the Stormwater Management Manual for Western Australia.

Surface Water

The subject property is located within the Serpentine River System as proclaimed under the Rights in Water and Irrigation Act 1914. Any taking or diversion of surface water in this proclaimed area for purposes other than domestic and/or stock watering is subject to licensing by the Department of Water. The issuing of a surface water licence is not guaranteed but if issued will contain a number of conditions that are binding upon the licensee. In addition any interference with the bed or banks of a watercourse will require a permit from the Department of Water.

Management of forestry products

In accordance with Water Quality Protection Note 90: Organic materials – storage and recycling (WQPN 90): Uncontaminated water should be captured for fit-for-purpose supply or infiltrated into the ground.

• Storage areas should be designed with sufficient capacity to ensure all material is properly contained and protected from dispersal by wind. Given the operation is located adjacent to a sensitive water resource, Gooralong Brook, the processed forestry products should be stored under a weatherproof cover and a low permeability hardstand. Refer to WQPN 90 for further information.

Foreshore protection

In accordance with DoW's Operational policy 4.3: Identifying and establishing waterways foreshore areas (Policy 4.3), the foreshore area shall be identified and protected under planning mechanisms. The foreshore area is defined as the land that adjoins the waterway to the extent of the riparian vegetation.

The Gooralong Brook flows in a westerly direction through Lot 801 Jarrahdale Road, Jarrahdale. A desktop review indicates the foreshore

relating to the specifications of the stockpile area. This should be addressed as part of the management plans, required to be submitted as part of the application.

4. Applicant has not provided a management plan addressing protection measures for the Gooralong Brook.

leasee struggled to keep it operating.

2. This proposal effectively re introduces an INDUSTRIAL operation based on 1872 practices which flaunt normal requirements such as buffer zones(usually a min of 500metres from any urban zoned land holdings) as well as new Fire Management requirements and environmental issues.

3. Copious quantities of water have been used in the past to keep milling timber dampened. The main source of supply has been the Gooralong Brook with water being pumped from Turtle Pond (a man-made dam) on the Gooralong Brook. In recent years the pumping has prevented the flow of water downstream in contravention of the Riparian Act. It is a legal requirement under this act that the flow of water must be allowed to continue and water can only be drawn for immediate domestic needs. The Gooralong stream no longer has the capacity to support any water being drawn off it as it is now reduced to a mere trickle during summer. 4 years ago the stream completely dried out during summer/The impact on the environment including trees, shrubs, birdlife, reptiles and fauna is already under threat and is the reason Francesca's Garden downstream (cnr Oak and Jarrahdale Roads) does not utilize water from the brook.

4. Land values in the immediate vicinity which are only just showing signs of recovery since the GFC will once again be suppressed whilst a mill is operating in such close proximity in particular the 20 hectares of land owned by the Shire (ratepayers) which adjoins the mill site was zoned URBAN with residential development in mind. Can the Shire afford to let ratepayers down by having their own holdings devalued. Potentially it could take 20 years (Proposed lease term with option) before values recover and the chance of on selling other than at very heavily discounted prices would be remote. It will weaken the value of the Shire's asset holdings and bank valuations.

2. The proposed development is considered to be of a low scale operation in comparison to the operation conducted throughout the 20th Century. No fire management plan has been submitted.

3. A Water Licence will be required to be obtained from the Department of Water for the taking or diversion of any water on site / from the brook.

5. Recent fires in the Hills Areas has made it essential that an adequate Fire Management Plan is in place for any new developments. The booklet Timber Mills of Jarrahdale clearly demonstrates that in the past many mills were burnt to the ground due to fires which began on site due to machinery incidents, spontaneous combustion etc. The stockpiling of sawdust and logs in what could only be termed an extreme fire hazard area would be an extreme risk. A fire in this locality virtually adjoining the town site would not only destroy the remaining historical significance of this site but would certainly place the Township under threat due to the intense vegetation which surrounds this former mill site. The historically preserved privately owned timber residences in the immediate vicinity and the historic managers’ timber cottage would all be under threat. It may be of interest to note that under new building regulations the construction of a timber residence in a new development would no longer be permitted in a fire hazard area....which means we cannot afford to lose our existing timber heritage buildings.

