    Annual Settlement-KSA 19-507 and KSA 19-508 & Motor Vehicle Funds per KSA 8·145(b)

    Please place on the Board of County Commission, Consent Agenda on Thursday, May 23, 2019 for acceptance of annual settlement per KSA 19-507 and KSA 19-506 plus the transfer of MV funds per KSA 8-145(b).

    The information for the annual settlement of receipts and expenditures are documented in OneSolution and are available to be audited. Attached is a copy of the 24MV account in OneSolution since all of the revenue is deposited into this account at this time. This report includes the funds transfer of$ 123,830.97 that will be credited to the County's General Fund per KSA 8·145(b) and$ 25,000 into the retirement account. The settlement of the financial affairs of each city, town, township, school district, or other municipal organizations are also available in OneSolution to be reviewed and audited.

    association organized in and existing under and by virtue of the Jaws of the State of Kansas, with

    one of its principal places of business and correct post office address at 3024 SW Wanamaker

    2. The defendant Mary E. Geer a/k/a Mary Geer may be served with process at 3124

    6. To the best of the Bank's knowledge and belief the individual ddendants, Mary

    E. Geer a/k/a Mary Geer ("Geer") and Elizabeth M. Shuman are not persons in the military

    service, on active duty, as defined in the Servicemembers Civil Relief Acl (''SCRA"). It is

    unknown whether the defendants John Doe and Jane Doe are persons in the military service, on

    active duty, but as to them the Bank seeks only to exclude them from any interest in the real

    estate described below which is the subject of this action.

    7. This Court has jurisdiction over the subject matter and the panies.

    8. Venue is proper in this court pursuant to K.S.A. 60-601 and 60-603.

    9. On or about December 31, 2013, for value received, Geer made, executed, and

    delivered to the Bank a Promissory Note ("Note"), in writing, and by the terms. of which

    promised and agreed to pay the principal amount of $167,000.00 plus interest at the contract nne

    of 5.0% per annum or $37.9807 per day, pursuant to the terms of the Note. A redacted copy of

    the Note is attached as Exhibit "A".

    PETITION FOR FORECLOSURE OF MORTGAGE

    COMES NOW, Plaintiff, Branch Banking and Trust Company, and for its cause of action

    against the Defendants sta1es as fallows:

    1. Plaintiff is a corporation duly organized and existing by virtue of law.

    2. Venue is proper in this District by way of the subject matter, i.e., the foreclosure of a

    mortgage on certain real esta!e located in the County of Shawnee, State of Kansas.

    3. On or about December 7, 2015, Jeremy Adam Leach [hereinafter 'Borrower(s)'] borrowed

    money from, executed and delivered to Armed Forces Bank, a Note, payable in monthly

    installments, in the original principal sum of $62,464.00, together with interest as stated. A true

    and correct copy of the Note Is attached and incorporated by reference as if fully set forth as

    Exhibit 1.

    4. As a part of the loan transaction and in order to secure payment of the Note, Borrower(s)

    and Kahla M. Leach aka Kahla M. Schuler executed and delivered to Mortgage Electronic

    Registration Systems, Inc., as nominee for Armed Forces Bank, a Mortgage of the same date

    5. Branch Banking and Trust Company is the current legal holder of the debt, and possesses

    all rights, including the right of enfore:ement of the Note and Mortgage. A true and correct copy.

