Highlights This Week: Henry signs measure for higher ed By Michael McNutt The Oklahoman 4/1/05 Gov. Brad Henry signed a measure Thursday authorizing a $500 million bond issue for higher education. His action, taken in his office without an audience, quietly ended a struggle that at one time threatened to divide the Republican-controlled House and Democratic-led Senate. House Bill 1191 includes $475 million in bonds for higher education improvements and a $25 million bond bank for future projects for colleges and smaller universities. "In signing this bill, we mark the beginning of an exciting and promising chapter for Okla-homa's system of higher education," the Democratic governor said in a news release. It is the first major piece of legislation this session signed by Henry. Henry will have a ceremonial signing Tuesday, featuring university presidents and stu-dents. State Bond Adviser James Joseph said the bonds could be approved for issuance this sum-mer. Money for the projects could be available a short time later. The Capital Improvement Authority will start the process by selecting a financing team, Joseph said. Henry originally proposed a $500 million program, using a project list prepared by the university and college presidents and using only lottery funds to repay the bonds. House Speaker Todd Hiett, R-Kellyville, came up with a plan that provided less money for the projects, did not have a list and suggested using gross production taxes as a secondary revenue source. Hiett and Henry sparred for two weeks, and it appeared negotiations broke off several times. The two struck a deal two weeks ago. The project list was pared down and the bond bank established. Gross production taxes were used as a secondary funding source to pay back the bonds. The bond bank will be a way for colleges and universities -- except the University of Oklahoma and Oklahoma State University -- to pledge school revenues, such as tuition and

student fees, to building projects. OU and OSU, under the agreement, will be allowed to issue their own bonds. Higher ed bonds get Henry's OK By MARIE PRICE AND APRIL MARCISZEWSKI Tulsa World Staff Writers 4/1/2005 Gov. Brad Henry signed a $475 million higher education bond issue into law Thursday and said it marked the beginning of "an exciting and promising chapter" for higher education. "A strong and vibrant economy hinges on making sure that our colleges and universities are first-rate and adequately preparing our young people for the realities of a global mar-ketplace," Henry said in a statement. "Higher education is pivotal to economic growth, job creation and an enriched quality of life." The final version of the bond measure, House Bill 1191, was the result of a compromise among the governor and Senate and House leaders. "I think it was a great example of the way the Legislature should work," House Speaker Todd Hiett said. The Kellyville Republican said state leaders crafted a plan that will invest millions in state colleges and universities but remove most of the politics from the process by giving the institutions more control of future bonds. The plan includes $25 million to go into a "bond bank" for projects at two- and four-year institutions. Sen. Cal Hobson, D-Lexington, who shepherded HB 1191 through the Senate, said it was the culmination of promises made to universities last May. "I'm ecstatic that it's as we promised them it would be, the first major piece of legislation to reach the governor's desk," Hobson said. He added that he was glad that the proposal made it through the legislative process basi-cally intact, totaling $500 million and funding almost all of the original project list com-piled by university presidents. Henry's action is the first step in a process that backers say will result in construction of about 140 projects in 36 communities. Tulsa-area university officials were pleased.

"We're just very excited," said Oklahoma State University-Tulsa President Gary Trenne-pohl. "We're very pleased they (legislators and the governor) were able to get all of this worked out." Henry's signature was like the blast of the gun at a race, triggering private pledges to the University of Oklahoma-Tulsa and allowing colleges to start taking steps toward getting new classrooms, laboratories and infrastructure. Jim Joseph, the state bond adviser, said he thought the bond funds could be available to the public colleges by early summer. First, the Oklahoma Capital Improvement Authority will select a "financing team" made up of an underwriting service, bond lawyers and others, Joseph said. The team, chosen through competitive bidding, will decide the terms and conditions of the bond sale. Colleges and industries will decide the details of construction and renovation plans. School officials already were jumping into the nitty-gritty details of their construction and renovation projects Thursday. OU-Tulsa got a head start because it raised private money to supplement the bond pro-ceeds, President Ken Levit said. Basic architecture is completed, and final drawings will come next, he said. A new class-room building could be finished by the end of next year, and a new library will be built af-ter that. OU and OSU campuses were considering how to scale back their projects because the bond issue had been reduced to $475 million from $500 million. Officials didn't expect to eliminate any projects but instead planned to, for example, make new buildings smaller than planned or raise private donations to make up the difference. OSU-Tulsa also started working early because its project -- the Advanced Technology Re-search Center -- dovetails into a Vision 2025 project. Trennepohl said he would work with architects, the construction company and academics to decide what to put in the labs and classrooms of the research center. He expected specif-ics to be worked out within six to nine months, the Vision 2025 part of the building to be open by January 2007 and the bond-funded phase to be open in summer 2007, he said. Some schools, such as Rogers State University, will hire one architect for all their projects, and others, such as Northeastern State University in Tahlequah, will seek separate bids for each project.

"Higher education is pivotal to economic growth, job creation and an enriched quality of life. The benefits of House Bill 1191 are tremendous." Henry proposed the bond plan in his State of the State address in February, but it was al-tered in the House, where Republican Speaker Todd Hiett forced through a provision to set up a $25 million "bond bank" to fund future projects designated by college and university presidents. Hiett, R-Kellyville, also inserted a provision giving the University of Oklahoma and Okla-homa State University the authority to issue their own bonds, with the Legislature having the ability to veto their proposals. The $500 million bond plan will be financed mainly by education lottery proceeds, with the gross production tax listed as a secondary revenue source. Henry said the program includes projects college regents and presidents consider critical to their campuses. It is estimated the program will have an initial economic impact of $737 million and will lead to the creation of more than 4,000 new construction jobs. College enrollments are at an all-time high in Oklahoma, but most state colleges and uni-versities have not seen major construction work in more than a dozen years, Henry said. Henry plans a ceremonial signing next week, to be attended by college presidents, stu-dents, legislators and other supporters.
