Los Bronces Development - ChileLOS BRONCES COPPER MINE - CHILE
STARTING POINT
� Copper mine expansion project to double copper mining production for US$ 2.8 billion, located 65km from Santiago in rugged mountain terrain and at high altitude.
� Work carried out under a bespoke EPC Target Cost contract between 2007 and 2011.
� Cost greatly exceeded the budget after delays and other issues including the 2009 global financial crisis, the 2010 earthquake, geotechnical issues and unexploded ordnance.
� Employer, Anglo American appointed Turner & Townsend as claims consultant to prepare robust claim documents against the Contractor to arbitration standard.

APPROACH
� Liaison with Employer and their legal team to understand the causes of losses and to identify potential commercial claims against the contractor under the contract or Chilean law.
� Establish Chilean legal principles and what needs to be achieved to produce a valid claim.
� Review of relevant documentation including cost records, correspondence other records and programmes to establish the project history.
� Prepared claim documents for US $ multi million addressing quantum and delay analysis including full supporting documentation and all based upon the evidence.

Rajasthan Northern Area Development - Contracts Project Team
Starting point
� The Client appointed Turner & Townsend as claims consultantsto investigate the facts and advise upon the strengths andweaknesses of the contractor’s final account claims for processplant civil engineering works, process works and exportpipeline EPC contracts.
� Tender readiness review of ITT documents including contractfor future phase well pads and in-field pipelines works.
� Advice on procurement best practice for response to Auditobservations. International contracts comparison.
� Support drafting of PR to PO and PO to Close-out handbooks.Lead Kick-off meeting and Commercial Close-out sections.
Approach
� Reviewed EPC contracts and advised on all contentious and non-contentious matters to be settled in the final accounts,including extension of time, disruption, acceleration and other claims and counterclaims.
� Recommended individual and collective strategy and timetable for structured close-out of all three contracts taking intoaccount cost recovery/audit requirements and the potential for Arbitration.
� Embedded in Client organisation to lead a team working closely with operations, procurement & supply chain management,project services, finance & legal and reporting direct to the Chief Operating Officer.
� Provided assurance to the Operations Board and ExCo to allow setting of considered settlement terms and financial limits withconfidence. Safeguarded cost-recovery position with Co-venturer and ensured cost and tax audit transparency withGovernment regulators.
� Provided assurance role in funding reviews by project bankers.
� Facilitated and led lessons learned workshops and recommendations report for the Phase 1 projects and developed thisprocess to provide a bespoke lessons learned portal on the Company intranet.
� Provided Programme Office manager and estimating support; developed estimating procedure, WBS, plans and estimates.

Norway Sub-Sea Contract - Contracts Project Team
Starting point
� The Client appointed Turner & Townsend as claims consultantsto investigate the facts and advise upon the strengths andweaknesses of their case concerning a dispute on a liveproject.
� To support the smooth progress of the works, it was importantthat the dispute was settled within a short time period.
Approach
� The initial task was to carry out forensic analysis to establish the various facts in issue, the history of the events, all relevantdocuments and programmes so that the facts were clear and supported by relevant documentation. During this time, and asthe facts crystallised, we worked closely with the client and their lawyers to establish the legal issues and frame thearguments that arose from the facts.
� A detailed Commercial Positioning Document was prepared to allow our client to enter into commercial settlementnegotiations. This document contained the legal arguments fully supported by the history of the facts.
� This enabled our client to undertake commercial negotiations from a position of maximum strength.
� We mobilised a team experienced both in oil & gas projects as well as dispute resolution. Team members were dually qualifiedtechnically and legally and were able to immediately integrate within the client office.
� We coordinated with the lawyers to develop the case strategy and prepare all necessary supporting documentation. TheCommercial Positioning Document was prepared in a matter of weeks to support our client in early dispute resolution, basedupon a full understanding of the issues with all supporting legal arguments.
