Die volgende Wet, wat ingevolge die Proklamasie op die lnstelling van Wetgewende en Uitvoerende Gesag vir Suidwes-Afrika, 1985 (Proklamasie R.l01 van 1985), deur die Nasionale Vergadering aangeneem en deur die Administrateur-generaal onderteken is, word hierby afgekondig ingevolge artikel 18 van daardie Proklamasie:-

The following Act, which has been adopted by the National Assembly and signed by the Administrator-General in terms of the South West Africa Legislative and Executive Authority Establishment Proclamation, 1985 (Proclamation R.l01 of 1985), is hereby published in terms of section 18 of that Proclamation: -

Om 'n Nasionale Arbeidsraad in te stel; om sy bevoegdhede en pligte te omskryf; en om vir bykomstige aangeleenthede voorsiening te maak.

DAAR WORD BEPAAL deur die Nasionale Vergadering, soos volg:-
1. In hierdie Wet, tensy uit die samehang anders blyk, beteken-
(i) "aangewese bedryf" 'n bedryf kragtens artikel 1 van die Vakleerlinge Ordonnansie, 1938 (Ordonnansie 12 van 1938), as 'n aangewese bedryf aangewys of geag word aldus aangewys te wees; (ix)
(ii) "arbeidsverhoudinge" aile aspekte van en aangeleenthede wat in verband staan met die verhouding tussen werkgewer en werknemer, met inbegrip van aangeleenthede betreffende kollektiewe bedinging ten opsigte van die besoldiging en ander diensvoorwaardes van die werknemer, die voorkoming en beslegting van geskille tussen werkgewer en werknemer, die toepassing, uitleg en uitwerking van wette op arbeidsaangeleenthede wat deur die Departement geadministreer word en die bestuur van die sake van vakverenigings en werkgewersorganisasies; (xvi)
(iii) "beampte" 'n beam pte of werknemer soos in artikel I van die Regeringsdienswet, 1980 (Wet 2 van 1980), omskryf; (xix)
(iv) "bedryf" ook 'n vertakking van 'n bedryf, of enige groep bedrywe of vertakkings van bedrywe; (xxviii)
(v) "besoldiging" enige betaling in kontant of in natura, of sowel in kontant as in natura, gedoen of verskuldig aan enige persoon uit hoofde van sy diens; en het "besoldig" 'n ooreenstemmende betekenis; (xxii)

NATIONAL LABOUR 'COUNCIL ACT, 1986
ACT
To establish a National Labour Council; to define its powers and duties; and to provide for incidental matters.

BE IT ENACTED by the National Assembly, as follows:-
Act No. 9, 1986
1. In this Act, unless the context indicates otherwise - Definitions.
(i) "additional member" means an additional member of the council appointed under section 6(1)(a); (vi)
(ii) "alternate member" means an alternate member of the council appointed in respect of a member under section 6(1)(b); (xxi)
(iii) "apprentice" means a person employed in terms of a contract of apprenticeship registered in terms of section 4(2) of the Apprenticeship Ordinance, 1938 (Ordinance 12 of 1938), or deemed to be so registered; (xxv)
(iv) "Cabinet" means the Cabinet constituted in terms of section 23 of the South West Africa Legislative and Executive Authority Establishment Proclamation, 1985 (Proclamation R.l01 of 1985); (xii)
(v) "chairman" means the chairman of the council designated as such under section 5(1)(a) and, for the purposes of section 4(2)(b) or 11 , includes the chairman of a committee which, under this Act, exercises or performs the powers, duties or functions of the council; (xxviii)
(vi) "committee" means a committee of the council established under section 7; (xiii)
(vii) "council" means the National Labour Council established under section 2 and, for the purposes of section 10, 11 or 12, includes a committee which, under this Act, exercises or performs

(vi) "bykomende lid" 'n bykomende lid van die raad kragtens artikel 6(1)(a) aangestel; (i)
(vii) "departement" 'n departement by of kragtens artikel 3 van die Regeringsdienswet, 1980 (Wet 2 van 1980), ingestel; (viii)
(viii) "die Departement" die Departement van Burgersake en Mannekrag; (xxvi)
(ix) "gebied" die gebied Suidwes-Afrika; (xxv)

(xiii) "komitee" 'n komitee van die raad kragtens artikel 7 ingestel; (vi)
(xiv) "lid" 'n lid van die raad kragtens artikel 5 aangestel en, by die toepassing van artikel 8, ook 'n lid van 'n komitee wat nie 'n lid van die raad is nie of 'n plaasvervangende lid en, by die toepassing van artikelll of 12, ook 'n lid van 'n komitee, · 'n bykomende lid of 'n plaasvervangende lid; (xvii)
(xv) "Minister" die Minister van Mannekrag en Nasionale Gesondheid en Welsyn; (xviii)
(xvi) "nywerheid" ook enige kategorie onderneming of bedryf, enige afdeling of deel van 'n nywerheid of enige groep nywerhede, asook werk in private huishoudings; (xv)
(xvii) "ondervoorsitter" die ondervoorsitter van die raad kragtens artikel 5(1)(a) as sodanig aangewys; (xxxi)
(xviii) "opleiding" enige opleiding waarvan die besondere oogmerk is om enige persoon beter te bekwaam vir werk wat in of in verband met 'n nywerheid verrig word, en ook opleiding in arbeidsverhoudinge; (xxx)

