Objectives of Session

• Been presented with the topic of discussing Workplace violence and thought I would provide an update as to efforts in this and other areas (DHS, RE-ISAC and other) for awareness

• Will bring you into my world and provide current issues we all need to be alert to and encourage growth within our respective groups.

– We are living in a VERY dynamic environment !!

– Access media (web, TV, newspaper, etc.) we are bombarded with incidents, issues which could make for a bad day for one or all of us

• Want to share with each of you a bit about: – Current trends

– I hope your able to identify one “nugget” you walk away from this discussion. If I accomplish that then the session has been a success.

State of our Industry

• “Our” business collectively has materially changed over the past 20 years since the 1993 bombing of the World Trade Center and will continue to change

• Many of us can recall times before that incident, it was a simple business model (budgets, operations, tenant relations, returns, protect the assets value, etc.)

• Fast forward to today concerns range from • Maintaining Basic operations, to• Pandemic issues, to• Increase in natural disasters, to • Being advised of Infrastructure issues/ deferred maintenance of life line services, to • Warnings about Terrorists or wannabe’s, to • Gun violence on the rise, to • Cyber issues within our facilities or at home where our stuff and that of clients could be compromised.

• Risk has become and will continue to be a major issue for each of us

Relevant Legal Actions – Boston, Mass

• Hotel Parking Garage Rape

– Female exiting garage elevator early AM May 1, 2009, homeless male grabs her by the hair, pulls her into stairwell and sexually assaults her for 25 mins.

– This was the homeless man’s 2nd victim at parking garage in 12 days.

– Add’l security officer added after 1st incident was in lobby away from garage at time of 2nd incident.

– Landlord and Management Co. were found negligent.

– Parking Co which helped manage the garage was cleared of responsibility.

– Victim was awarded $4 million, with interest, this increases to an estimated $6.6 million.

– The verdict will “certainly reverberate through the business community to be more responsible owners. Hopefully, this case will result in better protection and better safeguards for the public.”

Chicago workplace violence

• Incident occurred in 2006!! Initial case brought in 2008

• Illinois appeals court (3 judge panel) revived wrongful death suit against owner, manager and security provider where three (3) people were killed,1 wounded weighing questions of negligence.

• Joe Jackson threatened security officer to gain entry to law offices to escort him to tenant space. Upon entry he chain locked the doors and shot/killed/wounded attorneys and staff.

• Appeals court stated that “owner (manager) thru its security director both approved and oversaw the activity of security contractor and thus had duty to protect the tenants in the office building”

Nightclub shooting – Orlando, Fla.

• Early morning incident at nightclub (The Pulse) in June, 2016. Late night “Latin Night” event, crowd predominantly Hispanic. Estimated crowd 300+ people.

• Individual, who might have visited site before, gained access by walking up with semi-automatic rifle and handgun. Off duty police engaged individual and were unarmed against arms carried by shooter.

• Individual professed allegiance to ISIS leader during incident, standoff commenced for three hours.

• Frantic calls and texts were sent by patrons, employees of club helped many out, but others were unsuccessful in getting out.

• Killed 50,wounded 53, shooter neutralized after 3 hour standoff.• Confusion exists whether he frequented club on occasions before incident.

Civil protest - Dallas shooting

• Evening protest planned, expect 1,000 marchers, 100 police officers thru CBD. March started as bldgs. were going thru lockdown.

• Police deployed along route to control traffic and allow marchers to move unimpeded.

• Gun fire erupted outside bldg. at cross section. Shooter took up location across from large office bldg., police converged and entered lobby of bldg. to return fire.

• Shooter had ballistic rounds while police were using hollow points, police shots weren’t breaking windows.

