Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:
A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.
A phase two environmental site assessment of the RSC property, which includes the evaluation of the information gathered from planning and conducting a site investigation, a report, and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.
The information represents the site conditions at the sampling points at the time of sampling only and the conditions between and beyond the sampling points may vary.
As of 2014/11/14, in my opinion, based on the phase one environmental site assessment and the phase two environmental site assessment, and any confirmatory sampling, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that would interfere with the type of property use to which the RSC property will be put, as specified in the RSC.
Ground water sampling has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.
I have, within the six months immediately before the submission of this record of site condition, given written notice of intention to apply non-potable ground water site condition standards to the clerk of the local municipality in which the property is located and the clerk of any upper-tier municipality in which the property is located.
As of 2014/11/14, in my opinion, based on the phase one and phase two environmental site assessments and any confirmatory sampling, the RSC property meets the applicable full depth generic site condition standards prescribed by section 37 of the regulation for all contaminants prescribed by the regulation in relation to the type of property use for which this RSC is filed, except for those contaminants (if any) specified in this RSC at Table 2, Maximum Contaminant Concentrations Compared to Standards Specified in a Risk Assessment.
As of 2014/11/14, the maximum known concentration of each contaminant in soil, sediment and ground water at the RSC property for which sampling and analysis has been performed is specified in this RSC at Table 1, Maximum Contaminant Concentrations Compared to Applicable Site Condition Standards.
I am a qualified person and have the qualifications required by section 5 of the regulation.
I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.
I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.
The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location.

PHASE TWO CONCEPTUAL SITE MODEL Details of the Phase Two Conceptual Site Models developed based on the previous investigations can be found in the following reports and sections:

As discussed in Section 3.3, a CSM was prepared during the Phase One ESA and is included in Appendix C. The PCAs identified in the Phase One Study Area during the Phase One ESA are shown on Figure 3 in Appendix C. The APECs identified at the Phase Two Property during the Phase One ESA are shown on Figure 4 in Appendix C and presented in Table 1 at the end of text. The locations of the PCAs that gave rise to the identification of APECs are also shown on Figure 4 in Appendix C.
The APECs identified during the Phase One ESA were investigated in the Phase Two ESAs and subsurface investigations completed by the City of Kingston and XCG. The Phase Two ESAs and subsurface investigations covered the entire property as shown by the “Phase Two Property Boundary” indicated in Figure 1 at the end of text. The Phase Two results presented in this CSM cover the entire property.
During the Phase Two ESA activities, the stratigraphy at the Phase Two Property was determined to generally consist of sand and gravel fill underlain by silty clay and the south portion of the site consists of exposed bedrock. The shallow groundwater unit at the Phase Two ESA property is comprised of fractured limestone bedrock. The locations of the cross-sections A – A’ and B – B’ are shown on Figure 2 at the end of text, and the stratigraphy of the Phase Two Property is shown in the cross-sections included as Figures 5 and 6 at the end of text. The cross-sections also include the well construction details at the Phase Two Property, groundwater elevations, and the interpreted water table depth.
The average horizontal gradient for the shallow groundwater for March 4, 2014, was 0.134 m/m and for May 1, 2014, the average gradient was 0.287 m/m. The depth to groundwater was measured between 0.6 and 6.98 metres below ground surface (bgs) and varied between the two groundwater level measuring events. The interpreted groundwater elevations measured on March 4 and May 1, 2014, are shown on Figures 3 and 4 at the end of text. Based on the groundwater elevation contours, the general direction of groundwater flow is interpreted to be to the west northwest across the Phase Two Property.
Bedrock was encountered during the Phase Two ESAs and subsurface investigations at depths ranging from 0 to 2.1 metres bgs. No soil appeared to have been brought onto the site from another property, other than gravel that was likely brought on-site to construct the parking areas. Significant changes are proposed for the site including the construction of a multi-unit residential building. Construction of the building and associated facilities would possibly require the removal of some soil currently on site. As of the date of this report, no soil has been removed from the site.

