M E M O R A N D U M

A review of the functioning of Rogi Kalyan Samitis (RKS) at all levels of the Health Institution has revealed that these Samitis are not utilizing the RKS fund for the purpose of achieving the objectives for which such Funds were constituted. The central purpose of these Funds is improvement of facilities for patients and to ensure that patient-care does not suffer on account of small operational problems, which can be taken care of by accessing the RKS Funds with delegated authority for incurring expenditure for various activities related to patients welfare. In order that the RKS funds are properly utilized for achieving the intended purpose, the Governor is now pleased to issue a comprehensive operational guideline along with other different issues including delegation of financial power as envisaged in the enclosed annexure, by way of clarification/modification of all previous orders in the matter subject to the condition that normal financial rules shall be maintained.

This order issued with the concurrence of the Finance Department vide their U.O. No.496 Group ‘O’ dated 16.06.2010.

This order shall take immediate effect.

1. Goals & Objectives the RKS (1) The following shall be the Goal of the RKS:

“to form a consultative body at all the State govt. hospitals following the principles of decentralization and community participation which shall function for the improvement of patient care & welfare”

(2) The following shall be the broad objectives of the RKS: (a) To support the hospital administration for effective running of the available clinical services both quantitatively and qualitatively. (b) To ensure the provision of all the non-clinical services and other amenities including provision of diet, drugs, transport, drinking water, waiting rooms / sheds safety & security to the patients and their attendants as per the essential service package following standard operating procedures; (c) To ensure proper supply/availability of required medicines, equipment reagents, furniture, other consumables like X-ray/USG film, ECG Papers, stationery etc (d) To ensure the implementation of all sanitary and hygienic measures including provision of Pest control, cleanliness, toilet facilities for the patients and their attendants (e) To ensure timely maintenance and upkeep of hospital building including premises and to encourage community participation in these activities (f) To ensure timely maintenance and repair of hospital equipment, machinery & other assets subject to the guidelines issued by the govt.; (g) To ensure the rights and responsibilities of the service recipients through installation of Public Information System, Signage system, display a Citizens’ Charter, display of referral maps and chain and other mechanisms (h) To adopt sustainable and environmental friendly measures for day-to-day management of the hospital e.g. Bio-medical Waste Disposal System, etc.

2. Basic Structure (1) The Department of Health & Family Welfare, Government of West Bengal herein after referred to as the Department) shall constitute one RKS in the form of a functional committee for each Hospitals/ Health centres of the state from PHC to Medical College hospitals. (2) The RKS shall not be a society under the West Bengal Societies Registration act, 1961 but shall function under the overall guidance/control of a Health & Family Welfare Samity of the respective tier as specified in the schedule I (herein after referred to as the Parent Society) and shall be binding to all the rules and regulation of that Parent Society. (3) In turn, the Parent Society shall take a resolution for the formation of Rogi Kalyan Samities at different levels and opening of separate Accounts for these RKS. (4) The RKS shall be consisting of ex-officio members and members not holding any public office (hereinafter known as non-official members) as specified in the schedule

VI to schedule XV. The member shall follow the guidelines regarding membership as specified in the schedule II

3. Power of the Government to review and direct (1) The RKS shall not have the power to take any decision contradictory to policies and programmes of the Department. (2) The RKS shall not have the power to amend the guideline issued by the Department. Only the government shall have the power to amend and issue the guidelines regarding RKS. (3) The Department shall have the power to review, monitor, evaluate the performance of the Rogi Kalyan Samities at the District/Sub District levels and issue necessary direction from time to time which shall be binding. (4) For this purpose, the Executive Director of SHFWS and Dy CMOH-I of the district shall act as State Nodal Officer and District Nodal Officer respectively.

