ON THE ADMINISTRATION OF THEFOREIGN AGENTS REGISTRATION ACT OF 1938, AS AMENDED

JUNE 1959

TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE

UNITED STATES OF AMERICA IN CONGRESS ASSEMBLED:

I have the honor to report on the administration

of the Foreign Agents Registration Act of 1938, as

amended, pursuant to Section 11 of that Act, which

requires the Attorney General from time to time to

report to the Congress concerning the administration

of the Act as well as the nature, source and content

of political propaganda disseminated or distributed by

agents of foreign principals registered under the

terms of the statute.

This report deals with the administration and

enforcement of the Foreign Agents Registration Act

for the calendar year 1958, and is in supplement to

the reports submitted for the calendar years 1955

through 1957.

In general, the activities of the Section charged

with the administration and enforcement of the statute

continued at the same pace as that experienced in the

preceding year. Increased activity, however, occurred

in connection with enforcement proceedings under the

Act. On December 7, 1957, John Joseph Frank was found

guilty by a jury in the District Court for the District

of Columbia on all four counts of an indictment charging

him with having acted as an agent of the Dominican

Republic and of General Rafael Leonidas Trujillo with-

out having complied with the registration requirements

of the Act. On October 20, 1958, the Court of Appeals

in a two to one decision reversed the conviction on

the grounds that the attempts by the prosecution to

link the defendant with the Galindez-Murphy affair

were prejudicial. The case was remanded to the

District Court and retrial commenced. on March 5, 1959,

with the Government limited by a ruling of the trial

judge that no evidence as to Frankfs possible

participation in the disappearance of Professor de

Galindez could be introduced. On March 12, 1959,

after both sides had rested, but before the case was

submitted to the jury, the court accepted a plea of

nolo contendere offered by the defense to counts one

and three of the indictment on the express condition

that the defendant file an acceptable registration

statement. Prior to that date, the court on its own

motion had dismissed counts two and four. On March 20,

the defendant filed a registration statement and on

the same day was sentenced to a fine of $500 on each

count.

On November 17, 1958, Arnaldo G. Barron of New

York City was indicted by a Federal Grand Jury in the

District of Columbia, which charged him with having

acted as an agent of Fidel Castro and the July 26

Movement of Cuba without having filed the registration

statement required by the Foreign Agents Registration

Act. Subsequently, on March 6, 1959, the defendant

filed an acceptable registration statement and on

March 16, the District Court for the District of

Columbia accepted a plea of nolo contendere to the

indictment. On April 17, 1959, the defendant was

given.. a suspended sentence of five years and placed

on probation for that period.

The publicity given these two cases resulted in

more than the usual number of inquiries with respect

to the application of the statute and particularly as

it may be applicable to the activities of groups

within the United, States seeking the overthrow of a

government other than that of the United States.

STATISTICAL SUMMARY

During the year covered by the report, 94 regis-

tration statements were filed and 75 terminated,

leaving 387 active registration statements on file

as of December 31, 1958. This compares with 107

statements filed during 1957, 46 terminated and 368

active registrations on file as of December 31, 1957.

However, during 1958 there were 513 short-form

registration statements filed by partners, officers,

directors or other persons rendering assistance to

registrants which are partnerships, corporations,

associations, organizations or other combinations of

individuals, for or in the interest of the registrantos

foreign principal , in comparison with 402 short-form

registration statements filed in 1957.

An alphabetical list of registrants who filed

statements during 1958, together with the name of the

foreign principal and a brief description of the

nature of each agency, will be found in Appendix II,

while a list of these statements according to regis-

tration number is contained, in Appendix I. An

alphabetical list of individuals who filed short-

form registration statements is set forth in

Appendix IV and the identities of the registrants in

support of whose statement these short-form registration

statements were filed may be ascertained by reference

to Appendix I through correlation of the registration

number.