the powers, duties or functions of the council; (xxii)
(viii) "department" means a department established by or under section 3 of the Government Service Act, 1980 (Act 2 of 1980); (vii)
(ix) "designated trade" means a trade designated as a designated trade under section 1 of the Apprenticeship Ordinance, 1938 (Ordinance 12 of 1938), or deemed to be so designated; (i)
(x) "educational institution" means an institution where.education, which may include training, is provided and which is maintained wholly or partly from money appropriated for such purpose as a charge against the Central Revenue Fund; (xix)
(xi) "employed" or "employment" means employed or employment as an employee; (xi)
(xii) "employee" means any person who is employed by, or working for, an employer and receiving or entitled to receive any remuneration or who works under the direction or supervision of an employer, or any other person who in any manner assist in the carrying on or conducting of the business of an employer; (xxxi)
(xiii) "employer" means any person (including the State) -
(a) who employs, or provides work for, any person and who remunerates or expressly or tacitly undertakes to remunerate him;
(b) who permits any person to assist him in any manner in the carrying on or conducting of his business; or
(c) who trains any person as an apprentice in a Cfesignated trade, excluding an educational institution; (xxix)
(xiv) "employers' organization" means an employers' organization as defined in section 79 of the Wage and Industrial Conciliation Ordinance, 1952 (Ordinance 35 of 1952); (xxx)
(xv) "industry" includes any category of undertaking or trade, any division of or part of an industry or any group of industries, as well as work in private households; (xvi)

(xix) "opvoedkundige inrigting" 'n inrigting waar onderwys, wat opleiding kan insluit, verskaf . word en wat uitsluitlik of gedeeltelik uit geld, wat vir die doel ten laste van die Sentrale Inkoi:nstefonds bewillig is, in stand gehou word; (x)
(xx) "perseel" ook grond, 'n gebou of bouwerk, of 'n voertuig, vervoermiddel, skip, boot of lugvaartuig; (xx)
(xxi) "plaasvervangende lid" 'n plaasvervangende lid van die raad kragtens artikel 6(1)(b) ten opsigte van 'n lid aangestel; (ii)
(xxii) "raad" die Nasionale Arbeidsraad by artikel 2 ingestel en, by die toepassing van artikel 10, 11 of 12, ook 'n komitee wat kragtens hierdie Wet die bevoegdhede, pligte of werksaamhede van die raad uitoefen of verrig; (vii)
(xxiii) "Sekretaris" die Sekretaris van Burgersake en Mannekrag; (xxiii)
(xxiv) "Staat" ook die Administrateur-generaal of die Kabinet, na gelang van die geval; (xxiv)
(xxv) "vakleerling" 'n persoon wat in diens is ingevolge 'n leerlingkontrak wat ingevolge artikel 4(2) van die Vakleerlinge Ordonnansie, 1938 (Ordonnansie 12 van 1938), geregistreer is of geag word aldus geregistreer te wees; (iii)
(xxvi) "vakvereniging" 'n vakvereniging soos in artikel 79 van die Ordonnansie op Lone en Nywerheidsversoening, 1952 (Ordonnansie 35 van 1952), omskryf; (xxix)
(xxvii) "voorgeskryf' of "voorgeskrewe" by regulasie uitgevaardig kragtens artikel 14 voorgeskryf of voorgeskrewe; (xxi)
(xxviii) "voorsitter" die voorsitter van die raad kragtens artikel 5(1)(a) as sodanig aangewys en, by die toepassing van artikel 4(2)(b) of 11, ook die voorsitter van 'n komitee wat kragtens hierdie Wet die bevoegdhede, pligte of werksaamhede van die raad uitoefen of verrig; (v)
(xxix) "werkgewer" enige persoon (met inbegrip van die Staat)-

(xvi) "labour relations" means all aspects of and matters connected with the relationship between employer and employee, including matters relating to collective bargaining in respect of the remuneration and other conditions of employment of the employee, the prevention and settlement of disputes between employer and employee, the application, interpretation and effect of laws governing labour matters administered by the Department and· the management of the affairs of trade unions and employers' organizations; (ii)
(xvii) "member" means a member of the council appointed under section 5 and, for the purposes of section 8, includes a member of a committee who is not a member of the council or an alternate member and, for the purposes of section 11 or 12, includes a member of a committee, an additional member or an alternate member; (xiv)
(xviii) "Minister" means the Minister of Manpower and National Health and Welfare; (xv)
(xix) "officer" means an officer or employee as defined in section 1 of the Government Service Act, 1980 (Act 2 of 1980); (iii)
(xx) "premises" includes land, any building or structure, or any vehicle, conveyance, ship, boat or aircraft; (xx)
(xxi) "prescribed" means prescribed by regulation made under section 14; (xxvii)
(xxii) "remuneration" means any payment in money or in kind, or both in money and in kind, made or owing to any person by virtue of his employment; and "remunerate" shall have a corresponding meaning; (v)
(xxiii) "Secretary" means the Secretary for Civic Affairs and Manpower; (xxiii)
(xxiv) "State" includes the Administrator-General or the Cabinet, as the case may be; (xxiv)
(xxv) "territory" means the territory of South West Africa; (ix)