• Exiting tenants, cleaners, security officers, protestors were scampering for cover • Lockdown occurred through the night until 6AM for ALL occupants and protestors• Twenty five block area locked down, area slowly released over a nine day period.• Five (5) police officers were killed, 11 wounded. • Shooter neutralized via explosive device

Case Study: Robert Lewis Dear

2015 Colorado Springs Planned Parenthood Shootings: 3 Killed, 9 Wounded

Events:• Came to Planned Parenthood clinic with duffel

bag including 10 handguns and rifles

• Opened fire in clinic and 5 hr standoff at facility

ensued

• Eventually was persuaded to surrender. After

arrest was heard saying “no more baby parts”

• Dear had assembled propane tanks around vehicle

– potentially intended this to be a bomb

• Facility shutdown for 75 Days

Indicators:• Lived an isolated life in Carolinas and more recently

Colorado Springs

• History of crime – domestic assault, peeping Tom,

animal cruelty

• Had previously targeted Planned Parenthood. 20 yrs

prior glued clinic doors shut

• Believed to have strong anti-abortion sentiments.

Relevant Legal Actions– San Bernardino, Calif

• Work Place Violence– (12/15)

– 14 Killed and 22 seriously injured

– Two families of victims are seeking a total of $262 million in damages against San Bernardino County

– Claims were filed of negligence and wrongful death

– San Bernardino County is being accused of fostering a hostile work environment and failing to provide a safe work place

– Loss of use of space for 4 weeks

Recent Incident in Paris

• Paris – Guns and Bombing– 7 sites (Stadium, local stores/bars and

small theater), 130 dead, 360 injured.

– Three (3) teams of individuals

– Incidents were spread over a 40 mins before hostage siege at Bataclan.

– One individual got away are arrested in Brussels on early March

• “Way of life” targets selected

Recent Events in North America

– October 20, 2014: Vehicular assault against three members of the Canadian armed forces in St-Jean-sur-Richelieu, Quebec.

– October 22, 2014: In Canadian capital Ottawa, gunman murders honor guard at National War Memorial, then enters and opens fire in the Parliament building.

– October 23, 2014: Hatcheting of two uniformed police officers, amongst a group of four, on a sidewalk in Queens in New York City.

– May 3, 2015: Pair of gunman open fire at a convention center in Garland, Texas, outside Dallas, hosting a competition for cartondepictions of the Muslim prophet Muhammad; incident contained at security perimeter; guard wounded.

– June 2, 2015: Terrorism suspect in Boston engaged by officers acting through the FBI’s Boston Joint Terrorism Task Force; suspect killed after attempting to attack police with a knife; investigation revealed plans to commit knife attacks against uniformed police officers. A second suspect arrested in Everett, Massachusetts, for alleged involvement in the plot.

– June 17, 2015: Suspect in terrorism investigation in Staten Island in New York City arrested and charged with attempted murder after attacking an FBI agent with a kitchen knife during a search of his home.

– May – June 2015: Increase in force protection level at military installations throughout the United States – an action driven byposted threats by ISIL supporters.

– June – August 2015: Multiple arrests of suspects in several cities for alleged terrorism-related activities allegedly influenced by or supportive of ISIL. Goldberg in Florida – attack stair climb competition

Federal Bureau of Investigations study Sept 2014 w update May 2016

Initial Study 2000 - 2013• Study examined 160 incidents

• NYPD produced similar study in 2012 – 230 cases/incidents over 40+ yrs.

• 1,043 individuals killed or wounded, not including shooters• 486 killed (3.0 per incident); 557 wounded (3.5 per

incident)• 11.4 incidents per year

– (6.4 in 1st 7 yrs and 16.4 in last 7 yrs)• 70% of incidents took place in commercial or educational

facilities• 67% of incidents ended before law enforcement arrived!!• Sex of attacker - 97% male• Individuals involved and planning/tactics

– 99% single attacker– 6% (9) shooters killed family member before incident

• 40% of incidents considered as “Mass Killings”

Update to study for 2014 and 2015

• Study examined 40 incidents during 2015 and 2016, • 231 individuals killed or wounded, not including shooters• 92 killed (2.3 per incident); 139 wounded (3.5 per incident)• 20 incidents per year

– (6.4 in 1st 7 yrs and 16.4 in last 7 yrs)• 43% of incidents took place in commercial or educational

facilities• 35% of incidents ended before law enforcement arrived!!• Sex of attacker - 94% male• Individuals involved and planning/tactics

– 95% single attacker

• 26 States impacted– 2 states had 4 incidents,1 had 3 incidents– 6 states had 2 incidents each

