MINUTES OF THE 37th MEETING OF THE CENTRALSANCTIONING AND MONITORING COMMITTEE (CSMC) OFSUB-MISSION ON BASIC SERVICES TO THE URBAN POOR(BSUP) UNDER JAWAHARLAL NEHRU NATIONAL URBANRENEWAL MISSION (JNNURM)

The 3711, meeting of the Central Sanctioning and MonitoringCommittee (CSMC) of the Sub-Mission on Basic Services to the Urban Poor

(BSUP) under Jawaharlal Nehru National Urban Renewal Mission(JNNURM) was held under the Chairmanship of Secretary, Ministry ofF lousing and Urban Poverty Alleviation in New Delhi on 3«' June, 2008.List of participants is at Annexure - I.

2. Joint Secretary (JNNURM) welcomed the participants and requested

the States/ULBs to concentrate on implementation of already approved

projects. File drew attention of the States/ULBs/implementing agencies to

the following:-

* Capacity Building Activities: In the year 2006-07, the Ministry of

I-fUPA had released fund to the State Governments for capacity

building activities including Research and Training towards

implementation of BSUP and IHSDP projects. Unless the States

submit utilisation certificates for the funds released earlier, further

release of Central Assistance would be held up, as utilisation

certificates have to be furnished within 12 months from the date of

closure of the Financial year to which Financial sanction pertains.

e Status of Project Implementation: The States/Ul.Bs should

present Quarterly Progress Reports/Monthly Progress Reports

before bringing proposals to the Central Sanctioning & Monitoring

Committee/Central Sanctioning Committee further, one page

abstract on the status of implementation of projects & reforms must

be presented before presenting the project proposals in the

meetings of Central Sanctioning & Monitoring Committee/Central

Sanctioning Committee.

o Setting up of PMU/PIA/PIU:-The States should submitproposals to the o/o OSD UNNURiVM) which will get the sameappraised; and bring up before the Central Sanctioning &Monitoring Committee/Central Sanctioning Committee.

Fees for Preparation of DPRs: The States should submitproposals to the concerned Appraisal Agency which had appraisedthe projects. The Appraisal Agency has a crucial role in examiningthe claim with particular reference to the various stages ofimprovement and modifications that were brought out in the DPRsbefore they were finally approved by the Central Sanctioning andMonitoring Committee/Central Sanctioning Committee. 't lie,Appraisal Agency will submit proposals to the Ministry for releasingCentral Assistance towards the cost of preparation of DPRs (both

in the case of DPRs prepared by in-house personnel as well as by

consultants). 'These will be considered by the Central Sanctioning

and Monitoring Committee. After approval, recommendation willbe sent to Ministry of finance/Ministry of [tome Affairs forreleasing Central Assistance out of the ACA allocation for theparticular State/Ul' in the case of projects prepared by consultants.1'he Central Assistance for DPRs prepared through in-housepersonnel of the States would be released from out of the 1%JNNIJRM fund in the Budget of Ministry of 1-IUPAA as decided inthe Central Sanctioning & Monitoring Committee/CentralSanctioning Committee meetings earlier-.

Community Development Network (CDN): The State

should prioritise and get necessary approval from S]SC/S1 ,CC to

the proposals related to Community Development Network ((:DN).

Such proposals received in the Ministry of [IUPA will be appraised

by a team working under the GOI-UNDP Project on National

Strategy for Urban Poor coordinated by the National project

Coordinator/Depu(y Secretary QNNURM). The reports will then

be placed before the Central Sanctioning & Monitoring Committee.

3.1 Chairman, CSMC and Secretary (HUPA) said that in all meetings,

before new projects are taken up, a status report on already sanctioned

projects should be brought up before the Committee. 'I'bis should cover

physical and financial progress of projects, utilization of funds and reforms.

"1'he States should submit Quarterly progress reports and brief Monthly

Progress Reports without fail to enable the Ministry to report to Prime

Minister's Office in time. This should not only contain information on

physical and financial progress of the projects on hand, but also the

achievement of reforms in accordance with agreed timelines.

3.2. Chairman, CSMC and Secretary (HUPA) laid special emphasis on the

following:-

Quality of Projects : Housing for the poor does not mean poor

quality housing. Utmost emphasis must be given to the quality of

houses for the poor. A vector-free atmosphere and healthy living

environment should be ensured in the housing projects under

BSUP/THSDP.