As is to be expected, the largest number of new

registration statements was filed by persons engaged

in publicity, public relations, advertising or allied

activities on behalf of a foreign principal. Contin-

uing the trend, however, as first noted in 1957, an

increasing number of registration statements were

filed by travel bureaus and agencies engaged in the

promotion of American tourist traffic to Soviet bloc

countries. A table showing the classification of

statements according to the principal function reported

will be found in Appendix III.

Also affecting the number and character of

registrations filed are political developments in

foreign countries. For example, the overthrow of the

Batista regime in Cuba resulted in the termination of

registrations of those persons who had acted within

the United. States as agents of the Batista government,

while new registrations were filed by those who

undertook to represent the Castro government. A

similar situation occurred after the overthrow of the

Jimenez government in Venezuela.

NATURE, SOURCE AND CONTENTOF POLITICAL PROPAGANDA

As in past years, the source of the greatest

volume of political propaganda disseminated within

the United States continues to be the official foreign

government information and tourist offices. As of

December 31, 1958, there were 55 foreign government

information and tourist offices functioning within

the United. States, representing 3L different countries.

These offices expended a total of more than seven and

a half million dollars during the year 1958, and

employed: a total of 637 persons.

The total expenditures of foreign government

information and tourist offices for the year 1958

shows only a slight increase over 1957. It is noted,

however, that in 1958 the Arab Information Center,

the Australian News and. Information Bureau, the

Austrian State Tourist Department, the Bermuda Trade

Development Board and the Japan Tourist Association

almost doubled their 1957 expenditures.

Appendix VI contains a table showing the expenditures

and number of employees of government information and

tourist offices as reported during the year covered

by this report.

The material issued by these offices is designed

in the main to promote good will toward the particular

country concerned and to present its viewpoint on

various national and international issues. Much of

the material, of course, is aimed at promoting trade

and attracting the American tourist dollar. As in

previous years, foreign governments continue to rely

upon American public relations and advertising firms

for advice and. guidance in the presentation of their

information programs to the American people. Appendix

VII consists of a table showing the amounts, including

fees and expenses, received from foreign principals by

American organizations and citizens during 195 8 .

The stream of propaganda material will ebb and

flow in accordance with the intensity of the issu s

facing the foreign government or foreign political

party which is attempting to influence American public

opinion, and the various propaganda themes will vary

as world events influence a foreign principalts view-

point.

Following is an analysis of the principal trends

noted during 1958 in the propaganda material disseminated

by the countries or geographical areas listed below:

Great Britain. Great Britain maintains the largest

budget for informational purposes of any foreign

country conducting such activity within the United.

States. The British Information Services through the

media of printed matter, radio broadcasts, television

and lectures has touched upon practically every phase

of the economic, social and political life of the

British people in the United Kingdom, the Commonwealth

countries and the British Dependencies. Some of the

matters stressed. in 1958 concerned proposals for a

summit conference, the uncertainty in the Middle East

and. the Far East, and a solution to the so-called

Cyprus problem.

The British Information Services distributes

daily a summary of the principal comments published

in British newspapers entitled "Today's British

Papers," as well as a weekly publication entitled

"Summary of British Weeklies." One example of a

divergence of opinion among British publications was

the comment regarding the landing of British troops

in Jordan. The so-called right-wing papers indicated

the landing was justified while the so-called left-

wing press deplored the government's action. A large

amount of space was allotted in publications dissemi-

nated to the American public to the racial disturbances

occurring in Nottingham and London. These publications

as a rule indicated that these racial disorders were

generally deplored by the British public. For example,

mimeographed sheets were prepared showing the reaction

of British officials and the British press and a

statement was circulated which contained in part the

text of the sentences given the nine youths involved

in the London incidents. All of these statements

indicated the shock of the British public and the

desire to correct the situation and prevent a recurrence.

A booklet entitled "Color in Britain" was published

describing the social problems accompanying increased

colored immigration into the British Isles with suggested

remedies.

