MONTREAL PROTOCOL ON SUBSTANCES THAT DEPLETE THE OZONE LAYER CONCLUDED AT MONTREAL ON 16 SEPTEMBER 1987

ADOPTION OF ADJUSTMENTS AND AMENDMENT BY THE NINTH MEETING OF THE PARTIES HELD AT MONTREAL ,

ON 15-17 SEPTEMBER 1997

The secretary-General of the United Nations, acting in his capacity as depositary, communicates the following:

At the Ninth Meeting of the Parties to the above Protocol, held in Montreal from IS to 1 7 september 1997, the Parties adopted the Adjustments to the Protocol (Decisions IX!I, IX/2 and IX!3), pursuant to article 2 (9) of the Protocol.

The text of the Adjustments is transmitted herewith in the six languages of their conclusion, as Annexes 1, 11 and III to this notification.

The Adjustments will enter into f orce on the expiry of six months from the date of the present notification issued pursuant to article 2 (9) of the Protocol.

Also, at their Ninth Meetin~, the Parties further adopted, in accordance with the procedure la1d down in article 9 (4) of the 1985 Vienna Convention for the Protection of the Ozone Layer, the Amendment to the Montreal Protocol as set out in Annex IV to the report of the Ninth Meeting of the Parties (Decision lX/4).

The text o f the above Amendment, in the six official languages of its conclusion, is attached as Annex I V to this notification.

In accordance with its article 3 (1), this Amendment shall enter into force on 1 January 1999, provided that at least twenty ins truments of ratification , acceptance or approval of the Amendment have been deposited by States or regional economic integration organizations that are Parties to the Montreal Protocol on Substances that De~lete the Ozone Layer . In the event that this condition has not been fulf1lled by that date, the Amendment shall enter into force on the ninetieth day following the date on which it has been fulfilled.

After its entry into force, the Amendment, in accordance with its article 3 (3), shall enter into force f or any other Party to the Protocol on the ninetieth day following the date of deposit of the instrument of ratification, acceptance or approval.

TO adopt. in accordance with the procedure laid down in paragraph 9 of Article 2 of the Montreal Protocol and on the basis of the assessments made pursuant to Article 6 of the Protocol, the adjustments with re9~rd to production of the controlled substances listed in Annex B to the Protocol , as set out in annex II to the report of the Ninth Meeting of the Parties;

ADJUSTMENTS AGREED AT THE NINTH MEETING OF THE PARTIES RELATING TO CONTROLLED SUBSTANCES I N ANNEX A

Article 5. paragraph 3

The following words shall be added at the end of paragraph 3 (a ) o f Article 5 of the Protocol :

relating to consumption

The following subparagraph shall be added to paragraph 3 of Article 5 of the Protocol :

(cl Por controlled substances under Annex A, either the average of it. annual calculated level of production for the period 1995 to 1997 inclusive or a calculated level of production of 0 . 3 kilograms per capita. whichever ia the lower, •• the basis for determining its compliance with the control measures relating to production .

ADJUSTMENTS AGREED AT THE NINTH MEETING OF THE PARTIES RELATING TO THE CONTROLLED SUBSTANCE IN ANNEX E

A. Artic!e 28 : Methyl brom i de

1 . Paragraphs 2 to 4 of Article 2H of the Protocol shall be repl aced by the following paragraphs :

Bach Party shall eneure that for the twelve-month period commencing on 1 January 1999 , and in the twelve-month period thereafter, its calculated level of consumption of the controlled substance in Annex E does not exceed, annually, seventy-five per cent of it. calculated level of consumption in 1991. Each Party producing the substance shall , for the same periods , ensure that its calculated level of production of the substance does not exceed, annually, seventy-five per cent of its calculated level of production in 1991 . However , in order to satisty the basic domestic needs of the Parties operating ~~der paragraph 1 of Article 5, its calculated level of production may exceed that limit by up to ten per cent of its calculated level of production in 1991 .

3. Each Party shall ensure that for the twelve-month period commencing on 1 January 2001, and in the twelve-month period thereafter, its calculated level of consumption of the controlled _ub.tance in Annex E does not exceed, annually, fifty per cent of its calculated level of consumption in 1991 . Each Party producing the substance shall , tor the same periods , ensure that its calculated level ot production of the substance does not exceed , annually , fifty per cent ot ita calculated level of production in 199~. However, in order to .ati.fy the basic domestic needs of the Parties operating under paragraph 1 of Article 5 , its calculated level of production may exceed that limi t by up to ten per cent of its calculated level of production in U91 .

