    Short title 1. This Act may be cited as the Old Age Se-curity Act.

    Definitions 2.

    In this Act,allowanceallocation

    allowance means the allowance authorized tobe paid under Part III;

    applicantdemandeur

    applicant means a person who has applied, oris deemed to have applied, for a benefit, or withrespect to whom an application for a benefithas been waived;

    beneficiary means a person to whom pay-ment of a benefit has been approved;

    benefit means a pension, supplement or al-lowance;

    cheque means any instrument issued in pay-ment of a benefit;

    common-law partner, in relation to an indi-vidual, means a person who is cohabiting withthe individual in a conjugal relationship at therelevant time, having so cohabited with the in-dividual for a continuous period of at least oneyear. For greater certainty, in the case of an in-dividuals death, the relevant time means the

    (a) if the payment quarter commences onthe first day of April in a payment period, the

    period of three months commencing on thefirst day of November immediately before

    that first day of April,(b) if the payment quarter commences onthe first day of July in a payment period, the

    period of three months commencing on thefirst day of February immediately before thatfirst day of July,

    (c) if the payment quarter commences on thefirst day of October in a payment period, the

    period of three months commencing on thefirst day of May immediately before that firstday of October, and

    (d)

    if the payment quarter commences onthe first day of January in a payment period,the period of three months commencing onthe first day of August immediately beforethat first day of January;

    incomerevenu

    income of a person for a calendar year meansthe persons income for the year, computed inaccordance with the Income Tax Act, exceptthat

    (a) there shall be deducted from the personsincome from office or employment for theyear

    (i)

    a single amount in respect of all officesand employments of that person equal to

    (A) for the purpose of determining ben-efits payable in respect of any month

    before July 2008, the lesser of $500 andone fifth of the persons income fromoffice or employment for the year, or

    (B) for the purpose of determining ben-efits payable in respect of any month af-ter June 2008, the lesser of $3,500 andthe persons income from office or em-

    ployment for the year,

    (ii) the amount of employees premiumspaid by the person during the year undertheEmployment Insurance Act, and

    (iii) the amount of employees contribu-tions made by the person during the yearunder the Canada Pension Plan or a

    provincial pension plan as defined in sec-tion 3 of that Act,

    (b) there shall be deducted from the personsself-employment earnings for the year

    (i) the amount of contributions made in

    respect of those self-employed earnings bythe person during the year under theCanada Pension Planor a provincial pen-sion plan as defined in section 3 of thatAct, and

    (ii) the amount of premium paid by theperson during the year under Part VII.1 oftheEmployment Insurance Act,

    (c) there shall be deducted from the personsincome for the year, to the extent that thoseamounts have been included in computingthat income,

    (i)

    the amount of any benefit under thisAct and any similar payment under a lawof a provincial legislature,

    (ii) the amount of any death benefit underthe Canada Pension Plan or a provincial

    pension plan as defined in section 3 of thatAct, and

    (iii) the amount of any social assistancepayment made on the basis of a means, aneeds or an income test by a registeredcharity as defined in subsection 248(1) ofthe Income Tax Act or under a program

    provided for by an Act of Parliament or aprovincial legislature that is neither a pro-gram prescribed under theIncome Tax Actnor a program under which the amountsreferred to in subparagraph (i) are paid,

    (d) there shall be deducted from the personsincome for the year three times the amount,if any, by which

    (i) the total of any amounts that may bededucted under section 121 of the IncomeTax Act in computing the persons tax

    payable for the year

    exceeds

    (ii) the persons tax for the year other-wise payable under this Part (within themeaning assigned by subsection 126(7) ofthe Income Tax Act for the purposes of

    paragraph 126(1)(b) of that Act) for theyear, and

    Rgime de pensions du Canada ou dunrgime provincial de pensions au sens delarticle 3 de cette loi;

    (e) there shall be deducted from the personsincome for the year any amount included un-der paragraph 56(1)(q.1) or subsection 56(6)of theIncome Tax Actand there shall be in-cluded in the persons income for the yearany amount that may be deducted under

    paragraph 60(y) or (z) of that Act;Ministerministre

    Minister means the Minister of Employmentand Social Development;

    MONTHLY PENSION PENSIONS

    Payment of fullpension

    3.

    (1)

    Subject to this Act and the regula-tions, a full monthly pension may be paid to

    (a) every person who was a pensioner on Ju-ly 1, 1977;

    (b) every person who

    (i) on July 1, 1977 was not a pensionerbut had attained twenty-five years of ageand resided in Canada or, if that persondid not reside in Canada, had resided inCanada for any period after attaining eigh-teen years of age or possessed a valid im-

    migration visa,(ii) has attained sixty-five years of age,and

    (iii) has resided in Canada for the tenyears immediately preceding the day onwhich that persons application is ap-

    proved or, if that person has not so resid-ed, has, after attaining eighteen years ofage, been present in Canada prior to thoseten years for an aggregate period at leastequal to three times the aggregate periodsof absence from Canada during those ten

    years, and has resided in Canada for atleast one year immediately preceding theday on which that persons application isapproved; and

    (c) every person who

    (i) was not a pensioner on July 1, 1977,

    (7) No supplement may be paid to a pen-sioner for

    (a)

    any month that is more than elevenmonths before the month in which the appli-cation is received or is deemed to have beenmade or in which the requirement for an ap-

    plication has been waived, as the case maybe;

    (b) any month for which no pension may bepaid to the pensioner;

    (c) any month throughout which the pen-sioner is absent from Canada having com-menced to be absent from Canada either be-fore or after becoming a pensioner andhaving remained outside Canada before thatmonth for six consecutive months, exclusiveof the month in which the pensioner leftCanada;

    (d) any month throughout which the pen-sioner is not resident in Canada, havingceased to reside in Canada, either before orafter becoming a pensioner, six months be-fore the beginning of that month; or

    (e) any month during which the pensioner is

    (i) a specially qualified individual, and

    (ii)

    a person in respect of whom an under-taking by a sponsor is in effect as providedunder the Immigration and Refugee Pro-tection Act.

    12. (1) The amount of the supplement thatmay be paid to a pensioner for any month in the

    payment quarter commencing on April 1, 2005is,

    (a) in the case of a person other than a per-son described in paragraph (b), five hundredand sixty-two dollars and ninety-three cents,and

    (b) in the case of a person who, on the dayimmediately before that payment quarter,

    had a spouse or common-law partner towhom a pension may be paid for any monthin that payment quarter,

    (i) in respect of any month in that pay-ment quarter before the first month forwhich a pension may be paid to the spouseor common-law partner, five hundred andsixty-two dollars and ninety-three cents,and

    (ii) in respect of any month in that pay-ment quarter commencing with the firstmonth for which a pension may be paid to

    the spouse or common-law partner, threehundred and sixty-six dollars and sixty-seven cents,

    minus one dollar for each full two dollars of thepensioners monthly base income.