4. Power & Function of the RKS: (1) To review and suggest measures for improvement regarding following activities:

(a) Cleanliness and upkeep of Hospital premises both indoor & outdoor; (b) Display of referral map and chain, citizen charter, Drug availability stock, (c) Quality of Diet; (d) Fixed time schedule for Doctor-Patient Party meet; (e) Implementation of provisions of the West Bengal Prohibition of Smoking & Spitting and Protection of Health of Non-smoking and Minors Act, 2001 etc.

(2) To consider the report placed by the Hospital/Health centre Administration at the meeting of RKS regarding the following:

(a) Referral system, (b) Functional position of various equipment including status of AMC; (c) Quality and use of Ambulance services; (d) Functioning of the store including Stock of Mag-sulph, ARV, AVS, Tet.Toxoid, other live saving drugs, Oxygen Cylinder etc.; (e) Performance of Blood Bank; (f) Collection of user charges; (g) Functioning of Pay-clinics etc.

(3) To review the financial account, income & expenditure statements of RKS (4) To encourage and appreciate the hospital staff for the good performance (5) To constitute sub-committees for specific purposes (6) To take decisions in any matter that may be referred by the Parent Society or the State Govt. (7) To undertake any other activities that is consistent with the aims and objectives of the RKS.

5. Power & Function of the Member-Secretary of the RKS: (1) The Member-Secretary shall have the power to take decision and incur expenditure within his power as mentioned in the DFPR (Schedule IV) without the approval of the RKS. However he shall report to the RKS regarding all such action taken and expenditure incurred in the next meeting for information and record. (2) In addition to the power & function mentioned elsewhere in this guideline, the Member-Secretary of the RKS shall carry out and exercise the following functions and powers-:

(a) To manage day to day administration of the RKS with the help of Secretarial Support Unit as specified in para 10. (b) To make all correspondence on behalf of RKS on all matters (c) To arrange for safe custody of all records and moveable properties of the RKS (d) To convey and arrange meetings of the RKS or any sub-committee, record proceedings and resolution and act up on them (e) To assess and rationalize the requirement of manpower, materials Construction / expansion of the physical infrastructure of the Institution; (f) To prepare the Annual Action Plan including budget-estimate, Annual Administrative Report, and Annual Statements of accounts (g) To collect feedback, complaints, suggestion from the serve recipient and members of public and to take appropriate measures on a regular basis. (h) To collect, retain and utilize the user charges subject to the guidelines as specified in schedule III; (i) To implement, monitor and supervise the activities as per approved plan of RKS (j) To distribute the work related to RKS amongst the various staff who shall do this as part of their work without any extra remuneration. (k) To prepare & maintain the Accounts of RKS and arrange for Auditing of the RKS accounts as and when required (l) To undertake any other activities that is consistent with the aims and objectives of the RKS.

6. Emergency power Nothing in these guidelines shall prevent the executive chairperson or the member-secretary from exercising all the delegated powers in case of emergency for furtherance of the objective of the society and the action so taken shall be reported to the RKS at the next meeting for information and record..

7. Meeting & Agenda (1) The meeting of the RKS shall preferably be held at least once in a month in the office of the member-secretary on a fixed date/day each month. Every notice calling meeting of the RKS shall state the date, time and place at which such meeting shall be held and shall be served upon every member of the RKS not less than seven clear days

before the date appointed for the meeting. Such notice shall be issued by the Member-Secretary of the RKS and Proper receipt of acknowledgement shall be collected provided that accidental omission to give such notice to any member shall not invalidate any resolution passed at such meeting. In the event of any urgent business the Member-Secretary may call the meeting of the RKS at clear three days notice. (2) The Chairperson shall Chair the meetings of the RKS. In his/her absence, the Executive chairperson or any member selected by the RKS from among the members present shall act as Chairperson of the meeting. (3) One third of the members of the RKS, including the substitutes nominated and present in person, shall form a quorum at every meeting of the RKS. Absence of any member shall not invalidate the decisions taken in the meeting. (4) Such notice shall be accompanied by an agenda of the business to be placed before the meeting. Following shall be the regular agenda:

