3. The police were dispatched to a shot being fired in this area;

4. A juvenile walking in the area approached Darrin Langfordin front of the Church ofPeace. She observed him to be highly intoxicated or exhibiting unpredictable behavior, and inpossession of a firearm. As she backed away from him she told Darrin Langford that she hadseen police officers in the neighborhood. Darrin Langford then without warning fired three shotsin the air whereby the juvenile ran away from him;

5. Other juveniles in the area also witnessed Darrin Langford shooting a handgun in theair several times creating fear in them;

6. Officer DeRudder arrives at 12thAvenue and lih Street. Hehears three (3) loudgunshots and other officers in area hear the gunshots. Officer DeRudder is wearing his policeuniform and driving a marked police K-9 vehicle;

7. Officer DeRudder sees DarrinLangford with a gun. Darrin Langford looks at OfficerDeRudder and runs south oniz" Street, still armed with a handgun;

8. Officer DeRudder pursues on foot after Darrin Langford yelling at him to "stop" and"drop the gun". Other witnesses confirm these facts.

9. Daffin Langford ran into an alley east of Glenhurst Court and started to turn his bodyrotating his right shoulder back to Officer DeRudder who wasstill continuing to pursue him onfoot;

10. As Daffin Langford started to turn to his right with the gun in his right hand,Officer DeRudder was in fear of his safety and fired four (4) gun shots at Darrin Langford.Three of the four shots struck Darrin Langford, one in the right hip, one in the left buttock, andone in the right back. Darrin Langford was transported to Unity Point Trauma Center in RockIsland, 1L where he was pronounced dead at11:35 PM. Exhibit 2 is a copy of the Autopsyreport;

11. Jennaine Bell, Darrin Langford's brother, confirmed the forty caliber SmithvutsrqponmlkjihgfedcbaZYXWVUTSRQPONMLKJIHGFEDCBA&Wesson pistol collected at the scene was his gun and had been taken without his permission. Aconcealment style holster was located in Darrin Langford'spants.JIHGFEDCBA

C O N C LU S IO N :

The issue that must be determined by the State is whether there was justifiable use of_~,~,_,~"<>~iotCe:OllJhe.par.l_of.the"police,officeL,,12QlLCSStk..5&lefines.~en.a..,peace.,officeL.Call--USe..for~>~~_",_ ..~_.

in making an arrest. According to the law, a peace officer is justified in use of any force, whichthe peace officer believes to be necessary to effect the arrest, and of any force which the peaceofficer reasonably believes to be necessary to defend himself while making the arrest. Withshots being fired, Darrin Langford endangered human life. When he was pursued on foot by apolice officer and told to drop his weapon, Darrin Langford's actions as he fled by turning to hisright and to open up his stance as if to fire the handgun, Ryan DeRudder a Rock Island PeaceOfficer acted justifiably in discharging his weapon to protect himself and others.

The witness statements, evidence, and autopsy results are consistent with OfficerDeRudder's account of the incident. Had Darrin Langford survived his injuries, he could havefaced felony charges including Aggravated Discharge of A Firearm and Felon In Possession of AFirearm.

As the Rock Island County State's Attorney, I do offer my sincere condolences to thefamily of Darrin Langford for their loss.

Circumstances

The following history was obtained fro the Rock Island County Coroner's Officeand indicates the subject died at UnityPoi t Trauma Center on April 2. 2015 at11:35 p.m. He was brought there after be g shot by police during an altercation.

T h e autopsy is performed at KSB Hos~ital in Dixon, Illinois, on April 3, 2015, at10:15 a.m. Brian Gustafson of the Rock I land County Coroner's Office and tworepresentatives of the Illinois State Police ere present at the autopsy.

External Examination

The unclothed body is received within black body bag. The hands are covered bypaper bags which are removed and transf rred to the Illinois State Police. The followingjewelry is present: an earring in the right e r.

The body is that of a well-developed, ell-nourished black male of stated age 32years, who is 75" in length and weighs an stimated 210 pounds. Rigor mortis iscomplete and ftxed to an equat degree in extremities. Purple, fixed lividity involvesthe posterior dependent portions of the bo y, except in areas exposed to pressure. Thebody is cool to the touch.

Scalp hair is shaved. The eyes are br wn, pupils 5 mm in diameter, and normanyformed. The corneas are clear and the co junctivae are normal. The ears are normally