    6. Borrower{s} have failed and refused to make the payments as provfded for in the No1e and

    Mortgage, and said contracts are delinquent and the last payment received was the payment

    due October 1, 2018 and Borrower{s) remains due for all payments and interest from 1hat date •

    forward. For this reason, the Note and Mortgage are in default and Plaintiff has elected to

    accelera1e the maturity date of the contracts pursuant to their terms and declare the errti'e

    indebtedness due and payable as follows:

    a. 1he unpaid principal balance due on the Note in the sum of $59,199.01;

    b. the unpaid interest accruing at 3. 75000 percent per annum from October 1, 2018;

    c. any accrued late charges;

    d. any amount paid by Plaintiff for property inspections, BPOs, maintenance

    expenses, Insufficient funds charges, or other escrow advances, If applicable;

    e. all sums paid by Plaintiff for bankruptcy attomey fees and 'court costs, W

    applicable;

    f. all sums adVanced or to be advanced by P\alntlff prior to sale for real estate taxes

    and hazard insurance premiums;

    In accordance with Shawnee County Resolution 2012-59, the term for the City of Topeka Fire Department representative on the Ambulance Advisory Board will expire on June 11, 2019.

    Shawnee County Resolution 2012-59 reads that the ''Topeka Fire Chief shall be invited to recommend a person for this position."

    On April 21, 2019, this office contacted the City of Topeka Fire Chief in regards to making an appointment to the position.

    On May 1, 2019, this office was provided with an email from Fire Chief Craig Duke reappointing EMS Chief Richard Sigle to another term on the Board.

    The email from Chief Duke has been attached to this item

    EMS Chief Sigle was originally appointed to serve a three-year term as the City of Topeka Fire Department representative starting on 6/1112016.

    It is therefore requested that the Board of County Commissioners approve the reappointment of EMS Chief Richard Sigle to serve the three year term on the Ambulance Advisory Board (Term 611112019 to 6/1112022).

    In accordance with Shawnee County Resolution 2012-59, Stormont Vail President & CEO Rob Kenagy notified the Ambulance Compliance Officer that they wish to appoint Trauma Program Manager Brinton Baker to replace Dr. Renea Wilson on the Ambulance Advisory Board.

    Dr. Wilson has taken a new position at Stormont Vail and Shawnee County thanks her for service since she was appointed in 2016.

    Shawnee County Resolution 2012-59 reads that the Ambulance Advisory Board will consist of one "member from Stormont Vail Hospital, preferably someone with knowledge of or experience in providing emergency medical service. The CEO or other management personnel from Stormont Vail Hospital shall be invited to recommend a person for this position."

    In accordance with Shawnee County Resolution 2012-59, the term for the Rural Fire Chiefs representative on the Ambulance Advisory Board will expire on June 11, 2019.

    Shawnee County Resolution 2012-59 reads that the "Rural Fire Chiefs shall be invited to nominate a representative by majority vote."

    On April 21, 2019, this office contacted the Rural Fire Chiefs in regards to making an appointment to the position.

    On May 15, 2019, this office was provided with an email from Mission Township Fire Chief Forrest Walter reporting that the Rural Fire Chiefs had appointed him to another term on the Board.

    The email from Chief Walter has been attached to this item.

    Chief Walter was originally appointed to serve the unexpired three-year term as the Rural Fire Chief representative upon the retirement of Karl McNorton starting on January 8, 2018.

    It is therefore requested that the Board of County Commissioners approve the reappointment of Fire Chief Forrest Walter to serve the three year term on the Ambulance Advisory Board (Term 6111/2019 to 6/1112022).

    Compliance Officer Casteel reported that CECC Director Melanie Bergers had informed him that the CAD to CAD contract has all the signatures it needs and will be placed on the BOCC in the next couple weeks.

    Compliance Officer Casteel reported that there have been a number of calls reoently where the requests for AMR have not been making it to the AMR dispatchers in the CECC.

    Mr. Antnm and Complianoe Officer Casteel reported that CECC Director Melanie Bergers placed a CAD screen at the AMR area of the CECC sc that AMR dispatchers can see the calls that are being

    worked by the Fire Departments.

    Compliance Officer Casteel reported that he has received concerns about the bypassing of EMD processes by not having patients who have access to phone to be dialing 911. Instead many of the calls are going through the police radio system and there is not enough information to determine the true nature and appropriate response modes. Compliance Officer Casteel is going to continue to observe and monitor this issue.

