Minutes of the 20th meeting of Board of Trustees of R.P.M.F. held on 19th July, 2005.

The 20th Meeting of the Board of Trustees of R.P.M.F. was held on 19th July, 2005 at 12.30 P.M. in the Committee Room No.-I, Government Secretariat.

The Committee noted the Implementation/Compliance of the decisions of 19th Meeting of the Board of Trustees held on 6th Sept., 2004 and also Confirmed the Minutes of the Meeting. Regarding item No.6 the Director Pension & Pensioners Welfare apprised the Committee that Draft recommendation of the Committee Constituted under the Chairmanship of the Commissioner, Commercial & Taxes Department regarding procurement of Generic medicines by CONFED and other issues were submitted to Shri Deepak Upreti, Chairman of the Committee for approval. In the meanwhile Shri Upreti has been transferred as Divisional Commissioner, Ajmer and the requisite recommendations have not been received from him. The Chairman of the Board of Trustees directed that the recommendations can be finalised by other Senior Member of the Committee. Shri D.C. Gupta, President, Rajasthan Pensioners Samaj who is also a Member of the Committee may see the minutes and finalise them for being submitted to Govt. for taking necessary action in the matter. Item No. 2 Information of the Proceedings of 51st Meeting of the Sub-Committee held on 28th February, 2005.

The Committee noted the proceedings of 51st Meeting of the Sub-Committee held on 28th Feb., 2005. Item No. 3 Consideration of the Note of Shri Ashok Jain, Cooperative Secretary submitted to the Principal Secretary Finance for providing Rs.6.50 Crores to CONFED to enable them to procure medicines for supply to the Pensioners, Serving Government Servants etc.

The matter was discussed. It was the view of the Committee that inflow of the RPMF is lesser than outflow of the Fund and that's why the deficit in the Fund is increasing. To control the deficit, it was the view of the Committee that the Generic medicines may only be prescribed by the Doctors to the Pensioners. The Secretary to Govt., Medical & Health Department pointed out that orders have already been issued to the Doctors for prescribing Generic medicines to the Pensioners. It appears that the Doctors are not complying the orders issued by the Department. The Committee desired that some prescriptions may be collected from the Pensioners where Generic medicines are not being prescribed and send them to the Secretary to Govt., Medical & Health Department for taking necessary action. The Medical & Health Department may reiterate the orders already issued for prescribing only the Generic medicines to the Pensioners, making it clear that non-compliance would invite disciplinary action.

The Registrar, Cooperative Societies pointed out that the financial position of the CONFED/Bhandars is precarious owing to heavy pendency of their claims in the District Treasuries. He has pointed out that claims worth Rs.17.00 Crores of the CONFED and Bhandars are pending. Due to paucity of Funds, the Stockists have denied supplying medicines to the CONFED/Bhandars. He has requested for additional allotment so that the CONFED/Bhandars may procure medicines from the Stockists and supply to the Pensioners may be maintained. It was pointed out that recently Govt. have enhanced the rate of contribution from Serving Employees

and due to this more Funds will be received in the R.P.M.F. It was noted that Finance Department has already provided Rs.10.00 Crores assistance, which is what was provided in the entire year last year. Chairman desired that Finance Department look into the issue sympathetically. Item No. 4 Financial position of the Trust.

The matter was considered. It was the view of the Committee that Finance Department may examine the issue to see as to what best can be done. Item No. 5 Information of Court Cases.

The matter was considered. The Secretary to Govt. Law Department pointed out that the instruction issued by the Hon'ble Supreme Court of India from time to time are being implemented by the Govt. of Punjab regarding providing medical facilities to its pensioners. It was, therefore desired that Rules applicable in respect of Pensioners of Punjab Govt. may be obtained for taking necessary action in our State. The issue of weak pleading of cases by Govt. Advocate also came up for discussion and it was directed by the Committee that some reputed Advocates should be engaged for pleading the cases in the High Court and Supreme Court so that the interest of the State and the Scheme can be safeguarded. Item No. 6 Consideration of Memorandum submitted by Shri D.C. Gupta, President, Rajasthan Pensioners Samaj, Jaipur vide No.8190 dated the 21st June, 05 to Hon'ble Chief Minister Rajasthan and News relating to the Memorandum Publishedin 'RAJASTHAN PATRIKA' dated the 22nd June, 05 regarding problems of Pensioners under Rajasthan State Pensioners Medical Concession Scheme. The issue raised therein had already been discussed and/or disposed off. Item No. 7 Consideration of letter No.1-2/W dated the 24th Dec., 04 from Shri Vasudev Walia, Patiala addressed to the Hon'ble Chief Minister Rajasthan regarding enhancing the amount of Fixed Medical Allowance from Rs.100/- to 250/- p.m. to the State Pensioners residing in other States and getting pension from there. The matter was considered. The proposal of Shri Vasudev Walia regarding enhancing Fixed Medical Allowance in respect of State Pensioners residing and getting Pension in other States was not found acceptable at this stage. RPMF should first workout the total liability in this regard.

Item No. 8 Consideration of the letter dated the 23rd Sept., 04 & 9th Oct., 04 from Shri Raj Singh Nirwan, Chairman & Managing Director (Retd.), National Textile Corporation Ltd. and Ex-Member, State Planning Board, Govt. of Rajasthan addressed to the Hon'ble Chief Minister, Rajasthan regarding problems faced by the Pensioner on account of their medical treatment. The contents of the agenda were noted. The meeting concluded with the Vote of Thanks to the Chair.

Minutes of the 21st Meeting of Board of Trustees under Rajasthan State Pensioners Medical Concession Scheme held on 23rd August, 2005. As directed by the Hon'ble High Court on 10th August, 05 in S.B. Civil Letter Petition No.6019/2004 Ram Lal Sharma V/s. State of Rajasthan an urgent meeting of Board of Trustees to consider the points contained in the Writ petition was held on 23rd August, 2005 at 11.00 A.M. in Committee Room No. I Secretariat. Following decision were taken : -

The matter was considered. This matter is subjudice. Recently Hon'ble High Court in D.B. Civil Mis. Stay Application No.3653/05 in D.B. Civil Writ Petition No.4198/05 Ashish Kishore Saxena V/s. State of Rajasthan has ordered on 01/06/05 as under : -

"Head Learned Counsel for the Petitioner on Stay Application. Issue Notice to the respondents returnable on 20/07/05. Meanwhile the

respondents are restrained from charging the fee of Rs.500/- p.a. from the Pensioners for renewal of their medical diaries."

The decision of the Hon'ble High Court has been implemented by the Board

of Trustees vide letter No.F.4/PMF/2004/19th BOT/5266-5307 dated the 20th August, 2005 addressed to All the District Treasury Officers.

The reply of the D.B. Civil Writ Petition along with application for vacating

the order dated the 1st June, 05 has been filed in the Hon'ble High Court on 17th August, 2005. Thus no action is required as the matter is subjudice. However, the Board of Trustees considered the Renewal charges of medical diaries in respect of Family Pensioners and Pensioners living in remote places getting Fixed Medical Allowance @ Rs.100/- p.m. sympathetically and decided as under : -

1. The Renewal charges of medical diaries in respect of Family Pensioners may be reduced to 50% of the existing rates.

2. The Renewal charges of medical diaries in respect of Pensioners residing in remoted places getting Fixed Medical Allowance of Rs.100/- pm. may henceforth the fixed as Rs.100/- p.a. and made applicable from next financial year.

II. Petitioner's Contention is that the monetary limit for free supply of

medicines is not adequate i.e. Rs.3,000/- & 6,000/-.

The matter was considered. The initial limit for free supply of medicines was fixed as Rs.3,000/- in respect of Pensioners below the age of 75 years. The District Collectors have been authorised to further extend the limit by Rs.7,000/- and Rs.6,500/- respectively. If more medicines are required, the Director Pension & Pensioners Welfare, Rajasthan based on the recommendation of Authorised Medical Attendant can further extend the limit pending Ex-post-facto regularisation by the Sub-Committee of Board of Trustees.

Thus, there is no maximum ceiling fixed for supply of medicines to the

Pensioners. The initial limit of Rs.3,000/- & Rs.6,000/- have been fixed with the view to control the expenditure. There are so many cases wherein limits have been Rs.2.00 lacs, or even more to the Pensioners.

III. Petitioner's Contention is that the Orders of the Hon'ble High Court in D.B. Civil Writ Petition No.978/03 Satya Narain Singh V/s. State are not being implemented.

The matter was discussed. It was pointed out that against the order dated the

11th August, 03 of the Hon'ble High Court an application for clarification/modification has been filed in the High Court on 19th Sept., 2003 and an application for early hearing has also been filed on 16th Sept., 04. C:\web-site\rpmf.doc 7

Recently the Hon'ble High Court, Jodhpur in D.B. Civil Writ Petition No.148/04 Harendra Singh V/s. State of Rajasthan has issued on 12th Feb., 2004 that "in case designated Cooperative shops do not have medicines prescribed by the Doctor a Certificate should be issued by the Cooperative Store that the Pensioners can buy the medicines from any other source on the bases of the Certificate issued by Cooperative Store. The Pensioners should be reimbursed for the medicines purchased by him from any other source in case the prescribe: medicine is not available at the designated Cooperative shops." The Hon'ble High Court desired progress in the matter on 10th may, 2004 and 16th July, 2004.

