AGENDA ITEM: REQUEST FOR EXTENSION, THE GREENERY, BZC 12-002 51 52 Ms. Korleski said the 2 year extension previously granted by the BZC has expired and 53 Mr. Shade is requesting additional time. 54 55 Mr. Shade said this has been a very long process. The project originally came to the BZC 56 in 2012 when it was rezoned and approved via a preliminary plan on part of the property 57 and zoning on the entire property. This particular project was anticipating that 58 centralized sewer was going to be to this property long before now. His clients are a 59 number of LLCs made up of different members. They have combined their efforts to 60 bring this project forward. In addition to that, they are the main driving force in getting 61 the sewer project to where it is today. 62 63 Mr. Shade said that Mr. Savko, who is at this meeting, was one of the early consultants as 64 he looked at six different variations on pathways to get sewer to service this area. The 65 primary area will service the land that is in Berlin Township on the east side of Route 23 66 from Shanahan Road to Peachblow Road. That will be met with this project. 67 68 Mr. Shade said that he spoke with the deputy sanitary engineer last week, who informed 69 him the plan design is 75% complete. They are awaiting comments on that 75% and they 70 expect to have plans approved by the end of May. They will then submit it to bid after 71 the design has been completed and they expect that to be completed in August. They 72 expect construction to start in September 2018 and to not be completed no later than 73 April 1, 2019. There will be a very short window for construction. 74 75 Mr. Shade said the BZC recently dealt with the application for Timberlake Liberty, and 76 as part of that project, his client indicated the donation of land for a lift station/pump 77 station on that property. It will be gravity fed to the pump station and forced main down 78 to its connecting point further down on Piatt Road. 79 80 Mr. Shade said this project cannot go forward without centralized sewer; he is requesting 81 an additional 2-year extension, not because it necessarily will take that long but since that 82 time the combined partners have acquired some additional land and they may be seeking 83 a revision to their preliminary plan. That would cause him to come back to the BZC as 84 part of the process and to get through the final development process, which is an 85 altogether “different animal.” 86 87 Mr. Flaherty said he saw this come through as a trustee twice, and he understands that the 88 delays are not on the applicant’s end and they are waiting for the county. It has been a 89 long process and he is fine with extending it. He wanted to note that the BZC is not 90 setting precedent for other projects to be continually extended multiple times. Each 91 application will be considered on an individual basis. 92 93 Mr. Shade said that throughout this entire process, the trustees past and present have been 94 very supportive and have worked closely with the county commissioners to get this done. 95 The county commissioners made themselves available and understood the scope and that 96 this is a project that has real meaning to the community as far as growth and development 97 in that corridor. 98 99 Mr. Shade said this will also serve Orange Township and parts of Liberty Township. This 100 project must be completed in that time frame because they are going to be redoing Hyatts 101 Road at the intersection. Other improvements on Shanahan Road including widening and 102 turn lanes may be done as well. 103 104 Ms. Korleski said Mr. Shade is very persistent to stay on this so long. She feels he is 105 doing a great job to try to stay with it. Mr. Shade said it has been 9 years. Ms. Korleski 106 said she does not have a problem with it because once sewer is in there it will open up 107 some commercial property for the township and increase its tax base. Two years should 108 provide enough time to get the final development plan going after sewer is installed. 109

Mr. Spangler asked whether the applicant expected to update the preliminary plan. Mr. 110 Shade said he did not know that and it would depend on whether his clients develop it or 111 end up selling that portion of the project to another developer that is more attuned to that 112 kind of project. He expected that there would be an amendment because additional land 113 has been acquired and that would have to be brought in to the planning process. 114 115 Mr. Bardash was fine with the request. 116 117 Mr. Flaherty made a motion to extend the request for extension for The Greenery BZC 118 12-002 for an additional 2 years. AGENDA ITEM: CONTINUE DISCUSSIONS ON CHANGES TO THE BERLIN 123 TOWNSHIP COMPREHENSIVE LAND USE PLAN, 2010 124

125 Ms. Korleski said the BZC had requested input from residents and she received an email 126 from Mike Loeffler of Dale Ford Road, which she read into the record as follows: 127 128