(b) Third Party Inspection and Monitoring (TPIM):States/ULBs/Parastatal agencies should pay attention towards quality

assurance and the importance of third party inspection and monitoringof projects (TPINI). The Ministry would give necessary assistance tothe States for 'iPIM. 'Foolkit has been prepared and communicated tothe State Governments.

(c) Socio -economic Survey : No efforts should be spaced for

conducting socio-economic surveys of potential beneficiaries including

preparation of bio-metric cards. Such surveys should emphasize

housing, health, educational and livelihood profiles of the urban poor.

The survey would assist in designing good BSUP/TI-ISDP projects by

taking into account important aspects such as dependency load in the

existing schools and hospitals, need for multi-purpose community

centres including livelihood centre and informal sector market.

I-IUDCO and BMTPC have developed good designs of houses and various types of

social infrastructure which could he appropriately used while formulating project

proposals. A Toolkit has afro been published

Convergence of Health, Education and Social Security : It is

necessary to integrate provisions of Health, Fduration and Social

Security with I-lousing for the Poor to enable them to lead a better

quality of life. The Urban Local Bodies and the State Governments

have a critical role to play to ensure proper convergence of facilities

under the already available schemes for education, health and social

security implemented through different departments/fields. The

projects should list out the deficiencies in terms of access to school,

primary health centre, provision of social welfare measures so that

timely remedial measures in accordance with the socio-economic

survey can be taken up.

Community Development Network. The dynamics of the CDNshould lead to fraternity with the neighbourhood so that the issues ofalienation of all sorts are eliminated. CDN should work towards better

inter- and intra- relationships in colonies to get over the dividingforces. This will strengthen a feeling of solidarity among the residents.

3.3. Chairman, CS-NIC urged upon the States to come up with projects,especially for in-situ development, with good lay-outs and designs. In thecase of in-situ projects, the emphasis should be to provide a better andsupportive atmosphere of living. The in-situ development should not end upwith creation of another cluster of houses without access to water, sanitationand social infrastructure.

JA. To create a sense of belongingness, the slums may be named in

consultation with the intended beneficiaries. Provision of a low costenclosure around a slum pocket being covered under BSUP/IHSDP couldbe considered by a State/ULB in the interest of safety and a sense of localidentity, if the cost is not prohibitive.

3.5. Chairman, CSiMIC also reiterated that proposals for release of 2°`I

instalment should be based on the actual progress on the ground and

utilization of Central Share, State Share and UT,i3 share. He requested all

States to come up with proposals in the prescribed format for second and

subsequent instalments for already sanctioned projects with appropriate

utilisation certificates in the prescribed formats. Progress of sanctioned

projects and release of funds to them for completion should beaccorded Top Priority . Central share along with State share should be

released to UI,13s within 2-3 clays from the date of receipt of ACA. Any

delay on this account would result in delay in the completion of projects

Which would put the poor beneficiaries in undue hardships.

3.6. Chairman, CSiNIC further pointed out that special attention should

be paid for implementation of the three reforms stipulated underJNNURM that are critical to the urban poor : (i) internal earmarking

within local body budgets for basic services to the urban poor; (ii) provision

of basic services including the 7-point charter in accordance with agreed

timelines; (iii) earmarking at least 20-25% of developed land in all housing

projects (both public and private agencies) for LWS/T,IC category with a

system of cross subsidization. Chairman informed that poor are squeezed

out of the urban land market and the issue of land for housing the pool and

informal sector activities and security of land tenure must be accorded top-

most priority by the State Governments.

3.7. Chairman, CSMC drew attention of the States/U'I's towards the PrimeMinister's New 15-Point Programme for the Welfare of the Minorities. An

important objective of the new programme is to ensure that the benefits of variousgovernment schemes for the underprivileged reach the disadvantaged sections of the minority

comrrrurdties. In this regard, care should be taken to take up clusters ofminority beneficiaries to the extent possible. Wherever feasible, effortsshould be made to allocate.upto 15% of targets and outlays under BSUP andIHSDP for the minorities. Similarly, priority should be given toaccommodate physically challenged beneficiaries.