The Hon'ble High Court was assured that their orders have been

implemented and necessary instructions were issued to all the District Collectors vide order No.2887-2957 dated the 5th July, 04 and No.3742-3815 dated the 18th August, 2004. The District Collectors have also been requested to provide Revolving Fund, if required to the Bhandars for reimbursement N.A.C. issued by Cooperative shops.

The Hon'ble High Court dismissed the above Writ on 3rd Feb., 2005 as

follows : - "We have perused the Compliance Report submitted by Shri K.K. Singhal,

Treasury Officer, Bikaner. We are satisfied that the order of the Court has been complied with. The Petition stands dismissed."

IV. Petitioner's Contention is that Tonics, Bhasmis and Yogendra Ras are not being provided to the Pensioners.

It was decided that clarification from Director, Ayurved may be obtained as

to which of the medicines are required for cure of the disease and which are provided as a tonic only.

V. Problem of reimbursement of N.A.C. bills to the Pensioners.

The CONFED has been provided Revolving Fund of Rs.5.00 lacs to meet with the payment of N.A.C. claims of the Pensioners. They have also been provided more Funds as and when required by them. Recently Rs.30.00 lacs have been provided to CONFED to settle the claims. The Registrar, Cooperative Societies apprised that the claims upto May, 2005 have been settled. The claims of June, 2005 and onwards are in the process of finalisation. Hence there is now no major problem to the Pensioners regarding reimbursement of their N.A.C. claim.

VI. Denial of Homeopathy & Unani treatment to the Pensioners.

The matter was considered. The Homeopathy treatment has already been allowed to the Pensioners vide Para 11B(1) of Rajasthan State Pensioners' Medical Concession Scheme. Regarding Unani treatment the directions issued by Hon'ble Hunan Rights Commission on 18th May, 2005 are being followed and the District Collectors, Treasury Officers etc. have been requested accordingly vide No.F.187/PMF/2003/3840-3915 dated the 20th August, 2004.

The Board of Trustees requested Shri G.S. Gill, Addl. Advocate General, Rajasthan High Court to submit the proceedings of this meeting to Hon'ble High Court on 29th August, 2005 as desired by them.

(i) Issue of excluding costly Bhasmies and Ayurvedic Tonics from the list of reimbursable items may be taken up with Ayurvedic Department.

(ii) Possibilities of Ayurvedic medicines being produced by RDPL may be explored with Medical Department.

Item No. 2 Noting the proceedings of 52nd Meeting of the Sub-Committee held on 07/12/2005. The Committee noted the proceedings of 52nd meeting of the Sub-committee held on 07/12/05. It was noted that Sub-Committee has made 21 relaxation under clause 16 of the Scheme in last five years. C.S. & P.S.F. expressed surprise and anguish that : -

(a) relaxation had been made by the Sub-Committee even while the issue of bills of some important cases were pending and that too in the knowledge of the Sub-Committee.

(b) relaxations are apparently on a "pick and choose" basis, as the Sub-Committee cleared five cases even while more than 30 such cases are stated to be pending.

It was decided that Member Secretary R.P.M.F. would report the basis on

which these exceptions were made (including examination of contents of agenda note) and bring out the policy/criteria followed if any, in granting these relaxations. Report will be made in 15 days. It was also decided that Sub-Committee will not take decisions for relaxation under the savings clause 16 of the scheme till further orders in the matter by the Board of Trustees. Item No. 3 Consideration of formulation of a Uniform Policy for reimbursement for treatment taken in unrecognised hospitals. Board considered the three options for enduring a Uniform policy for granting reimbursement for treatment taken by the pensioners in unrecognised hospitals and decided as under : - (i) A policy may be formulated to deal with the cases of treatment by pensioners in

un-recognized hospitals keeping in mind that there may be at least 4 different situations : (a) expenses incurred in non-recognised hospital without reference being made

as required by rules. (b) expenses incurred in non-recognised hospitas, with a reference duly made. (c) expenses incurred in non-recognised hospitals, even though reference was

made to a recognised hospital. (d) expenses incurred on treatment taken in emergency situations.

This policy will be for cases in the future. In the meanwhile, the pending cases of extreme hardship (life threatening disease/accidents involving heart, cancer or other vital organs) will have to be dealt with [on grounds on equity, as some of them have been cleared by the Sub-Committee] and these may be dealt with in the C:\web-site\rpmf.doc 11

same manner as the cases of government servants who go to un-recognized hospitals, upto the ceiling of 1.20 lacs, with the approval of the Chairman, Board of Trustees, un file. (ii) Option of taking a group hospitalisation mediclaim policy for pensioners may

be explored which should not have exclusions/deductions to which pensioners are not currently subjected to.

(iii) The policy of not reimbursing for treatment taken in unrecognised hospitals in

the State was also discussed. It was decided that list of recognised hospitals in the State should be revised. Norms developed by hospitals recognised by CGHS for treatment of Central Government Pensioners in Rajasthan may be obtained and proposals be framed keeping the same in mind.

Item No. 2 Compliance of the proceedings of the 49th Meeting of Sub-Committee held on 15th April, 2004. The Committee perused the Compliance of the proceedings of the 49th Meeting of Sub-Committee held on 15th April, 2004. Item No. 3 Confirmation of enhancing the monetary limit beyond Rs.10,000/- / Rs.12,500/- for free supply of medicines to the Pensioners during January, 2004 to March, 2004 and also perusal of the progress of the System for reimbursement of the cost of medicines over & above Rs.3,000/- purchased by the Pensioners of Jaipur City during Jan., 04 to March, 04. The Committee agreed for Ex-post-facto regularisation of 1622 cases wherein monetary limit to the tune of Rs.63.14 lacs was extended with the approval of Director Pension & Pensioners Welfare cum Member Secy., R.P.M.F. during January, 2004 to March, 2004. Item No. 4 Transfer of Funds from One Treasury to another for payment of claims of Pensioners and authorised medical shop. The Committee agreed for Ex-post-facto regularisation in respect of Inter Treasury transfer of Rs.375.00 lacs sanctioned by Director Pension & Pensioners Welfare cum Member Secy., R.P.M.F. during January, 2004 to March, 2004. Item No. 5 Ex-post-facto approval of the Sub-Committee in respect of claims of Pensioners allowed by the Director Pension & Pensioners Welfare cum Member Secy., R.P.M.F. for the tests got done by them in the market after obtaining N.A.C. from the Govt. Hospitals in Rajasthan during Jan., 04 to March, 2004. The Committee agreed for Ex-post-facto regularisation of 60 cases wherein reimbursement of Rs.1,59,272/- was allowed to the Pensioners by the Director Pension & Pensioners Welfare cum member Secy., R.P.M.F. on account of tests got done by the Pensioners or their Spouse in the market after obtaining N.A.C. from the Govt. Hospitals during Jan., 04 to March, 04. Item No. 6 Financial position of the Trust. The Committee perused the Financial position of the Trust. The Dy. Secretary to Govt., Finance (G. & T.) Department pointed out that against the Budget provision of Rs.500.00 lacs for the year 2004-05, Government Grant to the C:\web-site\rpmf.doc 14