(a) wat enige persoon in diens het of aan hom werk verskaf en wat daardie persoon besotdig of uitdruklik of stilswyend onderneem om hom te besoldig;
(b) wat enige persoon toelaat om hom op enige wyse by te staan om sy sake voort te sit of te dryf; of
(c) wat enige persoon as 'n vakleerling in 'n aangewese bedryf, uitgesonderd 'n opvoedkundige inrigting, oplei; (xiii)
(xxx) "werkgewersorganisasie" 'n werkgewersorganisasie soos in artikel 79 van die Ordonnansie op Lone en Nywerheidsversoening, 1952 (Ordonnansie 35 van 1952), omskryf; (xiv)
(xxxi) "werknemer" enige persoon wat in diens is by, of werk verrig vir, 'n werkgewer en wat besoldiging ontvang of geregtig is om dit te ontvang of wat onder die aanwysing of toesig van 'n werkgewer werk, of 'n ander persoon wat op enige wyse help om die sake van 'n werkgewer voort te sit of te bedryf. (xii)
2. Daar word hierby 'n raad met die naam die Nasionale Arbeidsraad ingestel.
3. Die oogmerke van die raad is om die administrasie van arbeidsaangeleenthede in die gebied, met inbegrip van die opleiding, indiensplasing, ontwikkeling, veiligheid en welsyn van, en toesig oor, werknemers, en van arbeidsverhoudinge, te bevorder, aan te moedig, te vergemaklik of te koordineer.
4. (1) Die raad moet die ondersoek ins tel wat hy nodig ag, en moet die Kabinet in die algemeen of ten opsigte van 'n bepaalde geval van raad dien, met betrekking tot -
(a) die administrasie van arbeidsaangeleenthede in die gebied, met inbegrip van die opleiding, ontwikkeling, indiensplasing, veiligheid, welsyn van, en toesig oor, werknemers, en van arbeidsverhoudinge; en
(b) enige aangeleentheid wat na die oordeel van die raad daarmee in verband staan of wat deur die Kabinet aan die raad opgedra word.

(xxvi) "the Department" means the Department of Civic Affairs and Manpower; (viii)
(xxvii) "this Act" includes any regulation made thereunder; (x)
(xxviii) "trade" includes any branch of a trade, or any group of trades or branches 'of trades; (iv)
(xxix) "trade union" means a trade union as defined in section 79 of the Wage and Industrial Conciliation Ordinance, 1952 (Ordinance 35 of 1952); (xxvi)
(xxx) "training" means any training which has as its particular aim to better qualify any person for work which is performed in or in connection with any industry, and includes training in labour relations; (xviii)
(xxxi) "vice-chairman" means the vice-chairman of the council designated as such under section 5(l)(a). (xvii)
2. There is hereby established a council to be known as the National Labour Council.
3. The objects of the council shall be to promote, encourage, facilitate or co-ordinate the administration of labour matters in the territory, including the training, employment, development, safety and welfare of, and supervision over, employees, and of labour relations.
4. (1) The council shall make such investigations as it may deem necessary, and shall advise the Cabinet generally or in respect of a particular case, in relation to -
'
(a) the administration of labour matters in the territory, including the training, development, employment, safety, welfare of, and supervision over, employees and labour relations; and
(b) any matter which in the opinion of the council is connected therewith or which is assigned to the council by the Cabinet.

(2) By die toepassing van subartikel (1) -
(a) moet die raad -
(i) voortdurend die mannekragsituasie en arbeidsverhoudinge in die gebied ondersoek en, wanneer nodig, met verwysing na die mannekragsituasie en arbeidsverhoudinge in ander Iande, evalueer;
(ii) op die hoogte bly van ontwikkelinge en neigings op die internasionale arbeidsfront, in die besonder daardie Iande wat met die gebied verband hou;
(iii) voortdurend die toepassing en doeltreffendheid van die bestaande wette op arbeidsaangeleenthede, met die oog op heersende en verwagte ontwikkelinge, ondersoek en evalueer;
(iv) navorsing doen, met die oog op die opleidingsbehoeftes van die gebied, na die opleiding van mannekrag en die ontwerp, beplanning en aanpassing van mannekragprogramme;
(v) die daarstelling van eenvormige standaarde van opleiding, met die oog op die beheer en bevordering van die doeJtreffendheid van opleiding, -ondersoek;
(vi) met vakverenigings en werkgewersorganisasies en met liggame of organisasies wie se werk_§aa~h~de in verband staan met mannekragbenutting, navorsing, opleiding of imder arbeidsaangeleenthede oorleg pleeg;
(b) kan die raad by skriftelike kennisgewing, deur die voorsitter of die ondervoorsitter of 'n beampte deur die voorsitter daartoe gemagtig, onderteken, enige persoon wat na sy oordeel in staat is om enige inligting te verstrek wat die raad in verband met die uitoefening van sy bevoegdhede of die verrigting van sy pligte ingevolge hierdie Wet nodig ag, en wat so 'n persoon verplig kon gew9rd het om te verstrek indien hy voor die raad ingevolge 'n dagvaarding uitgereik · kragtens artikel 11(2) verskyn het, gelas om die inligting wat die raad vereis aan die raad te verstrek in die tydperk en die vorm in die kennisgewing vermeld.