6. Jarrahdale road is becoming very busy and an increasingly dangerous road. The use of heavy haulage log trucks on this road (over a 20 year lease period) would be a disaster with serious consequences for the future Jarrahdale Road between Medulla and Buckland Roads is a series of blind bends with narrow single lanes and steep gradients. The fast growing number of cyclists using this section creates another hazard with vehicles having to straddle double lines to avoid a catastrophe. Vehicles entering and exiting properties along this stretch cannot afford to pause as vehicles travelling at high speeds of 80kph around blind bends are likely to collide. A log truck would not have the capacity to slow down enough to avoid an accident. This area should be designated a 60 kph zone.

7. The noise from the Mill will impact on the peace and tranquillity of the town site and the 20 year lease would prove a lifetime sentence

should be submitted and approved prior to the commencement of the operation.

6. A traffic management plan has been requested. The applicant has yet to provide the Shire with details relating to trafficable movements.

8. The former timber mill would ideally be suited as a venue for a COUNTRY MARKET place providing a covered area for traders to sell their goods. Incorporating some of the features at both the Kalamunda Markets and the Mundijong markets would prove popular Jarrahdale's future is in promoting tourism however any commercial ,retail or industrial operation is welcomed provided it is suitably located and meets all appropriate protocols and regulations. The current proposal is based on a 19th century model which does not satisfy 21st century standards. Give it the flick!!I

9 We are opposed to the proposed re-commissioning of the saw mill on this site; Lot 801 Jarrahdale Road, Jarrahdale, for the following reasons:

Who are C & C Enterprises? An ABN was not supplied, do they have one? No names of Principals or contacts details were supplied. I was able to glean from a third party, that a Mr R. Croft is somewhat involved in the Development Application, who is he, who does he represent, and what experiences in the proposed enterprise does he have? All still unknown.

Item 1, in the application it is mentioned that sawmilling activities would be similar to those carried out on the site previously. The word similar can easily be interpreted to suit different agendas. Also one should remember that Bunnings sold out for commercial reason and previous leasee, had difficulties. Unless C & C Enterprises have some magic solutions, the viability of a timber mill on this site is very questionable.

Item 2 mentions an additional business etc. etc. The site use is zoned for a timber mill or historical use. After much research I have deduced that the "additional business" is the production of sawdust and/or wood pellets. The production of these products needs

machinery, the size of the pellet makers is unknown or how many will be installed, plus all the supplementary, like saws hammer mills etc, all requiring power to operate and producing noise, there is no indication of the proposed days and hours of operation. The process of making wood pellets is very dusty, what control are being considered to control this dust. Water and other liquids are used in wood pellet production, also what chemicals are used, how will they be stored? The water pipe line into Jarrahdale is barely able to cope with present demands and removal of water from Gooralong Brook is not an option.

Items 3 & 4, mentions the removal of residual waste. It is claimed that the removal of residual waste from the forest floor would reduce fire risks to the township of Jarrahdale. Once removed, where is this residual waste to be stored, where else, but on the mill site, thus becoming a fire hazard in its self, open to vandalism and/or spontaneous combustion, right in the middle of town. With storage of residual forest waste also allows for the leaching timber saps and tannins etc into the ground, creating an imbalance in the soil and obviously some of these nasties will ultimately find its way into Turtle Creek/Gooralong Brook. With a waterway so close, what has been considered for disposal of toilet and washing waste produced by the proposed increased workforce?

Also with item 4 & 5 this residual forest floor waste is ultimately removed by members of public, who pay a fee to collect fire wood. Besides the fee payment these people contribute to the local economy with purchases of supplies for their day's activity.

Traffic movement is mentioned in item 8, the whole project would be based on volume in and volume out, consequently there will be an increase of traffic volume down Jarrahdale and Millars roads, the intersection of these, which trucks would have to negotiate is far too tight. sawmill can be interpreted as the processing of trees or wood into smaller a smaller resource. Refer response to submitter 2.

are not conducive for large truck movements. With the restriction on the use of "Double B" trucks on Jarrahdale the truck numbers would be increased with use of smaller trucks.

