Armed Forces of the UnitedStates certifying that the person is a disabledveteran.

(4) Registration issued under this sectionis valid as provided in ORS 803.415. The reg-istration period for vehicles registered underthis section exempts the registration fromany requirement to be renewed or to makepayment of renewal fees. However, if anyowner would be required to comply with ORS815.310 upon issuance or renewal of regularregistration for the vehicle, the owner mustcomply with ORS 815.310 in the same man-ner as for other vehicles or the departmentmay suspend the registration of the vehicleuntil the owner submits proof of compliance.

(5) The department may suspend or re-voke any registration issued under this sec-tion if the department determines that thevehicle is owned by a person not qualified forregistration under this section or the vehicleis a kind not qualified for registration underthis section. 805.103 Congressional Medal of Honorrecipients; rules. (1) The Department ofTransportation shall provide for issuance ofregistration plates for a motor vehicle regis-tered under ORS 803.420 (6)(a), in a mannerconsistent with this section, to motor vehicleowners who qualify for the plates as Con-gressional Medal of Honor recipients undersubsection (2) this section.

(2) A person who is a CongressionalMedal of Honor recipient qualifies for regis-tration plates under this section if the personprovides the department with a certificatefrom the United States Department of Veter-ans Affairs attesting to the person’s statusas a Congressional Medal of Honor recipient.

(3) Registration plates issued under thissection shall be considered customized regis-tration plates for purposes of the fee requiredin ORS 805.250. The department may waivethe fee required in ORS 805.250.

(4) The department may not issue regis-tration plates for a motor vehicle under thissection if another motor vehicle owned bythe applicant has been issued registrationplates under this section.

(5) The registration plates issued underthis section shall:

(a) Be issued with a unique backgrounddesign determined by the department;

(b) Be issued with a specific configura-tion as determined by the department;

(c) Contain the words “Medal of Honor”;

(d) Contain the image of the Congres-sional Medal of Honor; and

(e) Meet the requirements for registra-tion plates under ORS 803.535.

(6) If there is a transfer of interest in themotor vehicle to which the registration plateunder this section is assigned, or if the motorvehicle is totaled and not reconstructed, themotor vehicle owner shall remove the regis-tration plate. The Congressional Medal ofHonor recipient may retain the registrationplate, but the registration plate may not beplaced on any other motor vehicle unless theregistration plate is transferred as set forthin subsection (7) of this section.

(7) If the motor vehicle owner qualifiesfor the registration plates under subsection(2) of this section, the department maytransfer registration plates issued under thissection to another motor vehicle registeredunder ORS 803.420 (6)(a), as set forth in ORS805.242.

(8) The department shall cancel any reg-istration plates issued under this section ifthe department determines that the motorvehicle is owned by a person who does notqualify for the registration plates under sub-section (2) of this section or that the motorvehicle is not registered under ORS 803.420(6)(a).

(9) The department may adopt rules nec-essary to carry out the provisions of thissection. [2007 c.311 §2; 2010 c.61 §4; 2017 c.750 §39h]

805.105 Veterans’ recognition plates;Gold Star Family plates; rules; sur-charge; disposition of moneys. (1) The De-partment of Transportation shall establish aveterans’ recognition registration plate pro-gram to issue registration plates called“veterans’ recognition registration plates”upon request to an owner of any motor vehi-cle registered under ORS 803.420 (6)(a) if theowner of the motor vehicle qualifies for theplates. Rules adopted under this section shallinclude, but need not be limited to, rulesthat:

(a) Describe general qualifications to bemet by any veterans’ group in order to beeligible for a veterans’ recognition registra-tion plate issued under this section.

(b) Specify circumstances under whichthe department may cease to issue veterans’recognition registration plates.

(c) Specify what constitutes proof of vet-eran status for issuance of a veterans’ re-cognition registration plate, if such proof isrequired by a veterans’ group or by the Di-rector of Veterans’ Affairs.

(d) Specify what constitutes proof that aperson is a surviving family member of aperson who was killed in action during an

armed conflict while serving in the ArmedForces of the United States. The departmentmay only issue a veterans’ recognition regis-tration plate displaying a gold star decal andthe words “Gold Star Family” to a personwho is a parent, sibling, spouse or dependentof a person who was killed in action duringan armed conflict while serving in the ArmedForces of the United States.

(2)(a) In addition to any other fee au-thorized by law, upon issuance of a veterans’recognition registration plate under this sec-tion and upon renewal of registration for avehicle that has plates issued under thissection, the department shall collect a sur-charge of $2.50 per plate for each year of theregistration period for the vehicle as de-scribed under ORS 803.415.

(b) Except as otherwise provided in para-graph (c) of this subsection, net proceeds ofthe surcharge collected by the departmentfor the veterans’ recognition registrationplate shall be deposited in the trust fund es-tablished under ORS 406.050 for paying theexpenses of operating the Oregon Veterans’Homes identified in ORS 408.362.

(c) If the department issues a veterans’recognition registration plate that names,describes or represents a veterans’ group,that veterans’ group may designate an ac-count into which the net proceeds of thesurcharge collected by the department underthis section are to be deposited. The depart-ment shall keep accurate records of thenumber of plates issued under this paragraphfor each veterans’ group and, after paymentof administrative expenses of the department,shall deposit moneys collected under thissubsection into the specified account.

(d) Deposits under this subsection shallbe made quarterly.

(3)(a) In consultation with the Depart-ment of Transportation, the Director ofVeterans’ Affairs shall design the veterans’recognition registration plate.

(b) If the department issues a veterans’recognition registration plate to recognize aveterans’ group, the department shall, inconsultation with the requesting veterans’group, add words or a military-related decalto the veterans’ recognition registrationplate that names, describes or represents theveterans’ group.

(c) The department shall add a gold stardecal and the words “Gold Star Family” toa veterans’ recognition registration platebackground to recognize surviving familymembers of persons killed in action duringan armed conflict while serving in the ArmedForces of the United States.

(d) Except as otherwise required by thedesign, veterans’ recognition registration

plates must comply with the requirements ofORS 803.535.

(4) The department shall determine howmany sets of veterans’ recognition registra-tion plates will be manufactured. If the de-partment does not sell or issue renewal for500 sets of veterans’ recognition registrationplates in any one year, the department shallcease production of veterans’ recognitionregistration plates. For the purposes of thissection, veterans’ recognition registrationplates that name, describe or represent aveterans’ group are included in the totalnumber of veterans’ recognition registrationplates issued.

(5) For the purposes of this section, “sib-ling” includes siblings of the whole or halfblood and siblings by adoption, marriage ordomestic partnership. [2007 c.564 §2; 2015 c.183 §1;2017 c.750 §39i; 2019 c.224 §9]

805.106 Funding for veterans’ recogni-tion plate costs. (1) The Director ofVeterans’ Affairs shall pay to the Depart-ment of Transportation all of thedepartment’s anticipated costs of issuance ofthe veterans’ recognition registration platefrom grants, donations and gifts accepted bythe Department of Veterans’ Affairs underORS 406.050 that may be expended for thepurpose of issuance of a veterans’ recogni-tion registration plate.

(2) If a veterans’ group requests issuanceof a veterans’ recognition registration plateunder ORS 805.105, the group shall pay tothe department all of the department’s antic-ipated costs of issuing a veterans’ recogni-tion registration plate that names, describesor represents the group. The department maynot begin creating or issuing the plates untilthe anticipated costs are paid. For purposesof this section, costs of issuing a veterans’recognition registration plate that names,describes or represents a veterans’ group in-clude, but are not limited to, computer pro-gramming costs and vendor set-up fees. 805.107 Disposition of certain platesissued to veterans. The surviving spouse ofa veteran who was issued registration platesunder ORS 805.105 may, upon the death ofthe veteran, continue to use the plates on amotor vehicle or may keep the plates as amemento. [Formerly 805.208]

805.110 Former prisoners of war. (1) Inthe absence of just cause for refusal, theDepartment of Transportation shall providefor registration of any motor vehicle requiredto be registered by this state in a manner

consistent with this section for persons whoqualify as former prisoners of war under thissection. The special registration provisionsunder this section are subject to all of thefollowing:

(a) The fee is the one-time registrationfee established under ORS 803.420 for vehi-cles registered under this section.