(a) Review of the physical and financial performance and service Setting up of delivery targets related to health care and non-health care services. (b) Consideration of action taken reports of the Hospital Administration for remedial action

(5) The minutes including resolution of the RKS meeting shall be placed before the RKS at its next meeting. It shall be send to the Parent Society. (6) Any decision once resolved in the meeting need no further approval. The Member- Secretary can take approval of the Chairman/Executive chairman/vice-chairman through note sheet for any decision particularly regarding expenditure which is urgent in nature and if the meeting of RKS can not be convened in time. Such decisions shall have to be ratified in the next meeting of RKS.

8. Fund (1) The funds of the RKS shall ordinarily be consisted of the following:

(a) Receipt of Grants-in-aid from the Central Government, State Government and/or Parent Society (b) Receipt of Grant from Corpus fund of Parent Society (c) Retention of collected user fees/charges as per guideline specified in schedule III.

(2) All the funds allotted for all Rogi Kalyan Samities shall ordinarily be transferred from the State to Parent Society. It shall then be entered in the main Cashbook of the Parent Society and subsequently the Parent Society shall transfer the fund to the accounts of Rogi Kalyan Samities. (3) Funds received from Parent society for any earmarked activities under National/State run programme/scheme like Illness assistance Fund, Fund for skill development training, IPPI etc should not ordinarily be deposited in the RKS account. (4) The RKS shall have the power to accept contribution, gift, Grants and donations in form of cash, kind or service from any trust, organization and individuals including MP LAD/ MLA LAD only with the prior approval by the Department.

(5) The RKS shall not have any power to raise money through disposal of assets.

9. Bank Account (1) To facilitate the deposit and withdrawal of different fund, the Parent Society shall open a separate savings Bank deposit account for the Rogi Kalyan Samity in the nearest branch of a Bank approved by the Government. (2) The Account shall be named and operated jointly as specified in the schedule VI to XV (3) All funds shall be paid into the RKS’s account with the appointed bank and shall not be withdrawn except by a cheque, bill note or other negotiable instruments signed by signatories as mentioned in the schedule VI to XV.

10. Office Administration (1) The office of the RKS shall be physically co-located within the Hospital in a suitable accommodation. The Department shall provide for the office furniture, equipment and necessary fund for purchase of office stationeries. The RKS fund shall ordinarily not to be utilized for this purpose. (2) The Hospital Administration shall establish a Secretarial Support Unit of the RKS to provide support of day-to-day management of the RKS’s activities like correspondence, maintenance of minutes and resolutions of meetings, etc. This Secretarial Support Unit shall consist of such secretarial, technical, financial and management professionals as specified in the schedule VI to XV

11. Contracts (1) The member- Secretary on behalf of RKS shall have the power to enter into contract with any agency, firm or individual subject to the delegated Financial Power guideline as specified in the schedule IV (2) All contracts and other instruments for and on behalf of the RKS shall be subject to the provisions of the rules & regulations of the parent society, and to be made in the name of the RKS and shall be executed by the persons authorized by the RKS. (3) No contracts for the sale, purchase or supply of any goods and services shall be made for and on behalf of the RKS with any member of the RKS or his/her relative or firm in which such member or his/her relative is a partner or shareholder or involved in any other way. (4) Unless approved by the Department. or the State Nodal Officer to do so, the RKS shall not select or engage any manpower even on daily wage basis or enter into contract with any agency, firm or individual for outsourcing of manpower. No post-facto approval shall be given.