The noise factor was mentioned item 9, the applicants will be attempting to put extra equipment on the site, how can there not be an increase in noise?

Item 10, talks about the perceived benefits from the proposed new industry; without more details how is it possible to even guess the numbers of a workforce or what effect/benefits will occur?

After frustrating many years of hollow promise work has finally started, with a dedicated band of local residents, on the "Heritage Park" with the removal of non-native wattle trees and the clearing under growth and debris from Gooralong Brook, which runs through the park. Already, in its incomplete state the park is receiving visitors who are enjoying the serenity and beauty that Park is starting to provide. Is there any guarantee that the brook will not be polluted with "mill" waste and the quiet and serenity will not be comprised by noise, smell or dust from the mill?

Eight years ago we became residents of Jarrahdale with understanding the town was focussed on the environment and tourism, an image promoted by the Shire.

Let's be realistic Jarrahdale is no longer a timber town, there relics and reminders of its past. That past was punctuated by the rape and pillage by moguls and companies whose only interested was in obtaining a financial reward from Jarrahdale, to the detriment of the local inhabitants and the surrounding environment. We do not wish for this to occur again.

We have no problem with commercial operations in Jarrahdale as long as they do not detract from the ethos that exists at the moment.

The proposal is high on rhetoric and low on facts and figures, it is considered the proposed project would not be of any benefit to Jarrahdale, we strongly recommend the Shire reject this application.

10 We are strongly opposed to a mill being used for these purposes in the middle of Jarrahdale. We do not want industrial work being carried out so close to town and our homes. The traffic will be horrendous as will the noise.

A mill like this would also affect the park which a lot of people are working hard to make into a place of beauty for the town and tourists alike, no one would want to come into the park for a picnic next to a dirty dusty smelly mill, this would spoil Jarrahdale which was a place of peace and beauty. Please consider these things carefully when making your decision.

11 We would like to respond with an objection to this plan "Sawmill Operation" as our surrounding environment and property will be affected.

We have concerns with the letter supplied it states Consultation the S / J shire the whole town should be informed about this, have a town hall forum for the whole Community/Town as it effects all that live in Jarrahdale, we are disappointed that this has not happen hopefully we are in the very early stages of this planning application.

In the letter it does not show any research on your behalf into this company or product that will be "Bleaching" there product, we are very concerned about the Environmental Impact this will have on our Community, Heritage Mill and our restoration project on the Gooralong brook "Turtle Creek" which has received Government funding, supported by our S / J shire, S / J Landcare, Tony Simpson, Don Randal, National Trust and the Jarrahdale Community Association.

In 2013 our group JCA/Friends of the Park manager Melissa Matheson placed 3 cockatubes for the endangered cockatoo species in the area,

The comments have been acknowledged and have been considered as part of the assessment of the current application. It is required that suitable management plans be submitted to undertake a suitable impact assessment to ensure suitable measures are in place to protect the amenity and environment of Jarrahdale and the greater locality prior to the development application being considered for approval. they are at the turtle creek site which is less than 100m from the Jarrahdale mill, our concern is noise pollution air pollution and toxic waste leaching back to the Gooralong Brook /Turtle Creek. In your letter it also states the business will be similar to the operation that ceased in November 2013 this is not true as to make this saw dust, mulch, pellet product they will be using a mulch machine and other large industrial equipment that make a lot more noise than timber saw's, chemical use, storage and waste of this toxic material how does this fall into "historic use and timber mill".

There is no information supplied about the products or company, has the company supplied a copy of their plant management plan, waste plan /traffic plan, water pipe plan.

We would like to see what the water corporation has to report, with the very low rain fall in the past 5 years it would be ridicules to pump the water from the Gooralong brook this water source is seasonal and cannot support water supply to this business, as little creatures brewery where advised by the S / J Shire that they had to build their own pipe line as the town water pipe did not have the right pressure and would not sustain the water use.

In the late 90's a local group formed and they stopped the large road trains from using the main road threw the town site Jarrahdale road No Link .