(b) The department may not register amotor vehicle under this section if anothervehicle owned by the applicant or a memberof the applicant’s household has been regis-tered under this section.

(c) The department may not register anycommercial vehicle under this section or anymotor vehicle with a loaded weight in excessof 10,000 pounds.

(2) A person is a former prisoner of warwho qualifies for registration of a vehicleunder this section if the person, while serv-ing in the active military, naval or air ser-vice of the United States or any of its Allies,was forcibly detained or interned in line ofduty:

(a) By an enemy government or itsagents, or a hostile force, during a period ofwar; or

(b) By a foreign government or its agents,or a hostile force during a period other thana period of war in which such person washeld under circumstances which the depart-ment finds to have been comparable to thecircumstances under which persons havegenerally been forcibly detained or internedby enemy governments during periods of war.

(3) The surviving spouse of a formerprisoner of war who was issued registrationunder this section may, upon the death of theformer prisoner of war, continue to use theregistration plates on a motor vehicle or maykeep the plates as a memento.

(4) The department may suspend or re-voke any registration issued under this sec-tion if the department determines that thevehicle is owned by a person not qualified forregistration under this section or the vehicleis a kind not qualified for registration underthis section. 805.115 Active members of OregonNational Guard. (1) In the absence of justcause for refusal, the Department of Trans-portation shall provide for registration in amanner consistent with this section for per-sons who qualify under this section as activemembers of the Oregon National Guard. Thespecial registration provisions under thissection are subject to the following:

(a) The fee to register or renew registra-tion under this section shall be the regularregistration fee for the vehicle.

(b) Any motor vehicle registered underORS 803.420 (6)(a) or (7)(c)(C) or (D) may beregistered under this section.

(2) A person is eligible for registrationunder this section if the person is issued acertificate by the Oregon Military Depart-ment certifying that the person is an activemember of the Oregon National Guard.

(3) The department may suspend, revokeor refuse to renew any registration issuedunder this section if the department deter-mines that the vehicle is owned by a personnot qualified for registration under this sec-tion or that the vehicle is not eligible forregistration under this section.

(4) The Oregon Military Departmentshall notify the Department of Transporta-tion within 30 days if a person issued a cer-tificate described in subsection (2) of thissection ceases to be an active member of theOregon National Guard. [1991 c.383 §2; 1993 c.741§129; 2001 c.293 §11; 2017 c.750 §39j]

805.117 Honorary consuls; rules. (1) Asused in this section, “honorary consul”means a resident of Oregon who has beenduly appointed by a foreign country as anhonorary consular officer to the UnitedStates, pursuant to the Vienna Conventionon Consular Relations.

(2) Upon application by an honorary con-sul who qualifies under this section, the De-partment of Transportation shall issueconsular corps registration plates for use onthe motor vehicle of the honorary consul.Registration plates issued under this sectionmay be displayed on the vehicle of the hon-orary consul in lieu of regular registrationplates issued under the vehicle code.

(3) The following apply to registrationplates issued under this section:

(a) The plates shall be considered cus-tomized plates for purposes of the fee in ORS805.250.

(b) The plates shall be assigned to a spe-cific vehicle.

(c) The plates may not be transferablefrom vehicle to vehicle, except as providedby the department by rule.

(d) The plates shall be valid for the termin which the person is acting in the officialcapacity of honorary consul for a foreignconsulate. If the term of honorary consulcontinues into a new registration period, thedepartment may provide for validation of theplates for the subsequent term by means ofa sticker or by any other means the depart-ment determines convenient.

(e) The person to whom the plates areissued may retain the plates after the officialterm of honorary consul is over, but theplates may not be valid if displayed on any

vehicle when the term of honorary consulhas ended and the person is no longer ap-pointed as an honorary consul.

(4) To qualify for consular corps regis-tration plates, the person must provide thedepartment with proof that the person is ap-pointed by a government as an honoraryconsul and is acting in that capacity.

(5) The department shall adopt rules nec-essary to carry out the purposes of this sec-tion. [2009 c.621 §2]

FLEETS805.120 Effect of fleet registration; re-

quirements; rules. (1) The owner of a fleetof vehicles may register the vehicles underthis section as a fleet in lieu of registeringthe vehicles individually.

(2) Except as otherwise provided underthis section, vehicles registered in a fleetunder this section are subject to the sametaxes, fees, qualifications, provisions, condi-tions, prohibitions and penalties applicable tosimilar vehicles otherwise registered underthe vehicle code.

(3) The following apply to fleets regis-tered under this section:

(a) The registered owner of the fleet mustmaintain the number of vehicles registeredin the fleet that the Department of Trans-portation determines by rule to be requiredfor participation in the fleet registrationprogram.

(b) Fleet registration or renewal of fleetregistration under this section may be an-nual or biennial registration as determinedby the department by rule.

(c) The registration of individual vehiclesin a fleet registered under this section doesnot expire as long as the fleet registration isvalid.

(d) The department shall assign identifi-cation to the fleet and, upon payment of ap-propriate fees, shall issue to the registeredowner of the fleet permanent fleet tags,stickers, plates or other identification thedepartment determines appropriate for thevehicles that the owner and the departmenthave agreed to place in the fleet. The de-partment may establish the use of any ap-propriate form of identification under thisparagraph as the department determinesconvenient for its own operation.

(e) The tags, stickers, plates or other ap-propriate identification issued under thissection shall be displayed on any vehicle towhich it has been assigned by the depart-ment.

(f) Registration cards issued by the de-partment for vehicles registered under thissection are only required to individually de-

scribe the vehicles in the fleet to the extentthe department determines necessary and toidentify the fleet in which the vehicles areregistered.

(g) Application for registration under thissection shall be in the manner determined bythe department by rule.

(h) The fleet owner shall maintain re-cords and provide information to the depart-ment as required by the department by ruleand shall allow the department to audit therecords of the owner and conduct inspectionsat any reasonable time to determine compli-ance with requirements for fleet registration.

(i) Vehicles shall be added to the fleetand transferred from the fleet according toprocedures established by the department byrule.

(j) The vehicles in the fleet shall bemarked in compliance with any requirementfor vehicle markings the department deter-mines necessary for identification of fleetvehicles.

(k) The department may adjust fee pay-ments and registration periods for individualvehicles added to a fleet registered underthis section as the department determinesnecessary for administration of the fleet reg-istration.

(L) The fees for a fleet registered underthis section are the same as the fees requiredif the vehicles in the fleet are individuallyregistered under the vehicle code.

(m) The department may charge a servicecharge for each vehicle entered into a fleetand a fleet vehicle renewal charge for eachvehicle in the fleet at the time of renewal.Fees described in this paragraph are estab-lished under ORS 803.420.

(n) The department may schedule thetime for payment of fleet registration fees inany manner convenient to the department orthe fleet owner.

(o) The fleet owner shall comply with anyrules the department establishes for the reg-istration of vehicles in fleets under this sec-tion.

(p) The department shall cancel any reg-istration under this section if the departmentdetermines that the owner of the vehiclesregistered is not complying with any re-quirements for fleet registration establishedunder this section or by the department.

(q) A fleet owner may certify compliancewith pollution control requirements underORS 815.310 in the manner provided underORS 815.310 for vehicles registered underthis section.

