COMMUNIQU

THE PUBLIC PROSECUTION SERVICE, to the Honduran people, the

diplomatic community accredited with the Government of Honduras,

and the nations political leaders and nongovernmental organizations,with respect to the enforcement of Legislative Decree No. 2-2010,

enacted by the National Congress on January 27, 2010, which contains

a general amnesty for the political crimes and associated common

crimes specified therein,

STATES THAT:

1. In strict compliance with Article 3 of the provision in question, it has

proceeded to shelve the case files of the investigations relating to

the offenses identified in the aforesaid Decree.

2. It also recognizes the power of the organs of the judiciary to

dismiss the cases placed before them that are covered by the

pardon set out in the Amnesty Decree.

3. Regarding the crimes not covered by the Decree, it ratifies its

respect for the principles of presumption of innocence, due process,

the right to be heard freely, the exceptional nature of preventive

custody, and any other formality or procedural guarantee due under

the constitutional rule of law to those suspected of the crimes in

question.

4. The Public Prosecution Service stresses its observance of its binding

obligation of pursuing criminal action in good faith and on an ex

officio basis and, in addition, of ensuring respect for the rights and

guarantees due to those under investigation, in accordance with the

duties imposed on it by the Constitution and by law.