The trucks that will transport the logs will cause great damage to the Gooralong Brook "Turtle Creek" as Millars road is a unsealed road the dust and erosion from just cars has been an ongoing issue for the water return I can only imagine the environmental impact the trucks will cause to the houses, Millars road, Jarrahdale Road and the Echo system of the water way and surrounding bushland we are very concerned.

Die back is a major problem to our Jarrah forest in this area will the shire have a management program plan in place for this company.

As we own our home all the noise and pollution caused by this mill our property will go down in value this is not acceptable, ask the town’s residents if they can hear the quarry on the South West high way in Byford now that's a lot further than the Jarrahdale mill.

Jarrahdale Community Association member/ Friends of the Park Manger Melissa Matheson of the Turtle Creek Project has worked on this project/site restoring and revegetating for the past 9 years with the support and help from the children of the Jarrahdale primary school, Serpentine/Jarrahdale Landcare, community volunteers, DEC and National trust.

As the Gooralong Brook is a Heritage water source that flows through the Town site of Jarrahdale down to kitty's gorge and onto the Serpentine falls it is a very sensitive echo system with a rare rock fly larva that needs protecting not polluting.

On behalf of my group JCA/Friends of the Park I Mrs Melissa Matheson would like to have a on site visit with you as soon as possible to show you the work that we have done.

12 We write in response to your correspondence, ref. P01146/03 RC:wj, and wish to express our deep concerns regarding the proposal as set out in the attachment. We address our concerns as below:

1. Despite extensive on-line searches we are unable to obtain any information on the Proposer, ie. C & C Enterprises (C&C) and, as we understand, the Shire does not have an ABN for this organisation. As such we would request further information on any existing or previous works that C&C have entered into.

2. Details of the proposed areas close to the Jarrahdale town site which C&C deem to consider for its ‘harvesting’ activities (refer item 4 of the attachment). There are several public wooding areas within the vicinity and intense rehabilitation forestation.

3. The issue of traffic is of major concern. Millars Road, as you would be aware, is a small access way to the town site and also includes access to the town’s recreation area (oval). It does not have any traffic management at the intersection to Jarrahdale Road, eg. Stop signs and is already a potential hazard point.

This end of the town is also home to many small children and the addition of heavy vehicles and increased traffic would introduce additional safety concerns. These children also frequent the creek, existing skate park and other natural environment areas directly within the vicinity of the mill.

Although the speed limit within the town site is deemed to be 50 km/hr, this is constantly ignored and, despite numerous requests, nothing has been done to ensure this speed limit is adhered to and/or policed – the addition of the heavy haulage etc. would likely increase the blatant disregard for the town’s community.

4. As for item 10 of the attachment:

(a) Long term employment in the town – the previous business carried out at the mill employed a maximum of four people, including the owner. If the proposed undertaking is to be set up as a similar operation (as stated in item 1), this statement would appear very questionable.

(b) Increase of local business trade - this item is not within our jurisdiction to make direct comment but again we would regard it as questionable, beside reiterating the subject of increased traffic.

(c) Residual waste product – what is it? How many chicken farms exist within the local community?

(d) Removal of residue - the ‘residue’ which may be left on the forest floor provides a habitat for many native species as well as

Based on past observations of this type of industry, no regard is given to other native vegetation (eg. Grass trees) which seem to be destroyed in the course of the exercise, this area is a lush area for these plants and we pay strong respect to the environment.

(e) This item appears ludicrous. With the size of the operation proposed it would seem unlikely that the ‘residue product’ (which has not been defined) would require to be of substantial proportions to be considered as an alternative to generate enough power to service a power generation plant.

(f) Use of site – this area would be better utilised to incorporate drawing visitors and enticing locals to an already attractive and natural environment eg. Restoration and installation of a Heritage Mill. Whilst this may not initially generate as much revenue for the Shire, it may ultimately provide a much longer term and agreeable option which would in turn address the previously mentioned points of long term local employment and increase to local business, whilst maintaining the atmosphere and uniqueness of the Heritage Town of Jarrahdale.