4 . Bach Party shall ensure that for t he twelve - month period commencing on 1 January 2003, and in t he twelve-month period thereafter, its calculated level of consumption of the controlled substance in Annex E does not exceed , annually, t hirty per cent of its calculated level of consumption in 1991 . Each Party producing the substance shall, for the same periods, ensure that ite calculated level of production of the substance does not exceed , annually , thirty per cent ot its calculated level of production in 1991 . However , in order to .atisfy the basic domestic needs of the Parties operating under paragraph 1 of Article 5 , its calculated level of production may exceed that limit by up to ten per cent of its calculated level of production in un.

S . Each Party shall ensure that for the twelve-month period commencing on 1 January 2005, and in each twelve-month period thereafter, its calculated level of consumption of the controlled substance i n Annex E does not exceed zero . Each Party producing the substance shall , for the same periods , ensure t hat its calculated level ot production of the substance does not exceed zero . However, in orde r

to satisfy the basic domestic needs of the Parties operating under paragraph 1 of Artic le 5, its calculated level of production may exceed that limit by up to fifteen per cent of its calculated level of production in 1991 . This paragraph will apply save to tbe extent that the Parties decide to perm~t the level o f production or consumption that i. neceseary to satisfy U8'S agreed by them to be critical uses .

2 . Paragraph 5 of Article 2H of the Protocol shall become paragraph 6.

B . Article S, caragraph 8 te; (d)

following shall be inserted after paragraph e eer (d ) (i l of of the Protocol:

(il) Each Party operating under paragraph 1 of this Article shall ensure that for the twelve ~month period commencing on 1 January 2005, and in each twelve ~ month period thereafter, its calculated levels of consumption and production of the controlled substance in Annex E do not exceed, annually , eighty per cent of the average of its annual calculated levels of consumption and production , respectively, for the period of 1995 to 199B inclusive;

(iii) Bach Party operating under paragraph 1 of this Article ahall ensure that for the twelve-month period commencing on 1 January 2015 and in each twelve-month period thereafter, its calculated levels of consumption and production of the controlled substance in Annex E do not exceed zero . This paragraph will apply save to the extent that the Parties decide to permit the level of production or consumption that ia necessary to satisfy uses agreed by them to be critical uses ;

AMENDMENT TO THE MONTREAL PROTOCOL ADOPTED BY THE NINTH MEETING

OF THE PARTIES

ARTICLE 1: AMENDMENT

A. Article 4. paragraph 1 qua.

The following paragraph shall be insereed after paragraph 1 t er of Article 4 of the Protocol :

1 ~. Within one year of the date of entry into force of this par.graph, each Party shall ba~ the import of the controlled substance in Annex E from any State not party to this Protocol .

B. Article 4. paragraph 2 qua ,

The following paragraph shall be inserted after paragraph 2 ter of Article 4 of the Protocol :

2 ~. Commencing one year after the date of entry into force of this paragraph, each Party shall ban the export of the controlled substance in Annex E to any State not party to this Protocol .

C. Article 4. paragraphs 5. 6 and 7

E. Article 4A: Control of trade with Parties

The following Article shall be added to the Protocol as Article 4A:

1 . Where, after the phase-out date applicable to it for · . controlled substance, • Party is unable, despite having taken all practicable .teps to comply with its obligation under the Protocol, to cease production of that substance f~r domestic consumption, other than for uses agreed by the Parties to be essential, it shall ban the export of used, recycled and reclaimed quantities of that substance, other than for the purpose of destruction .

2 . Paragraph 1 of this Article shall apply without prejudice to the operation of Article 11 of the Convention and the non-compliance procedure developed under Article e of the Protocol.

F. Article is; Licensing

The following Article shall be added to the Protocol as Article 4B:

1 . Bach Party shall, by 1 January 2000 or within three months of the date of entry into force of this Article for it, whichever is the later, establish and implement a system for licensing the import and export of new, used ; recycled and reclaimed controlled substances in Annexes A, B, C and E.

2 . Notwithstanding paragrap~ 1 of this Article, any Party operating under paragraph 1 of Article 5 which decides it is not in a position to establish and implement a system for licensing the import and export of controlled substances in Annexes C and B, may delay taking those actions until 1 January 2005 and 1 January 2002, respectively .