(r) The department shall establish proce-dures for the reporting of odometer disclo-sures for the vehicles in the fleet on a

regular basis and for vehicles that are with-drawn from the fleet, if odometer disclosuresare otherwise required. The reports shallprovide any information the department de-termines by rule to be necessary. The de-partment may establish any reporting timethe department considers convenient, butshall attempt to establish periods with a fre-quency roughly equivalent to those for re-newal of vehicle registration. Thedepartment shall retain the odometer infor-mation submitted under this section but neednot print it on certificates of title or regis-tration cards.

(4) A fleet owner may request that theregistration of all vehicles in the fleet expirein the same month. Notwithstanding ORS803.405 or any other provision of this section,if such a request is made the departmentshall:

(a) Adjust the registration expirationdate of all vehicles in the fleet.

(b) When a vehicle that is already regis-tered in this state is added to the fleet, ad-just the registration expiration date of thevehicle to correspond to that of other vehi-cles in the fleet.

(c) When a vehicle that has never beforebeen registered in this state is added to thefleet, assign a registration expiration date tothe vehicle that corresponds to that of othervehicles in the fleet.

(5) When the department adjusts or as-signs registration expiration dates in accor-dance with subsection (4) of this section, thedepartment shall prorate all registration feesto reflect the adjustment or assignment.

(6) The department shall adopt rules nec-essary for the administration of this section.The rules may include any rules that in-crease the convenience of administration orthe convenience of the registration processunder this section. 805.200 Plates and other devices withspecial designs; rules. (1) The Departmentof Transportation by rule:

(a) Shall design plates, stickers, plate andsticker combinations or other devices orindicia that distinguish government-ownedvehicles registered under the provisions ofORS 805.040 from other vehicles.

(b) May design plates, stickers, plate andsticker combinations or other devices orindicia for distinguishing vehicles registeredunder specific provisions of the Oregon Ve-hicle Code other than ORS 805.040, 805.105or 805.205. Plates designed under this para-graph shall comply with the requirements ofORS 803.535. The fees for plates or indiciadescribed in this paragraph are provided un-der ORS 805.250.

(2) Unless otherwise provided by statuteor by rule of the department, indicia of reg-istration that distinguish one kind of regis-tration from another may not be transferredunless the new owner of the vehicle qualifiesfor that specific kind of registration.

(3) The department may adopt rules con-cerning the disposition of plates, stickers,devices or other indicia of registration upontransfer of ownership of the vehicle or whenthe owner or the vehicle is no longer eligiblefor the particular indicia. The departmentmay cancel or revoke registration for failureto comply with rules adopted under this sec-tion. 805.205 Special plates for certaingroups; rules; surcharge; disposition ofmoneys. (1) Except as provided in subsection(7) of this section, the Department of Trans-portation shall provide for issuance of regis-tration plates described in this section fornonprofit groups meeting the qualificationsfor tax exempt status under section 501(c)(3)of the Internal Revenue Code and for insti-tutions of higher education. Plates issuedunder this section may be issued to ownersof motor vehicles registered under the pro-visions of ORS 803.420 (6)(a). Plates issuedunder this section may not contain ex-pressions of political opinion or religious be-lief. Rules adopted under this section shallinclude, but need not be limited to, rulesthat:

(a) Specify circumstances under whichthe department may cease to issue plates forany particular group.

(b) Require each group for which platesare issued to file an annual statement on aform designed by the department showingthat the group is a nonprofit group or is aninstitution of higher education and that thegroup or institution otherwise meets thequalifications imposed for eligibility forplates issued under this section. The state-ment shall include names and addresses ofcurrent directors or officers of the group orinstitution or of other persons authorized to

speak for the group or institution on mattersaffecting plates issued under this section.

(2)(a) Except as otherwise provided inparagraphs (b) and (c) of this subsection, inaddition to any other fee authorized by law,upon issuance of a plate under this sectionand upon renewal of registration for a vehi-cle that has plates issued under this section,the department shall collect a surcharge foreach year of the registration period. Thesurcharge shall be determined by the depart-ment by rule and may not be less than $2.50per plate or more than $16 per plate. In set-ting the amount of the surcharge, the de-partment shall consult with the nonprofitgroup for which the plates are issued.

(b) In addition to any other fee author-ized by law, upon issuance of a plate underthis section that recognizes an institution ofhigher education in this state, and upon re-newal of registration for a vehicle that hassuch plates, the department shall collect asurcharge of $8 per plate for each year of theregistration period.

(c) In addition to any other fee author-ized by law, upon issuance of a Share theRoad registration plate the department shallcollect a surcharge of $5 per year of regis-tration.

(3) Plates issued under this section shallbe from the current regular issue of platesexcept that:

(a) If the group requesting the plates isan institution of higher education, the platesshall, upon request, contain words that indi-cate the plates are issued to recognize theinstitution or shall contain the institution’slogo or an image of the institution’s mascot;or

(b) If the group requesting the plates isa group that recognizes fallen public safetyofficers, the plates shall, upon request, con-tain a decal that indicates the plates are is-sued to recognize fallen public safety officers.

(4) Except as otherwise required by thedesign chosen, the plates shall comply withthe requirements of ORS 803.535. The de-partment shall determine how many sets ofplates shall be manufactured for each groupapproved under this section. If the depart-ment does not sell or issue renewal for 500sets of plates for a particular group in anyone year, the department shall cease produc-tion of those plates.

(5) Except as otherwise provided in sub-section (6) of this section, each group that isfound by the department to be eligible forplates issued under this section may desig-nate an account into which the net proceedsof the surcharge collected by the departmentunder subsection (2) of this section are to be

deposited. The department shall keep accu-rate records of the number of plates issuedfor each group that qualifies. After paymentof administrative expenses of the department,moneys collected under this section for eachgroup shall be deposited by the departmentinto an account specified by that group. Ifany group does not specify an account forthe moneys collected from the sale of platesissued under this section, the departmentshall deposit moneys collected for thoseplates into the Passenger Rail TransportationAccount established under ORS 802.100 to beused as other moneys in the account areused. Deposits under this subsection shall bemade at least quarterly.

(6)(a) Each institution of higher educa-tion that requests a plate under this sectionshall designate an account in the generalfund of the institution, and the proceeds inthe account shall be used for the purpose ofacademic enrichment at the institution.

(b) Net proceeds of the surcharge col-lected by the department for Share the Roadregistration plates shall be deposited intotwo accounts designated by The Street TrustCommunity Fund and Cycle Oregon. The de-partment shall evenly distribute the net pro-ceeds to each account. Deposits under thisparagraph shall be made at least quarterly.At any time that the department determinesthat the accounts designated by The StreetTrust Community Fund and Cycle Oregoncease to exist, the department may depositthe proceeds into the Passenger Rail Trans-portation Account established under ORS802.100.

(c) Net proceeds of the surcharge col-lected by the department for Keep Kids Saferegistration plates shall be deposited into anaccount designated by the Children’s TrustFund of Oregon Foundation to fund strate-gies and approaches shown to prevent or re-duce child abuse. Deposits made under thisparagraph shall be made at least quarterly.At any time that the department determinesthat the account designated by the Children’sTrust Fund of Oregon Foundation ceases toexist, the department shall deposit the pro-ceeds into the Keep Kids Safe RegistrationPlate Account established in ORS 805.207.At the beginning of each biennium, the EarlyLearning Council shall evenly distribute themoneys in the Keep Kids Safe RegistrationPlate Account to the counties in this state,until each county receives $1,000. After eachcounty has received $1,000, the council shalldistribute any remaining moneys to eachcounty in an amount equal to the percentageof Keep Kids Safe registration plates sold inthat county. Each county shall use the mon-eys received under this paragraph solely forthe purpose of funding strategies and ap-

proaches shown to prevent or reduce childabuse.

