Please find enclosed Colt's Manufacturing Company Inc's (CMC) response to the EPA's 104(e) Information Request, the Attachment II.B Form, and the Attachment II.C. Form regarding the request for information for the Solvents Recovery Service of New England (SRSNE) superfund site.

CMC started operating on March 23, 1990 after acquiring the Colt's name and equipment from Colt Industries, Firearms Division. On that same date Colt Industries changed its name to Coltec, and continues to operate out of their NY corporate headquarters. CMC is an independent firm.

CMC does not believe that it shares in the cleanup liabilities involved with the SRSNE site because the previous owner ofthe business (Coltec) still exists, is a viable corporation, and because this business's operations are traceable to the time period involved in this Superfijnd cleanup. This aside, CMC has provided in this submission all ofthe relevant data that it has in its possession to date, and will provide the EPA with any other information that it becomes aware of that relates to the SRSNE case.

CMC's investigation for information was based on the fact that no information was known to exist linking CMC with SRSNE. In fact, those responsible for waste disposal were completely unaware that SRSNE was ever a vendor to Coltec or its predecessors. As such, our investigation consisted of a senior management inquiry, a verbal inquiry of those that were suspected of having any knowledge of Coltec's operating practices, a survey of all CMC departments to search their files for a SRSNE link, and an archive search to locate any file that may have been left by Coltec.

The senior management inquiry did not provide any link to past practices. Currently, there are only two senior managers with ties to the old company, all other senior management persormel have started their employment on or after the start of CMC as a company. The two that carried over were the V.P's of Finance and Administration; both were not directly involved with facility operations in the previous company.

The archive records search has yet to identify any information that is linked to SRSNE. This search consists of retrieving boxes of records from our historic records storehouse and separating the records into categories for review by the appropriate business department. Information that

exhibits a link to SRSNE will be isolated and forwarded to your attention. There are approximately 2400 boxes that remain to be reviewed.

Each department manager received a survey that consisted of a memo-response form describing the reason for a review of departmental records, and a two page list ofthe criteria to be followed in that search. All but two people surveyed responded that no pertinent information was found; the two remaining respondents are the V.P.s ultimately responsible for the archive search. A copy of each survey response is enclosed.

Also enclosed with this letter are the forms Attachment II.B., the Transactional Review Form; and Attachment II.C, the Additional Transactions Form. These forms are based entirely on the data provided by the EPA, sent with your information request, since CMC has no other data to go on at this point in time. Both of these attachments contain information that was reorganized from the document titled Solvents Recovery Service of New England Transaction Documentation Summary (by) Generator. These forms contain an additional listing from the photocopies of SRSNE's log provided by the EPA and overlooked in the Summary list. Copies ofthe Summary and log notes with CMC's markups are enclosed.

CMC's predecessors to our manufacturing locations have operated under a number of different name variations including Colt Patent Firearms, Colts Products, Colts Firearms, Colt Manufacturing Co., Colt Firearms Div., and Colt Industries. While the common denominator in all of these names is the term Colt, the similarity with Colt's Manufacturing Co. Inc. ends there. CMC believes that the response to the 104(e) request is appropriate, and that the procedures utilized to prepare this response and to provide for the future acquisition of data were adequate. At this point CMC has no information to prove or disprove the EPA's claim ofthe volumes of waste sent to SRSNE. We do feel that any fiiture inquiries should be directed to Coltec, 430 Park Ave., New York New York 10022-3597.

The US EPA has ordered CMC to investigate the possible or actual shipment of waste to Solvents Recovery Service (SRS), in Southington, CT, for the period of 1957 to 1991 as part of a Superfimd Site Remedial Action.

Please consult with your key staff and forward aU mformation, known or suspected, about the use of SRS to Joe Fainer (Ext. 1477).

We do not beheve, at this time, that CMC has a major stake in this Superfund action; however, since the potential habihty is expected to reach $30 miUion we want to take every step necessary tofiilfill the EPA's order and thereby hmit our involvement in the case.

I enclose a packet of information from United States Envirorunental Protection Agency ("EPA") concerning alleged shipments to the SRSNE site by Colt Patent Firearms. The package had originally been sent to Colt's Manufacturing Company, despite previous correspondence with EPA requesting that future correspondence be directed to you.

Please note that this package of information was to have included the "transactional documents" providing the alleged link between Colt Patent Firearms and the SRSNE site. However, no such documentation was included in the package. I have written to EPA reiterating our prior request that correspondence be directed to you. I have been told, informally, by Lloyd Selbst of the Office of Regional Counsel that, if you wish to review that documentation and, based upon your review, dispute any of the information, you will have an appropriate period of time to do so.
