    As the summer comes to a close, I hope everyone had an opportunity to

    spend time with family and escape the central valley heat. Despite the

    hiatus of scheduled board meetings, much was accomplished during the

    summer break.

    July was an eventful month with another successful Leland Chow Me-

    morial Fishing trip. The overnight underway to the channel islands was

    a bit rougher than years past, but worth the rocking and rolling to catch

    huge fish! Expert angler Dr. Koh won the jackpot with the biggest fish,

    and most everyone came home with bags full of yellowtail, snapper and

    white sea bass. On the ride home, Dr. Stewart and I discussed the possi-

    bility of an additional, shorter trip that might interest more members.

    Two well-attended CE courses were held at the Marriott this summer:

    OSHA and the Dental Practice act presented by Leslie Canham, and

    Employee Manual/Sick Leave Law Update presented by Michelle Cor-

    have come about in 2016. In case you may have missed the live CE

    courses this summer, extensive resources for updating your employee

    manual are available via the CDA website.

    preparation for this year's CDA Foundation Gala at the Petroleum Club

    Kern County has been chosen to host a CDA

    Cares Event on October 6th and 7th of 2017.

    We will need our members to step up and volun-

    teer. Please mark your calendars for these two

    days and plan on joining us to help those less

    fortunate in our area.

    The next CDA Cares event will be held in Stock-

    ton at the San Joaquin County Fairgrounds on Oct

    15 and 16, 2016. Please volunteer in preparation

    for Kern County hosting our event in 2017. Please

    click here for more information.

    The Taft Dental Hygiene Program is looking for

    patients. Particularly those with perio case types 2

    & 3 and those with moderate to heavy deposits.

    The students are able to perform analog and digital

    x-rays. Appointments are approximately 1/2 day, 8

    -12 or 1-5. The fee is $20.00 per patient, no extra

    charge for x-rays. The x-rays can be forwarded to

    their regular dentist. The program is not trying to

    take money out of the dental community but they

    do need patients to hone their skills on. Please send

    a referral or two their way.

    When changing your practice address or tax identi-

    fication number it is important to update the Dental

    Board of California and the NPPES (NPI registry).

    The Provider Directory law (SB 137) requires den-

    tists to update their information with plans they are

    in contract with twice a year and within 5 days of

    any changes.

    KCDS is selling raffle tickets for a Springfield

    1911A1 45 ACP handgun to raise funds for the up-

    coming CDA Cares event in Bakersfield 2017.

    2017 Slate of Candidates Kern County Dental Society

    Membership Notification of Slate of Candidates

    For 2017 Officer & Board Positions

    In accordance with the KCDS Bylaws, the membership of the Kern County Dental Society is hereby notified that

    nomination by petition for any office may be presented to the Secretary-Treasurer (Dr. Jared Simpson) any time

    prior October 1, 2016. The petition shall bear the signatures of ten (10) or more voting members in good stand-

    ing. Such nominations shall appear on the ballot in the order received following the names of the candidates se-

    lected by the Leadership Development Committee, and shall be published at least two (2) weeks prior to the elec-

    tion. Any member may write in the name of a member in good standing. Space for this purpose is provided on

    the ballot. Ballots will be mailed to the membership in early October. The election shall be declared at the No-

    vember Board of Directors meeting, and installation is scheduled for Friday, December 9, 2016.

    Trustee Report By Brenda Buzby, DDS

    The executive committee met on Aug. 19, the

    board of trustees (board) met on Aug. 19-20 and

    the nominating committee met on Aug. 20 in

    Sacramento. The next executive committee

    meeting is scheduled for Sept. 8 and the next

    board meeting is scheduled for Oct. 7.The fol-

    lowing actions were taken and discussions were

    held.

    Actions Taken: Actions of the executive com-

    mittee are subsequently considered by the board

    at its next meeting. Actions of the board, which

    are determined to be under House of Delegates

    (CDA house) authority, will be moved to the

    CDA house as a separate resolution.

    Minutes and Appointments: The executive com-

    mittee and board approved prior meeting

    minutes. The board also ratified the presidential

    appointments to the government affairs council

    and the innovations in membership models task

    force.

    Updates to the 2016 Management Objectives of

    the CDA Executive Director: The executive

    committee recommended and the board ap-

    proved revisions to the CDA executive direc-

    tor’s 2016 management objectives.

    Additional Alternate Delegates for the 2016

    ADA House: The board elected additional alter-

    nate delegates on the ADA delegation for

    2016.

    2018 CDA Cares Dates and Locations: The

    board approved the April 26-29 (Anaheim)

    and Oct. 25-28 (Modesto) CDA Cares dates and

    locations in 2018.

    Appointment of Auditors: The board approved

    retaining Crowe Horwath LLP as the independ-

    ent auditors for the CDA consolidated financial

    statements and 401 (k) plan financial statements

    for the year ended December 31, 2016.

    Fluoridation Funding-Healdsburg: The board

    approved funding for CDA engagement in a

    campaign to defeat an anti-water fluoridation

    initiative in the city of Healdsburg.