(7) The department may not accept appli-cations to create new group registrationplates on or after August 12, 2015. 805.207 Keep Kids Safe RegistrationPlate Account. The Keep Kids Safe Regis-tration Plate Account is established withinthe Early Learning Division Fund. All mon-eys received by the Early Learning Councilfrom the sale of Keep Kids Safe registrationplates shall be deposited into the accountand are continuously appropriated to thecouncil to be distributed to counties as pro-vided in ORS 805.205. 805.210 Special interest vehicle plates.(1) The owner of a vehicle of special interestmay apply to the Department of Transporta-tion for permission to use special interestregistration plates. To receive permission touse special interest registration plates theperson must:

(a) Maintain the vehicle of special inter-est as a collectors’ item and use the vehicleonly for exhibitions, parades, club activitiesand similar uses but not use the vehicle pri-marily for the transportation of persons orproperty;

(b) Supply the special interest registra-tion plates which the person desires to use;and

(c) Include the plates with the applica-tion for permission to use them.

(2) The department, prior to approval ofan application under this section, shall de-termine that the special interest registrationplates meet the following requirements:

(a) The plates shall be issued by the Stateof Oregon for use on vehicles in this state.

(b) The numbers and characters on theplate shall be distinctive.

(c) The plates shall be legible, durableand otherwise of a size, shape, color and de-sign that will serve the purposes of safetyand identification.

(d) If the plates are from a series ofplates in current use, the plates shall be

from the same year or period of issue inwhich the vehicle was manufactured.

(3) If the special interest registrationplate offered for approval was issued in ayear in which single registration plates onlywere required, the department shall grantpermission for use of that registration platealone if it is otherwise acceptable.

(4) If the special interest registrationplates offered for approval are from a seriesof plates in current use, as described in sub-section (2)(d) of this section, the departmentmay affix a distinctive sticker to each plateat the time of approval. Stickers shall be ofa size, color and design determined by thedepartment and shall be displayed on platesin the manner determined by the department.

(5) The department may approve platesissued by the state that have been restoredto their original color and design providedthat if the plate was reflectorized when ori-ginally issued, it must be fully reflectorizedwhen restored. 805.220 Elected official plates; quali-fications; fee; rules. (1) Upon applicationby an elected official who qualifies underthis section, the Department of Transporta-tion shall issue registration plates describedunder this section to the official for use onthe motor vehicle of the person. Registrationplates issued under this section may be dis-played on the vehicle of the person in lieuof regular registration plates issued underthe vehicle code.

(2) The following apply to registrationplates issued under this section:

(a) The plates shall be considered cus-tomized plates for purposes of the fee in ORS805.250.

(b) The plates shall be assigned to a spe-cific vehicle.

(c) The plates shall be issued in additionto regular registration plates issued for avehicle at the option of the applicant.

(d) The plates shall not be transferablefrom vehicle to vehicle except as provided bythe department by rule.

(e) The plates shall be valid for the termof office of the qualifying official. If the per-son is elected to a subsequent term of office,the department may provide for validation ofthe plate for the subsequent term by meansof a sticker or by any other means the de-partment determines convenient.

(f) The person to whom the plates are is-sued may retain the plates after the person’sterm of office, but the plates shall not bevalid if displayed on any vehicle while theperson is not holding the office for which theplates were issued.

(3) Only the following elected officialsqualify for issuance of registration platesunder this section:

(a) The Secretary of State.(b) The State Treasurer.(c) Members of the Oregon Legislative

Assembly.(d) Members of the Oregon Congressional

Delegation.(4) Nothing in this section applies to or

affects the authority of the department to is-sue distinctive registration plates on vehiclesowned by this state that are provided for useof the Governor.

(5) The department shall adopt rules nec-essary to carry out the purposes of this sec-tion. [1985 c.16 §105; 1993 c.741 §131]

805.222 Special registration program;rules. (1) The Department of Transportationshall establish a special registration programand provide for issuance of special registra-tion plates for nonprofit groups meeting thequalifications for tax exempt status undersection 501(c)(3) of the Internal RevenueCode, for institutions of higher education andfor public bodies, as defined in ORS 174.109.

(2) Plates issued under this section maybe issued to owners of motor vehicles regis-tered under the provisions of ORS 803.420(6)(a). In addition, the department may adoptrules for issuance of special registrationplates issued pursuant to this section for ve-hicles not registered under ORS 803.420(6)(a).

(3) Plates issued under this section maynot contain expressions of political opinionor religious belief.

(4) Rules adopted under this section shallinclude, but need not be limited to, rulesthat:

(a) Describe general qualifications to bemet by any nonprofit group, institution ofhigher education or public body in order tobe eligible for plates issued under this sec-tion.

(b) Specify circumstances under whichthe department may cease to issue platesunder this section.

(c) Require each nonprofit group, institu-tion of higher education or public body forwhich plates are issued to file an annualstatement on a form designed by the depart-ment showing that the group is a nonprofitgroup, institution of higher education orpublic body and that the nonprofit group, in-stitution of higher education or public bodyotherwise meets the qualifications imposedfor eligibility for plates issued under thissection. The statement shall include namesand addresses of current directors or officers

of the nonprofit group, institution of highereducation or public body or of other personsauthorized to speak for the nonprofit group,institution of higher education or public bodyon matters affecting plates issued under thissection.

(d) Specify the manner in which a non-profit group, institution of higher educationor public body may apply for a special regis-tration plate.

(5) In addition to any other fee author-ized by law, for each set of special registra-tion plates issued pursuant to this section,the department shall collect a surcharge of$40 payable when the plates are issued andupon each subsequent renewal of registrationof a vehicle bearing the plates. The depart-ment shall distribute the moneys from thesurcharge as provided in subsection (8) ofthis section.

(6) The department, in consultation withthe nonprofit group, institution of higher ed-ucation or public body requesting the specialregistration plate, shall develop a unique de-sign for each plate issued under this section.Any design must comply with requirementsdescribed under ORS 803.535.

(7) The department shall determine howmany sets of plates shall be manufactured foreach plate approved under this section. Ifthe department does not issue 2,000 sets ofplates for a particular nonprofit group, insti-tution of higher education or public body inany one year, the department shall ceaseproduction of those plates.

(8) Each nonprofit group, institution ofhigher education or public body that is foundby the department to be eligible for platesissued under this section may designate anaccount into which the net proceeds of thesurcharge collected by the department undersubsection (5) of this section are to be de-posited. The department shall keep accuraterecords of the number of plates issued foreach nonprofit group, institution of highereducation or public body that qualifies. Afterpayment of administrative expenses of thedepartment, moneys collected under this sec-tion for a nonprofit group, institution ofhigher education or public body shall be de-posited by the department into an accountspecified by that nonprofit group, institutionof higher education or public body. If anynonprofit group, institution of higher educa-tion or public body does not specify an ac-count for the moneys collected from the saleof plates issued under this section, the de-partment shall deposit moneys collected forthose plates into the Passenger Rail Trans-portation Account established under ORS802.100 to be used as other moneys in theaccount are used. Deposits under this sub-

805.225 Special registration plate;qualifications; application; fee; rules. (1)A nonprofit group, institution of higher edu-cation or public body, as defined in ORS174.109, that requests issuance of a specialregistration plate under ORS 805.222 shall:

(a) Submit an application, in the mannerprescribed by the Department of Transporta-tion by rule.

(b) Pay to the department the anticipatedcosts of adding the plate to the special reg-istration plate program, as determined by thedepartment. The department shall refund anyamount of the payment that is not needed topay the costs of adding the plate to the pro-gram.