(2) For the purposes of subsection (1) -
(a) the council shall -
(i) continuously inquire into, and evaluate, when necessary, with reference to the manpower situation and labour relations in other countries, the manpower situa~ion and labour relations in the territory;
(ii) keep abreast of developments and trends on the international labour front, particularly those countries that relate to the territory;
(iii) continuously inquire into and evaluate the application and the effectiveness of the existing laws governing labour matters with a view to prevailing and anticipated developments;
(iv) conduct research, with a view to the training needs of the territory, into training of manpower and the design, planning and adaption of manpower programs;
(v) inquire into the establishment of uniform standards of training with a view to the control and promotion of the effectiveness of training;
(vi) consult with trade unions and employers' organizations and with bodies or organizations having functions connected with manpower utilization, research, training and other labour matters;
(b) the council may by written notice, under the hand of the chairman or the vice-chairman or an officer authorized thereto by the chairman, direct any person who in its opinion is able to furnish any information which the council deems necessary in connection with the exercise of its powers or the performance of its duties in terms of this Act, and which any such person could have been compelled to furnish if he had appeared before the council in terms of a summons issued under section 11(2), to furnish the council with such information as the council may require within such period and in such form as may be specified in such notice.

5. (1) die raad bestaan uit -
(a) twee lede deur die Kabinet aangestel wat onderskeidelik as voorsitter en ondervoorsitter van die raad deur die Kabinet aangewys moet word; en
(b) die getal ander lede wat die Kabinet no dig ag met die oog op die behoorlike verteenwoordiging van die belange van onderskeidelik die Staat, werkgewers en werknemers met betrekking tot aile arbeidsaangeleenthede en wat deur die Kabinet aangestel word na oorlegpleging met die persone wat na sy oordeel bedoelde belange van die Staat, werkgewers en werknemers toereikerid verteenwoordig,
en van wie die getal deur die Kabinet bepaal persone moet wees wat na sy oordeel oor deskundige of besondere kennis of ondervinding oor arbeidsaangeleenthede beskik.
(2) Behoudens die bepalings van artikel 8 beklee 'n lid sy amp vir die tydperk van hoogstens drie jaar wat die Kabinet ten tyde van sy aanstelling bepaal, maar kan by verstryking van daardie tydperk weer aangestel word.
(3) (a) Aan 'n lid wat nie op 'n heeltydse grondslag in diens in 'n departement is nie, word, uit geld wat vir die doel ten laste van die Sentrale Inkomstefonds bewillig is, die vergoeding en toelaes, indien daar is, en, ten opsigte van 'n reis vir die doeleindes van die sake van die raad onderneem, die verblyf- en reistoelae, en die redelike verliese deur hom gely omrede hy hom met die sake van die raad besig gehou het, betaal wat die Kabinet bepaal.
(b) Die vergoeding en toelaes kragtens paragraaf (a) bepaal, kan verskil na gelang die amp wat die betrokke lid beklee of die werksaamhede wat hy verrig.
6. (1) Die Kabinet kan -
(a) in<;lien hy dit dienstig ag, vir 'n bepaalde doel en op die voorwaardes en vir die ,tydperk wat hy bepaal, 'n persoon as bykomende lid van die raad aanstel;
(b) met inagneming van die bepalings van artikel 5, vir elke lid 'n plaasvervangende lid aanstel, en 'n plaas-

5. (1) The council shall consist of -
(a) two members appointed by the Cabinet who shall be designated by the Cabinet as chairman and vicechairman of the council, respectively; and
(b) such number of other members as the Cabinet may deem necessary with a view to the proper representation of the interests of the State, employers and employees, respectively, in relation to all labour matters appointed by the Cabinet after consultation with such persons as in its opinion adequately represent the said interests of the State, employers and employees,
of whom such number as the Cabinet may determine shall be persons who in its opinion possess expert or special knowledge or experience on labour matters.
(2) Subject to the provisions of section 8, a member shall hold office for such period not exceeding three years as the Cabinet may determine at the time of his appointment, but may be re-appointed at the expiration of that period.
(3) (a) A member who is not employed in a department on a full-time basis shall be paid out of money, appropriated for such purpose as a charge against the Central Revenue Fund, such remuneration and allowances, if any, and in respect of a journey undertaken for purposes of the business of the council, such subsistence and travelling allowances and such reasonable losses suffered by him because he was engaged in the business of the council, as the Cabinet may determine.
(b) The remuneration and allowances determined under p<;tragraph (a) may differ according to the office held by the member concerned or the functions performed by him.
6. (1) The Cabinet may -
(a) if it deems it expedient, for a particular purpose and on such conditions and for such period as it may determine, appoint any person as an additional member of the council;
(b) with due regard to the provisions of section 5, for every member appoint an alternate member, and an