    Compliance Officer Casteel and Mr. Antrim provtded an update to the Board regarding the Protoools

    In answer to a question from a Board Member, Compliance Officer Casteel affirmed his previous stance that the term first responders in Contract C207-2016 between AMR and Shawnee County pertaining to the protocols and the duties of the Joint Medical Director refers only to the 190th Air-Refueling Wing Fire Department, City of Topeka Fire Department, Metropolitan Topeka Airport Authority Ftre, Mission Township Fire Department, Shawnee County Fire District #1, Shawnee County Fire District #2, Shawnee County Fire DIStrict #3, Shawnee County Fire District #4, Shawnee Heights Fire District and Soldier Township Fire Department.

    Mr. Antrim reported that the protocols are now being examtned by the Shawnee County Medical Society.

    Mr. Antrim advised that the Shawnee County Medical Society has appointed an EMS Protocol committee oonSisting of three medical professionals from each of the two hospitals and the Shawnee County Joint Medical Director.

    Mr. Antrim advised that it is the intent of the Shawnee County Medical Society and their committee to streamltne some of the processes

    Mr. Antrim also reported that concerns were brought forth regarding the transport of patients relating to possible traumas. He will provide an update if/when something further is brought forth of this nature.

    Compliance Officer Casteel reported that the communications, size-ups, triaging and other like protocols will be implemented in the future to better serve the whole system.

    Compliance Officer Casteel provided an update to the Board regarding the 2018 First Responder Grant statuses

    Compliance Officer Casteel reported that on January 3, 2019, the Shawnee County Board of County Commissioners approved the recommendations of the Ambulance Advisory Board and awarded lhe following grants:

    • Shawnee County Fire District #4 for AED in the amount of $3,422.00 • Metropolitan Topeka Airport Authority Fire for SafeKits in the amount of $2,445.82 • Shawnee Heights Fire District for CPR Equipment in the amount of $2,534.22 • Soldier Township Fire Department for 02 Bags in the amount of $865.20

    Compliance Officer Casteel advised that he submitted the check requests and in turn will provide the checks directly in person to the recipients.

    Compliance Officer Casteel and Mr. Antrim provided an update to the Board regarding the B+A 2018 Trial Program

    New Business

    Compliance Offrcer Casteel reported that the implementation of the B+A 2018 Trial Program and his request to the Board of County Commissioners regarding the stopping of the clock is still in progress.

    Mr. Antrim reported that AMR is going through restructuring following appointment of a new Regional President.

    Mr. Antrim advised that when the restructuring is completed he will be working with the financral personnel to set tile appropriate pricings as there is a definitive difference in ALS vs. BLS.

    Board approved the recommendation by the Compliance Officer and AMR to approve the Tuition Assistance Application from Soldier Township Fire

    Compliance Officer Casteel reported that on January 3, 2019, the Shawnee County Board of County Commissioners approved the 2018 grants and had further directed that the Ambulance Advisory Board address issues that arose from that process.

    Compliance Officer Casteel reported and outlined the following concerns: • The next First Responder Grant opens on June 1, 2019 • There is only one more Board meeting between the January meeting and the June

    start date of tile First Responder Grant application process • Any/all changes to the process will have to be approved by the Shawnee County

    Board of County Commissioners • It would behoove the Board and all parties/stakeholders to have firm requirements,

    expectations and strategies in place before the application period opens.

    Compliance Officer Casteel provided a draft document regarding the process changes and reported that he had reached out to Board Members for their input in order to formulate the document.

    The Compliance Officer advised that he plans to meet with the County Fire Chiefs at their next meeting in February to get their insight and input based on what the Board Members reccmmended

    Compliance Officer Casteel observations of AMR in their dispatch area of the CECC as well as in the field are continuing and any concerns are being forwarded as deemed appropriate and/or necessary.

    The Compliance Officer will be working to significantly expand the year-end report and presentalion from what was delivered last year in order to put emphasis on those areas where confusion, misunderstandings and misinformation has been exhibited.