4. Chairman also drew attention of the members of the CSMC and

representatives of the States to the following issues, raised in previous

meetings, directly related to improving the quality of life of the urban poor:-

* In case there is time constraint, a regular socio-economic survey can be

preceded by a rapid survey for identPing henefidaiies, their main and subsidiary

occupations, their educationalprfle and felt-needs so as to deci;n appropriate social

i frastructure for each project. Willingness of the beneficiaries should also

be taken for any rehabilitation/relocation projects.

a Affordability of the urban poor should be kept in view while working

out Beneficiary Contribution. Overall construction cost of the housing

unit should be kept at a minimum. The housing component should

generally be at least 50% of the total project cost with a view to giving

primacy to provision of shelter to the urban poor except where

housing units have already been constructed/arc being constructed

under VAMT3AY or other EWS scheme of Central or State

Governments. hurther, considering the difficulties and special needs

of the urban poor at some locations, clusters having 15 housing units

can also be considered.

® Lach project should be accompanied by a list of beneficiaries based on

a socio-economic survey and UI.Bs should go for bio-metric cards,

wherever feasible, to avoid the possibility of sale/misuse of housing

units allotted to properly targeted beneficiaries. The list should be

notified and placed in the website of the ULB/JNNURM.

o The layout plan must be socially cohesive and facilitate social

interaction. Efforts may be made for providing at least 30% open

spaces with 15% green area in the lay-outs and adequate social and

livelihoods infrastructure.

o Adequate space must be provided for community activities, informal

sector markets, livelihood activities, pen for animals (if permitted and

required), space to take care of convergent services such as health,

education and recreation conforming to the specific needs of each ofthe slum pockets and their beneficiaries.

© The houses proposed should have two rooms, balcony, kitchen and

separate bathroom and latrine, individual water connection and sewerconnection. Aspects such as storage space for keeping things inrooms/kitchen, location of kitchen, location of toilet and bathroom inthe houses to facilitate privacy, independent access from both rooms totoilet and bathroom, leaving a small space for fitting exhaust fan inkitchen and toilet, balcony for drying clothes etc., are some of thenuances that can be thoughtfully incorporated in the design of the

houses for the poor.

© The State authorities/ULBs may adopt some of the innovative designsand layouts of houses, multi-purpose community centres, informalsector markets and animal pen, etc., prepared and compiled byf-IUDCO and BNCI'PC. The Toolkit published may be referred to.

o 't'he State authorities in consultation with appraisal agencies shouldensure that necessary clearances such as environmental clearance,Coastal Regulation Zone (CRZ) regulation clearance, land use'

clearance, etc., are obtained. 't'hey should also ensure that necessarytechnical approvals are secured from the competent agencies as perState PWD Code.

o Since these projects are required to be generally completed in k2 to 15

months, it is generally expected that any escalation of the project: cost is

borne by the State Government/U1_13 concerned.

© Wherever informal sector markets are taken up as a part of social

infrastructure, their operation on a time-sharing basis by inhabitants for

enabling wider coverage of the beneficiaries can be considered by the

U1,B concerned.

Adequate provision should be made for solid and liquid waste disposal

and digester technology can be adopted in place of dual-pits/septic

tanks wherever feasible.

Road-side plantations with tree guards are advisable.

5. Chairman, CSNIC and Secretary (1-IUPA) further said that theresponsibility of the technical specifications (adherence to State PWD Code)and their approval by the competent authority lies with the ULBs/State LevelNodal Agency. The appraisal agencies must ensure that technicalspecifications are duly approved by the technically competent authority.

Management Units (PMU) - one each from the States of Andhra

Pradesh, Chattisgarh, Jharkhand, Uttarakhand, Rajasthan, NCl'

of Delhi and Kerala. Brief details are at Annexure-IV.

Thirteen proposals for support to City Level Project

Implementation Units (PIU) from three States (7 from Andhra

Pradesh, 2 from Rajasthan, 3 from Kerala and 1 from NCC of

Delhi). Brief details are at Annexure-V.

7. The Chairman, CSMC requested the representatives of the StateGovernments to give an account of the following:-

(i) 13rief details of physical and financial rogreas oj' alreacy approved projects

including the actual availability of Central share, State share, ULB share,

beneficiary contribution, and loan component; tentative schedule for

seeking 2-1 instalment of Central share; number of houses

actually constructed; stage of progress of housing and

infrastructure, reforms etc.;(ii) Basic details of the present proposals such as total project cost

and its break up into housing and infrastructure components(percentages); break-up of cost of housing and infrastructureunder Central Share, State share, ULB share, Beneficiarycontribution, loan, contribution by parastatals if any; and

(iii) Design of colony layout and house layout proposed.