3 . Each Party shall, within three months of the date of introducing its licensing system, report to the Secretariat on the establishment and operation of tha t system .

4 . The Secretariat shall periodically prepare and circulate to all Parties a list of the Parties that have reported to it on their licensing systems and shall forward this information to the Implementation Committee for consideration and appropriate recommendations to the Parties .

ARTICLE 2 : RELATIONSHIP TO THE 1992 AMENDMENT

No State or regional economic integration organization may deposit an instrument of ratification, acceptance, approval or accession to this Amendment unle •• it has previously, or simultaneously, deposited such an instrument to the Amendment adopted at the Fourth Meeting of the Parties in Copenhagen, 25 November 1992 .

ARTICLE ) : ENTRY INTO FORCE

1. Thi~ Amendment shall enter into force on 1 January 1999, provided that at least twenty instruments of ratification. acceptance or approval of the Amendment have been deposited by States or regional economic integration organizations that are Parties to the Montreal Protocol on Substances that Deplete the Ozone Layer . In the event that this condition has not been fultilled by that date, the Amendment shall enter into force on the ninetieth day following the date on which it has been fulfilled .

2 . For the purposes of paragraph 1, any such instrument deposited by a regional economic integration organization shall not be counted as additional to those deposited by member States of such organization.

3. After the entry into force of thia Amendment, as provided under paragraph 1, it shall enter into force for any other Party to the Protocol on the ninetieth day following the date of deposit of its instrument of ratification, acceptance or approval.

3. Chaque d'entr~e en Secr!tariat

Partie, dans un d!lai de trois mols a compter de la date vigueur du syst!me d'autorisatlon, falt rapport au sur la mise en place et le fonctionnement dudit syst!me .

4. Le Secr!tariat ~tablit et diffuse periodiquement a toutes les Parties la liste des Parties ayant fait rapport sur leur syst!me d'autorisation et communique cette information au Comite d 'application aux fins d'examen de recommandations appropriees aux Parties.

ARTICLE 2 : RAPPORT AVEC L'AMENOEMENT DE 1992

Aucun Etat ni aucune organisation regiona1e d'int!gration economique ne peut d!poser un instrument de ratification, d'acceptation et d'approbation du pr~sent amendement ou d'adhesion audit amendement s'i1 n'a, au pr~alable ou simultan!ment, depose un instrument de ratification, d 'acceptation et d'apprObation de 1'Amendement adopte par la quatri!me R~union des Parties A Copenhague, le 2S novembre 1992, ou d'adhesion audit Amendement.

ARTICLE 3 : ENTREE EN VlGUEUR

1. Le present Amendement entre en vigueur le 1er janvier 1999, sous r!serve du depOt 4 cette date d'au moins 20 instruments de ratification, d'acceptation ou d'approbation de l'Amendement ou d'adhesion A l'Amendement par des Etats ou des organisations regiona1es d'integration ~conomique Parties au Protocole de Montreal relatif a des substances qui appauvrissent la couche d'ozone. Si a cette date ces conditions n' ont pas ete remplies, le present Amendement entre en vigueur le quatre-vingt-dixiAme jour suivant la date a 1aquelle ces conditions ont ete remplies.

2. Aux fins du paragraphe 1, aucun deadita instruments d!pos!s par une organisation regionale d'int!gration !conomique ne doit Atre consider! comme un instrument venant s'ajouter aux instruments d~jl d~pos~s par lea Etats membres de ladite organisation.

ii ) Cada Parte que opere al amparo de l pArrafo 1 del presente articulo velarA por que en el perlodo de doee mesas contados a partir dell- de enere de 200S , yen cada perlodo sucesivo de doce meaes, SUB niveles calculados de consumo y producci6n de la sustancia controleda que tigura en el anexo E no superen, anualmente, el BOt del promedio de sus niveles calculados anuales de consumo y producci6n, relpectivamente, correspondientes al per!odo de 1995 a 1'98 inclusive ;

iii) Cada Parte que opere al amparo del plrrafo 1 del presente articulo velar' por que en el periodo de does meses contados a partir dell- de enero de 2015, y en cada periodo sucesivo de doce meses, sus niveles calculados de cO~5umo y producci6n de la sus tancia controlada que figura en el anexo E no sean 5uperiores a cero . Le dispuesto en este pArrafo se aplicarA salvo en la medida en que laa Partes decidan permitir el nivel de producci6n 0 consumo que sea necesario para atender 105 usos por ellas convenidos como us os criticos;