    Compliance Officer Casteel reported that he has seen good results from the AMR implementation of shift start-time changes.

    Compliance Officer Casteel advised that there were three complaints in the last month where AMR management has continued to provide stellar assistance in resolving.

    Mr. Antrim reported that there was an accident involving their newer supervisor SUV where it was totaled out

    Mr. Antrim advised that they will have contract with Heartland Park that entails 143 events.

    A RESOLUTION AUTHORIZING THE ISSUANCE OF AN ESTIMATED $13,000,000.00 AGGREGATE PRINCIPAL AMOUNT OF SHAWNEE COUNTY, KANSAS, TAXABLE INDUSTRIAL REVENUE BONDS (EIG WANAMAKER, LLC PROJECT), TO BE ISSUED IN ONE OR MORE SERIES; APPROVING AND AUTHORIZING THE EXECUTION AND DELIVERY OF A BOND TRUST INDENTURE, BASE LEASE AGREEMENT AND LEASE AGREEMENT; APPROVING THE FORM AND AUTHORIZING THE EXECUTION, DELIVERY AND SALE OF SAID BONDS; AND AUTHORIZING THE OFFICERS, EMPLOYEES AND REPRESENTATIVES OF SHAWNEE COUNTY, KANSAS, TO DO AND PERFORM ALL THINGS NECESSARY, APPROPRIATE AND INCIDENTAL THERETO UNDER THE AUTHORITY OF KS.A. §§12-1740 ET SEQ.

    Whereas, the Board of County Comnussioners (the "Boatd'') of Shawnee County, Kansas (the "County'') may, pursuant to K.'i'.A. §§12-1740 et seq., (the .. Act"), issue ib rcvt:nue bunds and use the proceeds therefrom to acquice improvements such u buildmgs, building additions, equipment, furnishings and other betterments and lease the same to a tenant for commercial purposes; and

    Whereas, EIG Wanamaker, lLC (with its successon and assigns, collectively referred to as the "Tenant'') has requested the Board to issue Shawn« County, Kansas, Taxable Industrial Revenue Bonds in one or more series of issues in the estimated aggregate principal amowJt of $13,000,000.00, (the "Bonds''), to (a) finance the construction, equipping. furnishing and improving of commercial related facilities genernlly located in an area southeast of the intersection ofSW 17th Street and Wanamaker Rd. in Topeka, Kansas (the "Project"); and (b) lease said Project under a base k:ase -lease purchase structure to the Tenant; and

    Whereas, the Board, pursuant to the Act, finds that the proposed issuance of the Bonds and leasing the Project to the Tenant would promote economic growth and jobs in the County and the State.

    NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF SHAWNEE COUNTY, KANSAS,

    .fection 1. Definition of Terms. AU terms and phrases not otherwise defined hert:in shall have the respective meanings set forth in the Bond Trust Indenture, (the "Indenture), the Base Lease (the "Base Lease'') and Lease Agreement (the ''Lease''), each dated as of the date reflected thereon.

    S edion 2. Authority to Cause the Project to be Leased. The County, in accordance with the Act, has nol received a wrillen objection from the City concerning the issuance of d1e Bonds; thus, the County is hereby authorized to issue the Bonds and cause the Project to be leased from and back to Tenant as more particularly described in the Indenture,. the Base Lease and the Lease hereinafter authorized.

    Section 3. Authorization of and Security for the Bonds. The County is hereby authorized and directed to isliue its ''Shawnee County, Kansas, Taxable Industrial Revenue Rands, (EIG Wanamaker, ILC Ptoject)" in the estimated aggregate principal amount of $13,000,000 in one or more series of issues for the purpose of providing funds to acquire the Project and pay certain costs of issuance. The Bonds shall be datctl and bear interest, shall mature and be payable at liuch rimes, shall be in such forms, shall be subject to redemption and payment prior to the maturity thereof, and shall be issued in the manner prescribed and subject to the provisionli, covenants and agreements set forth in the Indenture. The Bonds shall be special limited obligations of the County payable solely from the Trust Eslate under the indenture, incluchng revenues from the Lease for the Project. The Bonds shall not be general obligations of the County, nor

  • constitute a pledge of the faith and credit of the County and shall not be payable in any manner by taxation.