12. Expenditure (5) The member- Secretary on behalf of RKS shall have the power to expend the funds of the RKS subject to the delegated financial power guideline as specified in schedule IV. He/she shall follow the procedures regarding Purchase & Procurement

subject to the guidelines as specified in the existing WBFR with the modification that for purchase upto Rs.5,000 no quotation or tender will be required. (6) Save and except in emergency cases, the RKS fund shall not be utilized for those activities for which there is budgetary provision. A list of activities which can be carried out using the RKS fund is specified in the Schedule XVII. This list is only indicative in nature, not an exhaustive one. (7) However, this fund shall not be used for payment of any salaries, wages, major construction work (civil & electrical), purchase of vehicles, Hospital & office furniture, books & periodicals, Office stationeries or any other expenditure which are not directly related to patient care and welfare (8) For the purpose of day-to-day expenditure, a petty cash balance not exceeding Rs. 5,000/- can be maintained. All payment out of RKS fund over 500/ shall be made by cheque. (9) While issuing any purchase order using RKS fund, it should be clearly mentioned that payment shall be made from RKS fund.

13. Accounts and Audit (1) The RKS shall cause regular accounts to be kept in respect of the affairs of the RKS. A separate double entry cashbook shall be maintained. (2) The accounts of the RKS shall be subject to the Audit by the AGWB in addition to the system of ‘Internal audit’ (3) The report of extract of Audit para with suitable reply shall be communicated to the Parent society. (4) Each RKS shall send the Summary Statement of collection of User charges and expenditure to the Parent Society, on a monthly basis, with a copy to the Department [Additional Director of Health Services (A. A. & V), West Bengal].

Schedule I: Parent Society

(1) State Health & Family Welfare Samity shall act as Parent society for: (a) Medical College & Hospitals as specified in schedule VI (b) Dental Collages& Hospitals as specified in schedule VII (c) Medical Teaching Institutions other than Medical collages as specified in schedule VIII (d) Hospitals other than teaching institutions inside Kolkata as specified in schedule IX (e) Specialized Hospitals situated inside Kolkata as specified in schedule X

(2) District Health & Family Welfare Samity shall act as Parent society for: (a) All District Hospitals as specified in schedule XI; (b) All sub-divisional & State general Hospitals as specified in schedule XII (c) All Specialized Hospitals situated in districts other than Kolkata as specified in schedule XIII

(3) Block Health & Family Welfare Samity shall act as Parent society for: (a) All Rural Hospitals as specified in schedule XIV (b) All Block Primary Health centres as specified in schedule XIV; (c) All Primary Health centres as specified in schedule XV

Schedule II Membership

(1) The membership of an ex-officio member of the RKS shall stand terminated when he/she ceases to hold the office by virtue of which he/she was member and his/her successor to the office shall become such member. (2) Other members of the RKS shall be nominated as per schedule. They shall hold office for a period of three years from the date of their nomination. Such members shall be eligible for re-nomination for another period of three years. (3) The RKS shall maintain a roll of members at its designated office and every member shall sign the roll and state therein his/her rank or occupation and address. No member shall be entitled to exercise rights and privileges of a member unless he/she has signed the roll as aforesaid. (4) A member of the RKS shall cease to be members if s/he resigns, becomes of unsound mind, becomes insolvent or is convicted of a criminal offence involving moral turpitude or removal from the post by virtue of which s/he was holding the membership. Resignation of membership shall be tendered to the RKS in person to its Member-secretary and shall not take effect until it has been accepted on behalf of the RKS. (5) If a member of the RKS changes his/her address he/she shall notify his/her new address to the Member Secretary who shall thereupon enter his/her new address in the roll of member. But if a member fails to notify his/her new address the address in the roll of members shall be deemed to be his/her address. (6) Any vacancy in the RKS shall be filled by the Parent Society. No act or proceedings of the RKS shall be invalid merely by reason of the existence of any vacancy therein or of any defect in appointment of any of its members. (7) No member of the RKS shall be entitled to any remuneration in cash or kind. The members of RKS shall enjoy all the rights and privileges of the members of the parent society and deemed to be public servant. (8) The RKS shall have the power to co-opt any individual as invitee-member for any specific purpose. The invitee-member shall not have the rights and privileges of regular member.