tune of Rs.167.00 lacs has already been released to the Rajasthan Pensioners Medical Fund upto June, 2004 and the balance amount of Rs.333.00 lacs is being released to the Fund shortly. Last Year Rs.500.00 lacs under Government Grant and Rs.300.00 lacs as Interest free loan were provided to the R.P.M.F. Looking to the heavy liabilities pending in the various District Treasuries under R.P.M.F., the Chairman Sub-Committee directed that Rs.500.00 lacs may be released to the R.P.M.F. in addition to Rs.167.00 lacs released earlier. He has also indicated that more funds than provided last year may be made available to the R.P.M.F. this year. It was also decided that the proposals regarding enhancing the contribution from Serving Employees may be placed before the ensuing meeting of the Board of Trustees which may be got convened early. Item No. 7 The Committee perused the details of the cases pending in the various Courts. It was pointed out by the Member Secy., R.P.M.F. that in compliance of the decision taken in the 49th meeting of the Sub-Committee. Orders for Constitution of Negotiating Committee under the Chairmanship of the Secretary to Govt., Finance (Exp.) Department have been issued vide No.2129-31 dated the 27th May, 2004. The Member Secretary, Board of Trustees further apprised the Committee that details of the cases relating to Pensioners pending in the various Courts have been worked out. It was, therefore, decided that the cases may first be reviewed by Director Pension & Member Secy., R.P.M.F. and President, Rajasthan Pensioners Samaj and thereafter proposals may be submitted to the Chairman for his perusal and taking decision for Negotiations by the Sub-Committee in its ensuing meeting. Item No. 8 Consideration of fixing the Rate of Angiography Tests being done in respect of the Pensioners at S.M.S. Hospital, Jaipur. The matter was discussed in detail with Dr. J.P. Verma, Addl. Superintendent, S.M.S. Hospital, Jaipur who has participated in the Meeting as a Special Invitee. It was pointed out to Dr. Verma that M.B. Govt. Hospital, Udaipur is charging around Rs.3,000/- for Angiography Test whereas S.M.S. Hospital is charging Rs.5,000/- which does not seem to be justified. Dr. Verma apprised the Committee that the charges of Angiography Test in S.M.S. Hospital, Jaipur comes out to be around Rs.5,000/-. He has also pointed out that in S.M.S. Hospital, Jaipur the information obtained from Angiography is recorded on Cine Films while in Udaipur the same is recorded on C.D. (Compact Disk) which makes Jaipur Rs.1,000/- more expensive than Udaipur. Keeping above facts in view it was decided that Rs.4,000/- may be allowed for Angiography test to S.M.S. Hospital, Jaipur. The pending claims of the hospital may be decided accordingly and the excess payment of Rs.1,000/- per test made to the hospital in respect of 277 tests during 30th Sept., 02 to 28th June, 03 may also be adjusted against their pending claims. Item No. 9 Approval of Sub-Committee of the Board of Trustees regarding granting Revolving Fund to the tune of Rs.5.00 lacs by the District Collector, Bikaner to Bikaner Upbhokta Wholesale Bhandar, Bikaner in implementation of the order of the Hon'ble High Court, Jodhpur dated the 12th Feb., 2004 given in D.B. Civil Writ Petition No.148/04 Shri Harendra Singh Chandel V/s. State of Rajasthan. The matter was considered in the light of decision given by the Hon'le High Court, Jodhpur on 16th July, 2004 in D.B. Civil Writ Petition No.148/04 Shri Harendra Singh Chandel V/s. State of Rajasthan and decisions were taken as under in implementations of the directions of the Hon'ble High Court : -

1. The action of District Collector, Bikaner for providing Revolving Fund of Rs.5.00 lacs to Bikaner Upbhokta Wholesale Bhandar in arranging payment of medicines purchased by Pensioners from market against N.A.C. issued by the Bhandar is approved.

2. The District Collector may be requested to ensure compliance of letter No.F.193/PMF/04/2887-2957 dated the 5th July, 2004 from the Director pension & Pensioners Welfare cum Member Secretary, R.P.M.F.

3. The Registrar, Cooperative Societies may be requested to issue instructions to Upbhokta Wholesale Bhandars to make available all the medicines prescrebed to the Pensioners by the Authorised Medical Attendant in their Medical diaries. The issuance of N.A.C. to the Pensioners may be minimised.

4. The District Collectors may be requested to provide Revolving Fund to the Wholesale Bhandars to enable them to make reimbursement of the cost of medicines purchased by Pensioners from market against N.A.C. issued by them. The amount of Revolving Fund may be ascertained by the District Collector/Treasury Officer in the light of N.A.C. to be issued by the Upbhokta Wholesale Bhandars. It may be as per their actual requirement subject to the maximum of Rs.5.00 lacs.

5. The Managing Director, CONFED may also be requested as per (3) above. 6. All the District Collectors may be requested to issue instructions to the Drug

Inspectors to ensure that the verdict of the Hon'ble High Court is complied with invariably and the Pensioners may get all the Genuine medicines on the Cooperative Shops and no Pensioners should go without having the medicines.

7. The Treasury Officer, Bikaner may be requested that the Hon'ble High Court may be apprised that the matter regarding implementation of the judgement of the Hon'ble High Court dated the 12th Feb., 04, 10th May, 2004 and 16th July, 2004 was placed before the Sub-Committee of the Board of Trustees in its 50th Meeting held on 5th August, 2004 and the above decisions were taken to implement the verdict of the Hon'ble High Court.

Item No. 10 Consideration of increasing the staff at Treasury Level, Headquarter and enhancing the remuneration of the staff working in the District Treasuries & in the office of the Board of Trustees. C:\web-site\rpmf.doc 16

The matter was considered. The Director, Treasuries & Accounts, Rajasthan, Jaipur pointed out that due to paucity of time he could not make available the requisite report to the Sub-Committee. He has assured that the report shall be submitted to the Chairman, Sub-Committee within a month positively. The Director Pension & Pensioners Welfare cum Member Secy., R.P.M.F. pointed out that in the office of the Board of Trustees the Officers and the staff are getting nominal emoluments. These emolument are inadequate in view of the increasing trend of market prices including cost of Petrol & Conveyance charges. The Chairman, Sub-Committee desired that proposals for enhancing the emoluments of the staff working in the office of the Board of Trustees may be submitted to him on the file for taking necessary action in the matter. Item No. 11 Consideration of Writing off loss of Rs.25,849/- occurred in Reodar Sub-Treasury (Distt. Sirohi) owing to Theft in the Night on 3rd March, 2001. The matter was considered. It was decided that in the light of F.R. given by Police on 28th Nov., 2001, its acceptance by the Civil Judge & Judicial Magistrate, Reodar and the enquiry made by the District Collector, Sirohi wherein no employee of Sub-Treasury, Reodar was found at fault, it was decided that the loss of Rs.25,849/- occurred in the Sub-Committee owing to Theft may be written off and the District Collector Sirohi may be requested to get payment of Fixed Medical Allowance arranged to the Pensioners by drawing money from the P.D. A/c. of R.P.M.F. of Sirohi Treasury. Item No. 12 Authorisation of Private Medical Shops at places below Tehsil Headquarters in various Districts. The matter was considered. It was decided that in the light of norms prescribed by Sub-Committee in its 33rd meeting held on 1st Dec., 1997 and 48th Meeting held on 26th July, 03 sanction for opening Private medical shops below Tehsil level may be accorded in the following Districts. authorise their shop at these places, 'No Objection Certificate' may be issued so that private medical shops may be authorised there. The District Collectors may be informed in this regard so that they may take necessary action. The norms prescribed for authorising medical shops below Tehsil Level and the details regarding No. of Pensioners and the distance where medical shop already exists may be intimated to the Registrar, Cooperative Societies to enable him to take decision in the matter. Item No. 13 Consideration of allowing charges of PLATELET PHARESIS PROCEDURE to Shri Dewan Das, Pensioner bearing PPO No.53749(R) required in respect of treatment of his Spouse Smt. Beena Devi for Rs.6,000/- in S.M.S. Hospital, Jaipur. The matter was considered in the light of Certificate of Dr. H. Saxena, Prof. & Head, Department of Pathology and Transfusion Medicines, S.M.S. Medical College & Hospital, Jaipur that "PLATELET PHARESIS" procedure is not a diagnostic investigation and Platelets are collected from the healthy Donor and supplied to the patient, it was decided to reimburse balance amount of Rs.2,400/- to Shri Dewan Das, Pensioner bearing PPO No.53749(R) in respect of treatment of his Spouse in S.M.S. Hospital, Jaipur wherein he has incurred expenditure of Rs.6,000/- against which Rs.3,600/- have already been reimbursed to him from the RPMF. Item No. 14 Consideration of granting financial assistance to Shri Ram Nath Arya, Pensioner, PPO No.50429(R) for purchase of Ultra Flex Disc Cov. ESO Stent Sys. 15 cm for Rs.34,992/- from M/s. Beston Scientific International B.V., New Delhi which was required for Implantation to the Patient in his Cancer treatment at S.M.S. Hospital, Jaipur in March, 2004. The matter was considered. It was decided to allow financial assistance @ 80% of the cost of Ultra Flex Disc. Cov. ESO Stent Sys. 15 cm of Rs.34,992/- purchased by Shri Ram Nath Arya, Pensioner bearing PPO NO.50429(R) for Implantation of the same in connection with his Cancer treatment at S.M.S. Hospital, Jaipur in March, 2004. The amount of financial assistance to be allowed to the Pensioner is Rs.27,994/-. Item No. 15 Consideration of granting financial assistance to the Pensioners for purchase of DHS Plate, DHS Screw Drill Bit, Cortical Screw, Proline Mech and other required in their Orthopedic and Hernia Operation in S.M.S. Hospital, Jaipur. The matter was considered. It was decided to allow financial assistance @ 80% of expenditure incurred to the following Pensioners in respect of DHS Plate, DHS Screw, DHS Screw, Drill Bit Cartacal Screw and Proline Mech. purchased by them in connection with Orthopedic/Hernia Operation of Self or their Spouse in S.M.S. Total 8,966/- 7,173/- Item No. 16 Consideration of enhancing the monetary limit of financial assistance being allowed to the Pensioners for their Bye-pass Surgery treatment in recognised hospitals outside the State. The matter was considered. It was decided that financial assistance for CABG treatment taken in AIIMS, New Delhi or any other recognised hospitals outside the State may be enhanced from Rs.44,000/- to Rs.48,000/- as the AIIMS New Delhi has increased the package charges of CABG in their General Ward from Rs.55,000/- to Rs.60,000/- vide No.F.4/Billing/Sec/03-04 dated the 15th January, 2004 and as such 80% of the package charges of Rs.60,000/- may be allowed to the Pensioners w.e.f. 5th August, 2004. It was decided that Finance (Rules Dn.) Department may be requested to issue necessary amendment in the Rajasthan State Pensioners Medical Concession Scheme. Item No. 17 Consideration of letter No.21 dated the 6th June, 2004 of Shri D.C. Gupta, President, Rajasthan Pensioners Samaj addressed to the Secretary to Govt., Finance (Exp.) Department regarding implementing the Rajasthan State Pensioners Medical Concession Scheme more effectively in order to reduce the deficit of the Fund and to resolve the problems of the Pensioners in getting medicines. The matter was discussed in detail. The Member Secy. brought to the notice of the Sub-Committee, the heavy variation in per Pensioner expenditure in different Districts. Letters written to the District Collectors and the Treasury Officers to ensure tight control over the Fund were placed before the Sub-Committee for perusal. Looking to the heavy liabilities outstanding in the District Treasuries and increasing trend of expenditures on medicines, specialised treatment etc. it was considered that the contribution from serving Govt. Servants towards RPMF should be increased by 50% of the existing contribution for which the matter may be placed in the meeting of the Board of Trustees which may be got convened early.