(c) Collect and hold prepaid vouchers fornew special registration plates, until it hasreceived at least 3,000 vouchers along withrequired fees. Once a participating nonprofitgroup, institution of higher education orpublic body has received at least 3,000vouchers, it shall submit the vouchers, alongwith the required fees, to the department.

(2) The department shall begin designing,producing and issuing the plates after thenonprofit group, institution of higher educa-tion or public body submits the following:

(a) The application;(b) Payment for the anticipated costs of

adding the plate as determined under sub-section (1) of this section; and

(c) Three thousand prepaid vouchersalong with required fees.

(3) For purposes of this section, costs ofadding a new special registration plate in-clude, but are not limited to, computer pro-gramming costs and vendor set-up fees.

(4) The department shall adopt rules forthe administration and implementation of thespecial registration plate program. [2015 c.806§13]

805.230 Amateur radio operatorplates; fee. (1) A motor vehicle owner whois a resident of this state and who holds avalid, unrevoked and unexpired official ama-teur radio station license issued by the Fed-eral Communications Commission may obtainfrom the Department of Transportation spe-cial registration plates designed by the de-partment for use on the vehicle in lieu of theregularly issued registration plates for thevehicle. To obtain special registration platesdescribed under this section, a person mustsubmit to the department the fee establishedunder ORS 805.250 for issuance of the specialregistration plates.

(2) Upon the revocation or expiration ofthe radio license, the person must return the

plates issued under this section to the de-partment and receive in lieu thereof regularregistration plates. [1983 c.338 §265; 1985 c.16 §106;1993 c.741 §132]

805.240 Customized plates; fee. TheDepartment of Transportation is authorizedto issue customized registration plates uponthe request of vehicle owners. Such registra-tion plates shall meet the requirements forregistration plates described in ORS 803.535.The fee for issuance of the customized platesis as provided under ORS 805.250. [1983 c.338§266; 1993 c.741 §133]

805.242 Transfer of plates that are notfrom current issue; fee. NotwithstandingORS 803.530, the Department of Transporta-tion shall approve a request to transfer reg-istration plates that are not from a currentissue of plates if the owner of the platessubmits an application for transfer alongwith the plate transfer fee and the fee for acustomized registration plate established inORS 805.250, in addition to any requiredregistration fee. Upon transfer of the plates,the plates shall for all purposes be consid-ered customized registration plates issued asprovided in ORS 805.240. [1993 c.741 §116a; 2018c.114 §15]

805.250 Fees for special plates. Thissection establishes fees for issuance of regis-tration plates authorized under ORS 805.200.If a fee for plates authorized in ORS 805.200is not established in this section, the fee isthe same fee as established under ORS803.570. Where a fee is established under thissection, the fee is in addition to the fee es-tablished under ORS 803.570 unless other-wise provided in the following:

(1) Amateur radio operator registrationplates issued under ORS 805.230, $5.

(2) Customized registration plates issuedunder ORS 805.240:

(a) For original issuance or renewal, $50annual fee.

(b) For issuance of a duplicate or re-placement plate, $5 when the plate is issuedat the time of renewal of registration or $10when the plate is issued at any other time.

(3) Special interest registration platesapproved under ORS 805.210 are approvedwithout cost except as provided in this sub-section, including without payment of the feeestablished under ORS 803.570. If identifyingstickers are required, $1 per sticker or pairof stickers.

(4) Dealer plates issued under ORS822.020 and 822.040 are as follows:

(a) For the original dealer plate, no feeexcept the fee established under ORS 803.570.

(b) For replacement dealer plates, $10 foreach plate except that persons dealing exclu-

(c) For additional plates, or for renewalof registration, $42, except that personsdealing exclusively in motorcycles, mopedsor snowmobiles or any combination of thosevehicles shall pay only $9 for each additionalplate, or for renewal of registration.

(5) Special vehicle transporter plates ordevices issued under ORS 822.310, $5 foreach plate or device. (Salmon Registration Plate)805.255 Salmon registration plate;

rules; fees. (1) The Department of Transpor-tation shall establish a salmon registrationplate program to issue special registrationplates called “salmon registration plates”upon request to owners of motor vehiclesregistered under the provisions of ORS803.420 (6)(a) to observe the importance ofsalmonid to Oregon. In addition, the depart-ment may adopt rules for issuance of salmonregistration plates for vehicles not registeredunder the provisions of ORS 803.420 (6)(a).

(2) In addition to any other fee author-ized by law, for each salmon registrationplate issued under subsection (1) of this sec-tion, the department shall collect a sur-charge of $7.50 for each year of theregistration period, payable when the plateis issued and upon each subsequent renewalof registration of a vehicle bearing the plate.The department shall distribute the sur-charge as provided in ORS 805.256. 805.256 Disposition of moneys fromsalmon registration plate surcharge. (1)After deduction of the cost of administrationof the salmon registration plate program,moneys from the surcharge imposed by ORS805.255 shall be transferred and appropriatedas follows:

(a) Half of the moneys shall be trans-ferred to the Watershed Conservation GrantFund and used only for funding projects un-der ORS 541.956 to:

(A) Protect or restore native salmonhabitat; or

(B) Restore natural watershed orecosystem functions by removing artificialobstructions to native salmon migration.

(b) Half of the moneys shall be trans-ferred to the State Parks and RecreationDepartment Fund established under ORS

390.134 and continuously appropriated for thepurposes described in ORS 390.134 (4).

(2) As used in this section, “the cost ofadministration of the salmon registrationplate program” is the sum of all Departmentof Transportation expenses for the issuanceor transfer of salmon registration plates un-der ORS 805.255 that are above the normalcosts of issuing, renewing and transferringregistration plates in the normal course ofthe business of the department. These ex-penses include, but are not limited to, thecosts of collecting the salmon registrationplate surcharge and transferring salmon reg-istration plates. (Cultural Registration Plate)805.260 Cultural registration plates;

rules; fees. (1) The Department of Transpor-tation shall establish a cultural registrationplate program to issue special registrationplates called “cultural registration plates”upon request to owners of motor vehiclesregistered under the provisions of ORS803.420 (6)(a) to observe the importance ofculture to Oregon. In addition, the depart-ment may adopt rules for issuance of culturalregistration plates for vehicles not registeredunder the provisions of ORS 803.420 (6)(a).

(2) In addition to any other fee author-ized by law, for each cultural registrationplate issued under subsection (1) of this sec-tion, the department shall collect a sur-charge of $15 payable when the plate isissued and upon each subsequent renewal ofregistration of a vehicle bearing the plate.The department shall distribute the sur-charge as provided in ORS 805.261.

(3) The department, in consultation withthe Trust for Cultural Development Board,shall design the cultural registration plates.The plates shall meet the requirements forregistration plates described in ORS 803.535.[2001 c.954 §21; 2003 c.409 §7; 2017 c.750 §39n]

805.261 Disposition of moneys fromcultural registration plate surcharge. (1)After deduction of the cost of administrationof the cultural registration plate program,moneys from the surcharge imposed by ORS805.260 shall be transferred to the Trust forCultural Development Account establishedunder ORS 359.405.

(2) As used in this section, “the cost ofadministration of the cultural registrationplate program” is the sum of all Departmentof Transportation expenses for the issuanceor transfer of cultural registration plates un-der ORS 805.260 that are above the normalcosts of issuing, renewing and transferringregistration plates in the normal course ofthe business of the department. These ex-penses include, but are not limited to, the

(Crater Lake National Park Registration Plate)

805.263 Crater Lake National Parkregistration plate; rules; fees. (1) The De-partment of Transportation shall establish aCrater Lake National Park registration plateprogram to issue special registration platescalled “Crater Lake National Park registra-tion plates” upon request to owners of motorvehicles registered under the provisions ofORS 803.420 (6)(a) to commemorate the 100thanniversary of Crater Lake National Park.The department may adopt rules for issuanceof Crater Lake National Park registrationplates for vehicles that are not registeredunder the provisions of ORS 803.420 (6)(a).