Schedule III: User Charge & Corpus Fund

(1) The Government has already introduced the system of collection of user charges from patients / patient parties at fixed rate for the services rendered by the different Health Institution of this State. The issue of retention of such user charges at different Health Institution to provide better health care services for the people was under consideration of the department for sometime past. The Governor has been pleased to accord approval for such retention of user charges. (2) Accordingly it has been decided that the total user charges collected at each Health Institution, shall be remitted to the designated Savings Bank Account of the respective RKS. Out of the total user charge received, 40% of the user charges shall be retained by the respective RKS in the said bank account. After retaining 40% of the collected user charges, each RKS shall transfer the rest 60% to the corpus fund of the Parent Society. (3) The Parent Society shall allocate funds from this corpus to different Rogi Kalyan Samitis on the basis of need of each Health Institution. (4) The Rogi Kalyan Samiti of the respective Health Institution shall have the full authority to use the fund which is either retained by each facility or allotted to it by the Parent Society. (5) The procedure for accounting such retained user charges shall be as under:

(a) All user charges from the patients / patient parties shall be collected on-line through the existing system of collection. Necessary modification shall be made in the collection receipt. If it is not possible to collect user charge on-line through computer due to some unavoidable problem, the same can be done through paper receipt supplied by the Government. (b) A separate Subsidiary Cash Book shall be maintained on a daily basis for recording all receipts and payments out of the user charges and all entries in the Subsidiary Cash Book shall be authenticated by the Member- Secretary or any other officer authorized by the RKS. (c) The user charges shall be collected as per rates fixed / to be fixed by the Government from time to time. (d) All purchases and new acquisitions made out of this fund shall be entered in to the stock register of the respective Health Institution. (e) Daily collection of the user charges shall be deposited in the RKS account on the next working day and not later than 3 (three) working days. It shall not be deposited in the Government Account through treasury. except diet charges. (f) The RKS shall remit 60% of the user charges collected in a particular month to the Parent Society within the seventh day of following month (g) The RKS shall issue standing instruction to each of the concerned branch of the Bank to remit 60% of the collected user charges in a particular month within the seventh day of following month for credit to the designated Savings Bank Account of the Parent Society

(a) All Mental Hospitals situated in districts other than Kolkata namely: (i) Institute for Mental care, Purulia (ii) Behrampur Mental Hospital, Murshidabad (iii) Tufanganj Mental Hospital, Coochbehar (b) The TB Hospitals situated in districts other than Kolkata namely: (i) N.S.S. Kalyani, Nadia; (ii) B C Roy Chest Sanatorum, Nadia; (iii) Niramoy TB Sanatorium, Birbhum; (iv) Darjeeling TB Hospital; (v) S B Dey Sanatorium, Darjeeling; (vi) Gaurhati TB Hospital, Hoogly, (vii) Srirampur TB Hospital, Hoogly; (viii) Raja Sarat Chrandra TB Hospital, Malda; (ix) M R Bangur TB Sanatorium, Paschim Medinipur

(2) The composition of the Rogi Kalyan Samity for the all the above mentioned hospitals shall be:

(a) Zilla Parishad member of the area/ the chairman of the municipality (If the PHC is physically located in a municipal area) – Chairman (b) Panchayat Pradhan of the panchayat where the PHC is phycically located: Executive Chairman (c) Medical Officer-in-charge-of the PHC: Member-Secretary. (d) One MO/AMO of the BPHC/RH (to be nominated by the BMOH): Jt. Secretary (e) The senior most GNM of the PHC – Member (f) Pharmacist – Member. (g) One Representative of NGO (nominated by BHFWS)– Member. (h) Officer in-charge of the local Police station – Member (i) Nirman Sahayak of the Gram panchayat where the PHC is physically located – Member (j) Local Councillor (If the PHC is physically located in a municipal area): Member