It was pointed out that the Cooperative shops are charging cost of medicines being supplied to the Pensioners @ M.R.P. – 2% + Local Tax/Sales Tax. It was therefore, decided that Cooperative Department and Medical & Health Department C:\web-site\rpmf.doc 19

may look into the matter and see that nothing beyond M.R.P. may be charged from the RPMF. The Managing Director, CONFED and Cooperative Bhandar may also be requested to consider lumpsum discount on supply of medicines to the Pensioners on total yearly payments, as they are earning handsome profit on sale of Medicines.

Regarding prescribing medicines in Generic names to the Pensioners by the Authorised Medical Attendant, the Special Secretary to Govt., Medical & Health Department, Rajasthan, Jaipur was requested to look into the matter and issue the orders for strict compliance to the Doctors so that the expenditure on account of medicines being supplied to the Pensioners may be reduced.

To examine thoroughly the issue regarding purchase, supply and price fixation of the medicines by CONFED/Bhandar and prescribing medicines in Generic names by the Authorised Medical Attendant and other points regarding monitoring and control of RPMF Fund, it was decided to constitute a Committee consisting of the following members under the Chairmanship of Divisional Commissioner, who is also the chairman of Medicare Relief Society : - 1. Divisional Commissioner, Jaipur Chairman 2. Director, Medical & Health Services, Rajasthan Jaipur Member 3. Registrar, Cooperative Societies, Jaipur Member 4. Supdt., S.M.S. Hospital, Jaipur Member 5. Managing Director, CONFED, Raj., Jaipur Member 6. President, Rajasthan Pensioners Samaj, Jaipur Member 7. The Director Pension & Pensioners Welfare, Rajasthan Jaipur Member Secy. The Orders for formation of the Committee and its scope shall be issued by the Secretary to Govt. Finance (Exp.) Deptt., Rajasthan, Jaipur, Chairman of the Sub-Committee. The scope of the Committee shall be as follows : - 1. The Committee will examine and decide the Generic medicines which shall be

prescribed by the Authorised Medical Attendants to the Govt. Servants/Pensioners. A list of such generic medicines shall be provided to the Cooperative Medical Shops/other Authorised Medical Shops. The Cooperative Medical Shops and other Authorised medical shops shall keep all these Generic medicines in their shops. The Medicare Relief Society and the CONFED will exchange the list of medicines kept by them.

2. The Committee will also examine the issue whether Medicare Relief Society can also be authorised to supply medicines to the Pensioners.

3. The Committee shall also consider and discuss the letters written by the Member Secy., R.P.M.F. to the District Collectors and Treasury Officers regarding monitoring and control of R.P.M.F. Scheme.

4. The Committee shall also review the system purchase of medicines by CONFED and Upbhokta Wholesale Bhandars and also the rates fixed by the Institutions for supply of medicines to the Pensioners. It has been pointed out to the Committee that in many cases the print rate of M.R.P. of Generic medicines may be much higher than its purchase price by the CONFED or Upbhokta Wholesale Bhandars. The Committee will consider to bring parity between the purchase price and sale price of the medicines by adding reasonable profit in the purchase price so as to provide relief to the Pensioners Fund.

Item No. 18 Consideration of the cases which were deferred in the 49th Meeting of Sub-Committee for being discussed in the ensuing i.e. 50th Meeting of the Sub-Committee. The matter was considered and it was decided that based on letter No.398 dated the 29th Jan., 2004 of the District Collector, Barmer that facility of Brain Hemmarage treatment was available neither at Barmer nor at Jodhpur, financial assistance @ 80% of the reimbursable amount may be allowed to Shri Shankar Lal Jain bearing PPO No.431995 (R) in his claim for Rs.39,186/- regarding treatment of his Spouse Smt. Radha Devi at AIIMS, New Delhi during 4th Dec., 03 to 20th Dec., 03 without the constitution of Medical Board. The Treasury Officer, Barmer may work out reimbursable amount in the claim of Rs.39,186/- submitted by the Pensioner and 80% thereof may be allowed as financial assistance to him. Other two claims of Sarvashri Raghu Nath Prasad Sharma bearing PPO No. 131050 (R) and Radh Mohan Goyal, Pensioners may be rejected as the treatment in both the cases was taken outside the State without getting the Medical Board constituted. Item No. 19 Consideration of issuance of medical diary to Shri Suraj Karan Verma (Ajmer District) who is in receipt of Ex-gratia allowance of Rs.1,275/- w.e.f. 12th July, 2002. The matter was considered. As Shri Suraj Karan Verma is in receipt of Ex-gratia allowance and not the Pension, no medical diary can be issued to him under the provisions of the Rajasthan State Pensioners Medical Concession Scheme. Item No. 20 Consideration of allowing reimbursement of medicines purchased by Shri Murli Dhar Sharma, Pensioner bearing PPO No.44639 (R) from Rajasthan Medicare Relief Society (Life Line Fluid Store) from 30/08/03 to 19/09/03 during which he remained as indoor Patient at S.M.S. Hospital, Jaipur and also to Shri Maheshwar Dayal Kurmi, Pensioner, bearing PPO No.148237 (R) in connection with the treatment of his Spouse who was as indoor Patient in S.M.S. Hospital, Jaipur during the 05/12/03 to 08/12/03 for purchase of medicines from Life Line Fluid Store without obtaining N.A.C. from Cooperative shop. The matter was considered. It was decided to reimburse the cost of medicines (Rs.9,397/-) purchased by Shri Murli Dhar Sharma, Pensioner bearing PPO No.44639(R) during his Indoor treatment from 30/08/03 to 19/09/03 from Life Line Fluid Store, Jaipur after getting the same prescribed by the Authorised Medical Attendant of S.M.S. Hospital, Jaipur in the medical diary. Similarly it was decided to reimburse the cost of medicines purchased by Shri Maheshwar Dayal Kurmi, Pensioner bearing PPO No.148231 from Life Line Fluid Store, Jaipur in connection with Indoor treatment of his Spouse at S.M.S. No reimbursement is allowed to the Pensioner in respect of test not exceeding Rs.500/- got done in the market even after obtaining N.A.C. from the Hospital. Item No. 21 Consideration of allowing financial assistance to Shri Ram Sahai, Pensioner, PPO No.107912 (R) in connection with the expenditure of Rs.12,633/- incurred by him on his Eye treatment at Post-graduate Institute of Medical Education & Research, Chandigarh during March, 2001 and again incurred an expenditure of Rs.10,595/- on his Urology treatment in this hospital during 24/05/03 to 29/05/03. The matter was considered. It was decided to reject the claims of Shri Ram Sahai, Pensioner bearing PPO NO.107912(R) in connection with treatment at Post-graduate Institute of Medical Education & Research, Chandigarh during March, 2001 and again during 24/05/03 to 29/05/03 as both the times the Pensioner did not get the Medical Board Constituted for his treatment outside the State & deliberately flouted the provisions of the Scheme. Item No. 22 Clarification regarding providing medical facilities to both the Wives of the Pensioner under Rajasthan State Pensioners Medical Concession Scheme. The matter was considered. It was decided that in both the cases it may be ascertained as to under what circumstances family pension was allowed to Two Wives of the deceased Pensioner. The present position regarding providing medical facility in both the cases may also be ascertained. Addl. Item No. 1 Medical claim of Shri V.K. Garg, Retd. Managing Director Rajasthan State Road Development & Construction Corporation Ltd. for Rs.46,152/- in connection with Cancer treatment of his Wife at S.M.S. Hospital & Zenana Hospital, Jaipur.