I would like to comment on proposed roads. I am especially concerned about the 129 proposed road connecting Piatt north of Berlin Station to Roloson. To the best of 130 my knowledge, this road was first proposed nearly 20 years ago. However, since 131 this time, there have been homes built directly or nearly directly in the proposed 132 route of the road. I feel that serious thought needs to be put into the continued 133 inclusion of this proposed Road in the plan. There would be a negative impact to 134 several homeowners on Berlin Station and Dale Ford, Curve and Roloson Roads. 135 Some roads would need to be taken by eminent domain or be impacted by 136 reduced property values. 137 138 I feel that the greater good benefit would not justify the cost of harming these 139 residents and homeowners. I do not see the need. In my opinion, 36/37 does not 140 need to befit increased traffic and more intersections. Rather, traffic should feed 141 36/37 in a few main access points, specifically Africa, Lackey Old State, and 142 Glenn Parkway should be the primary feeders. Other roads should be restricted to 143 direct 36/37 access. These roads should only have secondary access by way of a 144 parallel access road to 36/37 and that would access 36/37 at one of the previously 145 mentioned main feeder roads. 146 147 I feel this especially makes sense as 36/37 it would be more commercial in the 148 future. I propose a new future road north of Berlin Station that would provide a 149 route to the future Olentangy School on Sweeney Curve Road. As the student 150 population of the school would be the south, this road would provide a clear need. 151 Also, this road could be farther to the west then the currently proposed extension 152 Road. This would allow the road to go in an undeveloped area that would not 153 negatively impact existing homes and Families. 154

155 Ms. Korleski said the township does not have control of the roads as the county engineer 156 does and they make all the decisions, but it is helpful to receive such comments from the 157 public. 158 159 160 Scott Sanders, Director of the Delaware County Regional Planning Commission 161 (DCRPC), said that tonight he will provide a very broad overview of the township. 162 Mr. Sanders said the DCRPC is made up of all the township’s villages and cities that 163 want to join. He reviews zonings and recommends those zoning reviews back to the 164 township, which make the ultimate decision on rezoning pieces of property. 165 166 Mr. Sanders said that once a project becomes a subdivision, they review the subdivision 167 as well to make sure all the departments get together to do the lots or streets to make sure 168

the zoning inspector or zoning staff is involved so that the final plat that creates those lots 169 meets zoning, drainage, health district, road standards, etc. 170 171 The DCRPC also does consulting work to update or create a comprehensive plan; that 172 was done for Berlin Township in 1999, which he was not personally involved in, but he 173 was involved in the update in 2009-2010. Even though a lot has happened over the past 174 10 years on paper, not much has happened on the ground although it is starting. 175 176 In the past, each month a couple of chapters were reviewed sentence by sentence and that 177 takes close to a year and people get weary. His intention is to move more quickly and get 178 to the recommendations more quickly. 179 180 Mr. Sanders said the CLUP (Comprehensive Land Use Plan) states the township’s vision 181 which, in this case, involves uses and densities. Backage roads are also discussed 182 because even though they are not under the authority of the township, when they come in 183 it is much more difficult to get that piece of road built unless they have been planned. 184 185

186 187 Mr. Sanders reviewed the CLUP maps. He said the digital elevation map has not 188 changed since the last review. He said each map has numerous GIS layers for features 189 such as roads, rights-of-way, municipal boundaries, water etc. 190 191

Mr. Sanders said that 200 because Alum Creek has been dammed 201 and turned into a reservoir, flood 202 plains are not really very critical here. It 203 is mostly constrained to lands within the 204 Army Corp of Engineers. 205 206

MORPC (Mid-Ohio Regional Planning Commission) hired a consultant to fly the entire 218 Central Ohio region to come up with a new sidewalk layer. These items were merged 219 together for the maps. There is a requirement now that all subdivisions have sidewalks. 220 221

222 223 Mr. Sanders said the county commissioners found that many stakeholders and business 224 owners said they need more bikeways and they decided they need a county-wide plan. 225 Several county wide agencies got together and they came up with major arteries that use 226 connections between communities and within communities, while honoring existing 227 community plans. 228

Mr. Sanders showed the census data from 2010 and also the projections for future years. 242 243

Mr. Sanders reviewed the Home Value Map, which is based upon the auditor’s home 271 value. The warmer the color, the higher the value. Some of the larger parcels skew the 272 image, but one can see where the neighborhoods are. 273 274

289 290 Mr. Sanders said that Berlin Township has a net developable acreage calculation that is 291 done by taking out certain undevelopable areas from the gross acreage prior to 292 calculating density. 293 294 Mr. Sanders said this is county-wide information. This development is tracked year by 295 year and each year represents a different stage including zoning in blue at the bottom, red 296 indicates “sketch plan” which involves the zoning of the site, and green indicates 297 preliminary plots. Lots can stay in zoning for several years before they ever start. 298 299