    Addition of Outside Directors to ADA Board:

    The board approved that the thirteenth district

    delegation to the ADA House of Delegates

    (ADA house) propose the consideration of the

    addition of outside directors to the ADA board.

    Inclusion of Student Members in Delegations to

    ADA House: The board approved that the thir-

    teenth district delegation pursue the ability to

    include student members on district delegations.

    Revision of Medicare Dental Coverage Policy:

    The board approved that the thirteenth district

    delegation propose a resolution to the ADA

    house to evaluate and consider the Medicare

    dental benefit.

    Budget Software Solution: The executive com-

    mittee recommended and the board approved

    funding to support the budget software imple-

    mentation.

    Thirteenth District Delegation Selection Pro-

    cess: The board approved a modification to the

    terms of service for delegates and alternate dele-

    gates on the delegation to the ADA house. The

    CDA house will consider bylaws revisions in

    November.

    Recommendations for Council, Commit-

    tee, CDA Presents Board of Managers and ADA

    Thirteenth District Delegation Vacancies: The

    board nominated candidates for positions on

    councils, committees, the CDA Presents Board

    of Managers and ADA delegation for election

    by the CDA house.

    Nominations to Subsidiary Company Boards of

    Directors: The board nominated candidate mem-

    bers to the subsidiary companies boards of di-

    rectors to be elected by the CDA Holding Com-

    pany Inc. (CDAHCI) board.

    Recommendations to the CDA Foundation

    Board of Directors At-Large Positions: The

    board elected at-large directors to the CDA

    Foundation (Foundation) board.

    Elections and Nominations to Fill Trustee Posi-

    tions on Committees and Board of Directors:

    The board elected trustees to fill positions on

    committees, subsidiary boards, the affiliate

    Discussions Emerging Issues Discussion: Gary Price, Dental

    Trade Alliance (DTA) president and chief executive

    officer, led the board in discussion on DTA’s re-

    search and policy work on oral health connections

    to medical conditions and the potential opportuni-

    ties for public-private partnerships.

    Strategic Plan Update: The board received updates

    to the strategic plan.

    DBIC, DBC and NORDIC Acquisition Update: The

    board received a verbal update on activities associ-

    ated with the DBIC, DBC and NORDIC acquisi-

    tion.

    Volunteer Organizational Health Assessment Up-

    date: The board received an update on the commu-

    nication plan and a series of initiatives related to the

    volunteer organizational health assessment.

    Updates: The board received verbal updates on leg-

    islative efforts related to tobacco and soda tax initi-

    atives, activities and projects associated with the

    finance committee, the foundation board, ADA ini-

    tiatives, TDIC/TDIC IS, peer review programs and

    discussed legislative activities with Assembly

    Carefully monitor and review all incoming

    correspondence from dental plans with which

    you are contracted that outline provider re-

    sponsibilities to comply with SB 137. This cor-

    respondence may include revised provider

    agreements, contractual amendments or opt-in

    or opt-out letters.

    Respond to dental plan correspondence re-

    questing verification of dental practice infor-

    mation within 30 days to avoid disruption in

    plan reimbursement and provider participation.

    Notify those plans with which you are con-

    tracted within five business days if you are no

    longer accepting new patients into your prac-

    tice or are now open to new patients.

    Dental practices not accepting new patients

    from the plan(s) are required to direct patients

    back to their dental plan or applicable regulator

    to report any directory inaccuracies.

    CDA will provide more additional information

    regarding the implementation of this legislation as

    it becomes available. CDA members may contact

    Last October CDA Cares came to Fresno and was a rousing success!

    Though many FMDS members participated and a majority of the vol-

    unteers were local, the success of CDA Cares Fresno would not have

    been possible without a large number of volunteers who traveled from

    outside of the area to join us. Now we have the opportunity to pay it

    forward and help out a fellow central valley city by volunteering at

    CDA Cares Stockton.

    Perhaps the biggest challenge of organizing CDA Cares Fresno was

    attracting volunteers to a city that is perceived to be “less desirable”

    then cities in the Bay Area or Southern California. Stockton faces the

    same challenge which we can help alleviate by making the short drive

    up highway 99 to help out.

    CDA Cares will take place on October 15th and 16th and will have the

    same goal of treating approximately 2000 patients in 2 days. Anybody

    can be a volunteer so gather up your friends and family members and

    plan to be in Stockton this October. The bottom line with CDA Cares

    is that the more volunteers that show up, the more treatment that gets

    performed, and ultimately the more lives that are improved. Don’t

    The U.S. Department of Labor released new Fair

    Labor Standard’s Act (FLSA) rules that require

    employers to pay overtime to exempt employees

    who earn salaries less than $47,476 per year, be-

    ginning Dec. 1, 2016.

    What does this mean for California practice own-

    ers? Currently, a full-time employee classified as

    an exempt, salaried employee must be paid a mini-

    mum salary of two times the current minimum

    wage of $800 per week, or $41,600 per year, and

    must perform exempt work (performance of office

    or nonmanual work directly related to the manage-

    ment or general business operations of the employ-

    er or the employer’s customers) at least 51 percent

    of the time.