(2) In addition to any other fee author-ized by law, for each Crater Lake NationalPark registration plate issued under subsec-tion (1) of this section, the department shallcollect a surcharge of $15 payable when theplate is issued. The department shall distrib-ute the surcharge as provided in ORS805.264. [2001 c.824 §1; 2003 c.409 §6; 2017 c.87 §1; 2017c.750 §39o]

805.264 Disposition of moneys fromCrater Lake National Park registrationplate surcharge. (1) After deduction of thecost of administration of the Crater LakeNational Park registration plate program,the Department of Transportation shalltransfer moneys from the surcharge imposedby ORS 805.263 to the Oregon CommunityFoundation for use on Crater Lake NationalPark projects.

(2) As used in this section, “the cost ofadministration of the Crater Lake NationalPark registration plate program” is the sumof all Department of Transportation expensesfor the issuance or transfer of Crater LakeNational Park registration plates under ORS805.263 that are above the normal costs ofissuing, renewing and transferring registra-tion plates in the normal course of businessin the department. These expenses include,but are not limited to, the costs of collectingthe Crater Lake National Park registrationplate surcharge and transferring Crater LakeNational Park registration plates. (Wine Country Registration Plate)805.266 Wine country registration

plate; fee. (1) The Department of Transpor-tation shall establish a wine country regis-tration plate program to issue specialregistration plates called “wine country reg-istration plates” upon request to owners ofmotor vehicles registered under the pro-visions of ORS 803.420 (6)(a).

(2) In addition to any other fee author-ized by law, for each set of wine countryregistration plates issued under subsection(1) of this section, the department shall col-lect a surcharge of $30 payable when theplates are issued and upon each subsequentrenewal of registration of a vehicle bearingthe plates. The department shall transfer themoneys from the surcharge as provided inORS 805.272. [2011 c.709 §2; 2015 c.138 §24; 2017 c.750§39p]

805.268 Wine country registrationplate design. (1) The Department of Trans-portation, in consultation with the OregonTourism Commission and Travel Salem, shalldesign the wine country registration platesissued under ORS 805.266.

(2) Except as otherwise required by sub-section (1) of this section, wine country reg-istration plates shall comply with therequirements of ORS 803.535. [2011 c.709 §5]

805.272 Disposition of moneys fromwine country registration plate sur-charge. (1) After the deduction of the costof administration of the wine country regis-tration plate program, the Department ofTransportation shall deposit the net proceedsof the surcharge collected by the departmentunder ORS 805.266 into the account of theOregon Tourism Commission established un-der ORS 284.131. The department shall makedeposits under this subsection at least quar-terly.

(2) Moneys deposited under subsection (1)of this section are continuously appropriatedto the Oregon Tourism Commission for thepurposes set forth in ORS 284.131.

(3) As used in this section, “the cost ofadministration of the wine country registra-tion plate program” means the sum of alldepartment expenses for the issuance ortransfer of wine country registration platesunder ORS 805.266 that are above the normalcosts of issuing, renewing and transferringregistration plates in the normal course ofthe business of the department. These ex-penses include, but are not limited to, thecosts of collecting the wine country registra-tion plate surcharge and transferring winecountry registration plates. [2011 c.709 §4]

805.274 Distribution of moneys; rules.(1) After payment of the cost of productionof the wine country registration plates in-cluding administrative expenses relating tomarketing the wine country registrationplates issued under ORS 805.266, the OregonTourism Commission shall distribute themoneys received from the Department ofTransportation pursuant to ORS 805.272 asfollows:

(a) One half of the moneys shall be dis-tributed as matching grants. The commissionshall develop a matching grant program andshall award grants to tourism promotionagencies for tourism promotion of wine andculinary tourism. The commission shall es-tablish the maximum grant amount in theapplicant guidelines prepared for the match-ing grant program in each biennium. Nomore than 50 percent of the total cost of aproject may be paid for with moneys fromthe program. An applicant must show a min-imum one-to-one match from private or pub-lic sources other than Oregon BusinessDevelopment Department or commission pro-grams. The applicant must also show a cashmatch of at least 50 percent of the amountrequested under the matching grant program.

(b) One half of the moneys shall be dis-tributed to tourism promotion agencies forthe purpose of wine and culinary tourismpromotion. The commission shall distributethe moneys in proportion to the amount ofacreage in each region used for wine grapeproduction. The commission shall designatea tourism promotion agency for each region.The regions shall include the mid-WillametteValley region and each other major wineproducing region of the state as determinedby the commission. The commission shall re-quire, by rule, tourism promotion agencies tocollaborate with the Oregon Wine Board andrelevant regional wine industry associationsdesignated by the commission whenever thetourism promotion agencies develop expendi-ture plans for moneys distributed by thecommission under this section.

(2) The commission annually shall submita report on the moneys distributed under thissection to the Legislative Assembly in themanner provided in ORS 192.245 on or beforeOctober 1.

(3) The commission shall adopt rules tocarry out this section.

(4) As used in this section:(a) “Mid-Willamette Valley region”

means Marion, Polk and Yamhill Counties.(b) “Tourism promotion” has the meaning

given that term in ORS 320.300.(c) “Tourism promotion agency” has the

meaning given that term in ORS 320.300.[2011 c.709 §6; 2016 c.124 §1]

(Portland Trail Blazers Registration Plate)

805.278 Portland Trail Blazers regis-tration plate; rules; fee. (1) The Depart-ment of Transportation shall establish aPortland Trail Blazers registration plate pro-gram to issue special registration plates tosupport charitable initiatives through theTrail Blazers Foundation established by thePortland Trail Blazers. The special registra-tion plates shall be issued upon request toowners of motor vehicles registered underORS 803.420 (6)(a). In addition, the depart-ment may adopt rules for issuance of Port-land Trail Blazers registration plates forvehicles not registered under ORS 803.420(6)(a).

(2) In addition to any other fee author-ized by law, for each set of Portland TrailBlazers registration plates issued under sub-section (1) of this section, the departmentshall collect a surcharge of $40 payable whenthe plates are issued and upon each subse-quent renewal of registration of a vehiclebearing the plates. The department shall dis-tribute the moneys from the surcharge asprovided in ORS 805.279.

(3) Notwithstanding ORS 803.530, Port-land Trail Blazers registration plates may betransferred from vehicle to vehicle if the de-partment stops issuing the plates, as long asthe plates are legible and capable of beingused for identification purposes.

(4) The Portland Trail Blazers registra-tion plate must include the name or logo ofthe Portland Trail Blazers basketball team.The department shall design the plate inconsultation with the Portland Trail Blazers.The final design of the plate is subject toapproval by the Portland Trail Blazers. Thedepartment may enter into agreements nec-essary for the use of the logo, name, marksor slogans associated with the Portland TrailBlazers or the National Basketball Associ-ation.

(5) Except as otherwise required by thedesign approved by the department, PortlandTrail Blazers registration plates must complywith the requirements of ORS 803.535. [2015c.806 §2; 2017 c.750 §39q; 2018 c.114 §12]

805.279 Disposition of moneys fromPortland Trail Blazers registration platesurcharge. (1) Moneys from the surchargeimposed by ORS 805.278 must be transferredto the Trail Blazers Foundation establishedby the Portland Trail Blazers after deductionof the cost of administration of the PortlandTrail Blazers registration plate program, in-cluding but not limited to the costs of col-lecting the Portland Trail Blazersregistration plate surcharge and transferring

Portland Trail Blazers registration platesthat are above the normal costs of issuing,renewing and transferring registration platesin the normal course of business of the De-partment of Transportation. Any royaltiesdue to the National Basketball Associationare the responsibility of the Portland TrailBlazers.