300 301 Mr. Sanders reviewed the Large Township Lot Pipeline Berlin Township is indicated in 302 teal. This is after the lot is platted, the roads are in place, sewer is in place and all the 303 digging has been done. The major one in green is Liberty Township. During the 304 slowdown there were a lot of projects out there slowly being built. Once the economy 305 slowed down, it took a few years for the lots to catch up with the economy situation. 306 307

Mr. Sanders reviewed the Berlin Township Lot Pipeline. He said much of 2017 is Evans 310 Farm. 311 312

Mr. Sanders said the city of Delaware has a first right of refusal for sewer service in one 325 area. Anybody in that area who wants sewer would go to Del-Co Water and ask for 326 water in their development. Del-Co would tell them that the city of Delaware has the first 327 right of serving that so they would then go to the City. The City would then require that 328 the property be annexed to the City. 329 330 Mr. Sanders said that part of the sewer plan includes other major improvements. Years 331 ago it was not known what size the pipes would need to be in the future. At some point 332 certain improvements need to be made in order to serve the next site. The county prefers 333 that developers pay for that and sometimes they do. Other times the project is big enough 334 that the county takes it on, adding a surcharge to a certain area. 335 336

339 Mr. Dardamanis had questions about annexation and sewer systems. Mr. Sanders said 340 that is only in certain areas and typically for subdivisions. Small property owners can 341 typically get the right approvals without annexation. 342 343 Mr. Flaherty said he wanted to clarify that Delaware County is the sewer department for 344 all of the townships. Just the piece discussed, which is technically township land, is part 345 of the agreement with the City, and services would follow to the City which would 346 require annexation of just that property. However, that does not apply to the areas in 347 Berlin Township that are outside that area. 348 349 Mr. Shade said it is important to note that annexation to the City of Delaware has taken 350 place on property just down the road. All of those annexations were expedited Type 2 351 annexations, which means that people who live in that area are not only citizens of the 352 city of Delaware but are also citizens of Berlin Township. They will vote for township 353 trustees as well as Delaware City Council. 354 355

Mr. Sanders said he has shown where Glenn Parkway will go. 356 357 Mr. Sanders said that after years of discussing the possibility of a sewer plant in the 358 peninsula between Big Run and Dunham Roads, the county finally bought property in 359 that general area to build a plant of some size. At that point, everything north of Cheshire 360 Road would be redirected up to that plant. When a plant is built it must be ensured that 361 service is available on day one. There is a lot of concern about the interchange as an 362 economic development tool for the county. He would like to see it developed properly. It 363 is a little complicated now because Sunbury now has some parcels on that side that go 364 over the interchange. Mr. Sanders said that the new plant could conceivably open 36/37 365 up for reasonable development. 366 367 Mr. Harmon asked whether the bold purple lines that indicate “upgrade” were for future 368 items. Mr. Sanders said that is probably a pipe currently in the ground that is not big 369 enough to serve what it needs to serve and would require what is called “downstream 370 upgrades.” That would consist of bigger pipes that would handle more volume. 371 372 Mr. Harmon asked whether that would be for present property owners who want to install 373 sewer, and/or for potential growth? Mr. Sanders said he was not certain. Everything 374 north of the Franklin County line all the way up to Powell Road is city of Columbus but 375 is served by Delaware County. 376 377 Mr. Valentine asked what the time frame was for the sewer plant. Mr. Sanders said he 378 heard a reference that it would not be designed for five or more years. 379 380 Mr. Schlegel asked whether it was a bad idea to put a sewage plant near a water plant. 381 Mr. Sanders said the regulations are very strict on sewer plants. There is a section in the 382 Berlin Township zoning code about land application systems. This system is used at 383 Scioto Reserve and Northstar, where effluent is treated and the water is sprayed on the 384 golf courses. 385 386 Mr. Shade said there is already a major sewer pipe that runs under O’Shaunessy 387 Reservoir over to the Moore Road plan, which will serve as the entire corridor along the 388 Sawmill Parkway extension north. Mr. Sanders said once it is treated, it goes into the 389 O’Shaunessy Reservoir. 390 391 Mr. Shade said that most of the plants in Delaware County are nearly at 99% efficiency 392 and effectiveness, and all pipes under the reservoirs are double-lined. 393 394 Mr. Sanders said at the current Alum Creek plant, the effluent goes into Alum Creek near 395 Polaris. There is never an issue with foul odors; at Scioto Reserve, the usage of well 396 water caused odors of sulfur. 397 398