Medical claim of Shri Ram Swaroop Patwari for Rs.2,16,659/- in connection with Brain Hemurrage treatment of his Wife at Sterling Hospital, Ahmedabad. The matter was considered. It was decided to reject both the claims of Sarvashri V.K. Garg & Ram Swaroop Patwari as in the former Shri V.K. Garg did not get the medicines prescribed in the old as well as duplicate medical diary and in the other case the Pensioner did not get the Medical Board Constituted for treatment of his Spouse and went to Sterling Hospital, Ahmedabad for treatment at his own which is not a recognised hospital. The Committee perused the Compliance of the Proceedings of the 50th Meeting of Sub-Committee held on 5th Aug., 2004. Item No. 3 Confirmation of enhancing the monetary limit beyond Rs.10,000/- /Rs.12,500/- for the supply of medicines to the Pensioners during April, 04 to January, 2005. The Committee agreed for Ex-post-facto regularisation of Rs.2,954/- cases wherein monetary limit to the tune of Rs.237.33 lacs was extended with the approval of Director, Pension & Pensioners Welfare cum Member Secretary, RPMF during April, 2004 to January, 2005. Item No. 4 Transfer of Funds from One Treasury to another Treasury for payment of claims of Authorised shop. The Committee agreed for Ex-post-facto regularisation in respect of Inter treasury transfer of Rs.1,128/- lacs sanctioned by Director, Pension & Pensioners Welfare cum Member Secretary, RPMF during April, 2004 to January, 2005. Item No. 5 Ex-post-facto approval of the Sub-Committee in respect of claims of Pensioners allowed by the Director Pension cum Member Secretary, RPMF for the tests got done by them in the market after obtaining N.A.C. from the Govt. Hospitals in Rajasthan during the period from April, 04 to Jan., 2005. The Committee agreed for Ex-post-facto regularisation of 166 cases wherein reimbursement of Rs.5,02,195/- was allowed to the Pensioners by the Director Pension & Pensioners Welfare cum Member Secretary, RPMF on account of tests got done by the Pensioners or their Spouse in the market after obtaining N.A.C. from the Govt. Hospitals during April, 04 to January, 2005. Item No. 6 Information of Court Cases. The Committee perused the details of the cases pending in the various Courts and decided that the Negotiating Committee which was Constituted vide Order No.2129-31 dated the 27th May, 2004 as per decision of the Sub-Committee taken in its 49th Meeting held on 15th April, 2004 may review all the pending cases and make recommendations for settlement of the same. The Director, Pension & Pensioners Welfare & President, Rajasthan Pensioners Samaj, Jaipur may do the needful in this connection and submit their report to the Chairman, Sub-Committee for his perusal and order. Item No. 7 Financial position of the Trust & reducing the deficit of the Fund.

The Committee perused the Financial position of the Trust and expressed concern on the increasing trend of deficit in the Rajasthan Pensioners Medical Fund. The Committee also perused the recommendations of the Meeting of the Committee held under the Chairmanship of the Secretary to Govt., Finance (Exp.) Department on 9th Feb., 05 to take measures to reduce the deficit of RPMF and decided as under : -

1. The issue of providing lumpsum discount by CONFED and Upbhokta Wholesale Bhandars to the RPMF on supply of medicines to the Pensioners on total yearly payment may be kept pending.

2. It was principally agreed by the Committee that the District Collectors may be empowered to authorise Private medical shop in their Districts after inviting Tenders for supply of medicines to the Pensioners against N.A.C.s issued by Cooperative medical shops in respect of medicines not available with them. It was also decided that Finance (Rules) Department may be requested to amend para 11 of the Scheme accordingly.

3. The Medicare Relief Societies in the District may also be authorised to supply medicines to the Pensioners and prefer their claims to the concerned Treasury Officer for reimbursement in the same manner the Private & Cooperative shops submit their claims to the Treasury Officer for payment may be requested to insert the requisite provision in Para 10 of the Rajasthan State Pensioners Medical Concession Scheme.

Item No. 8 Consideration of letter No.GSG:AAG:L:04:110 dated the 21st July, 2004 from Shri S. Gurcharan Singh Gill, Addl. Advocate General, Rajasthan, High Court, Jaipur addressed to the Chief Secretary cum Chairman of Board of Trustees Rajasthan State Pensioners Medical Concession Scheme in connection with making proper Amendment in the Scheme for grant of Medical concession to State Govt. Pensioners. The matter was considered. It was decided to submit the matter on file to the Finance Department for examination and necessary action. Item No. 9 Consideration of letter No.5161 dated the 14th Sept., 2004 from Shri D.C. Gupta, President, Rajasthan Pensioners Samaj, Jaipur & letter dated the 10th Sept., 2004 from the Pensioners Samaj, Sub-Branch, Rajgarh (Alwar) regarding directions to the Govt. Hospitals in Rajasthan not to take any advance amount from the Pensioners for their Specialised treatment in the Hospitals. The matter was considered and it was decided that it is not practicable to provide any advance amount to the Govt. Hospitals for conducting Specialised treatment of Pensioners in these hospitals. Hence the proposal was rejected. Item No. 10 Consideration of the Report of the Director, Treasuries & Accounts submitted by him vide No.14302 dated the 21st Dec., 04 regarding increasing the Staff at

Treasury level & improving the work of RPMF in Treasuries as well as at Headquarter level. The matter was considered and it was principally agreed that in the office of the Board of Trustees One Computerman with machine may be kept on contract basis. It was, therefore, decided to process the matter on the file and submitted to the Finance Department for consideration. It was also decided that the proposals for keeping additional staff at Treasury level may also be processed on file accordingly. Item No. 11 Consideration of the Memorandum of President, Rajasthan Pensioners Samaj, Dungarpur dated the 17th Dec., 2004 addressed to Hon'ble Chief Minister Rajasthan & Chief Secretary Rajasthan forwarded by the Finance (G.&T.) Department vide their letter dated the 6th January, 2005. The matter was considered and rejected. Item No. 12 Consideration of Judgement of LOK ADALAT, Udaipur dated the 23rd Sept., 2004 given in the case of Shri Parshmal Kothari V/s. State & Treasury Officer, Udaipur and also notice dated the 4th January, 2005 issued by Civil Judge, Udaipur. The matter was considered. In the light of the decision of LOK ADALAT, Udaipur and directions of the Civil Judge, Udaipur and it was decided to allow financial assistance of Rs.44,000/- to Shri Parashmal Kothari in relaxation of Para 4E of the Scheme for his Bye-pass Treatment at Sterling Hospital, Ahmedabad during March, 2005. Item No. 13 Ex-post-facto approval of Sub-Committee for allowing cost of implants for Rs.1,21,055/- required in the Cancer, Orthopedic, Harnia etc. treatment of the Pensioners in Govt. Hospitals in Rajasthan. The Sub-Committee has agreed to accord Ex-post-facto approval for the financial assistance of Rs.1,21,055/- allowed to the 11 Pensioners for purchase of Implants required in their Cancer, Orthopaedics and Harnia etc. treatment in Govt. Hospitals in Rajasthan. It was also agreed that henceforth the Director, Pension & Pensioners Welfare cum Member Secretary, RPMF may decide such cases at his level pending Ex-post-facto approval of the Sub-Committee in its ensuing meeting. Item No. 14 Consideration of allowing financial assistance to Dr. B.L. Gupta, Pensioner bearing PPO No.108182 (R) for Rs.3,38,140/- in connection with his Heart treatment at Escort Hospital, New Delhi during August/Sept., 99.

The matter was considered. Shri B.L. Gupta got his medical diary renewed on 27th May, 94 and thereafter he did not get the same renewed. He underwent treatment in the year 1999. Since he did not possess a renewed medical diary at the time of treatment, his claim was rejected. Item No. 15 Consideration of granting financial assistance to Shri Daulat Mal Singhvi, Pensioner (Retd. Chief Engineer, Irrigation Department) for his Angioplasty with Stent, treatment at Escort Hospital, New Delhi during 15th May, 03 to 18th May, 2003. The matter was considered. Since Shri Daulat Mal Singhvi has submitted original vouchers relating to his treatment in Escort Heart Hospital, New Delhi to Insurance Co., from where he was already sanctioned Rs.1.40 lac against his Medi-Claim-Policy, there is no justification of allowing any financial assistance to him under the Rajasthan State Pensioners Medical Concession Scheme in absence of original vouchers which have already been submitted by him to the Insurance Co. His claim is therefore rejected. Item No. 16 Consideration of granting financial assistance to Sarvashri Om Prakash Joshi in connection with treatment of Blood Cancer of his Wife at M.P. Shah Cancer Civil Hospital, Ahmedabad and incurred an expenditure of Rs.82,165/- on the treatment and Shri Banwari Lal Patel for his PTCA and Stenting treatment at U.N. Mehta Institute of Cardiology & Research Centre, Ahemdabad & incurred an expenditure of Rs.1,13,978/- on the treatment. The cases were reconsidered and decision were taken as under : -

1. Shri Om Prakash Joshi, Pensioner, bearing PPO No.429262(R) The matter was considered in the light of Certificate issued by M.P. Shah

Cancer Hospital, Ahmedabad vide No.GCRI/EST/D/14054 dated the 1st Dec., 2004 that the hospital is a autonomous body 100% Grant in Aid from Govt. of Gujrat. G.C.RI is also recognised as Regional Cancer Centre by Ministry of Health & Family Welfare, Govt. of India, it was decided to allow 80% of his claim as financial assistance. The Treasury Officer (R), Jodhpur will scrutinise his claim and allow 80% of the admissible amount to him.