(2) Die bepalings van subartikels (2) en (3) van artikel 5 is mutatis mutandis ten opsigte van 'n plaasvervangende lid van toepassing.
7. (1) Die raad kan van tyd tot tyd komitees instel om hom by die uitoefening van die een of ander van sy bevoegdhede of die verrigting van die een of ander van sy pligte van raad te dien.
(2) 'n Komitee kragtens subartikel (1) ingestel, bestaan uit die lede of ander persone deur die raad aangestel wat die raad goeddink om lede van daardie komitee ie wees.
(3) Die raad kan enige twee lede van die komitee onderskeidelik as voorsitter en ondervoorsitter van daardie komitee aanwys.
(4) Die raad kan enige van sy bevoegdhede, pligte of werksaamhede aan 'n komitee delegeer, maar word nie ontdoen van 'n bevoegdheid, plig of werksaamheid aldus gedelegeer nie.
(5) Die bepalings van artikel 5(3) is mutatis mutandis van toepassing ten opsigte van 'n lid van 'n komitee wat nie 'n lid van die raad is nie.
8. (1) 'n Lid ontruim sy amp indien -
(a) hy deur 'n bedankingsbrief, deur hom onderteken en aan die Sekretaris gerig en afgelewer, uit sy amp bedank;
(b) hy sonder verlof van die raad van drie agtereenvolgende vergaderings van die raad afwesig is;
(c) in die geval van 'n plaasvervangende lid, die lid ten opsigte van wie hy as plaasvervangende lid aangestel is, sy amp ontruim;
(d) hy ingevolge subartikel (2) van sy amp onthef word.
(2) 'n Lid kan te eniger tyd deur die Kabinet van sy amp onthef word deur 'n skriftelike kennisgewing aan

alternate member so appointed shall act in the place of the member in respect of whom he has been appointed during such member's absence or his inability to act as a member.
(2) The provisions of subsections (2) and (3) of section 5 shall apply mutatis mutandis in respect of an alternate member.

7. (1) The council may from time to "time establish Committees of counci l.
committees to advise it In fhe exercis·e of any of its powers or the performance of any of its duties.
(2) A c-ommittee established under subsection (1) shall consist of such members or other persons appointed by the council as the council may deem fit to be members of that committee.
(3) The council may designate any two members of the committee as chairman and vice-chairman of that committee, respectively.
(4) The council may delegate any of its powers, duties or functions to a committee, but shall not be divested of any power, duty or function so delegated.
(5) The provisions of section 5(3) shall apply mutatis mutandis in respect of any member of a committee who is not a member of the council.
8. (1) A member shall vacate his office if -
(a) he, by writing under his hand addressed and delivered to the Secretary, resigns from his office;
(b) he has absented himself from three consecutive meetings of the council without the leave of the council;
(c) in the case o-f an alternate member, the member in respect of whom he has been appointed as an alternate member vacates his office;
(d) he is removed from his office in terms of subsection (2).
(2) Any member may at any time be removed from his office by the Cabinet by notice in writing addressed and

(3) Indien 'n lid sterf of om die een of ander rede sy amp ontruim, word die vakature, met inagneming van die bepalings van artikel 5, gevul vir die onverstreke gedeelte van die ampstermyn van die lid wat gesterf of, na gelang van die geval, sy amp ontruim bet.
9. (1) Die eerste vergadering van die raad word gehou op die tyd en plek wat die voorsitter bepaal en 'n vergadering van die raad daarna word gehou op die tyd en plek wat die raad, behoudens die bepalings van subartikel (2), bepaal.
(2) Die raad moet minstens vier maal gedurende elke tydperk van 12 maande vanaf die datum van die eerste vergadering van die raad vergader.
(3) Die meerderheid van die lede maak 'n kworum vir 'n vergadering van die raad uit.
(4) Die voorsitter moet op alle vergaderings van die raad waarop hy aanwesig is, voorsit.
(5) Indien die voorsitter afwesig is of om die een of ander rede nie in staat is om sy werksaamhede as voorsitter te verrig nie, neem die ondervoorsitter as voorsitter waar, en terwyl hy aldus waarneem, bet hy al die bevoegdhede en verrig hy al die pligte en werksaamhede van die voorsitter.
(6) Indien die voorsitter sowel as die ondervoorsitter van 'n vergadering van die raad afwesig is, kies die aanwesige lede 'n voorsitter uit hul geleder~ om op daardie vergadering as voorsitter op te tree, en terwyl hy aldus optree, bet hy al die bevoegdhede en verrig hy al · die pligte en werksaamhede van die voorsitter.
(7) Die besluit van die meerderheid van die lede wat op 'n vergadering van die raad aanwesig is, is 'n besluit van die raad: Met dien verstande dat in die geval van 'n staking van stemme die persoon wat op die vergadering as voorsitter optree 'n beslissende stem benewens sy beraadslagende stem bet . .
(8) Geen besluit deur die raad geneem of handeling op gesag van die raad verrig, is ongeldig nie bloot weens 'n vakature in die raad of omdat 'n persoon wat nie geregtig is om as lid sitting te neem nie, as lid sitting geneem bet