    J'ution 4. Authorization of Indenture. The County is hereby authorized to enter into the Indenture with BOKF, N.A., Kansas City, Missouri dated as of the date set forth therein. The form of such document is deemed approved a~ evidenced by the Chairman's execution thereof, under which the County ~hall pledge to the Trustee, the Trust Estate as d~cribed in the Indenture, for the benefit of the owners of the Bonds on the terms and conditions set forth in the Indenture.

    Section 5. Lease of the Project. The County shall cause the Project to be leased from and back to the Tenant pursuant to and in accordance v.rith the provisions of lhe Base Lease and Lease Agreement each to be dated a~ of the date set forth therein, all in the form as approved by the Chairman as i11 evidenced by his execution thereof.

'The Cbainnan of the County is hereby authorized and directed to execute the Bonds and delivtt- them to the Trustee' for-authentication on behalf of, and as the act and deed of the County in the manner provided by the Act attd .in the Indenture. The Chairman, or the member of the CoWity's governing body who is authorized by law to exercise the powers and duties of the Chairman in the Chairman's absence, is further authorized and directed to execute and deliver such other documents on behalf of, and as the act and deed of the County, with such corrections or amendments thereto as the Chairman or other person lawfully acring in the absence of the Chairman may approve, which approval shall be evidenced by his or her execution thereof, and such other documents, certificates and instruments as may be necessary or desirable to carry out and comply v.rith the purposes and intent of this Resolution. The County Oerk or the Deputy Cnnnty Clerk of the County is hereby authorized and directed to attest the execution of the Bonds and such other documents, certificates and instruments as may be necessary or desirable to carry out the intent of this Resolution under the County's corporate seal.

    Sectiotl 8. Pledge of the Project. "The County hereby pledges the Trust Estate as defined in the Tndenture, which includes but is not limited to, the Project and all the Rental Payments under the Lease, to the payment of the Bonds, in accordance with KSA §12-1744. The lien created by such pledge shall be discharged when all of said Bonds shall be deemed to have been paitl Wlthin the meaning of the applicable Indenture.

    Section 9, Further Authority. The officials, officers, agents and employees of the County are hereby authorized and directed to take such action, expend such funds and execute such other documents, certificates and instruments as may be necessary or desirable to carry out the provisions of this Resolution and to carry out and perfo.tm. the du.tiea of the County with [espect to the Bonds as nec~sary to give effect to the transactions contemplated in this Resolution.

    Sectiqa 10. Effective Date. This Resolution shall take effect from and after its passage by the Board

    Section 11. Severability. If any section, paragraph, clause or provision of thi.o;, Rcmlution shall for any reason be held to be invalid or unenforceable, the .invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any remaining provisions of this Resolution.

    2019 Firework Stand Applications/Permits

    In accordance with Home Rule Resolution No. HR 2003-7, attach are the individual firework applications that were filed by the May 1" 2018, deadline for the sale of fireworks between Thursday, June 27 and Friday, July 5, 2019.

    The Shawnee County Public Works Director, Shawnee County Sheriff and I, have reviewed and signed the twenty-three (23) firework stand applications, which generated ten thousand ($11 ,500) dollars. The authorized signatures reftect approval of the applications.

    I have attached a list of all 2019 Firework Applications, which provides specific information on each application as well as a map indicating the location of each firework stand.

    All applicants, reviewing departments and Fire Districts have been notified that the Board of Commissioners will consider their application on Thursday, May 23,2019, at 9:00am.

    Your consideration and approval is requested as well as the signature of Chairman Robert E. Archer.