Because the depth to bedrock is less than 2 metres over more than one-third of the area of the Phase Two Property, the site is considered to be a shallow soil property as defined in Section 43.1 of Ontario Regulation 153/04. As a result, the analytical results for the soil and groundwater samples collected during the Phase Two ESA were compared to the standards published by the Ministry of the Environment and Climate Change (MOECC) in “Soil, Ground Water and Sediment Standards for Use Under Part XV.1 of the Environmental Protection Act,” dated April 15, 2011 (MOECC Standard) for shallow soils (coarse-textured) in a non-potable groundwater setting (Table 7 Standards). The City of Kingston, where the Phase Two Property is located, is serviced by a municipal water distribution system with a surface water source, and the soil types at the site include sand and gravel fill, which is coarse-grained material. Based on the proposed land use of residential, the Table 7 Standards for Residential/Parkland/Institutional Property Use, applying to coarse textured soil, were used for evaluation of on-site soil and groundwater.
On a number of areas of the Phase Two Property there is very little soil present—the surface of the bedrock is at or very close to the ground surface. This is true over virtually the entire southern portion of the site. For this reason, there was insufficient soil available to collect samples in this southern area of the Phase Two Property. Consequently, because petroleum hydrocarbons (PHCs) were only a contaminant of concern with respect to APECs on the southern part of the Phase Two Property, where no soil was available for sampling, no soil samples were collected and analyzed for PHCs. PHCs were addressed through groundwater sample collection and analyses.
Exceedances of chloroform were identified in groundwater from monitoring wells MW1 and MW2 reported in the Phase Two ESA conducted by DST Consulting Engineers in April 2012. Exceedances of chloroform and benzene were identified in groundwater from monitoring well MW7, and an exceedance of chloroform was identified in groundwater from monitoring well MW8 reported in the Supplemental Phase Two ESA Investigation conducted by DST in May 2012.
Several rounds of additional monitoring well development and groundwater sampling were completed by the City of Kingston at 1316 Princess Street following the Phase Two ESA work undertaken by DST on the subject property. After these additional rounds of groundwater sampling at 1316 Princess Street, PHCs in the F3 range were found to exceed the applicable MOECC standard for PHC (F3) in one or more of the following monitoring wells: MW2, MW3, MW5, and MW7. However, the additional sampling rounds did not show chloroform or benzene exceedances in any of the wells. Two rounds of groundwater samples were collected from the monitoring wells at 1316 and 1318 Princess Street in March and May, 2014, by XCG. The groundwater samples collected from 1316 Princess Street were submitted for analysis of PHCs (F1 – F4). The groundwater samples collected from 1318 Princess Street were submitted for analysis of PHCs (F1 – F4), VOCs, PAHs, metals, and pH. There were no exceedances of the MOECC Table 7 standards identified in the groundwater samples collected by XCG. Figure 7 at the end of text summarizes the groundwater quality findings.
Based on the results of the recent groundwater sampling, indicating that no contaminants exceeded the applicable standards in at least the two most recent rounds of sampling, it is XCG’s opinion that the previous exceedances identified in groundwater were not truly representative of the dissolved phase contaminants present in the groundwater. Because the sampling method used in the earlier sampling rounds involved collection of samples using