delivered to him, if the Cabinet is of the opinion that good reasons for the removal from office of such member exist.
(3) If a member dies or for any reason vacates his office, the vacancy shall, with due regard to the provisions of section 5, be filled for the unexpired portion of the period of office of the member who has died or, as the case may be, vacated his office.
9. (1) The first meeting of the council shall be held at such time and such place as the chairman may determine and any meeting of the council thereafter shall be held at such time and place as the council may, subject to the provisions of subsection (2), determine.
(2) The council shall meet at least four times during any period of 12 months as from the date of the first meeting of the council.
(3) The majority of its members shall form a quorum for a meeting of the council.
(4) The chairman shall preside at all meetings of the council at which he is present.
(5) If the chairman is absent or unable to perform his functions as chairman the vice-chairman shall act as chairman, and while he so acts he shall have all the powers and shall perform all the duties and functions of the chairman.
(6) If both the chairman and the vice-chairman are absent from a meeting of the council the members present shall elect a chairman from among their number to act as chairman at that meeting, and while he so acts he shall have all the powers and shall perform all the duties and functions of the chairman.
(7) The decision of a majority of the members present at the meeting of the council shall be a decision of the council: Provided that in the event of an equality of votes the person presiding at the meeting shall have a casting vote in addition to his deliberative vote.
(8) No decision taken by the council or act performed under the authority of the council shall be invalid by reason only of a vacancy on the council, or by reason only of the fact that any person who is not entitled to sit as a

(9) Die raad rnoet aantekeninge van die verrigtinge op die vergaderings van die raad laat hou.
(10) Die raad kan reels rnaak met betrekking tot die hou van, en prosedure op, vergaderings van die raad of 'n komi tee.
10. (1) Die adrninistratiewe en klerklike werk verbonde aan die verrigting van die raad se werksaarnhede, word verrig deur bearnptes in die Departernent wat deur die Sekretaris vir die doel beskikbaar gestel word.
(2) Die Sekretaris kan 'n bearnpte in subartikel (1) bedoe! as sekretaris van die raad aanwys.
11. (1) Die raad of enige lid wat deur die raad daartoe gernagtig is, kan, in verband met die uitoefening van sy bevoegdhede of die verrigting van sy pligte ingevolge bierdie Wet enige perseel betree waar 'n werknerner in diens is of wat deur 'n werkgewer geokkupeer of gebruik word of waar opleiding plaasvind, en kan op so 'n perseel die ondersoeke en navrae doen wat die raad nodig ag.
(2) Die raad kan enige persoon wat na sy oordeel in staat is om inligting wat hy in verband met die uitoefening van sy bevoegdhede of die verrigting van sy pligte ingevolge hierdie Wet nodig ag, of wat enige hoek, stuk of voorwerp wat hy aldus nodig ag in sy besit of bewaring of onder sy beheer het, dagvaar om op 'n in die dagvaarding verrnelde tyd en plek voor horn te verskyn om ondervra te word, of om daardie hoek, stuk of voorwerp voor te le, en k(!.n enige hoek, stuk of voorwerp wat aldus voorgele is, vir ondersoek in sy besit hou.
(3) 'n Dagvaarding ingevolge subartikel (2) word deur die voorsitter onderteken, en rnoet so naby rnoontlik in die voorgeskrewe vorrn wees, en rnoet op die voorgeskrewe wyse beteken word.
(4) Die voorsitter kan 'n persoon wat by 'n vergadering van die raad teenwoordig is en wat ingevolge subartikel (2) gedagvaar is of kon geword het, oproep en horn 'n eed ople of van horn 'n bevestiging aanneern en die voorsitter of 'n ander lid kan horn ondervra in verband met enige

member sat as a member when the decision was taken or the act was authorized, if the decision was taken or the act was authorized by the requisite majority of the members who were present at the time and entitled to sit as members.
(9) The council shall cause a record to he kept to the ~roceedings of the meetings of the ~ouncil.
(10) The council may make rules in relation to the holding of, and procedure at, meetings of the council or any committee.

10. (1) The administrative and clerical work involved in the performance of the council's functions shall be performed by officers in the Department made available by the Secretary for that purpose.

(2) The Secretary may designate an officer referred to in subsection (1) as secretary of the council.
11. (1) The council or any member of the council Inquiries by counci l.
authorized thereto by the council may, in connection with the exercise of its powers or the performance of its duties in terms of this Act, enter upon any premises where an employee is employed or which is occupied or used by an employer or where training takes place, and may make such investigation and inquiries on any such premises as the council may deem necessary.
(2) The council may summon any person who in its opinion may be able to furnish information which it deems necessary in ·connection with the exercise of its powers or the performance of its duties in terms of this Act, or who has in his possession or custody or under his control any book, document or object which it so deems necessary, to appear before it at a time and place specified in the summons, to be questioned or to produce that book, document or object, and may retain for examination any book, document or object so produced.'
(3) A summons in terms of subsection (2) shall be signed by the chairman, and shall be as nearly as practicable in the prescribed form, and shall be served in the prescribed manner.
( 4) The chairman may call and administer an oath to or accept an affirmation from any person present at any meeting of the council and who was or could have been summoned in terms of subsection (2) and the chairman or any other member may question him in connection with any matter connected with his inquiry, and require him to