5. Further to the above points we would also like to address the control of noise and chemicals to be used in the processing procedures. Although C&C have mentioned using similar machinery as in the previous Mill, it would appear it intends to carry out several other processes which would inherently mean the utilization of other types of machines. As such we would like to be made aware of the noise levels of the machines and what types of chemicals would be necessary and used. This point also raises the subject of where

We have a number of concerns regarding this proposal.

Firstly C&C Enterprises want to run their business similar to previous business. The previous business operating at the site dumped wood including rubbish such as tarps, plastic etc past the boundary of the sawmill into the Heritage Park.

Sprinklers were often turned on even on rainy days, the pipes were leaking and water was being wasted. With climate change and reduced rainfall we cannot afford to pump water out of Turtle Creek anymore.

We don't need more traffic, especially trucks who continuously speed and increase vehicle noise along Jarrahdale Road.

The stock piling of timber would be a fire hazard

We don't want to see more forest close to Jarrahdale being harvested.

This site could be better utilized, such as a market where people to could sell local produce.

We live on Millars Road and have done so for the past 6 years. In this time the current mill has been in operation and there have been no issues from this mill. In saying that we are 100% against the proposal of a new mill operating in this location due to the following :

The amount of trucks that will be going down Millars road to take the residue from the Jarrahdale forest to the mill is of great concern due to the amount of small children living in the vicinity of Millars Road and Jarrahdale Road and the traffic does not adhere to the current 50 km/h speed limit so adding more trucks to the equation can only lead to disaster.

We also have concerns for the local waterhole which will take in the water runoff from this mill which then flows on down the Gooralong Brook through the town of Jarrahdale. What toxins will be in this water

As a resident of Jarrahdale living within 200 meters of this mill we would like to see an EPA report on this new proposal and see that there will be no runoff of toxic residue from this operation running into the Gooralong brook.

There is also the concern about the piles of mulch in the summer as Jarrahdale gets temperatures exceeding 42 degrees and the mulch can combust and cause a fire.

Also the concern of the smell of piles of mulch sitting out in the elements may become very offensive to those living within the vicinity of this mill operation.

Please take into consideration the above concerns and we would like to think that you would call a town meeting for all those concerned that live near this mill to explain in more detail what the plans and proposals are.

that we and most of the Jarrahdale residents have only heard about it second hand in the last day or so we are hurriedly writing to oppose to the woodchip mill on the following grounds:

• Noise pollution. The noise from such an operation will impact on residents' quality of life and have a negative impact on Jarrahdale's status as a tourism destination. Many volunteer hours have been spent developing walks, cycle ways, museum, picnic spots etc.

• Dust pollution. The dust from such a venture is likely to be harmful to the general health of children and adults living in the area.

• This enterprise would lead to Increased, noisy and dangerous haulage traffic on the picturesque route through Jarrahdale where residential homes are alongside Jarrahdale Road.

• The proposed area is part of a Heritage Park and as such not suitable for noisy industrial activity. I am unaware of any scheme amendment or change of use applications for this area.

• "Clear felling is a controversial forest practice in Australia, and opponents argue that the wood chipping industry is culpable for its continuation", Wikipedia.

• DEC provide an excellent fire protection for Jarrahdale, why would these logs then be a concern for a fire hazard and if there is, a fire hazard why has this mattered not been addressed earlier.

25 My views in regards to points raised by C&C Enterprises.

1. I tend to regard the applicant’s stated intention to set up a similar operation to that previously conducted at the mill site is a bit of a smoke screen.

As it is common knowledge that the applicants had entered into discussion with the operator of the old mill, and indicated their intention to purchase the entire plant needed to operate the boutique style mill.

In fact they failed to make any effort to obtain any of the equipment prior to the closure of the mill or at auction. This would not seem to be the actions of an astute prospective operator of a boutique mill.

2. The applicant states it is their intention to start and additional business as soon as possible to process waste from other mills. Which to my mind suggests that this is their primary interest, and given permission to operate will be their only interest.

3. Forest Floor Residue. Reduction in fuel load can be a good thing, but it can also create an in-balance in natural plant and animal life.