(2) The Trail Blazers Foundation shalluse the surcharge proceeds received underthis section to issue grants for youth-relatedprograms and initiatives.

(3) Each year, the Trail Blazers Founda-tion shall report to a committee or interimcommittee of the Legislative Assembly re-lated to transportation. The report must pro-vide information about the grants awardedwith the funds from the surcharge. [2015 c.806§3]

(Breast Cancer Awareness Registration Plate)

805.283 Breast cancer awareness reg-istration plate; rules; fee. (1) The Depart-ment of Transportation shall establish abreast cancer awareness registration plateprogram to issue special registration platescalled “breast cancer awareness registrationplates” upon request to owners of motor ve-hicles registered under ORS 803.420 (6)(a). Inaddition, the department may adopt rules forissuance of breast cancer awareness regis-tration plates for vehicles not registered un-der ORS 803.420 (6)(a).

(2) In addition to any other fee author-ized by law, for each set of breast cancerawareness registration plates issued undersubsection (1) of this section, the departmentshall collect a surcharge of $40 payable whenthe plates are issued and upon each subse-quent renewal of registration of a vehiclebearing the plates. The department shall dis-tribute the surcharge as provided in ORS805.285.

(3) Notwithstanding ORS 803.530, breastcancer awareness registration plates may betransferred from vehicle to vehicle if the de-partment stops issuing the plates, as long asthe plates are legible and capable of beingused for identification purposes. [2015 c.806 §6;2017 c.750 §39r; 2018 c.114 §13]

805.285 Disposition of moneys frombreast cancer awareness registrationplate surcharge. (1) Moneys from the sur-charge imposed by ORS 805.283 must betransferred to the Oregon Health AuthorityFund established by ORS 413.101 after de-duction of the cost of administration of thebreast cancer awareness registration plateprogram, including but not limited to thecosts of collecting the breast cancer aware-ness registration plate surcharge and trans-ferring breast cancer awareness registration

plates that are above the normal costs of is-suing, renewing and transferring registrationplates in the normal course of business of theDepartment of Transportation.

(2) Moneys deposited under subsection (1)of this section are continuously appropriatedto the Oregon Health Authority for activitiesunder ORS 414.534 related to early detectionof breast and cervical cancers as part of theOregon Breast and Cervical Cancer Program.[2015 c.806 §7]

(Pacific Wonderland Registration Plate)805.287 Pacific Wonderland registra-

tion plate; rules; fee. (1) The Departmentof Transportation shall establish a PacificWonderland registration plate program to is-sue special registration plates called “PacificWonderland registration plates” upon requestto owners of motor vehicles registered underthe provisions of ORS 803.420 (6)(a). In addi-tion, the department may adopt rules for is-suance of Pacific Wonderland registrationplates for vehicles not registered under theprovisions of ORS 803.420 (6)(a).

(2) In addition to any other fee author-ized by law, for each set of PacificWonderland registration plates issued undersubsection (1) of this section, the departmentshall collect a surcharge of $100 payablewhen the plates are issued. The departmentshall transfer the moneys from the surchargeas provided in ORS 805.289.

(3) Notwithstanding ORS 803.530, PacificWonderland registration plates may betransferred from vehicle to vehicle if the de-partment stops issuing the plates, as long asthe plates are legible and capable of beingused for identification purposes. 805.289 Disposition of moneys fromPacific Wonderland registration platesurcharge. (1) After deduction of the costof administration of the Pacific Wonderlandregistration plate program, the Departmentof Transportation shall transfer 50 percentof the moneys from the surcharge imposedby ORS 805.287 to the Oregon State CapitolFoundation for the general purposes of thefoundation under ORS 173.500 and 50 percentto the Oregon Historical Society.

(2) As used in this section, the cost ofadministration of the Pacific Wonderlandregistration plate program is the sum of alldepartment expenses for the issuance ortransfer of Pacific Wonderland registrationplates under ORS 805.287 that are above thenormal costs of issuing, renewing and trans-ferring registration plates in the normalcourse of the business of the department.These expenses include, but are not limitedto, the costs of collecting the Pacific

FARM VEHICLES805.300 Farm vehicle registration;

general requirements; fees. Any farmerwho is the owner of a motor vehicle mayapply to the Department of Transportationfor and, upon payment of appropriate fees,may receive farm vehicle registration de-scribed in this section to operate the vehicle.Farm vehicle registration is subject to thefollowing as described:

(1) Application is as provided under ORS805.320.

(2) Qualification is as provided underORS 805.310.

(3) The fees are as provided under ORS803.420.

(4) The registration period is as providedunder ORS 803.415.

(5) Once registered under a farm vehicleregistration, a vehicle may be used only forpurposes described under ORS 805.390. Vio-lation of limits imposed on use is punishableas provided under ORS 805.350.

(6) Vehicles are exempt from or subjectto regulation under ORS chapter 825 as pro-vided in ORS 825.024.

(7) Transfer is subject to ORS 805.340.(8) The registration may be canceled as

805.310 Qualifications for registration.To qualify for issuance of registration de-scribed under ORS 805.300 a person must beengaged, either as owner or renter, in oper-ating one or more farms, orchards or ranchesactually producing agricultural products orraising livestock in sufficient quantities toreasonably require the use of the motor ve-hicle or vehicles for which the farm vehiclelicense is sought. Cooperative corporationsor associations organized under the pro-visions of ORS chapter 62 or corporations orsubsidiaries of corporations do not qualify forthe issuance of licenses described under ORS805.300 if owned by more than 100 share-holders. As used in this section,“shareholder” has the meaning given thatterm in ORS 60.001. [1983 c.338 §769; 1985 c.16 §368;1987 c.94 §109; 2003 c.80 §26]

805.320 Application for registration.Application for registration described underORS 805.300 shall be made in a form pre-scribed by the Department of Transportationand certified to by the applicant and shallinclude all of the following:

(1) The name and residence or businessaddress of the applicant, except as providedfor Address Confidentiality Program partic-ipants in ORS 192.846.

(2) The number of acres as shown on thelatest county real property tax statements ofone or more of the farms, orchards orranches upon which the motor vehiclesought to be registered is to be used.

(3) The type and amount of agriculturalcommodities, agricultural products or live-stock produced annually on one or more ofthe farms, orchards or ranches upon whichthe motor vehicle sought to be registered isto be used.

(4) The number of trucks used on the oneor more farms, orchards or ranches uponwhich the motor vehicle sought to be regis-tered is to be used and the combined weightof the motor vehicle sought to be registered.

(5) A statement that any motor vehicleregistered under ORS 805.300:

(a) Will be used for one or more of thepurposes specified under ORS 805.390.

(b) Will not be used, at any time whileregistered under ORS 805.300, for any otherpurpose or for the transportation of anyother commodities or products for hire ex-cept as provided under ORS 825.024.

(c) Is needed in the operation of the oneor more farms, orchards or ranches uponwhich the motor vehicle sought to be regis-tered is to be used.

(6) Any other information required by thedepartment.

(7) Additional information required bylaw or by the department in making an ap-plication for regular registration for the mo-tor vehicle.

(8) The application shall contain a decla-ration that it is made under penalties forfalse certification. Violation of this subsec-tion is subject to penalties under ORS805.370. 805.322 Annual proof of qualificationfor farm vehicle registration. The ownerof a vehicle or combination that has four ormore axles and that is registered as a farmvehicle under ORS 805.300 or has a farm de-vice issued pursuant to ORS 805.400 shallannually show to the satisfaction of the De-partment of Transportation that the ownermeets the qualifications of ORS 805.320. 805.350 Violation of farm registrationlimits; penalty. (1) A person commits theoffense of violation of farm registration lim-its if the person uses or owns and permits tobe used a vehicle registered under ORS805.300 for purposes other than purposes de-scribed under ORS 805.390.