2. Shri B.L. Patel Pensioner, PPO No.801498 (R) The matter was considered in the light of clarification issued by U.N. Mehta

Institute of Cardiology & Research Centre vide No.3487 dated the 19th August, 2004 that the eligible Gujrat Govt. Servants are treated and expenditure incurred at the Institute is fullyreimburseable to them and decision taken by Sub-Committee in its meeting held on 15th April, 2004. It was decided to allow financial assistance to Srhi B.L. Patel, Pensioner as follows : -

Item No. 17 Reconsideration of allowing financial assistance to Shri Ram Sahai, Pensioner in connection with expenditure of Rs.12,633/- incurred by him on his Eye treatment and again incurred an expenditure of Rs.10,595/- on his Urology treatment at Post-Graduate Institute of Medical Education & Research, Chandigarh. The matter was reconsidered. It was decided to allow financial assistance equivalent to the cost of expenditure which would have been admissible had Shri Ram Sahai, Pensioner taken treatment in S.M.S. Hospital, Jaipur in the year 2001 & 2003. The Treasury Officer, Alwar will ask the Pensioner to produce the requisite Certificate of the S.M.S. Hospital, Jaipur and reimbursement may be allowed to him to that extent. Item No. 18 Reconsideration for allowing reimbursement of the cost of Tab. LEUKERAN for Rs.10,786/- purchased by Shri R.K. Whig from M/s. Apollo Pharmacy, Pondicherry in connection with his Cancer treatment and also consideration of allowing medicines purchased by Late Shri P.N. Ravindranathan for Rs.25,597/- from Private Medical shop at Jaipur against the N.A.C. issued by Bhilwara Cooperative Bhandar, Bhilwara. The matter was considered in the light of Para 16 of the Rajasthan State Pensioner Medical Concession Scheme and circumstances under which Sarvashri R.K. Whig and P.N. Ravindranathan had to purchase medicines from M/s. Applo Pharmacy, Pondicherry and from Private Medical Shop at Jaipur against the NAC issued by Bhilwara Upbhokta Wholesale Bhandar, Bhilwara and it was decided to reimburse them the cost of medicines as follows : -

1. Shri R.K. Whig Rs.10,768/- 2. Shri P.N. Ravindranathan Rs.25,579/- Addl. Agenda Item – Consideration of entrusting work of RPMF to Jt. Directors, Pension at Divisional Hqrs. with the permission of the Chairman of the Committee for consideration. After consideration of the matter it was decided that the matter might be processed on file and comments of the Director Treasuries & Accounts be obtained. The meeting concluded with the Vote of Thanks to the Chair.

The following decisions were taken : - At the outset it was pointed out by the Chairman, Sub-Committee that he is not included in the Board of Trustees as its one of the member. It was, therefore, desired that the Chairman, Board of Trustees may be requested to include the Chairman, Sub-Committee as a Member of the Board of Trustees. Secondly, Shri D.K. Dutta, Retd. I.P.S. was also a Member of the Board of Trustees. After his death no other officer has been nominated in his place in the Board of Trustees. It was therefore, desired that the matter may be referred to the Finance Department for Nominating a Retd. I.A.S. officer as a Member in the Board of Trustees. Item No. 1 Confirmation of 51st Meeting of Sub-Committee held on 28th February, 2005. The Minutes of the 51st Meeting of Sub-Committee held on 28th February, 2005 were Confirmed. Item No. 2 Compliance of the Proceedings of the 51st Meeting of Sub-Committee held on 28th Feb., 2005. The Committee perused the Compliance of the decision taken in the 51st Meeting of Sub-Committee held on 28th Feb., 05. It was decided that the Finance (Rules) Department may issue order regarding amending Para 10 of the Scheme as requested by the Board of Trustees to Finance Department vide No.F.21/PMF/05/ 51st SC/1621 dated the 30th March, 05, wherein the Medicare Relief Societies may be authorised for supply of free medicines to the Pensioners like CONFED and Upbhokta Wholesale Bhandars and submit their claims to the concerned Treasury Officer for reimbursement. Item No. 3 Confirmation of enhancing the monetary limit beyond Rs.10,000/- / Rs.12,500/- for the supply of medicines to the Pensioners during February & March, 2005 and from April, 2005 to July, 2005. The Committee agreed for Ex-post-facto regularisation of 2,386 cases wherein monetary limit to the tune of Rs.112.94 lacs was extended with the approval of Director, Pension & Pensioners Welfare cum Member Secretary, R.P.M.F. during Feb., 2005 to July, 2005. Item No. 4 Transfer of Funds from One Treasury to another Treasury for payment of claims of Authorised Medical shops. The Committee agreed for Ex-post-facto regularisation in respect of Inter treasury transfer of Funds of Rs.143.00 lacs sanctioned by the Director Pension & C:\web-site\rpmf.doc 32

Pensioners Welfare cum Member Secretary, R.P.M.F. during Feb., 2005 to July, 2005. Item No. 5 Ex-post-facto approval of Sub-Committee in respect of claims of Pensioners allowed by Director, Pension cum Member Secretary RPMF for the tests got done by them in the market after obtaining N.A.C. from the Govt. Hospitals in Rajasthan during the period from Feb., 2005 to March, 2005 & April, 05 to July, 05. The Committee agreed for Ex-post-facto regularisation of 141 cases wherein reimbursement of Rs.3,65,430/- was allowed to the Pensioners by the Director Pension & Pensioners Welfare cum Member Secretary, RPMF on account of Tests got done by the Pensioners or their Spouse in the market after obtaining NAC from Govt. Hospitals during Feb., 2005 to July, 2005. Item No. 6 Financial Position of the Trust The matter was considered. It was pointed out by the Dy. Secretary to Govt. Finance (Rev.) Department that the proposals for enhancing the provision under Head 2235 & 6235 – Social Security and Welfare, Loan for Social Security & Welfare respectively may be moved on file to Finance Department so that the same may be included in the recommendation of the P.F.C. In the B.F.C. it was discussed to provide a provision of Rs.7.50 Crores in each of the head 2235 – Social Security Welfare and 6235 – Loan for Social Security & Welfare. It was therefore, decided, the matter for getting the Revised Estimates approved for the year 2005-06 and B.E. 2006-07 enhanced under these Heads may be processed on file by the Director, Pension & Pensioners Welfare Rajasthan, Jaipur and submit the same to the Finance Department for further necessary action. Item No.7 Information of Court Cases The matter was discussed in detail. Shri G.S. Gill, Addl. Advocate General, Rajasthan High Court, Jaipur requested for the enforcement of the Circular of Punjab Govt. issued vide No.5251-54 dated the 13th Feb., 95 in the State Rajasthan also wherein the Pensioners have been given freedom to get treatment in any Private Institute/Hospital (of their own choice) in the Country provided that he gives an undertaking that he will accept reimbursement of expenses incurred on treatment to the level of expenditure as per rate fixed by the Health & Family Welfare Department for a similar treatment package or actual expenditure, which ever is less. The Committee agreed in principle to adopt this System for Pensioners. It was, therefore, decided to request the Medical & Health Department to bring out a list of Specialised diseases and the approximate expenditure for their treatment at Govt. Hospitals in Rajasthan. It was also decided that the requirement of the Constitution of Medical Board may not be enforced if the Pensioner or his State. C:\web-site\rpmf.doc 33

The Officer on Special Duty, Finance (Rules) Department pointed out that Govt. is also considering to amend the Rajasthan Civil Services (Medical Attendance) Rules, 1970 after that similar facility would be extended to the Pensioners. Item No. 8 Ex-post-facto approval of Sub-Committee for allowing cost of Implants for Rs.1,99,700/- required in the Cancer, Orthopaedic, ENT etc. treatment of the Pensioners in Govt. Hospitals in Rajasthan. The matter was considered. It was decided to accord Ex-post-facto approval in respect of cost of Rs.1,99,700/- allowed by the Director Pension to 14 Pensioners in respect of DHC Plates, DHS Screw, Drill, Bit, Carticil Screw purchased by them for being Implanted in their Orthopaedic & Cancer treatment in the Govt. Hospitals in Rajasthan. Item No. 9 Consideration of recommendations of the Committee Constituted under the Chairmanship of the Commissioner, Commercial & Taxation Department vide order No.F.4/PMF/04/19th BOT/512-20 dated the 12th Oct., 04 to examine the issue regarding purchase, supply price fixation of medicines by CONFED/Upbhokta Wholesale Bhandars & prescribing medicines in Generic names by the Authorised Medical Attendants & Other points regarding monitoring & Control of RPMF. The Report of the Committee Constituted under the Chairmanship of the Commissioner, Commercial Taxes Department vide order No.F.4/PMF/04/19th BOT/5112-20 dated the 12th Oct., 04 to suggest Ways & Means to improve financial position of the Fund and to examine the issues regarding procurement and supply of Generic Medicines after adding reasonable profit margin by the CONFED and Upbhokta Wholesale Bhandars was considered by the Sub-Committee as follows : -

1. Regarding the recommendation of minimising the number of Private Medical shop in District it was apprise by the Member Secretary, RPMF that the recommendation of the Committee to ninimise the number of Private Medical shop is being followed by the Treasury Officers and District Collectors.