• 15 of 40 (38%) incidents classified as “Mass Killings”

Identifying Threats in the Workplace

• An active shooter in your workplace may be a current or former employee, or an acquaintance of a current or former employee

• Intuitive managers and coworkers may notice characteristics of potentially violent behavior in an individuals

• Alert your supervisor, or human resources if you believe an employee or coworker exhibits potentially violent behavior

Identifying Threats in the Workplace

• Employees typically do not just “snap,” but display indicators of potentially violent behavior over time

• If these behaviors are recognized, they can often be managed and treated

• Potentially violent behaviors by an employee may include one or more of the following (this list of behaviors is not comprehensive, nor is it intended as a mechanism for diagnosing violent tendencies)

Identifying Threats in the Workplace• Increased use of alcohol and/or illegal drugs

• Unexplained increase in absenteeism; vague physical complaints

• Noticeable decrease in attention to appearance and hygiene

• Depression / withdrawal

• Resistance and overreaction to changes in policy and procedures

• Repeated violations of company policies

• Increased severe mood swings

• Noticeably unstable, emotional response

• Explosive outbursts of anger or rage without provocation

• Suicidal; comments about “putting things in order”

• Behavior which is suspect of paranoia, (“everybody is against me”)

• Increasingly talks of problems at home

• Escalation of domestic problems into the workplace; talk of severe financial problems

• Talk of previous incidents of violence

• Empathy with individuals committing violence

• Increase in unsolicited comments about firearms, other dangerous weapons and violent crimes

DHS & Private Sector Activities

Sector Specific Plan – recently released Hyper link – (https://preview.dhs.gov/publication/nipp-ssp-commercial-facilities-2015)

Intelligence Working Group – established and running to allow for early read of information for potential

impact to Sector and challenge relevance of planned work product. Has allowed us to cut down on the volume

of crap previously published.

Active Shooter Training – Program updated, has been pilot tested and adjusted, is being reviewed by

external affairs and should be released shortly.

Safety Act – Pilot program completed at 5 buildings across the US to allow for single facility to be taken in for

consideration for coverage, includes an on line tool, release expected in late 2016/early 2107.

Post Paris activities – Meetings held to discuss where are the gaps, who isn’t at the table being represented

RE-ISAC

As background ISAC established in 2002 to foster greater sharing of information between gov’t and private sector. RE-ISAC stood up but was a shell of what it could be. Operated under the umbrella of the Real Estate Roundtable and its member associations, BOMA included.

Revamped structure in 2009 with hiring of permanent director and aligning our needs with financial services sector, many members of the Commercial Facilities sector relay on banking including all of us.

We are working through some changes now as we work to re-organize group and to access additional resources (MSA, etc.)

Effort will continue thru 2017.

American Red Cross

• We all know the organization and what it does after disasters

• They need our help (!!) with:

– Blood drives – immediate and continuing need

• National team pitched the Preparedness Committee to establish relationship

• Contact

– Disaster Preparedness – upcoming hurricane and wind season

• Connect with BOMA locals and others to assist in getting the word out now ahead of season as to needs for vacant or under utilized space for

– bulk distribution,

– kitchens,

– feeding stations, and

– command posts

• You know your markets and can be instrumental

• Last re-write of the BOMA Preparedness Guide – Fall 2012

– Cyber issues for owners and operators, threats and cyber hygiene

• Working with insurance firms to target program

– Protests – planning for, potential issues and awareness

– Active Shooter/Workplace violence – incorporate program by DHS

– Lockdown of facilities

– Update for severe weather

Closing and next steps

• Take time (a few meetings) for preparedness and talk to– team members– Team and local first responders – confirm programs and response to events– Team, local first responders and Tenants – Discuss ERP’s

• Meet with your tenants about potential threats/issues – Indicators are occurring within your buildings workforce that could create situations

• Renew/establish networks within your neighborhood to get/stay connected• Reach out to DHS PSA’s (Joe & Jamie), Jory, Wade – Depending on where you work and live• Make Preparedness part of your normal business plan • Risk is and will be part of our industry going forward • Stay alert and aware to incidents – abroad and in US – COPY CATS are real, take stock when

events occur.