Waterra inertial lift pumps, which can cause agitation of the water column and suspension of fine particulate (which is normally settled in a layer at the bottom of the well) in the water, false exceedances of certain contaminants are believed to have appeared in the groundwater results due to contaminants that were adsorbed to the fine suspended particulate matter rather than being actually dissolved in the groundwater itself. The recent results (March and May 2014) were collected using a low flow sampling technique that minimizes agitation of the water column and gives results that are more truly representative of what is actually dissolved in the groundwater. Therefore, the earlier groundwater exceedances are considered to have been false exceedances. No remediation was completed to address any contaminant exceedances at the site (i.e., no actions were taken to reduce contaminant concentrations to meet the standards), and therefore the post-remediation groundwater monitoring as detailed in Section 40(8)(i)(A) of Schedule E of Ontario Regulation 153/04 was not required.
Because the property is vacant, there are no utilities servicing the property at this time. However, utilities serviced the property in the past and subsurface utility trenches exist for water, sewer and natural gas services. If contamination were present on the property, the utility trenches could potentially influence contaminant migration and distribution. However, as discussed above, contaminants exceeding the MOECC Table 7 standards do not appear to be present on the Phase Two Property based on the investigations completed.
Section 41 of O. Reg.153/04 does not apply to the Phase Two Property as it is not located within, adjacent to, or near an area of natural significance; the soil pH on site is within 5 to 11 range for sub-surface soil; and the qualified person is not of the opinion that Section 41 applies to the subject site. Stratified site condition standards were not used to evaluate soil and groundwater quality at the site.
In the two most recent rounds of groundwater sampling conducted at the Phase Two Property, there were no exceedances of the MOECC Table 7 Standards for PHCs (F1 – F4), VOCs, PAHs and metals identified in groundwater. There were no exceedances of the MOECC Table 7 Standards identified in the soil at the Phase Two Property.
As summarized in Section 5 above, the initial Phase Two ESA activities identified chloroform and benzene as COCs in groundwater and later identified PHCs in the F3 range and 1,4-dichlorobenzene in groundwater at the Phase Two Property. Subsequent groundwater sampling activities at the Phase Two Property indicated concentrations of chloroform, benzene, PHCs in the F3 range, and 1,4-dichlorobenzene below the MOECC Table 7 Standards; therefore, eliminating these as COCs at the Phase Two Property.
The Phase Two ESA pictorial CSM is presented in Figure 8 at the end of text. Based on the findings of the Phase Two ESA, no COCs were identified at the Phase Two Property; therefore, all release and exposure pathways are incomplete at the Phase Two Property. Groundwater at the Phase Two Property is not used as a potable or industrial source of water.

6.4 Phase One Conceptual Site Model The Phase One Study Area, including property boundaries and roadways, is shown on Figure 1. Potentially contaminating activities identified in the Phase One Study Area are shown on Figure 3. There are no water bodies located on the Phase One Property or within the Phase One Study Area. The Phase One Property is not designated as an area of natural significance, and there are no areas of natural significance within the Phase One Study Area. There are 11 monitoring wells and no potable water supply wells on the Phase One Property. There are no potable water supply wells within the Phase One Study Area.
The occupants and land use on the adjacent neighbouring properties are shown on Figure 2. It is possible that the sanitary and storm sewer lines on and in the vicinity of the Phase One Property may influence the migration of shallow contaminants. It is not anticipated that other buried utilities would influence contaminant distribution and migration.
The stratigraphy below the Phase One Property is primarily sand and gravel, and clay with some silt. The majority of the property at 1316 Princess Street is exposed bedrock. Based on a review of borings in the Phase One Study Area, the stratigraphy in the vicinity of the Phase One Property consists of sand, gravel and clay. Borehole logs included in historical Phase Two ESA reports indicated the depth to bedrock (limestone) between 0 and 2.0 metres on the Phase One Property. A pictorial conceptual site model (CSM) is presented in Figure 5.
The data for the Phase One Property and the Phase One Study Area was reviewed and uncertainties identified. The uncertainties that could affect the validity of the model are presented in Table 6-5.

APEC1 The southern part of the Phase One Property at 1316
Princess Street formerly operated as a lumber yard,
hardware store, and door factory.
APEC2 A coal-fired boiler and coal bin were historically located
south of the southern boundary of the 1316 Princess
Street portion of the Phase One Property.
APEC3 An underground storage tank, likely containing
gasoline or another type of fuel, was formerly
located on the 1316 Princess Street portion of the
Phase One Property near its southwest corner.
APEC4 Several electrical transformers, possibly containing