aangeleentheid wat met sy ondersoek in verband staari, en van hom die voorlegging eis van enige boek, stuk of voorwerp wat in sy besit of bewaring of onder sy beheer is.
(5) Die ondervraging van 'n getuie kragtens subartikel (4) -
(a) vind agter geslote deure plaas tensy die raad, met die toestemming van die getuie, anders gelas;
(b) kan, met die toestemming van die raad, in die teenwoordigheid van 'n bepaalde persoon plaasvind.
(6) Aan 'n persoon wat gedagvaar is om voor die raad te verskyn, kan, indien die voorsitter oortuig is dat hy as gevolg van sy verskyning ter voldoening aan die dagvaarding geldelike verlies gely het of onkoste moes aangaan, uit gelde, wat vir die doel ten laste van die Sentrale Inkomstefonds bewillig is, die toelaes deur die Kabinet bepaal of 'n bedrag wat gelyk is aan sy redelike werklike verlies of onkoste betaal word.
(7) (a) Die raad kan om die een of ander rede wat hy voldoende ag, gelas dat 'n ondervraging gedoen word deur, of dat 'n boek, stuk of voorwerp voorgele word, aan 'n beampte (in hierdie artikel die ondersoekbeampte genoem) wat deur die raad vir die doel aangewys is.
(b) Die ondersoekbeampte kan 'n getuie wat voor hom verskyn 'n eed ople of van hom 'n bevestiging aanneem, en die toepaslike bepalings van hierdie artikel is mutatis mutandis van toepassing ten opsigte van 'n ondervraging gedoen deur die ondersoekbeampte of die voorlegging aan of inbesithouding deur die ondersoekbeampte van 'n boek, stuk of voorwerp, of die betaling van 'n toelae of enige verliese of onkoste aan so 'n getuie, en die ondersoekbeampte word, by die toepassing van hierdie subartikel, geag die voorsitter te wees.
(8) 'n Persoon mag nie die voorsitter, enige lid of die ondersoekbeampte by die uitoefening van sy bevoegdhede of die verrigting van sy pligte of werksaamhede ingevolge hierdie Wet opsetlik hinder, belemmer of beledig nie.
(9) Indien 'n getuie die bepalings van subartikel (8) oortree, kan die voorsitter gelas dat geen betaling nie of slegs 'n verminderde betaling aan hom ingevolge subartikel (6) gedoen word.

produce any book, document or object in his possession or custody or under his control.
(5) The questioning of any witness under subsection (4) -
(a) shall be conducted in private unless the council, with the consent of the witness, directs otherwise;
(b) may, with the consent of the council, be conducted in the presence of any particular person . .
(6) Any person summoned to appear before the council may, if the chairman is satisfied that he has by reason of his appearance in obedience to the summons suffered pecuniary loss or being put to any expense be paid from money, appropriated for that purpose as a charge against the Central Revenue Fund, such allowances as the Cabinet may determine or an amount equal to his reasonable actual loss or expense.
(7) (a) The council may for any reason for which it may deem sufficient, direct that any questioning be made by, or that any book, document or object be produced to, an officer (in this section referred to as the investigating officer) designated for this purpose by the council.
(b) The investigating officer may administer an oath to or accept an affirmation from any witness appearing before him, and the applicable provisions of this section shall mutatis mutandis apply in respect of a questioning done by the investigating officer or the production to, or retention by, the investigating officer of any book, document or object, or the payment of any allowance or any loss or expense to such a witness, and the investigating officer shall, for the purposes of this subsection be deemed to be the chairman.
(8) No person shall wilfully hinder, obstruct or insult the chairman, any member or the investigating officer in th~ exercise of his powers or the performance of his duties or functions in terms of this Act.
(9) If any witness contravenes the provisions of subsection (8) the chairman may direct that no payment or only a reduced payment be made to him in terms of subsection (6).

(10) 'n Persoon mag nie, indien hy behoorlik kragtens subartikel (2) gedagvaar is, sonder voldoende rede versuim om op die in die dagvaarding vermelde tyd en plek te verskyn nie.
(11) 'n Persoon mag nie, indien hy behoorlik ingevolge subartikel (2) gedagvaar of ingevolge subartikel (4) opgeroep is, versuim om aanwesig te bly totdat die raad hom van verdere aanwesigheid vrystel nie, of weier om as 'n getuie 'n eed opgele te word of 'n bevestiging aan te neem nie, of versuim om op aile aan hom wettiglik gestelde vrae ten voile en op 'n bevredigende wyse na sy beste wete en oortuiging te antwoord nie, of om enige boek, stuk of voorwerp wat in sy besit of bewaring of onder sy beheer is, voor te le wanneer dit wettiglik van hom vereis word om dit te doen nie: Met dien verstande dat die regsreels betreffende privilegie, soos toepaslik op 'n getuie wat gedagvaar is om getuienis af te le of om 'n boek, stuk of voorwerp in 'n geregshof voor te le, van toepassing is in verband met die ondervraging van so 'n persoon of die voorlegging van so 'n boek, stuk of voorwerp.
(12) 'n Getuie wat nadat hy 'n eed opgele is of 'n bevestiging aangeneem het 'n valse antwoord gee op 'n vraag deur die betrokke voorsitter of lid of die ondersoekbeampte aan hom gestel, of 'n valse verklaring doen aangaande enige aangeleentheid, wetende dat daardie antwoord of verklaring vals is, is aan 'n misdryf skuldig en by skuldigbevinding strafbaar met die strawwe wat regtens ten opsigte van meineed opgele kan word.
12. 'n Lid of 'n beampte of 'n persoon wat 'n vergadering van die raad of 'n ondervraging deur 'n ondersoekbeampte in artikel11(7) bedoel, bywoon, mag nie aan enige ander persoon enige inligting openbaar nie met betrekking tot die finansiele of besigheidsake van enige persoon wat hy by die uitoefening van die bevoegdhede of die verrigting van die pligte van die raad ingevolge hierdie Wet of as gevolg van sy bywoning van so 'n vergadering of ondervraging, na gelang van die geval, te wete gekom het, behalwe-
(a) aan die Kabinet, die Minister of 'n beampte; of
(b) by die uitoefening of verrigting van sy bevoegdhede, pligte of werksaamhede ingevolge hierdie Wet; of
(c) wanneer dit op bevel van 'n bevoegde geregshof of ingevolge die een of ander wet vereis word.