Mr. Sanders reviewed the Current Land Use Plan 36/37 Corridor and displayed this area 400 on the map. 401

402 403 He said ODOT has a limitation on how many new accesses there will be on their roads. 404 They did an access management plan and studied the corridor. He wants to make sure 405 backage roads are shown as well so that every trip is not going out on the highway. 406 Some people are concerned about the road becoming like Morse Road, which actually 407 has “frontage roads.” These proposed backage roads are more like Owenfield Drive 408 along Route 23. 409 410 Mr. Sanders said everything in the red hatched area is on the inside of the backage roads 411 and would be a mix of Planned Commercial and/or Planned office, the purple is Planned 412 Industrial and the brown colors are different densities. 413 414 Mr. Wilson said that the intersection at Lackey Old State and 36/37 is a “nightmare”. He 415 asked how to get feedback to those who could change that. Mr. Flaherty said residents 416 can go through their elected officials and have them put pressure on the government 417 agencies. 418 419 Mr. Shade said the 2010 ODOT corridor study shows a light planned at Lackey Old State 420 and 36/37 also other locations. Mr. Flaherty said the more political pressure, the better. 421 Unfortunately, the township cannot deny development due to traffic. Also, the township 422 has no jurisdiction on state highways. Mr. Shade reviewed how ODOT determines where 423 to place lights. 424 425 Mr. Sanders said ODOT’s plan is less detailed and in other cases is more detailed. There 426 are three options although he is not certain what the status is. 427 428 Option A is very much like the current plan. The pink area is called “work force”, the 429 darker red is “retail.” Everybody wants office parks and data centers because they 430 generate the least amount of traffic except for those two times. 431

456 457 Planning Area One - U.S. 36 Corridor 458 Land area: 2,089 acres, Potential development acreage: 738 acres 459 Current estimated population: 206 (77 housing units) 460 461 Area One consists of lands bordering the city of Delaware on the west, Brown Township 462 on the north, Alum Creek on the east, U.S. 36 on the south between Alum Creek and 463 Lackey Old State Road, then bordering on the south along property lines that are 464 generally parallel to, and approximately 2,000 – 4000 feet south of U.S. 36 from Lackey 465 Old State Road to the railroad tracks, where the southern border of area shifts to the south 466 side of Curve Road. There is potential future sewer service by the county, as this area is 467 within the Central Alum Creek Service Area. A future Olentangy school is proposed for 468 the corner of Sweeney and Curve Roads. Soils are prime agricultural soils, with poor 469 suitability for septic systems. 470 471 1.1 The Curve Road Corridor north of Curve Road but south of the Conrail tracks is 472 recommended for single family and agricultural uses at one unit per net developable acre. 473 474 1.2 The railroad corridor extending north from Curve Road to U.S. 36 is recommended 475 for Planned Industrial use adjacent to the tracks, and Planned Commercial west of the 476

tracks. Parcels southwest of the school site should remain residential at 1 unit per net 477 developable acre. 478 479 1.3 Lands along U.S. 36 are recommended for Planned Commercial to a depth of 480 approximately 700 feet north and south of U.S. 36, provided that: 481

a.) Parcels have limited access to U.S. 36 and are linked with parallel rear access roads 482 built in increments by developers. 483 b.) Buildings should be designed with four-sided architectural features, minimizing 484 blank walls and un-buffered service areas. 485 c.) Only low level, downward-cast lighting should be allowed to prevent a halo effect 486 on the night sky in support of the Perkins Observatory. 487 d.) To avoid sign clutter, ground signs should be the only sign type permitted along 488 U.S. 36. Tall pole signs and billboard signs should be prohibited. A Berlin Township 489 “look” or architectural sign syntax should be developed. 490 e.) Extensive landscaping should be required in parking lots to avoid the “sea of 491 asphalt”. Use landscaping to divide parking areas by using islands at reasonable 492 spacing, at ends of rows, and along U.S. 36 frontage. 493 f.) Areas should be developed with pedestrian connectivity and access as a goal. Retail 494 and office design elements should include rear parking, grid streets, sidewalks, street 495 trees and building orientation. Angled and parallel on-“street” parking, may be used to 496 improve walkability. Office, civic, and multi-type residential use may use campus-497 style building orientation, courtyard and on-street parking and pedestrian connections. 498 499

