OSHA New Reporting Rule Could Impact Workers' Compensation PoliciesInsurance industry access to serious incident reports is in the plans.Dr. David Michaels, OSHA's top leader, recently told a group of construction industryadvisors about the impact the January 1, 2015, serious injury reporting rule change ishaving. Michaels said that the agency is receiving hundreds of reports per week. In many cases, thereports are coming from employers that OSHA never knew existed ­ they had not previouslybeen on any OSHA inspection lists. But, because of the new rule requiring reporting ofamputations, as well as hospitalizations of one or more employees, OSHA now has contactwith these employers. Click HERE to read entire article.

OSHA Official Outlines New Policies, Age­Old ConcernsOSHA's dedication to safety continues to grow, deputy director Dean McKenzie toldattendees on May 6 at the 2015 Remodeling Leadership Conference. With a recoveringhousing market and falling workplace fatality rates, OSHA continues to promote workplacesafety with inspections and important new regulations. McKenzie showcased current statistics for fatal falls at jobsites and also mentioned OSHA'spush to protect temporary workers. All remodelers will have a reason to hire a temporaryworker at some point in time, and it's important to remember that temporary workersshould be treated the same as your full time employees. Click HERE for the full article.

NLBMDA Commends the House of Representatives forReintroducing Bill Reforming EPA Lead Rule[Washington DC] ­ The National Lumber and Building Material Dealers Association(NLBMDA) commends the U.S. House of Representatives for reintroducing legislationreforming the Environmental Protection Agency's (EPA) Lead: Renovation, Repair andPainting (RRP) Rule.  H.R. 2328 was introduced yesterday by Congressman Kevin Cramer(R­ND) and would reduce the burdens of the rule on the home remodeling and retrofitmarket, while maintaining protections for pregnant women and young children from leadhazards. NLBMDA has worked with lawmakers on Capitol Hill to scrutinize EPA'simplementation and enforcement of the rule. Click HERE to read entire article.

Representative to cosponsor the Lead Exposure Reduction Amendments Act (H.R. 2328).The legislation, introduced on Thursday, May 14, would reform the EnvironmentalProtection Agency's (EPA) Lead: Renovation, Repair and Painting (RRP) rule for residentialbuilding. Among the key provisions in the bill, it would restore the opt­out clause andrequire EPA to identify a test kit meeting the rule's standards.

The legislation was introduced by Rep. Kevin Cramer (R­ND). In addition, H.R. 2328 haseight original cosponsors including Reps. Rod Blum (R­IA), Chris Collins (R­NY), CharlesFleischmann (R­TN), Tim Murphy (R­PA), Collin Peterson (D­MN), Pete Sessions (R­TX),Steve Stivers (R­OH) and Lynn Westmoreland (R­GA). NLBMDA has made passage of H.R.2328 a top legislative priority and we encourage you to take action now by contacting yourrepresentative and asking them to cosponsor the Lead Exposure Reduction Amendments Actby clicking HERE.

Employee OSHA Training Requirements on Product Label Elements and Safety Data  Sheets DVD NLBMDA has produced a 15­minute training DVD that dealers can use to train their employees on the new OSHArequirements, which went into effect December 1, 2013. OSHA has revised its Hazard Communication Standard(HazCom) to align with the United Nations' Globally Harmonized System of Classification and Labeling of Chemicals(GHS). The revisions require employees potentially exposed to hazardous material be trained on the new labeling and SafetyData Sheet (SDS) requirements. This employee training is based on the specific topics that OSHA has determined mustbe provided by employers for employees.