8.1. Representative of NCT of Delhi made a presentation on the project for

MCD. The Committee observed the following:-

o Central share for dwelling unit should be in the ratio of 50:50, instead

of the proposed share of 44% from Centre and 56 from State

(including beneficiary contributioa);

a Beneficiaries have to be identified and socio-economic survey

conducted. The Committee decided that this should be done

within a period of two months and that the release of furtherinstallments to the project would depend on submission of thereport of the survey;

o Cost of dwelling unit needs to be clearly stated. The cost per DU

presented in the meeting is Rs. 2,33,412 as against Rs.2,29,350

proposed in the DPR; and

o Necessary approval from SLSC should be obtained for the project and

communicated.

8.2. The appraisal agency (BNIPC) has informed that the State agency

(MCD) has made necessary corrections regarding sharing of cost of DUsbetween Centre and State/ULB. beneficiaries will be identified and socioeconomic survey conducted within 2 months and clue care will be taken toaccommodate minorities. It has also been informed that the cost of DU hasbeen fixed as Rs.2,33,412 per DU as there is an addition of Rs.4,062 per DUdue to additional estimated quantity of reinforcement based on technical

scrutiny. Details of the approved project are at Statement-I of

Annexure-VII. First instalment of Central share will be released on

receipt of SLSC approval.

9.1. Representative of the State Government of jharkhand made a

presentation on the BSUP project for Dhanbad. The Committee observed

the following:-

e Cost: estimates of the scheme have been prepared as per the

,Jharkhand lWD SOR 2006. This may be revised as per the latest

schedule of rates; and

V.lected body is not in place. As a special dispensation was

accorded to jharlchand , the Committee , decided that only first

instalment of Central share will be released for the time being.

Release of 2,1d instalment will be considered only if the elected

body is in place.

9.2. The appraisal agency (I-IUDCO) has informed that the State has

revised the cost as perjharkhand PWD SOR 2008. The project cost has now

increased to Rs.2055.06 lakh as against the cost of Rs.2042.28 lakh mentioned

in the agenda circulated. However, this does not attract fresh SLSC approval

as the project cost approved by SLSC is more than the revised cost. Details

of the approved proposal are at Statement-II of Annexure-VII.

10. The Committee then considered the proposal from Uttar Pradesh for

release of 2nd instalment of Central assistance for the BSUP projects in

Lucknow and Mathura. OSD QNNURM) informed that the State/ULB hasfurnished required documents and utilisation certificate as per prescribedguidelines. It was, however, noticed that the State share did not reflect thebeneficiary contribution. Also copies of the. Resolutions passed by the StateGovernment/ ULB regarding commitment to reforms had not been

submitted. The Committee approved the proposal for releasing the 2ndinstalment of Central assistance for BSUP projects in Luclcnow and

Mathura to ensure speedy execution of work, subject to the following

conditions:i) State Government releasing in full its share of lit installment

including beneficiary share.ii) Furnishing copies of resolution passed regarding

commitment to reforms

Details of the approved 2°1' instalment are at Annexure-VIII.

i i. The proposals for reimbursement of cost of DPRs for 4 BSUP projectsin Raipur prepared by consultants were deferred to enable the appraisalagency (IIUDCO) to come Lip with detailed analysis of the proposals andfulfill requisite formalities in consultation with the State Government -subject to limits prescribed by guidelines issued by CSMC.

12.1. The Committee then considered the proposals received from 7 States

for support to State Level Programme Management Units (PMU) and City

Levc Project Implementation Units (PIU). The representative of the State

Government of Kerala requested for considering inclusion of 22 towns for

settirg up of PIUs. He stated that the State's request for setting up of 9 Pt Us

for 22 towns have not been reflected in the agenda. IIe made a presentation

on the proposal from Kerala. OSD ONNURM) referred to the latest request

from the State of Andhra Pradesh (vide letter No.1/APUFIDC/JNNURM/

PM(,-BSUP/07-08 dated 2.6.2008_ The representative from GoAP/AP

Urban Finance and Infrastructure Development Corporation Ltd. , explained

about the decision of the State Government to set up PIU for a group of

towns in different districts. He presented the revised proposal of the State

Government which has more clarity than the State's proposal sent earlier. He

requested the Committee to consider the revised proposal for setting up of

P1 Us (Annexure-VI).