1.4 West of Roloson Road, and south of the commercial corridor, residential is 500 recommended to be 1.5 units per net developable acre (NDA) if sewer becomes available. 501 1.5 East of Roloson Road and west of Old State Road, and south of the commercial area, 502 residential use is recommended at one unit per acre without sanitary sewer or up to 503 approximately 1.5 units per net developable acre with centralized sewer. 504 1.6 A future traffic signal at Lackey Old State Road and U.S. 36 should be installed when 505 the warrants are met. This would regulate the traffic from the commercial corridor and 506 new backage roads. 507 1.7 North of U.S. 36, the lands outside of the commercial corridor are recommended for 508 residential and agricultural use at one unit per acre without sanitary sewer and 1.25 units 509 per net developable acre with centralized sewer. No sewer service is anticipated for this 510 area in the near term. 511 512 Ms. Korleski thanked Mr. Sanders and Mr. Bennetch for the presentation. Mr. Sanders 513 said at the next meeting he would probably go south from corridor one. He said this 514 presentation would be available on the Delaware County Regional Planning website 515 within the next few days. 516 517 Ms. Korleski thanked meeting attendees for coming to the meeting. 518 519 Ms. Wilson asked what the process was between the BZC and the DCRPC. She asked to 520 whom residents should provide their input and who would listen. Ms. Korleski said input 521 should be directed to the BZC. 522 523 Ms. Korleski said if residents review the information and have comments or concerns, 524 they can be addressed at the next meeting Mr. Sanders is here. There is also zoning 525 business to take care of. Ms. Wilson said she has read the BZC minutes on the website. 526 Per the Berlin Township website, Chapter 4 was to be discussed at this meeting. 527 528 Ms. Korleski said Mr. Sanders went through the demographic and community profile 529 information. The residents will not have any input on that, and Mr. Sanders will review 530 that. He has provided an overview of that. She said the BZC has no impact on utility 531 changes. She said if the residents have recommendations, they should provide them to the 532 BZC. 533 534

Ms. Korleski said all comments will be taken into consideration. Mr. Sanders will make 535 the changes requested by the BZC then initiate the changes, which goes to the DCPRC 536 and then the trustees. She suggested that they look at this corridor first. 537 538 Ms. Wilson asked how the township would communicate with the residents who cannot 539 be here and whether there would be a survey. Ms. Korleski said she would like to put a 540 copy online as well. The BZC first needs to get approval to do so and they first have to 541 decide what kind of questions they want to ask. 542 543 Ms. Korleski said when there are no zonings the BZC will discuss the CLUP update. Ms. 544 Wilson asked whether that would be on the agenda. Ms. Korleski said it would be and 545 that one of the problems is that sometimes the BZC does not know somebody will appear 546 before them until a week before. 547 548 There was a discussion about the survey. 549 550 Mr. Flaherty said the vision is the guiding line for the entire CLUP. He asked residents 551 to look at it to see whether the vision still makes sense for the direction that the township 552 has moved in the past 8 years. Changes are made here and then comprehensive changes 553 are made based on what the vision is saying. 554 555 Mr. Flaherty said the residents’ input is welcome at any time. Mr. Valentine said the 556 entire CLUP for 2020 does not need to be done all at once. Currently the township thinks 557 that section 1 and revising the vision are the two most important parts at this time. 558 559 Ms. Korleski said when the BZC has a final decision on the changes they will initiate the 560 changes and have Mr. Sanders put them in writing and they will be sent onto the trustees. 561 Then the BZC can move onto something else. 562 563 Mr. Wilson said Chapter 4 references the 1999 initiative, which he was involved in. He 564 asked whether the input provided in 2010 from the survey was put into this chapter 4 and 565 updated. Mr. Valentine said it was. Mr. Sanders said it was also included in appendix B 566 in the back. 567 568 Mr. Schlegel said there was discussion about historic Cheshire being the historical center 569 of Berlin Township, and he asked whether Evans Farm was intended to take the place of 570 that or whether there was still a desire to have an Old Cheshire district. Mr. Flaherty said 571 that is the kind of input they are seeking. Has the vision shifted and will Evans Farm 572 now take more of the community center up or will they still look at Old Cheshire to serve 573 that purpose? 574 575 Mark Mess asked whether the new interchange on I-71 would be discussed at a future 576 meeting. Ms. Korleski said that would be discussed when the corridor is discussed 577 because Berlin Township will be impacted by this. 578 579 Ms. Rippel said the Berlin Meadows subdivision will be discussed at the next BZC 580 meeting. Ms. Korleski said the next meeting will be held on May 22, 2018 at 7:00 pm. 581 There will be no time to discuss the CLUP at that meeting. 582 583 There was no further business to come before the Commission.