2. The recommendation of the Committee that the Medical Relief Societies may also be authorised for supply of free medicines to the Pensioners is already under consideration of the Finance Department.

3. Regarding the recommendation of Draft Agreement, the Committee perused the Draft Agreement to be executed between the Board of Trustees and CONFED/Bhandars and decided to submit the same to the Finance Department for final approval.

4. The Committee also recommended that some percentage of reasonable profit margin from 15% to 20% should be fixed for supply of Generic medicines by the CONFED/Bhandars. The Sub-Committee considered the matter and decided that the profit margin @ 20% may be allowed to the

CONFED/Bhandars on the purchase price of Generic medicines for their supply to the Pensioners.

The Committee has also prescribed standard Companies/Firms from where

Generic medicines can/should be procured by the CONFED/Bhandars. It was pointed out by the Member Secretary, RPMF that orders regarding

prescribing medicines in Generic names by the Authorised Medical Attendance have been issued by the Medical & Health (Gr.I) Department vide No.F.13(108)ME/Gr.I/98 dated the 10th Sept., 05 and Director, Medical & Health Services, Rajasthan, Jaipur letter No.1802-1887 dated the 1st Sept., 05. The Member Secretary, RPMF also reiterated the orders vide No.5892-6037 dated the 26th Sept., 05 to all the District Collectors & Treasuries Officers to ensure compliance of the instructions issued by Medical & Health Department.

It was pointed out by the Member Secretary, RPMF that as per feed back from Treasuries Officers no where these orders are being complied with by the Authorised Medical Attendants. It was the view of the Committee that the orders should be complied with invariably and stern action should be taken against the defaulting doctors.

It was also pointed out by the Director Medical & Health Services and the Superintendent, S.M.S. Hospital, Jaipur that CONFED & Bhandars should be directed to keep adequate stock of Generic medicines. Managing Director (CONFED) assured that if the doctors start prescribing the Generic medicines the CONFED and Bhandars shall keep sufficient stock of medicines with them.

It was also decided that the latest list of Generic medicines prepared by Medical & Health Department may be provided to CONFED and Upbhokta Wholesale Bhandars.

The Chairman of the Sub-Committee desired that noncompliance of the orders be brought to the notice of the Finance Department so the Medical Department may be requested to take necessary action in the matter. Item No. 10 Reconsideration of fixing the Rate of Angiography Test being done in respect of the Pensioners at S.M.S. Hospital, Jaipur. The matter was considered. It was pointed out by the Superintendent, S.M.S. Hospital, Jaipur that the expenditure on Angiography test in the Hospital comes out Rs.4,400/- per test. It was therefore, decided that the details of the expenditure may be obtained from the S.M.S. Hospital, Jaipur and Rs.4,400/- per Angiography test done to Pensioners may be allowed w.e.f. 1st Dec., 2005. It was also decided that the Hospital will not ask the Pensioners to purchase consumables required for the test from the market. The cost of consumables is included in Rs.4,400/- to be allowed to the S.M.S. Hospital, Jaipur. Item No. 11 Clarification under 4E & 4G of the Rajasthan State Pensioners Medical Concession Scheme in the light of provision contained in Para 4A of the Scheme for treatment taken by the pensioners in recognised hospitals outside the State.

The matter was considered. It was pointed out by the officer on Special Duty, Finance (Rules) Department that the exercise is being done to club Para 4A, 4E & 4G in the Scheme. It was therefore decided that the Finance Department may do the needful early. Item No. 12 Consideration & decision in respect of Weeding out record of the Rajasthan State Pensioners Medical Concession Scheme in the District Treasuries. It was decided to Weed out record relating to RPMF in District Treasuries in view of provisions contained in Appendix – 6 of Rule 327 of G.F. & A.R. Before Weeding out the record it may be kept in view that

i) The record is to be retained for 3 years after audit of the Accounts by L.F. & A.D. and no para is pending.

ii) There is no case relating to the record to be weeded out is pending in the Court.

Item No. 13 Consideration of authorising Private Medical shops below Tehsil level in the 33 & 48 meetings of the Sub-Committee held on 1st Dec., 97 and 26th July, 2003, it was decided to authorise private medical shop at the following places : -

The proposal for authorising a private medical shop at Suroth District Sawai Madhopur was considered and rejected as the distance between Surotht & Hindaun is only 15 Km. The concerned District Collectors before authorising private medical shops at these places shall obtain "No Objection Certificate" from the Cooperative Department for authorising private medical shops at these places. Item No. 14 Consideration of the request of President Rajasthan Pensioners Samaj, Beawar for authorising the S.D.O., Beawar to convene the meeting of District Committee at

Beawar for extending the monetary limit for free supply of medicines to Pensioners of Beawar. The matter was considered. It was decided to authorise S.D.O., Beawar to convene the meeting of District Committee regarding extending monetary limit for free supply of medicines to Pensioners of Beawar. The Treasury Officer, Beawar , PMO/CHMO Beawar and the Representative of Rajasthan Pensioners Samaj, Beawar Shall be the other member of the Committee. Besides, the action taken by District Collector, Chittorgarh vide No.183-197 dated the 10th June, 2002 for authorising ADM, Pratapgarh to convene the meeting of District Committee for extension in the monetary limit for free supply of medicines of Pratapgarh is also regularised. Item No. 15 Consideration of letter dated the 6th Oct., 05 from Shri S.R. Sharma, Pensioner for granting financial assistance in respect of his Endocarcenoma treatment at Sir Ganga Ram Hospital, New Delhi. The matter was considered. It was decided to allow financial assistance to the tune of Rs.1.20 lac to Shri S.R. Sharma, Pensioner for his Endocarcenoma treatment at Sir Ganga Ram Hospital, New Delhi in Sept., 2005 against the expenditure of Rs.1.88 lac incurred by him on his treatment. This matter was considered under para 16 of the Scheme as the Pensioner underwent treatment at Delhi after getting the Medical Board Constituted. Item No. 16 Consideration of the letter of Smt. Satish Sharma, Pensioner bearing PPO NO.136930(R) dated the 7th May, 2005 addressed to Principal Secretary Finance for granting her financial assistance in connection with expenditure incurred by her on Hip replacement treatment at Peerless Hospital and B.K. Roy Research Centre, Kolkata during June, 2001. The matter was considered. It was decided to allow financial assistance of Rs.40,000/- to Smt. Satish Sharma Pensioner, PPO No.136930(R) for her Hip replacement treatment at Peerless Hospital & B.K. Roy Research Centre, Kolkata during June, 2001 subject to production of Certificate of the treatment taken by the Pensioner at above hospital. Item No. 17 Consideration of D.O. letter No.RPMF/Try./Chittor/290 dated the 28th July, 05 from the Collector, regarding allowing financial assistance to Smt. Kamla Samdani, Retd. Head Minsterss bearing PPO NO.556148(R) on account of expenditure of Rs.1,35,477/- incurred by her on her Cancer treatment Modilink Hospital and Shubham Hospital, Ahmedabad during December, 2004 to May, 2005. The matter was considered. It was decided to allow financial assistance to the extent of the expenditure which would have incurred had the treatment been taken in S.M.S. Hospital, Jaipur to Smt. Kamla Samdhani, PPO No.556148(R) for her Cancer treatment at Medilink Hospital & Shubham Hospital, Ahmedabad (un-recognised) during December, 2004 to May, 2005 without getting the Medical Board Constituted. Item No. 18 Consideration of Order dated the 17th May, 05 of the District Forum, Chittorgarh passed in the case No.304/04 Shri Nawal Singh Sancheti Pensioner V/s. State in connection with financial assistance to Shri Nawal Singh Sancheti for his treatment in AIIMS, New Delhi during 9th April, 02 to 17th April, 2002. The matter was considered. As Shri Nawal Kishore Sancheti did not possess a renewed medical diary in April, 2002, his claim was rejected on per para 11(i) (c) of the Scheme. Item No. 19 Consideration of letter No.F.1(8)FD/G&T/05 dated the 29th July, 2005 to reimbursement of medical expenses incurred by Shri K.C. Goyal, Retd., Executive Engineer, P.H.E.D. bearing PPO No.761097(R) on his heart treatment at Metro Heart Institute, Faridabad in March, 05. The matter was considered. In view of the fact stated, it was decided to allow reimbursement of Rs.67,172/- as follows to Shri K.C. Goyal, Pensioner against the expenditure of Rs.1,78,965/- incurred by him on his treatment at Metro Heart Institute, Faridabad in March, 2005. 1. Angiography Charges Rs.4,000/- (as per S.M.S. Hospital rate) 2. Stent Rs.60,000/- 3. 80% of cost of medicines

