The enclosed material, consisting of25 pages, is provided in response to your request. As a result of the national emergency declared by the President September 14, 200 I, the Department of Defense (DoD) determined that the release of the names and identifying information, including work address and duty stations, pertaining to DoD personnel would result in a clearly unwarranted invasion of their personal privacy. You have requested "a copy of the resignation letter sent from U.S. Defense Secretary Dona.ld Rumsfeld to President George W. Bush in November 2006." We have assigned your request FOIA case number 07-F-0306.

You have also requested that this request receive expedited processing "due to the compelling need to disseminate information concerning secretary's official activities and official correspondence related to his leadership of the department.:~ By requesting expedited processing you are asking that this Office place your request ahead of all other requests that were received before your request. Requests will be taken out of chronological order based on the date of receipt and given expedited treatment only when it is determined that they involve: ( l) circumstances in which lack of such treatment could reasonably be expected to pose an imminent threat to the life or safety of an individual; (2) there is an urgency to inform the public about an actual or alleged federal government activity, if made by a person primarily engaged in disseminating infonnation; (3) the loss of substantial due process rights; or ( 4) humanitarian need. See 32 C.F.R. § 286.4( d)(3 ).

You have identified yourself as a reporter for Reuters and that the request is made as part of ne\VS gathering and not for a commercial purpose. Therefore, I· tind that you qualifY as a representative of the news media f()r fee purposes. When a requester claims that information is urgently needed it ordinarily means that the information has a particular value that will be lost if not disseminated quickly and that it is the subject of a breaking news story of general public interest. The res~gnation of the Secretary of Defense was extensively covered in the national and international press and is no longer a breaking news story, In addition, you have failed to demonstrate how the value of this infom1ation will be lost if it is not disseminated quickly. For these reasons, I have decided to deny your request for expedited processing.

Although you have not addressed the specific amount of fees you are willing to pay, as a member of the news media, you are only responsible for document reproduction

Information Act (FOIA) request, which we received on the same day. You have requested "a copy of the resignation letter sent from U.S. Defense Secretary Donald Rumsfeld to President George W. Bush in November 2006." We have assigned your

request FOIA case number 07-F-0306.

You have also requested that this request receive expedited processing "due to the compelling need to disseminate information concerning secretary's official activities and

official correspondence related to his leadership of the department." By requesting expedited processing you are asking that this Office place your request ahead of all other requests that were received before your request. Requests will be taken out of chronological order based on the date of receipt and given expedited treatment only when it is determined that they involve: ( 1) circumstances in which lack of such treatment could reasonably be expected to pose an imminent threat to the life or safety of an individual~ (2) there is an urgency to inform the public about an actual or alleged federal government activity, if made by a person primarily engaged in disseminating information; (3) the loss of substantial due process rights; or ( 4) humanitarian need. See 32 C.F.R. §

286.4(d)(3).

You have identified yourself as a reporter for Reuters and that the request is made as part of news gathering and not for a commercial purpose. Therefore, I tind that you qualify as a representative of the news media for fee purposes. When a requester claims that information is urgently needed it ordinarily means that the information has a particular value that will be lost if not disseminated quickly and that it is the subject of a breaking news story of general public interest. The resignation of the Secretary of Defense was extensively covered in the national and international press and is no longer a breaking news story. In addition, you have failed to demonstrate how the value of this information will be lost if it is not disseminated quickly. For these reasons, I have

decided to deny your request for expedited processing.

Although you have not addressed the specific amount of fees you are willing to pay, as a member of the news media, you are only responsible for document reproduction at $0.15 per page, after the first 100 pages. Rumsfeld resigned before election, letter shows By Kristin Roberts1 hour, 55 minutes ago Donald Rumsfeld, architect of the unpopular Iraq war, resigned as defense secretary before last year's November.election but his decision was not announced until after the voting, according to his resignation letter obtained by Reuters on Wednesday.

The letter was dated November 6, the day before voters, angered by Iraq, went to the polls and swept Republicans from power in Congress. According to a stamp on the letter, President George W. Bush saw it on election day.

Bush, however, did not announce that Rumsfeld would leave until the day after the election. That infuriated some Republicans, who said their party might have kept more seats in Congress and perhaps kept control of the Senate if Rumsfeld had left before the election.

Rumsfeld did not mention the Iraq war in his four-paragraph resignation letter. Instead, the man who had become the focal point for critics of the Bush administration's management of the war praised the president for his leadership.

"I leave with great respect for you and for the leadership you have provided during a most challenging time for our country. The focus, determination and perseverance you have so consistently provided have been needed and are impressive," Rumsfeld told Bush.

"It is time to conclude my service. As I do, I want you to know that you have my continuing and heartfelt support as you enter the final two years of your presidency," Rumsfeld wrote.

Rumsfeld also praised U.S. troops for their dedication, professionalism, courage and sacrifice.

Donald Rumsfeld, architect of the unpopular Iraq war, resigned as defense secretary before last year's November election but his decision was not announced until after the voting, according to his resignation letter obtained by Reuters on Wednesday.

The letter was dated November 6, the day before voters, angered by Iraq, went to the polls and swept Republicans from power in Congress. According to a stamp on the letter, President George W. Bush saw it on election day.

Bush, however, did not announce that Rumsfeld would leave until the day after the

election. That infuriated some Republicans, who said their party might have kept more seats in Congress and perhaps kept control of the Senate if Rumsfeld had left before the election.

Rumsfeld did not mention the Iraq war in his four-paragraph resignation letter. Instead, the man who had become the focal point for critics of the Bush administration's management of the war praised the president for his leadership.

"I leave with great respect for you and for the leadership you have provided during a most challenging time for our country. The focus, determination and perseverance you have so consistently provided have been needed and are impressive," Rumsfeld told Bush.

"It is time to conclude my service. As I do, I want you to know that you have my continuing and heartfelt support as you enter the final two years of your presidency," Rumsfeld wrote.

Rumsfeld also praised U.S. troops for their dedication, professionalism, courage and

sacrifice.

True enough, that story pretty much covers it. Mary checked and advised that the no­record response to Reuters in the story is true and came from our office. There was another request from the AP which we also answered with a no record. No appeals or litigation.
