WHEREAS, Section 321 of the Local Government Code of 1991 states that “Changes in the Annual Budget. – All budgetary proposals shall be included and considered in the budget preparation process. After the local chief executive concerned shall have submitted the executive budget to the sanggunian, no ordinance providing for a supplemental budget shall be enacted, except when supported by funds actually available as certified by the local treasurer or by new revenue sources;”

WHEREAS, In the matter of providing for Supplemental Budget for local government units, Section 1 (a) of Administrative Order 47 of the President of the Philippines, Provides that: “(a) When supported by funds actually available as certified by the local treasurer:

Funds actually available refer to the amount of money actually collected as certified by the local treasurer at any given point during the fiscal year which is over and above the estimated income collection for that point in the year. Thus,

funds are actually available when realized income exceeds estimated income as of the said fiscal year. Funds are likewise deemed actually available when there are savings, for this purpose, savings refer to portions or balances as of any given point in the fiscal year of any programmed or allotted appropriation which remain free of any obligation and encumbrance and which are still available after the satisfactory completion or the unavoidable discontinuance or abandonment of the work, activity or purpose for which the appropriation was originally authorized, or which result from unobligated compensation and related costs pertaining to vacant positions and leaves of absence without pay.

WHEREAS, The City Treasurer, Ms. Evelina M. Garma, certified that the amount of Six Million Pesos (P6,000,000.00) from Maintenance and Other Operating Expense Account in the Annual Budget for 2014 is available and exisiting;

WHEREAS, The Office of the City Mayor has presented to the Sangguinang Panlungsod a proposal for the repairs and maintenance of motor vehicles and public infrastructures, artesian wells, pumping stations and conduits;

WHEREAS, The proposed projects have been found by the Sangguniang Panlungsod to be appropriate and relevant;

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of Caloocan City in session duly assembled, that:

Section 1. REALIGNMENT – The amount of SIX MILLION PESOS (P6,000,000.00) that was appropriated under Maintenanace and Other Operating Expense Account in the Annual Budget for 2014 be realigned as follows:

Section 2. SEPARABILITY CLAUSE – If for any reasons, any provision of this Ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, the remaining parts thereof not affected thereby shall continue to be in full force and effect.

Section 3. REPEALING CLAUSE – All Ordinances, resolutions, Executive Orders, Memoranda and Administrative Regulations or part thereof in conflict or inconsistent with the provisions of this Ordinance are thereby repealed amended or modified accordingly.

Section 4. EFFECTIVITY CLAUSE – This Ordinance shall take effect immediately upon approval.