E. Articulo 4A: Control del comercio con Estados que sean Partes en el Protocolo

El siguiente articulo se anadir6 al Protocolo coma artIculo 4A :

1. En el Caao en que, transcurrida la fecha que le sea aplicable para la aupresi6n de una Bustancia controlada. una Parte no haya podido. pe se a haber adoptado todas laa medidas posibles para cumplir 8US obligaciones derivadas del Protocolo, eliminar la producci6n de esa BUBtancia para el consumo interne con destino a U608 distintos de 106 convenidos por las Partes come esenciales, esa Parte prohibirA la exportaci6n de cantidadea usadas, recicladas y regeneradas de esa 8ustancia, para cualquier fin que no sea su destrucci6n .

2. El pArrafo 1 del presente articulo se aplicarA sin perjuicio de 10 diepuesto en el articulo 11 del Convenio y en el procedimiento relative al iDcumplimiento elaborado en virtud del articulo 8 del Protocolo .

F . Articulo is; Sistema de licencias

El sigUiente articulo se aftadir4 al Protocolo como articulo i8:

1 . .LAs Partes establecerAn y pondrAn en pr4ctica, para el 1- de enero de 2000 0 en el plazo de tres meses a partir de la entrada en vigor del presente articulo para cada una de ellas, un sistema de concesi6n de licencias para la i~rtaci6n y exportaci6n de sustancias controladas nuevas, usadas, recicladas y regeneradas enumeradas en 108 anexos A, 8 Y C.

2. Sin perjuicio de 10 dispuesto en el pArrafo 1 del presente articulo, si una Parte que opera al amparo del p4rrafo 1 del articulo 5 decide que no est' en condiciones de establecer y poner en prActica un sistema para la concesiOn de licencias para la imporcaci6n y exporcaci6n de sust&ncias controladas enumeradas en los anexos eyE, podr4 posponer la adopci6n de esa& medidas haBta el 1- de enero de 2005 y el 1- de enero de 2002, respectivamente.

3 . En el plazo de tres meses a parcir de la fecha en que introduzcan su aistema de licencias, las PArtes informarAn a la Secretar!a del establecimiento y el funcionamiento de dicho sistema .

i. LA Secretaria prepararA y distribuir4 peri6dicarnente a todas las Partes una lista de las Partes que le hayan informado de Sll sistema de licencias y remitirA esa informaci6n al Comit~ de Aplicaci6n para su examen y la formulaci6n de las recomendaciones pertinentes a las Partes .

ARTiCULO 2 : RELACI6N CON LA ENMIENDA DE 1992

NingUn Estado u organi zaci6n de integraci6n econ6mica regional podrA depositar un instrumento de rati!icaci6n , aceptaci6n, aprobaci6n 0 adhesiOn de la presente Snmienda a menos que haya depositado, previa 0 simultAneamente , un instrumento de rati!icaci6n, aceptaci6n. aprobaci6n ° adhesiOn de la Enmienda aprobada en la Cuarta Reuni6n de laB Partes , en Copenhague, e1 25 de noviembre de 1992 .

ARTicuLO 3 : ENTRAOA EN VlGOR

1. La presente Enmienda entrarA en vigor ell - de enero de 1999, siempre que se hayan depositado al menes 20 instrumentos de ratificaci6n, aceptaci6n o aprobaci6n de la Enmienda par Eetedos U organizaciones de integraci6n econ6mica regional que sean Partes en e1 Protocolo de Montreal relative alas 8u8tancias que agotan la cape de ozono. En el caso de que en eS8 feche no se hayan cumplido estas condicionee, la Enmienda entrarA en vigor e1 nonagEsimo dIe contade desde la feche en que se hayan cumplido dichas condiciones .

2 . A 108 efectos del p!rrafo I, 105 instrumentos depositados per una organizaci6n de integraci6n econ6mic& regional no se canter'" coma adicionales a 105 depositados per 108 ABtados miembros de eea organizAci6n .

3 . Despu~s de la entrada en vigor de la presente Enmienda, BegUn 10 dispuesto en el pArrafo 1, la Enmienda entrarA en vigor para cualquier otra Parte en el Protocolo el nonag~simo d1a contado desde la techa en que haya ~poBitado su instrumento de ratificaciOn, aceptaciOn 0 aprobaci6n .