4. With regard to areas of forest that are ready for harvest in the local area, it has long been the practice to open local areas for the collection of firewood in the season. This has been a low impact and effective method of forest floor clearance for years, and I am concerned that if the proposal goes ahead local access will cease to exist.

5. The fact that a then year contract is in the pipeline with the FPC only increases my concerns that the local ratepayers will be shut out from these areas.

6. As a resident of Millars Road I have no wish to see the mill locked into a possible 20 year contract. 300 Metres from my back door with all the problems that will be associated with this proposal.

7. If the Council agrees to this proposal it appears that items 5 and 6 are locked in. I think that the reaction to this by Jarrahdale residents will not be taken lightly.

8. The proposal suggests that the movement of trucks may be an issue to Council. Well I can assure Council the movement of trucks will absolutely disturb local residents. The use of Millars road via Jarrahdale road would impinge on the lifestyle of all the residents of Millars Road.

I would also like to remind the Council that all the Residents have entered into an agreement with the Shire to protect the status of the homes in Millars Road, I would suggest that by virtue of that agreement the Shire has a responsibility to protect the interest of the residents of Millars Road in regard to traffic flow through a protected heritage area.

9. It is incorrect for the intended occupiers of the site to suggest that noise considerations will be the same or less than the last mill operation. The last mill never had more than 2 employees and the owner working.

Plain economics would suggest you cannot have higher outputs, more employment, more traffic movement, constant machinery running, etc and still produce less noise.

10. Benefits

When I spoke to Rob Casella regarding this proposal I became aware that no business registration or ABN was with the submission. I have been unable to trace any information on C&C Enterprises. Do they actually exist as an entity?

Where is a proper environmental proposal. What will be the impact on the turtle creek area, that local residents have put so much time and energy into?

What bleaching and chemical process do they intend to use?

To my mind the application is shocking, incomplete, and what’s worse misleading. It has been the intention to maintain heritage type operations in the area, it is my hope that the mill site can continue those type of activities.

26 I am a local Jarrahdale resident and would like some more information regarding the proposal of wood chipping at the mill and what steps this organization has taken to reduce dust levels whilst wood chipping and the health implications if it isn't kept to a minimum.

Wood dust has many health issues over long term exposure such as asthma, skin irritations and cancer.

I am also concerned it could potentially have environmental impact on turtle creek and the life that's lives in and around it as wood dust can stick to fish gills and has carcinogenic properties.

I am also wishing to know which route the trucks will be taking to transport these woodchips, will they be driving right through our town or use Nettleton Road.

Department of Environment Regulations

27 The Department of Environment Regulation (DER) has reviewed the information submitted in regard to the proposed development (Reference number P01146/03) of the abovementioned Lot. DER understands that C & C Enterprises have an agreement to lease Lot 801 Jarrahdale Road, Jarrahdale from the National Trust of Australia (WA) to utilise the former timber mill to process residual waste from processed logs and logs that have been felled and would usually remain on the forest floor. The waste material will be processed into woodchips and saw dust and stockpiled on-site for a short period before being provided to local businesses as required (e.g. for use by chicken farms).

Lot 801 Jarrahdale Road, Jarrahdale was reported to DER as a known or suspected contaminated site as per the reporting obligations under section 11 of the Contaminated Site Act 2003 (the Act) on 31 May 2007. Due to the very large amount of reports received during this peak reporting period, DER was unable to adhere to the statutory 45 day classification period set out in section 14 of the Act for many of the submissions made at this time.

The site was reported due to its former use as a timber mill which began operations in 1949. Following our phone conversation on 13 August 2014, the Shire of Serpentine Jarrahdale is not aware of any historical timber treatment or timber preservation activities being undertaken at the site. The site is currently zoned 'rural' under the Metropolitan Regional Scheme and 'special use' under the relevant Town Planning Scheme. The site is currently listed as 'awaiting classification'. However, based on the available information at this time the site is likely to be classified as 'report not substantiated' under the Act. DER will complete the classification as soon as practicable, and will inform the relevant stakeholders of the classification once completed.

Based on the available information and considering the land use is to remain unchanged and there is no change to a more sensitive land use,