12.2. The Committee decided that staffing proposed at the State and City

level for `Research & Training' (vide special CSNIC meeting held on24.12008) would be part of PMU & PIU respectively. Therefore, PMU andPlU will consist of 5 experts (in various fields) to be supported by BSUP andIHSDP. The funding for experts would be on the same pattern as approvedat the special meeting of CSMC held on 24.1.2008 i.e. 60%.of the financialsupport for PNIU/PIU by MoNUPA would be for the staff cost and 40% for

the non-staff cost. The non staff cost, would be subject to the following

limits:

o Travel Cost -- 20%;© System Support Cost Plus Stationery, Documentation & printing etc. -

10°/i ; ando Overheads & Other Miscellaneous expenses - 10%.

12.3. The Committee approved these proposals from the States of Andhra

Pradesh, NC'I: of Delhi, Chhattisgarh, Jharkhand, Kerala, Rajasthan and

Uttarakhand for engaging 5 experts at PNIU/PIU with the following

conditions:-

o Annual support (staff and non-staff) for the PNIU in connection with

the engagement for Project Specialist (I [ousing & Slung Development),

Specialist (Social Development) and Specialist (Community

Mobilisation & ^NIIS) will be limited to Rs. 40 lalchs per annum. Annual

support for PMU for the engagement of Urban Poverty and

Management Specialist & Research and Training Coordinator will be

limited to Rs.40 lakhs per annum for large States and Rs.25 lalchs for

small States;o Annual support for the PIU/PIA for the engagement of three experts

namely Project Coordinator, Social Development Officer &

livelihoods Development Specialist will be on tapering basis. The first

year support will be 100%, the second year support will be 75% and

the third year support will be 50% of the approved first year amount.

Annual Support for the PIU in connection with the engagement of

Research Officer (Urban Poverty and Management Specialist) and

Research and Training Coordinator to support research and training

activities will be limited to Rs.15 laldis per city for cities selected under

BSUP and cities selected under IHSDP, preferably with more than 5

lalchs population.

o A single PIU/PIA may be set up for 3 or more towns or for a group oftowns/districts, subject to administrative and geographical feasibility if

considered appropriate by the State Government. In such case thecombined population of IHSDP towns could be considered for settingup of PIUs/PIAs. This would help reduce administrative expenditure.

The number of experts in a PIU/PTA may go up to 5. Where feltnecessary, the number could be reduced.

© Engagement of experts, the remuneration to be paid, staff and non-staff costs, etc., will be as per the guidelines approved by the Ministry(as per Minutes of the special meeting of CSMC held on 13.9.2007 and24.1.2008/guidelines approved by Minister for Housing & UrbanPoverty Alleviation from time to time).

Details of approved proposals in respect of PMU are at Annexure-IXand PIU at Annexure X(a), (b), (c) & (d).

13. Concluding the meeting, the Chairman of CSMC and Secretary

(HUPA) once again urged the States/UTs/UI,I3s/parastatals (e.g.,

Development Authority)/implementing agencies/appraisal agencies to

adhere to the guidelines as well as undertake measures for smooth

implementation of the projects to benefit urban poor.

The proposal has been appraised and following are the observations:

1. The Agency has not submitted any documents evidencing actual

payment made to consultants. So fclr, they have not paid any

amount. The Raipur Municipal Corporation informed that due to

race iv ad.2. The work was awarded to 8 prcjecf consultants for preparation of

DPR5 jointly. Raipur Municipal Corporation has selected the Bconsultants tram their empanelled consultants with post factorapproval of the General Body meeting held on 05.12;2007. It has

been informed bythe Municipal Corporation that, work was awarded

informally to the consultants durirg October 2006 without competitive

faco . Hiowever, the schemes were appro ed ai nt MC

executed between Municipal Corporation and the consultants. Thedetailed item wise breakup of fees has not been furnished. However,the consultant wise fees charged for each of the project withsupporting bills have been submitted.

4. Details of admissible / ineligible components cannot be ascertainedas the fees charged and claimed on lumpsump basis i.e. @ 0.5% ofthe Project cost plus service tax as applicable as per the agreementexecuted between Municipal Corporation and the consultants.Considering the ceiling of Rs. 75.00 lakhs per project or 2% of theProject cost, whichever is the minimum as per guidelines, theadmissible amount for the above 4 BSUP work of Raipur MunicipalCorporation works out to Rs. 20906429/-.

As indicated in the points above, CSMC may take a view on the proposal forreimbursement of DPR charges as requested by Raipur Municipal Corporationand SUDA, Chhattisgarh,

The duty filled in Worksheet 2 (lo be filled by Appraiser) and Proposal alongwithrorm A, Worksheet 1 and SupplernenI as .subrnifled by the SUDA and RaipurMunicipal Corporation for reimbursement of DPR is enclosed.