of Rs.3,965/- Rs.3,172/-

Total Rs.67,172/- Item No. 20 Consideration of the request of Smt. Uma Gupta W/o Late Srhi Mahesh Chand Gupta Pensioner forwarded by the Treasury Officer Sikar vide No.867 dated the 26th July, 2005 for providing financial assistance to her in respect of the expenditure incurred on the treatment of her husband Sh. Mahesh Gupta at S.M.S. Hopital, Jaipur as an Indoor patient on 21st Feb., 05 and the Pensioner has died. The matter was considered. Taking a sympathetic consideration in the matter under Para 16 of the Scheme it was decided to allow reimbursement of Rs.1,798/- to Smt. Uma Gupta W/o Late Shri Mahesh Chand Gupta being the expenditure incurred on his treatment at S.M.S. Hospital, Jaipur on 21st Feb., 05. C:\web-site\rpmf.doc 38

Item No. 21 Consideration of the claim for Rs.8,363/- & Rs.9,088/- submitted by Smt. Mradula Sharma on account of treatment of Sh. Satish Kumar Sharma Pensioner, PPO No.134041(R) Indoor patient in S.M.S. Hospital, Jaipur during 1st May, 05 to 17th May, 05. The matter was considered. As the patient Sh. Satish Kumar Sharma, Pensioner is no more, it was decided to allow reimbursement of Rs.17,350/- to his spouse Smt. Mradula Sharma against the claim of Rs.17,451/- submitted by her, Rs.101/- have been dis-allowed as the medicines were supplied by CONFED free of charge to the patient. The reimbursement has been allowed to the spouse of the Pensioner in view of sympathetic consideration of the matter under Para 16 of the Rajasthan State Pensioners Medical Concession Scheme. Item No. 22 Consideration of letter No.1443 dated the 11th March, 05 received from the Treasury Officer (C), Jaipur regarding allowing financial assistance to Smt. Sudesh Puri, Pensioner bearing PPO No.149528 (R) on account of her husband's treatment in Navi Mumbai Corporation Hospital, Mumbai during Nov., & Dec., 04. The matter was considered. Since Mahanagarpalika Hospital, Navi Mumbai where Shri Goswami Lal Puri took treatment from 23rd Nov., to 4th Dec., 04 is a Govt. Hospital, it was decided to allow him reimbursement of the expenditure of Rs.9,734/- incurred on his treatment. The Ambulance charges (Rs.60/-) are not reimbursable to the Pensioner. Item No. 23 Consideration of the letter dated the 11th April, 05 from Sh. Prem Chand Benara, Pensioner bearing PPO No.106264 (R) and notice of Shri Ramesh Chand Papdiwal, Advocate regarding allowing financial assistance to Shri Prems Chand Benara for Pacemaker Implantation treatment of his Spouse at S.D.M. Hospital, Jaipur. The matter was considered. Shri Prem Chand Benara has stated that his spouse was taken to S.D.M. Hospital, Jaipur for her heart ailment on 18th March, 05 as the Cardiology Department in S.M.S. Hospital, Jaipur was closed on that day being Friday and there was no other option left except to take the patient in nearby S.D.M. Hospital, Jaipur. The Superintendent, S.M.S. Hospital, Jaipur who also participated in the meeting clarified that the statement given by the Pensioner is false. The Cardiology Department in S.M.S. Hospital, Jaipur does not remain closed on Friday. In view of wrong statement given by Shri Prem Chand Benara, Pensioner it was decided to reject his claim. Item No. 24 Consideration of letter No.566-67 dated the 5th Sept., 05 from the Treasury Officer, Sriganganagar for allowing financial assistance to Shri Jagdish Rai Lodha,

It was decided to allow financial assistance of Rs.1.20 lac (Rupees One Lac Twenty thousand only) to Shri Jagdish Rai Lodha, Pensioner, PPO No.602173 (R) against the expenditure of Rs.2,27,039/- incurred by him on heart treatment of his Spouse (Smt. Godawari Devi) in AIIMS, New Delhi during 6th Feb., 05 to 18th March, 05. Item No. 25 Consideration of letter No.7889 dated the 14th Oct., 05 from the Treasury Officer, Ajmer in connection with granting financial assistance to Shri Chain Singh Mehta, Pensioner PPO No.119856(R) for his PTCA and Stent treatment at U.N. Mehta Institute of Cardiology & Research Centre, Ahmedabad. The matter was considered. In view of decision taken by the Sub-Committee in its 49th Meeting held on 15th April, 04 regarding providing financial assistance for PTCA & Stenting treatment to the Pensioner in respect of their claims pending with the Board of Trustees, it was decided to allow financial assistance of Rs.60,000/- for the Implantation of Stent to Shri Chain Singh Mehta, Pensioner bearing PPO No.119856(R) in June, 04 at U.N. Mehta Institute of Cardiology & Research Centre, Ahmedabad as Shri B.L. Patel, Pensioner was also allowed financial assistance in respect of his heart treatment in this hospital during the year 2003. Item No. 26 Consideration of the request of Shri Roop Puri, Pensioner PPO No.431514 (R) for reimbursement of expenditure of Rs.41,164/- incurred on the treatment of his Spouse who was suffering from Cronic Renal Failure, H.T. & Paralysis. The matter was considered. In view of the circumstances stated, it was decided to allow reimbursement of Rs.33,058/- & Rs.8,106/- Total Rs.41,164/- to Shri Roop Puri, Pensioner PPO No.431514(R) on account of medicines purchased by him during 19-06-04 to 02-08-04 and 15-11-04 from M/s. D.K. Enterprises, Jaipur in connection with treatment of his Spouse Smt. Geeta Devi who was a patient of Cronic Renal Failure, H.T. & Paralysis. Item No. 27 Consideration of letter dated the 25th August, 05 from Shri M.L. Parihar, Member, Rajasthan Public Service Commission (Retd.) & Shri R.S. Gupta, IPS (Retd.) addressed to the Principal Secretary Finance regarding enhancing monetary limit to Pensioners requiring Specialised treatment in respect of Life Long disease under Rajasthan State Pensioners Medical Concession Scheme. The matter was considered. Since it was not possible to enhance the initial limit of Rs.3,000/- / Rs.6,000/- for the supply of medicines to the Pensioners suffering from T.B. by the Pensioners for Cancer and Heart ailment the existing powers of the District Collectors for enhancing the monetary limit for free supply of medicines to the Pensioners upto Rs.10,000/- / Rs.12,500/- may be enhanced to Rs.20,000/- in place of Rs.10,000/- / Rs.12,500/- in respect of Cancer & Heart ailment. In respect of other ailment the powers of District Collectors for enhancing the limit to Rs.10,000/- / Rs.12,500/- will remain unchanged. Addl. Item No. 1 Consideration of the cost of medicines charged in the past by Jodhpur Wholesale Bhandar on MRP (-) 20% whereas MRP of the medicines is much more higher that their purchase price. The matter was discussed in detail. It was decided to request the Director L.F. & A.D. to get Special Audit of the Accounts of the Jodhpur Wholesale Bhandar conducted in the light of facts contained by the Bhandar in their letter No.264 dated the 26th April, 05 and 228-46 dated the 29th April, 04 regarding the cost at which they were supplied to the Pensioners. The Audit may be conducted for the period during which the Generic medicines worth Rs.23,61,423/- were purchased by the Bhandar and their supply to the Pensioners upto 30th Nov, 05. The Director, L.F. & A.D. will get the accounts of the Bhandar Audited expeditiously and send their report for being submitted to the Board of Trustees for necessary action. Addl. Item No. 2 Consideration of the request of Shri Radhey Mohan Goyal, Pensioner bearing PPO No.850187 (R) for allowing him financial assistance in connection with Neuro Surgery treatment of his Spouse Smt. Savitri Goyal at AIIMS, New Delhi during 11th Dec., 02 to 17th Dec., 02 & incurred an expenditure of Rs.91,388/- on the treatment. The matter was considered. In view of the circumstances stated, it was decided to allow Reimbursement of Rs.73,074/- to Shri Radhey Mohan Goyal, Pensioner as 80% of the expenditure incurred by him on Neuro Surgery treatment of his Spouse Smt. Savitri Goyal at AIIMS, New Delhi during 11th Dec., 02 to 17th Dec., 2002 under Para 16 of the Rajasthan State Pensioners Medical Concession Scheme and also in relaxation of Para 4A of the Scheme.