    In most cases, employees should be considered

    nonexempt, hourly wage employees unless they

    clearly meet a duties test for an executive, admin-

    istrative or professional. (View dir.ca.gov for more

    information.)

    Effective Dec. 1, the new federal salary require-

    ments are higher and will require exempt employ-

    ees to be paid a minimum salary of $913 per week

    or $47,476 per year. To complicate things further,

    California employers will need to pay close atten-

    tion to and adjust salaries over the next several

    years as the minimum wage increases and the De-

    partment of Labor’s estimated automatic increases

    affect the minimum salary threshold. As of now,

    the new federal salary basis of $47,476 is higher

    than California’s salary basis (currently, $41,400;

    $43,680 as of January 2017).

    In 2019, California employers with 26 or more

    employees will need to meet the $49,920 per year

    salary threshold – this will likely be higher than

    the federal amount. These numbers will change

    over the years ahead, with minimums adjusted for

    inflation, so it’s important to monitor and keep

    track of the current salary thresholds.

    California practice owners will need to review the

    duties test to determine that employees clearly

    meet the job duties of an exempt position and ei-

    ther increase employee salaries to be compliant

    with these new regulations or reclassify employees

    as nonexempt, hourly employees.

    Newly classified nonexempt employees must un-

    derstand that they are now required to record their

    working hours (including any “off the clock”

    work), and take appropriate meal and rest breaks

    within standard guidelines.

    In addition, employers will be required to pay

    these employees at a rate of not less than one-and-

    a-half times their hourly rate for any hours worked

    in excess of eight hours a day or 40 hours in a

    workweek. (View dir.ca.gov for more infor-

    Infection Control Reminders for Dental Offices Reprinted with Permission from California Dental Association

    There are a number of actions taken every day,

    for every patient receiving care in a dental office.

    Below are reminders for four infection control

    procedures that are easily misunderstood, what

    can happen and how to prevent repeating mis-

    takes.

    Purging dental water Lines

    What: Water lines must be purged daily for two

    minutes at the beginning of each workday and 20

    seconds between patients.

    What can happen: Biofilm builds up in the

    equipment water lines and staff may not under-

    stand the importance of reducing this buildup.

    How to prevent it: Essentially, the first thing you

    should do when you walk in your operatory is run

    your water lines.

    Dating instrument sterilization bags

    What: After a bag of instruments has gone

    through the sterilizer and has cooled off, it must

    be labeled with the date of sterilization.

    What can happen: When this action is not a reg-

    ular part of the instrument handling routine, it can

    easily be forgotten.

    How to prevent it: Get a date stamp and keep it

    next to the sterilizer. Every back office staff

    should check bags for dates and date bags before

    storing in the cabinets. Make it part of your rou-

    tine. The last person in the office at the end of the

    day and the first person in the office at the begin-

    ning of the day should make sure everything is

    date stamped.

    Labeling containers

    What: All containers filled with a liquid must be

    labeled. This is to prevent a liquid from being

    used for the wrong reason, such as disinfecting,

    and to prevent injury. Not labeling containers of

    potentially hazardous materials is a violation of

    the Cal/OSHA Hazard Communication regula-

    tion.

    What can happen: Sometimes liquids are trans-

    ferred from the original container(s) to smaller

    container(s) for individual use, and staff may as-

    sume everyone knows what is in these smaller

    containers.

    How to prevent it: Check every type of liquid

    container (bottles, trays) that is not the original

    container and affix a clear label. If/when the liq-

    uid is drained and replaced with a different liquid,

    change the label.

    Ensuring proper personal protective equip-

    ment (PPE) protocols

    What: PPE is how dentists, hygienists and assis-

    tants protect themselves against disease. All staff

    who work in the back office should have PPE to

    cover skin, mucous membranes and street clothes.

    PPE should not be removed from the dental prac-

    tice by staff; to do so is a violation of Cal/OSHA

    regulations.

    What can happen: For convenience or comfort,

    dental staff may wear scrubs, which are short-

    sleeved and have a V-neck, when treating a pa-

    tient. In addition, some staff take their PPE home

    to wash them.

    How to prevent it: Make sure all staff have prop-

    er PPE that covers them to the wrist and neck.

    PPE should not leave the operatory area and cer-

    tainly should not appear in the waiting room. It

    should be washed on site or washed by a profes-

    sional cleaner that picks up PPE at the dental

    practice.

    As a reminder, dentists are responsible for ensur-

    ing that all unlicensed dental assistants who are in

    their employ for longer than 90 days complete the

    required eight-hour infection control course. Den-

    tal assistants are required to complete this course

    one time only and should retain verification of

    course completion indefinitely in their records.

    Dentists who hire an unlicensed dental assistant

    must verify the assistant has completed this

    course previously, or must ensure course comple-

    tion within the first 12 months of employment.
