EXECUTIVE SUMMARY: The objective of this report is to seek Council approval to award the supply traffic management services within the City. The successful Contractor will be appointed for a two year period. EXECUTIVE RECOMMENDATION; That Council by Simple Majority pursuant to Section 3.18 of the Local Government Act 1995 as amended RESOLVES to:

1. AWARD RFT 10 1415 Supply Of Traffic Management Services to the preferred tenderer; and

2. RECORD the tender details in the minutes. PROPONENT: The proponent is the City of Greater Geraldton. BACKGROUND: The tender was advertised in The West Australian on Saturday 20 September 2014 and in the Geraldton Guardian on 19 September 2014. The tender was also advertised on the WALGA Tender Link e-Tendering Portal. Tender details were also available on the City’s website. The closing date for the tender was 1pm Tuesday 14 October 2014.

These works include, but are not limited to, the design, supply, installation, maintenance and removal of temporary traffic control devices, traffic controllers, signposting, lights, barriers and other items to meet traffic management services required by the City.

The tender is weighted on relevant experience, key personnel, resources and demonstrated understanding of the tender requirements.

Thirteen suppliers registered to receive copies of the tender, five submissions were received from the following Tenderer’s:

(a) Tru-Line Excavations & Plumbing Pty Ltd

(b) Altus Traffic Pty Ltd

(c) Evolution Traffic Control

(d) Midwest Traffic Controllers

(e) Advanced Traffic Management (WA) Pty Ltd

ECONOMIC, SOCIAL, ENVIRONMENTAL & CULTURAL ISSUES: Economic: The two yearly supply tenders allow Community Infrastructure managers and supervisors to cost effectively purchase goods and services from approved suppliers at known costs. Social: There are no known social impacts. Environmental: There are no known environmental impacts. Cultural & Heritage: There are no known cultural or heritage impacts. RELEVANT PRECEDENTS: Two yearly supply Contracts have been used for a number of years and have been proven to be an effective method of obtaining goods and services at competitive rates. COMMUNITY/COUNCILLOR CONSULTATION: There has been no community/councillor consultation. LEGISLATIVE/POLICY IMPLICATIONS: Tenders are called to determine a preferred supplier to comply with the provisions of the Local Government Act 1995 and with Local Government (Functions and General) Regulations 1996. FINANCIAL AND RESOURCE IMPLICATIONS: Prices tendered are recorded and utilised for future project pricing. The tables in the Confidential Attachment indicates prices of all services. Budget allocation is within the annual construction (budget projects) and maintenance budget provisions. INTEGRATED PLANNING LINKS:

ALTERNATIVE OPTIONS CONSIDERED BY CITY OFFICERS The following alternatives have been considered by officers:

1. NOT TO PROCEED with RFT 10 1415 Supply of Traffic Management Services; and

2. That the City re-tender to source another supplier.

Alternative 1 was discounted as the two yearly tender process allows the City to secure goods and services at current competitive rates for managing traffic for the construction and maintenance of roads, drains and footpaths within the City. Alternative 2 was discounted as the submissions received through this tender process were compliant and competitive. The submissions gave the City an excellent cross section of price, supply and service of the required goods and services.

EXECUTIVE SUMMARY: The purpose of this item is to seek Council approval to award RFT 14 1415 to the preferred tenderer. EXECUTIVE RECOMMENDATION; That Council by Simple Majority, pursuant to Section 5.20 of the Local Government Act 1995 RESOLVES to:

1. AWARD the contract for RFT 14 1415 – Mullewa Flood

Damage Repairs to the preferred tenderer; and 2. RECORD the tender details in the minutes.

