l. Affiant, James E. Melle, being first duly cautioned and sworn states that he is an attorneyadmitted to the practice of law in the State of Ohio, Attorney Registration Number0009493, and is Counsel for all of the Plaintiffs-Appellees/Cross-Appellants in this caseand that he is competent to testify and has personal knowledge of the matters statedherein and of the Exhibits attached hereto which are tr-ue and accurate copies of theoriginals which were copied from and/or printed by him from digital online newspapersources and from the Columbus Public Library as shown thereon.

2. Afflant makes this affidavit pursuant to S.Ct.Prac.R. 4.04(B).

3. On or about October 25, 2014 while campaigning for election to the Ohio Supreme CourtJustice Judith L. French made certain public comments which were published in theColumbus Dispatch Online (Dispatch.com), a digital newspaper of general circulation.Exhibit I attached hereto and incorporated herein is a true and accurate copy of thatdigital online article written by Columbus Dispatch reporter Randy Ludlow. It wasdownloaded and printed by affiant.

4. Affiant was not present when the statements were made by Justice Judith L. French.Affiant can only rely upon what has been reported in Exhibit 1. Affiant believes that thestatements published with quotation marks and attributed to Justice French are statementsmade by her and are accurately and correctly printed therein.

5. According to Exhibit 2 from Dispatch.com, three days thereafter Justice Frenchacknowledged making the statements attributed to her in Ex. 1.

6. Exhibit 2 attached hereto and incorporated herein is a true and accurate copy of thatdigital online article written by Columbus Dispatch reporter Randy Ludlow andpublished in Dispatch.com. It was downloaded and printed by affiant.

7. Exhibits 3 and 4 attached hereto and incorporated herein are true and accurate copies ofdigital publications from plunderbund.com and cleveland.com which are available on theinternet by using a search engine and were discovered by affiant on the internet anddownloaded and printed by affiant.

8. Exhibit 5 attached hereto and incorporated herein is a copy of the printed article writtenby Columbus Dispatch reporter Randy Ludlow and published in the Columbus Dispatchon October 28, 2014 which is on microfiche in the archives of the ColumbusMetropolitan Library. Exhibit 1 could not be located in the Columbus MetropolitanLibrary archives.

9. Affiant believes that the statements published with quotation marks in Exhibits 2, 3, 4and 5 and attributed to Justice French are statements made by her and are accurately andcorrectly printed therein. Affiant also believes that Justice French's statementsparaphrased by the reporters are, in sum and substance, accurate and correct paraphrasesof her actual statements.

10. According to the Exhibits, Justice French's statements were made while she wascampaigning for elective judicial office and were said in the presence of at least GovernorKasich and Auditor Yost who were actively campaigning for her at the time.

11. Governor John Kasich, the Ohio General Assembly, State Auditor David Yost, AttorneyGeneral Mike DeWine, Secretary of State Jon Husted and other State Officials are theDefendants-Appellants/Cross-Appellees ("State Defendants") in the case of Ohio CivilService Employees Association v. State of Ohio, Case No. 2014-0319, which is currentlypending before the Ohio Supreme Court having been accepted for review on June 25,2014, State ex yel. Ohio Civ. Serv. Emps. Assn. v. State, 2014-Ohio-2725, 139 Ohio St. 3d1428.

12. The pending appeal involves two complex constitutional questions arising under the OhioConstitution, Article II, Section 15(D) and Article VIII, Section 4 challenging asunconstitutional statutes and programs enacted or amended in Am. Sub. H. B. No. 153,an Appropriations Bill of the 129th General Assembly. More particularly, one set ofchallenged statutes allows the sale and privatization of several Ohio prisons. Otherchallenged statutes relate to non-appropriation items in the Appropriations Bill includingthe JobsOhio program. A third issue also arising from the passage of Am. Sub. H. B. No.153 is a disputed jurisdictional issue involving the State Employment Relations Boardand the Franklin County Common Pleas Court.

13. The case is now fully briefed, the final brief having been filed on January 12, 2015.

14. The "backstop" comments mentioned in Exhibits 1 through 5 relate directly to the issuesin this case as may be seen from the filed briefs.

15. The case has not been set for oral argument.

16. After careful consideration of the statements and subsequent explanation made in thoseExhibits, and with the respect due to Justice French, affiant believes that the commentsmade in these publications, including the subsequent explanation, indicate, and give theappearance, that litigation challenging legislative programs enacted by the Ohio GeneralAssembly and executive actions implementing them taken by Governor John Kasich,State Auditor Yost, Attorney General Mike DeWine, Secretary of State Jon Husted andother State Officials will not be free from bias and partisanship favoring the legislativeprograms and State Officials.

17. For the foregoing reasons, Affiant for himself and on behalf of the Plaintiffs-Appellees/Cross-Appellants believe that in these circumstances Justice French shouldrecuse herself from all further proceedings in this case.

18. Ohio Constitution, Article IV, Section 2 provides "If any member of the court shall beunable, by reason of illness, disability or disqualification, to hear, consider and decide acause or causes, the chief justice or the acting chief justice may direct any judge of anycourt of appeals to sit with the judges of the supreme court in the place and stead of theabsent judge."