(10) No person shall, if he has been duly summoned under subsection (2), fail, without sufficient cause, to attend at the time and place specified in the summons.
(11) No person shall, if he has duly been summoned under subsection (2) or called in terms of subsection (4), fail to remain in attendance until excused from further attendance by the council, or refuse to be administered an oath or to accept an affirmation as a witness, or fail to
i answer fully and satisfactorily to the best of his know; ledge and belief all questions lawfully put to him, or to
produce any book, document or object in his possession or custody or under his control when lawfully requested to do so: Provided that in connection with the questioning of any such person, or the production of any such book, document or object, the law relating to privilege, as
1 applicable to a witness summoned to give evidence or to produce any book, document or object before a court of
; law, shall apply.
(12) Any witness who after having administered an oath or having accepted an affirmation gives a false answer to any question put to him by the chairman or a member or the investigating officer, or makes a false statement on any matter knowing that answer or statement to be false, shall be guilty of an offence and liable on conviction to the penalties which may by law be imposed in respect of perjury.

(b) in the exercise or performance of his powers, duties or functions in terms of this Act; or

13. (1) 'n Persoon wat die bepalings van artikel 11(8), (10) of (11) of 12 oortree of versuim om daaraan te voldoen, is aan 'n misdryf skuldig en by skuldigbevinding strafbaar met 'n boete van hoogstens R200 of met gevangenisstraf vir 'n tydperk van hoogstens drie maande of met daardie boete sowel as daardie gevangenisstraf.
(2) 'n Persoon wat -
(a) versuim om aan 'n lasgewing bedoel in artikel 4(2)(b) te voldoen;
(b) op enige wyse enige verklaring vir die doeleindes van of in verband met enige ondersoek ingevolge hierdie Wet, of so 'n verklaring waarvoor op enige wyse in hierdie Wet voorsiening gemaak word, doen of laat doen terwyl hy weet dat daardie verklaring ten opsigte van enige besonderheid daarvan vals is,
is aan 'n misdryf skuldig en by skuldigbevinding strafbaar met die strawwe by subartikel (1) voorgeskryf.
14. (1) Die Kabinet kan regulasies uitvaardig met betrekking tot enige aangeleentheid wat ingevolge hierdie Wet voorgeskryf moet of kan word, en in die algemeen enige aangeleentheid wat hy nodig of dienstig ag om voor te skryf ten einde die oogmerke van hierdie Wet te bereik.
(2) 'n Regulasie kragtens subartikel (1) uitgevaardig, kan vir 'n oortreding daarvan of 'n versuim om daaraan te voldoen 'n straf voorskryf wat nie die straf by artikel 13 voorgeskryf te bowe gaan nie.
15. Hierdie Wet heet die Wet op die Nasionale Arbeidsraad, 1986, en tree in werking op 'n datum deur die Administrateur-generaal by proklamasie in die Offisiele Koerant bepaal.

13. (1) A person who contravenes or fails to comply Offences and penalties.
with the provisions of section 11(8), (10) or (11) or 12 shall be guilty of an offence and liable on conviction to a fine not exceeding R200 or to imprisonment for a pe-riod not exceeding three months or to both such fine and such imprisonment.
(2) Any person who -
(a) fails to comply with a direction referred to in section 4(2)(b );
(b) in any manner makes or causes to be made any statement for the purposes of or in connection with any investigation in terms of this Act, or any such statement in any other manner provided for in this Act, knowing such statement to be false in respect of any particular thereof,
shall be guilty of an offence and liable on conviction to the penalties prescribed by subsection (1).
14. (1) The Cabinet may make regulations in relation Regulations.
to any matter which is required or permitted to be prescribed in terms of this Act, and generally any matter it deems necessary or expedient to prescribe in order to achieve the objects of this Act.
(2) Any regulation made under subsection (1) may prescribe for a contravention thereof or any failure to comply therewith a penalty not exceeding the penalty prescribed by section 13.
15. This Act shall be called the National Labour Council Act, 1986, and shall come into operation on a date fixed by the Administrator-General by proclamation in the Official Gazette.
