We take it as a pride saying that TAMILNADUstands first in Health care in our Country. But it hasbeen put to test by the presence of large number ofDengue cases in the past one month. The root causehas been the poor social conscious of the public andthe failure on the part of the Local Administration toeffectively clean the state. Hence it is the Healthdepartment and the Doctors who are put to unduehardship. We request the members to take effectivesteps to clean your home, clinic or hospital and theroads and place where we live. It is our duty as citizensto keep our place clean andprofessional duty to treat thepatients with a humane approach.There are instances where thehospitals are put to some hardshipby the authorities; but let’s followthe rules of the land for the benefitof the community. Please keep usinformed of any events to takeaction from our end. Let’s followthe WHO protocol when treatingthe Dengue patients- inform thelocal authority as it is a notifieddisease as per MCI code of Ethics,and refer the patient if we do not have the necessaryinfrastructure to treat Dengue. (Cell counter,accessible transfusion facilities, Physician/Pediatrician etc.)
The State council meeting organized by IMACoimbatore was one of the well-organized with greathospitality.We thank the office bearers for theircommitment in organizing to the demands of the Stateoffice.
One of the major resolutions in the SCM was toorganize a Nursing School in the Northern districtsof Tamilnadu. This will help us to some extent getqualified Nursing personals for our hospitals. Ifeveryone put their heart and mind into it we shall beable to organize in a years’ time. We have the expertiseas well the funds for it. We hope to complete theprocess within one academic year.
The response for the TRAUMA CARE PROJECTis unbelievable for the past two days and we hope tocomplete it this on October 15that Trichy honoring
the Branches who have respondedin an excellent way. Hats off to all ofthem.
IMA ‘s venture the Brain childof Dr.J.A.Jayalal to organize NEETcoaching has receive a big boost bythe committed work of Dr.K.M.AbulHassan who is also emotionallyinvolved to tide over the NEET crisisfor the rural Tamilnadu.
We will effectively do theproject for the next three years andprove that Tamilnadu students are
in no way behind any one and can perform better andbest given the ample opportunity.
This is a great organization which has provedbeyond doubt the our NUMERICAL POWER hasbeen able to achieve lots.
If our Numerical strength increases further it isjust unimaginable. Let’s work more for our POWERSenrolling more members into our Organisation.

IMA Coimbatore hosted an excellent StateCouncil meet and I am happy we could have a fruitfulState Council meet with major decision on theimprovement of IMA activities like new FSS titled asFSS II Scheme, a comprehensive insurance coverageof Doctors family with Star Health, approval of ourmajor plans in the year 2018 and steps to establishIMA Nursing School and College with the approvalof Government of Tamilnadu and Nursing Council.Weare going ahead with these vision and I am sure inthe state conference we will inaugurate all thesethings.
Dengue is posting formidable challenge. Inspiteof hard sustainable works by health team from bothGovernment and private sector due to natural calamityand our indiscipline life style, it is playing havoc.Every one of us are responsible. IMA firmly affirmour full hearted involvement and active participationwith Government. Government has also realized therole of private sectors in promoting education andawareness on control the breeding of mosquitoes
and ensuring adequate health care to all. We urgeevery member of IMA to spare one hour every day incleaning our environment and also empowering ourcommunity to keep their home clean and free fromwater stagnations.
IMA Neethi is a social responsive project initiatedby IMA, envisioning to have District/Branch levelNEET coaching centresfor poor and downtroddenpeople free of cost and empowering them to faceNEET exam so as to make their dream come true. It isplanned to do absolutely free of cost with raisingfund among philanthropic doctors and well-wishersfor the welfare of our poor students. I appeal to allbranches to carry on this mission and we are ready tosupport you in all areas.

In 1967 Prof. Dr.R.Nanjunda Rao wastransferred from StanleyMedical College as thechief of 7th Surgical Unit
in GH. We the Post graduates weresurprised that he landed in DAS Quarters to join us refusingto occupy his exclusive Professor’s rest Room. He purchasednew books in surgical advances and helped us.
1968 to 70 saw the emergence of the Head quartersBuilding of ASI with RNR as the Treasurer. He rose to becomethe National Treasurer of the ASI. He was the first Chairmanof the Tamilnadu Pondicherry Chapter ASI. The first paperpresented in that Conference in Salem was by his Post GraduateStudent.
