RULES OF THE TOURNAMENT

The tournament is to be known as the Bell's Old Tom's Legacy, a tourna-ment to celebrate the spirit of Old Tom Morris and other golfing legends.

The competition is to be played on Wednesday afternoons, Saturday afternoons and Sunday mornings during the period 26th January 2011 to the end of September 2011, and such other days as the Trustees of the Kwa Jabu Trust (The Trustees) may determine from time to time, so as to celebrate special occasions or events during the course of the year.

TheThe competition will be played as a betterball competition with a maximum individual handicap of 24, and in the case of women, a maximum handicap of 30. Only S.A.G.A. handicaps will be accepted. Each team shall also be limited to a maximum combined handicap of 36 in the case of men, and 48 in the case of women. In the event of the combined handicap of a team being higher than 36, then the person with the higher handicap be deducted one shot, if the handicap is still above the maximum combinedcombined handicap of 36, then the person with the lower handicap shall then also be deducted with one shot, and this procedure shall continue until such time as the combined handicap of the team is 36. (For example if the team is made up of an 18 handicap golfer and a 19 handicap golfer, then the 19 handicap golfer shall play off 18, and the combined handicap shall be 36. If the team is made up of an 18 handicap golfer and a 20 handicap golfer, then 1 shot shall be deducted from each of the players official handicaps. Should the combined handicaps be 39 and be made up of a 15 handicap golfer and a 24 handicap golfer, then 1

shot shall be deducted from the 15 handicap golfer and 2 shots from the 24 handicap golfer).

Each month there shall be a winner. The winner shall be the team with the highest stableford score. In the event of there being a tie the winner will be determined by a count out.

TheThe count out shall be on the basis that the team with the highest score on the back nine (ten to eighteen) shall win. Should both teams have equal scores on the back nine, then the team with the best score on the stroke one hole shall win. Should this not decide a winner then it shall progress from stroke 1 to stroke 18. If the count-out does not determine a winner, then the winner shall be decided by the spinning of a coin.

TheThe rules of the R & A shall apply, and such local rules as may be published by the Gowrie Farm Golf Club from time to time. The referee for the monthly tournament shall be the Chairman and the Club Captain of the golf club. Their decision shall be final and binding.

Each month there shall be a winner who shall proceed to the final which is to be held on the 28th and 29th of October 2011. January competitions shall be included in the February competition.

In addition to the monthly winner there shall be a lucky draw. The winner of the lucky draw shall advance to the final, together with the monthly winner. The lucky draw shall be done at the Gowrie Farm Club-house on such day as the Trustees may determine.

In addition to the eight winners of the lucky draw there shall be winners from six competitions which shall be held in Pretoria, Johannesburg, South Coast of KZN, North Coast of KZN, Durban and Hillcrest/Kloof. The winner and the runner-up of The Folie 10 shootout shall make up a team which shall advance to the final.

AA person shall only qualify once for the final, and while players may enter the competition with more than one partner, they shall qualify for the final on the basis of their first winning entry. Should a person qualify a second time in the course of the year, then the runner-up in that particu-lar month shall progress to the final. The person who is a previous winner, who wins for the second time, shall however be entitled to qualify for the monthly prizes.

The final shall be held on the 27th and 28th October 2011. All teams are to register on Thursday the 26th October 2011.

The final shall be 36 holes of golf with prizes being limited to the maximum allowed in terms of S.A.G.A.'s rules relating to amateur golf. In addition to the golf final, all teams shall participate in a fishing competition to be held on the 27th and 28th October 2011. Each team shall fish during designated hours, and the first fish caught by each member of the team shall count for the competition. The competition will be decided on the aggregate length of the fish caught and in addition to the length of the fish caught, each team shallshall be granted a further two centimetres for every stableford point scored by the team on the Par 3 holes during the first 18 holes of the final.

The rules of the fishing competition shall be determined by WildFly and pub-lished prior to the final. The event shall be administered by representatives of WildFly.

Employees of Gowrie Farm and/or Kwa Jabu Trust shall not progress to the final. They shall however be entitled to enter into the monthly competi-tions. Prior to the announcement of monthly winners, handicaps shall be verified by the Trustees.

The winning prize for the competition to be held at the final shall be a trip to Scotland for the winners. The trip shall take place during May 2012. The prize includes flights, meals, nine nights of accommodation, six rounds of golf, together with visits to the R & A Clubhouse.

The prize is not transferable and may not be exchanged for cash.

The winners must procure their own travel insurance, valid passports and visa's.

UnderUnder no circumstances shall the Kwa Jabu Trust or the Gowrie Farm Golf Club be liable to anyone who enters this competition for any direct or consequential loss, however arising which may be suffered relating to the competition, whether as a result of any negligent act or omission, or any default on the Trust nor the Club.

No correspondence will be entered into concerning the winner of the prize and the Trustees decision is final.

TheThe Trust reserves the right to terminate, temporarily suspend or amend the promotion in the event of any unforeseen circumstances outside their reasonable control, or technicalities or other difficulties that might compromise its or Gowrie Farm's integrity.

ByBy entering the competition you will grant Gowrie Farm Golf Club and the Trustees of the Kwa Jabu Trust, its members, its agents, its employ-ees, assignees, the right in their sole and absolute discretion to use and exploit the footage and images of you, in whole or in part, and in connec-tion with the distribution, broadcasting and all advertising and marketing promotions to be done with the footage.

All and any materials, including publicity materials, shall be the sole property of Gowrie Farm Golf Club and the Trust.

By entering the competition you assign to the Trust for present and future copyright, and any other rights and footage and/or images of you for the full period of copyright, and any extensions or renewals.

ByBy entering the competition you agree that you do not have any claim what-soever to future payment by or to the revenues of the club as regard the footages of you.

You specifically acknowledge the terms and conditions which you accepted on entering the competition, including the limitation of liability clause.

The Trust and Club accept no responsibility for difficulties experienced in submitting an entry to this competition.

The laws of the Republic of South Africa go on these terms and conditions and participants agree to be subject to the exclusive jurisdiction of the South African Courts.

Entrants are deemed to have accepted these terms and conditions by par-ticipating in this competition.

The Kwa Jabu Trust's domiciium is 281 Pietermaritz Street, Pietermaritz-burg, 3200, and the Gowrie Farm Golf Club is R103 Nottingham Road, Kwazulu Natal.

The Trustees and Club reserve the right to amend the Rules during the competition, so as to give clarity to the Rules should it be felt so neces-sary.