PROPONENT: The proponent is the City of Greater Geraldton. BACKGROUND: On 26 July 2014 the Mullewa area was subjected to exceptionally heavy rainfall, as a result, several roads within the area were damaged (Carnarvon Mullewa Road, Williams Road, Fegan Road, Barrabarra Road & Nungulya Road). The City made a submission to Main Roads WA (MRWA) for funding to undertake the repairs. The City’s submission was successful and the City has received sufficient funding to undertake design, construction & project management of the repair works. The tender is weighted on relevant experience, key personnel, resources and demonstrated understanding. REGIONAL OUTCOMES: Once the works are completed the community will see an improvement in the road network within the Mullewa area. RISK MANAGEMENT Not awarding the tender at this stage will lead to further deterioration of the affected roads within Mullewa. The City would also lose all grant funding should the works not be completed within this financial year and this in turn would mean that the City would have to find further funding in the 2015-2016

The attached report provides explanatory notes for items greater than 10% or $50,000. This commentary provides Council with an overall understanding of how the finances are progressing in relation to the adopted budget. The financial position represented in the December financials shows a positive variance of $1,587,353 in the net operating result. The closing funding surplus is due to year to date Capital expenditure being less than YTD budget, as a result of timing of works for buildings, roads, plant & equipment ECONOMIC, SOCIAL, ENVIRONMENTAL & CULTURAL ISSUES: Economic: There are no economic impacts. EXECUTIVE SUMMARY: The purpose of this report is to seek formal endorsement from the Council for the City of Greater Geraldton Welcome to Country Guidelines.

EXECUTIVE RECOMMENDATION; That Council by Simple Majority pursuant to Section 3.1 of the Local Government Act RESOLVES to:

1. ENDORSE the City of Greater Geraldton Welcome to Country Guide; and

2. IMPLEMENT the Welcome to Country Guide including changing the wording of the current Acknowledgment to Country at Council meetings.

PROPONENT: The proponent is the City of Greater Geraldton. BACKGROUND: The draft Welcome to Country Guide provides an explanation about when, and how, to conduct a Welcome to Country, or an Acknowledgement of Country. The document explains the differences and cultural nuances that need to be observed, and provides guidance for the City, Council, or its representatives about Welcome to Country, and Acknowledgement of Country protocols.

The draft guide has been developed using information sourced from previous versions of similar documents developed at the City and via extensive engagement with Aboriginal community members.

The draft Welcome to Country Guide has been reviewed and endorsed by the Reconciliation Committee.

In addition, on 2 December 2014 the draft Guide was presented at the Concept Forum for review and discussion.

All feedback from the Aboriginal community, the Reconciliation Committee and the Concept Forum has been very positive.

The City is mitigating this risk by having a replaceable page in the final document which will be updated regularly with a clear disclaimer about the potential for changing roles in the Aboriginal community and the date that the information was printed. ALTERNATIVE OPTIONS CONSIDERED BY CITY OFFICERS An alternative option could be to not have an official Welcome to Country Guide, and all City officers and representatives to navigate this sensitive issue without clear guidance. PROPONENT The proponent is the Development Assessment Panels who report directly to the Minister for Planning. BACKGROUND On 1 July 2011, 15 Development Assessment Panels (DAP) came into operation in order to determine development applications that meet a certain threshold value. In the case of the City of Greater Geraldton for development applications with an estimated cost of $7 million or more, it is mandatory that they are determined by a DAP. For applications $3 million or more and less than $7