(2) The offense described in this section,violation of farm registration limits, is aClass A misdemeanor. [1983 c.338 §775; 1985 c.16§372]

805.360 Failure to register farm vehi-cle properly; penalty. (1) A person commitsthe offense of failure to register a farm vehi-cle properly if the person is the new ownerof a vehicle with registration under ORS805.300, and the person operates the vehiclebefore properly registering it.

(2) Nothing in this section prohibits aperson from registering the vehicle underORS 805.300 if qualifications for registrationunder that section are met.

(3) The offense described in this section,failure to register a farm vehicle properly, isa Class A misdemeanor. [1983 c.338 §776; 1985 c.16§373; 1993 c.741 §137]

805.370 False certification; penalty. (1)A person commits the offense of false certi-fication on farm registration if the personknowingly certifies falsely to any informationon any application for issuance of registra-tion under ORS 805.320.

805.380 Department investigation;cancellation. The Department of Transpor-tation shall have the authority to investigateand verify information provided in conjunc-tion with application for registration underORS 805.300. The department may cancel theregistration of any vehicle that has registra-tion issued under ORS 805.300 if the owneror a lessee or an employee of either is con-victed of violation of ORS 805.350 to 805.370,if the department determines that such per-son has violated ORS 805.350 to 805.370whether or not the person is convicted forthe violation or if the department determinesthat either the vehicle or the owner nolonger qualifies for farm vehicle registration.If registration is canceled under this section,the vehicle shall not again be eligible forregistration under ORS 805.300 for a periodof one year after the cancellation. 805.390 Permitted uses of farm-registered vehicles. This section establishesthe uses allowed for vehicles registered un-der ORS 805.300, and for vehicles authorizedby ORS 805.400 to be registered under ORS826.009 or 826.011. Vehicles with farm vehi-cle registration or farm vehicle proportionalregistration may only be used for purposesdescribed in this section. Uses permitted ona farm under this section are also permittedon one or more farms, orchards or ranchesof the qualifying farmer. Violation of thelimits established under this section is sub-ject to penalty under ORS 805.350. The fol-lowing describes the uses permitted vehiclesregistered under ORS 805.300 and for vehi-cles authorized by ORS 805.400 to be regis-tered under ORS 826.009 or 826.011:

(1) The vehicles may be used in trans-porting the farmer’s own agricultural com-modities, agricultural products or livestockthat were originally grown or raised by thefarmer on the farmer’s own farm. This sub-section includes products and by-products ofcommodities or livestock that were packed,processed or manufactured by or for the farmoperation so long as the farmer retains own-ership of the products but does not includeproducts that have been transformed into afinished state. For purposes of this subsec-tion, products have not been transformedinto a finished state if the products:

(a) Will be used in agricultural produc-tion;

(b) Will be used in the production of an-other product;

(c) Are not changed in visible character;or

(d) Are of a type or kind ordinarily re-quiring further processing prior to sale tothe ultimate consumer.

(2) The vehicles may be used in anytransportation that is incidental to the regu-lar operation of the farmer’s farm.

(3) The vehicles may be used to transportsupplies, equipment or materials to thefarmer’s farm that are consumed or used onthe farm.

(4) The vehicles may be used in trans-porting forest products to the farmer’s ownfarm or transporting for any purpose forestproducts originating on the farmer’s farm.The only forest products included under thissubsection are forest materials originating ona farm or as an incident to the regular oper-ation of a farm.

(5) The vehicles may be used in thetransportation of products, supplies, equip-ment or materials for another farmer whoqualifies under ORS 805.310 on an exchangeof labor basis if such products, supplies,equipment or materials are to be used or

consumed on such farm or are directly re-lated to the operation of the farm.

(6) The vehicles may be operated for thepersonal use of the farmer, any member ofthe farmer’s immediate family or any personin the farmer’s employ.

(7) The vehicles shall not be used totransport any of the following:

(a) Piling.(b) Poles over 30 inches in circumference

at the large end.(c) Except as otherwise provided in this

paragraph, logs over eight feet six inches inlength. A vehicle may be used to transportlogs over eight feet six inches but not over16 feet 6 inches in length if the vehicle hasa loaded weight of 16,000 pounds or less.

(8) The vehicles may be partially oper-ated under a permit issued by the Depart-ment of Transportation under ORS 825.102,as described in ORS 825.024. When operatedunder a permit issued under ORS 825.102, thevehicles are subject to ORS chapter 825.

(9) The vehicles may be partially oper-ated for hire as permitted in ORS 825.024(1)(c) and (d).

(10) The vehicles may be rented or bor-rowed by a farmer to haul the farmer’s ownproducts if the farmer would qualify for farmvehicle registration for vehicles of the typeand size rented or borrowed.

(11) The vehicles may be used in trans-porting straw, whether or not the straw wasgrown on the farmer’s own farm, if thetransporting farmer is the one who bales thestraw. [1983 c.338 §767; 1985 c.16 §367; 1985 c.668 §20;1989 c.43 §33; 1993 c.368 §5; 1995 c.248 §1; 1995 c.522 §5;1999 c.59 §237]

805.400 Proportional registration forfarm vehicles; rules. (1) Any person whoqualifies under ORS 805.310 for farm vehicleregistration under ORS 805.300 may chooseto register farm qualified vehicles under theproportional registration provisions of ORS826.009 or 826.011 in lieu of registering thevehicles under the farm vehicle registrationprovisions of ORS 805.300. Except as other-wise provided in this section, farm vehiclesregistered under ORS 826.009 or 826.011 aresubject to the same requirements, conditionsand privileges as other vehicles registeredunder those sections. Farm vehicle propor-tional registration is subject to the following:

(a) In addition to any application forregistration required by ORS 826.009 or

826.011, the applicant must submit an appli-cation to the Department of Transportationcertified by the applicant and containing theinformation specified in ORS 805.320 for farmvehicle registration.

(b) The department shall issue appropri-ate identification devices for proportionallyregistered farm vehicles. The design for suchdevices shall be determined by the depart-ment by rule and the fees for such devicesare as provided in ORS 803.577.

(c) An identification device for propor-tionally registered farm vehicles is subject tocancellation as provided in ORS 805.410.

(2) The following provisions apply to avehicle that has been issued farm vehicleproportional registration:

(a) The vehicle may be used only forpurposes described in ORS 805.390. Violationof this paragraph is punishable as providedin ORS 805.350 for violation of farm regis-tration limits.

(b) The vehicle is exempt from or subjectto regulation under ORS chapter 825 to thesame extent and in the same manner as pro-vided in ORS 825.024 for vehicles registeredunder ORS 805.300. [1985 c.668 §18; 1989 c.43 §34;1991 c.284 §23; 1991 c.407 §37; 1993 c.751 §111]

805.410 Department investigation offarm vehicle proportional registrationapplication; cancellation. (1) The Depart-ment of Transportation shall have the au-thority to investigate and verify informationprovided in conjunction with application forproportional registration of a farm vehicleunder ORS 805.400. The department maycancel an identification device for a propor-tionally registered farm vehicle if the de-partment determines that the owner or lesseeof the vehicle, or an employee of either, has:

(a) Operated the vehicle in violation offarm registration limits; or

(b) Falsely certified an application re-quired by ORS 805.400 for registration or re-newal of registration of a proportionallyregistered farm vehicle.

(2) If a farm vehicle proportional regis-tration identification device is canceled un-der this section, the vehicle is not eligiblefor registration under ORS 805.300 for a pe-riod of one year after the cancellation. [1985c.668 §19]