He used to accompany the Post Graduates and Assistantsin the same class in the Train. Never claiming a separate roomfor himself he used to join us in same room sometimes even asa third member. This habit he continued with the IMAMembers while attending any Meetings till the end.
1977-78 saw him as the State President of IMA Tamilnadu.From that time for nearly 40 years he never missed a Statecouncil. This he did till five years ago when he had fracturedhis lower limb at Tiruchendur at the age of 90 while attendingthe State Council Meeting. Thus has been with us till he wasphysically prevented from attending our meetings.
He used to observe the proceedings silently only to comeout with his opinion at the end if there is a strongdisagreement. Then he will say what he feels right but neverinsisted on his decisions being followed. We had the greatestrespect for his wisdom and guidance.
As the Chairman of the Core Committee with me andDr. N.S. Chandra Bose as members he took special care todefine the general principles of relationship between thebranches, branches to the state and various schemes likeNHB, PPLSSS with their commitment to parent body and todefine mode of functioning. This formed the guidelines forthe constitution for which he had to make frequent travelswhich he tiredlessly took
The PPLSSS assembled for a new constitution atThanjavur Meeting. Dr. R. Najunda Rao and Dr.U.Mohamedthough not members of the Scheme made it a point to attend
personally and encouraged the structuringand smooth functioning of the Scheme.
When Clinical Establishment Act wasintroduced in 1997 the entire medicalcommunity was shocked The IMA, TAMPA,TNGDA whole heartedly joined to opposethe Act in that form Dr. R. Nanjunda Rao wasour natural choice as Leader of the jointaction committee to represent ourgrievances. He made countless travels fromChennai to South to various places and inChennai attended all meetings. His untiringeffort with us as our Leader established thecredibility with officials for favourableconsiderations the services ofDr.B Ramamoorthy the eminent Neurosurgeon who attended all such meeting atChennai with his personal presence andsupport had the great political advantage forus with former CM Dr. Kalaingar.
He was election commissioner for IMAfor number of years. He was the founder ofthe service brigade let the way for the villagehealth and entered LIMCA Book Records.I had to limit due to constrain space. Manyreaders will have more to offer.
He is survived by his Grand daughterand Son -in -law Dr.Manoharan, PlasticSurgeon.
Sir your mortal remains will join theuniverse matter in its natural course. TheSpiritual Character, Culture, Discipline whichyou emanated, conducted or transmittedhave already reached the receptive andappreciative minds of countless people. Theyare being followed by many. Your legacy andspirit will live forever in them and transmittedthrough them to others to come into thisworld. Your spirit will remain forever.

Greetings from IMA CGP
IMA CGP is going through a face of review andrestructuring. Based on this a review meeting washeld in IMA head quarters JVL plaza on 27/9/17. Ourstate president Dr.TN. Ravisankar, state secretary Dr.N. Muthurajan, President elect Dr.J.A. Jayalal,National vice president Dr. K. Prakasam, National CGPSecretary Dr.R. Gunasekaran, Election commissionchairman Dr.T. Sadagopan, Professors of MadrasMedical College, course coordinators and incomingoffice bearers of CGP and other leaders participated.The following points were discussed.
1) Dr.T.N.Ravishankar: CGP courses can not beconcentrated in one place, but it should be conductedall over Tamil Nadu. We can have the short timecourses for a period of 6 months rather than 1 year.He requested the members to give suggestions toimprove the CGP courses.
All the courses should have fee of Rs. 20,000/-only and requested the Faculty Secretary Dr.B.Sridharto conduct separate meeting on 08 Oct 2017. Healso requested him to shoot for online classes at theearliest.
Dr.R.Gunasekaran: CGP should enroll allcandidates undergoing courses as CGP members. Hehas suggested not to conduct the same courses inNational DGP s sell as IMA TNSB. New courses canbe started
Dr.J.A.Jayalal: It is not the objective of CGP toearn money, but to enhance knowledge of the MedicalProfessionals. Academic is our concern which shouldbe in a structural way. Restructuring CGP is ourpriority. CGP courses should spread out. We haveto rope in good faculties. we can go for Acute Carecourse in 6 months duration. In one year we shouldable to train 100 doctors in 4 online classes and 4 in
house classes. He also asked the Professors to givepapers for Medical Publication.