million, the applicant has the option of having the application determined by a DAP or the local government. Each DAP comprises 5 members; 3 specialist members, one of which is the presiding member, and 2 local government members. Appointments of all local government DAP members expire on 26 April 2015. Members whose term has expired will be eligible for re-consideration at this time. Council is requested to nominate 4 elected members (comprising 2 local members and 2 alternate local members) to sit on the JDAP as required. Nominations are required to be received no later than Friday 27 February, 2015. Following receipt of all local government nominations, the Minister for Planning will consider and appoint all nominees for up to a 2 year term, expiring on 26 April 2017. All appointed local members will be placed on the local government member register and advised of DAP training dates and times. It is a mandatory requirement, pursuant to the DAP regulations, that all DAP members attend training before they can sit on a DAP and determine applications. Local government representatives who have previously been appointed to a DAP and have received training are not required to attend further training. Local government elections may result in a change to local DAP membership if current councillors, who are DAP members, are not re-elected. In this instance, the deputy local DAP members will take the place of the former local DAP members. If both local and alternate (deputy) local members are not re-elected, the local government will need to re-nominate for the Minister’s consideration of appointment. Council at its meeting held on 29 January 2013 nominated Mayor I Carpenter and Councillor N McIlwaine as the City’s local government representatives on the JDAP, and also nominated Councillor L Graham and Councillor S Van Styn as alternate local government representatives. COMMUNITY/COUNCILLOR CONSULTATION Mayor Ian Carpenter and Deputy Mayor Cr Neil McIlwaine indicated their desire to continue to represent the City on the Development Assessment Panel. LEGISLATIVE/POLICY IMPLICATIONS Part 11A of the Planning and Development Act (2005) introduced Development Assessment Panels into the Act and this is supported by the Planning and Development (Development Assessment Panels) Regulations 2011. ALTERNATIVE OPTIONS CONSIDERED BY CITY OFFICERS The option to not nominate any elected members is not supported by City officers as the City is required, under Regulation 26 of the Planning and Development (Development Assessment Panels) Regulations 2011, to nominate elected members to sit on the JDAP as required. The option to defer the matter is not supported by City officers as nominations are required to be received no later than Friday 27 February 2015. Thrift shop; and

Indoor playground and crèche. The applicant has provided an indicative long term concept plan for the site as part of the Amendment document which is included as Attachment No. SC197A. This approach is also consistent with Town Planning Scheme No. 3 (Geraldton) which has ‘Community Purpose’ as an ‘SA’ (advertising use) within the Residential zone. Part 5 of the Planning and Development Act 2005 provides for the amendment of a Local Planning Scheme. FINANCIAL AND RESOURCE IMPLICATIONS There are no financial and resource implications. ALTERNATIVE OPTIONS CONSIDERED BY CITY OFFICERS The option to refuse the Amendment is not supported by City officers as it is considered that the Amendment will allow for the comprehensive development of the site for community and care facilities with integrated residential areas. In the context of the location of the site adjacent to existing and planned education facilities and the approved church proposed for the site, it is considered that the additional ‘Community Purpose’ use will enhance the level of community facilities in the area. The subject land is located north of Presentation Parade and west of Half Moon Drive and is subject to a WA Planning Commission subdivision approval. The specific site, the subject of this Scheme Amendment, will be created as Lot 442. Future Lot 442 is 3,000m2 in area with frontages of 40 metres and 59 metres respectively to Half Moon Drive and Presentation Parade. The lot will adjoin future public open space on its western and southern boundaries. The Waggrakine Residential Estate Structure Plan requires that a Detailed Area Plan (DAP) be adopted prior to subdivision and/or development for the site which will ensure that the future development is integrated with the open space through passive surveillance and active frontages. Extracts from the Amendment document, which includes a copy of the Waggrakine Residential Estate Structure Plan and an extract of the subdivision approval, is included as Attachment No. SC198A. The lot layout should provide a mix of housing types, lot sizes and densities with smaller residential lots and higher density housing in areas close to town and neighbourhood centres, near public transport stops, and in areas with high amenity such as next to parks.

Residential Development Strategy (2013): The Strategy is a response to the changing local and regional economic environment and the need to provide a logical, coherent, highly liveable and sustainable model for residential development in the City to meet the needs of all residents and build strong communities. It broadly indicated the extent of residential and future residential land along with existing and proposed rural living areas. The subject land is identified as “Single Residential (R10-R25) however clause 2.2 states that:

RISK MANAGEMENT There are no inherent risks to the City in approving the Amendment. ALTERNATIVE OPTIONS CONSIDERED BY CITY OFFICERS It is considered that the Amendment is consistent with the overall strategic planning framework and the direction given in the recent modification to the Waggrakine Residential Estate Structure Plan. The Amendment proposed is of a minor nature and will facilitate medium density development in an area of higher amenity. The option to refuse the Amendment is not supported by City officers as it is consistent with the endorsed Waggrakine Residential Estate Structure Plan which clearly identifies the site for ‘medium density development’. The option to defer the Amendment is not supported by City officers as there is considered to be sufficient information for Council to determine the matter.