Dr.M.Parthiban:. The courses should have brandname. Duration must be small. Doctors attendingCGP classes should have computer knowledge. It isalso decided to have 2 hours Computer classcompulsorily in all courses. All the courses shouldhave certain online programmes. Using smart phoneand IMA Apps emphasized
D r.C.N.Raja: He emphasised the need of FamilyPhysician and requested IMA TNSB to bring certaincourse accordingly.
Dr.Raghunandhan, Professor/HOD CriticalCare, MMC: The course should be knowledge andskill based, so as to attract the candidates. We shouldhave structured modules and the faculty should ableto move place to place to conduct the programme,rather calling the candidates to one place. Peopledon’t like exam. Evaluation can be simple. Contactclasses can be minimised. He also agreed to cooperateand undertake the training for IMA Doctors, providedhe gets a G.O. for it. Dr.N.Muthurajan agreed to gethim G.O. from Govt., so as to conduct Toxicology/Poison in phase I and Trauma care in Phase II.
Dr.M.Balasdubramanian: As we don’t have thestamp of University, CGP set back. We should havecertain University affiliation and put stamp over thecertificate. Dr.J.A.Jayalal requested Dr.M.Balasubra-manian to get approval to CGP courses.
IMACGPTN plans to go ahead and plan the futuretaking the suggestions of the leaders into account.We promise you a bright future for IMACGP.

It is essential to note that this offence iscognizable, bailable and non-compoundable.Meaning thereby, arrest of suspected offender canbe affected by the police officer without a warrant.However, according to Section 41(1) of code ofcriminal procedure 1973, the police officer is expectedto take an objective decision as to arrest on the basicsof either reasonable suspicion or credible information.Otherwise, the arrest would be arbitrary(j‹Å¢irahd, xUjiyahd).
The doctor who is arrested under this section isentitled to be released on bail, as of right, as it isbailable offence (ãizÉL F‰w«). Under nocircumstances, Compromise between the suspectedoffender and the attendants of the victim is possible,as it is non-compoundable offence (ïirªJ
Ô®¡fÉayhj F‰w«).The Supreme Court has made arrest of a doctor
in cases of medical negligence virtually impossibleby stating thus, “A doctor accused of rashness ornegligence may not be arrested in a routine manner(simply because a charge has been levelled againsthim). Unless his arrest is necessary for furthering theinvestigation or for collecting evidence or unless theinvestigation officer feels satisfied that the doctorproceeded against would not make himself availableto face the prosecution unless arrested, the arrestmay be withheld”-Para 53, Jacob Mathew Vs State ofPunjab & Anr (AIR 2005 SC 3180).
Other provisions of Indian Penal Code applicableto medicine Sections: 176, 269, 270, 271, 274-276, 287,312-316 & 318.
Dear friends, Greetings to all.Crime is a social harm defined and madepunishable by law; the punishment may be inthe form of a fine or imprisonment or both.Doctors in the course of discharging theirprofessional duty face criminal prosecutioneither under the Indian Penal Code(IPC) orunder the various Penal Statutes for example, thepreconception and pre-natal DiagnosticTechniques (Prohibition of sex selection) Act, 1994.
The Penal Provisions that the doctors must likelyto encounter are Sec 304A, 336 or 337 and 338 IndianPenal Code.
The relevant provisions read as under:Sec 336: Act endangering life or personal safety ofothers:-
Whoever does any act so rashly or negligentlyas to endanger human life or the personal safety ofothers shall be punished with imprisonment of eitherdescription for a term which may extend to threemonths, or with fine which may extend to two hundredand fifty rupees or with both.
This offence is cognizable, bailable andcompoundable.Sec: 337: Causing hurt:-
Whoever causes hurt to any person by doingany act so rashly or negligently as to endanger humanlife or the personal safety of others, shall be punishedwith imprisonment of either description for a termwhich may extend to six months or with fine whichmay extend to 500 rupees or both.
This offence also is cognizable, bailable andcompoundable.
Sec: 338: Causing grievous hurt-by actendangering life or personal safety of others:-
Shall be punished with imprisonment of eitherdescription for a term which may extend to two yearsor with fine which may extend to one thousand rupeesor with both.
This offence is cognizable, bailable andcompoundable.
Section 304 A:Causing death by negligence:-