Another matter of prominence treated by the

British press was the dispute with Iceland over its

declaration of a twelve-mile limit on fishing. The

British presented the problem as they saw it with a

possible solution in a booklet called "The Problem of

the Fisheries Around. Iceland."

Dominican Republic, The Dominican Republic Information

Center in New York in its news releases dealt princi-

pally with the topic of tourism and various aspects

of the economy of the Dominican Republic with the

purpose, of course, of attracting tourist traffic.

Some of the propaganda disseminated was designed to

counteract the adverse publicity received from the

American press by Generalissimo Trujillo's son while

attending a military school in this country. The

Galindez-Murphy affair was touched upon at the time

Mr. Morris Ernst of New York published his report.

Propaganda in opposition to the Trujillo regime

was disseminated by the Dominican Revolutionary Party.

As would be expected, the material strongly condemned

the Ernst report.

Cuba. During 1958, the greatest volume of propaganda

from agents registered with foreign principals in the

Latin American area came from the factions involved

in the Cuban revolution.

The July 26 revolutionary movement, with offices

in New York, Miami, Chicago and other cities, published

a considerable amount of material attacking the Batista

gov rnment in the form principally of small newspapers,

pamphlets and press releases. All of this was aimed

at the American public and sought to discredit the

Batista government as a cruel dictatorship-. Its

primary objective was to arouse public sympathy for

the July 26 Movement and to raise funds. On the other

hand, the Batista government through its-registered

agent, Universal Research and Consultants, Inc.,,

distributed a monthly bulletin defending its position

in the struggle and accusing the Castro forces of being

communist-controlled. Included in the material issued

by Universal Research and Consultants was a pamphlet

which contained information concerning the alleged

communist background of several of the leaders of the

July 26 Movement.

U.S.S.R. No official government information or

tourist office is maintained by the Soviet-bloc

countries. Considerable information with respect to

the nature and content of political propaganda origi-

nating in these countries and disseminated within the

United States is obtained from Four Continent Book

Corporation and Imported Publications and Products,

which are registered under the Act and are actively

engaged in the sale of. Soviet-bloc publications.

From the material distributed by these agencies,

as well as from other sources, it was evident that the

USSR continued to stress the tremendous achievements

of the Soviet regime in the fields of culture, science

and industry. Another theme that recurred frequently

was what the Soviets described as the "relentless

progress of socialism and resulting capitalist decline."

Emphasis was also placed upon the solidarity

existing between the nations of the socialist camp

while at the same time scorn and criticism was cast

upon the revisionists and those showing an inclination

for independence of thought. Much was made in Soviet

propaganda of what was claimed to be failure of the

European common market countries and Great Britain to

agree on a free trade area in Europe. In other

publications the Soviets claimed that the rivalry

between West Germany and Great Britain in the export

markets of the world contains the germ of discord and

may lead to irreconcilable antagonism. However, the

need to establish trade relations between the Soviet

Union and the Western countries was urged, since,

according to the Soviets, normal commercial intercourse

between nations was a sure way of instilling confidence

among them. For example, the Moscow trade agreement

with West Germany was hailed as a contribution to better

understanding between the two countries. In the same

theme, Soviet propaganda emphasized the fact that the

United. States is the only great power that has no

trade agreement with the Soviet Union.

As in past years, the theme of "peace` was prominent

in Soviet propaganda and the point was made that it is

the Soviet Union that continues unremitting efforts to

establish ''world peace.' According to Soviet propaganda

the Soviet Unionts efforts for the suspension of nuclear

testing are intimately connected with its desire for

world peace.

China. The Chinese News Service, which is registered

under the Act as the information agency of the Republic

of China, issued weekly news bulletins in both English

and Chinese, as well as special news releases to the

American press. The material, in general, presented

the Nationalist Chinese Government's views and comments

on matters of current interest with additional space

devoted during the year to the crisis created by the

bombardment and threatened invasion of Quemoy by Red

China. The material also stressed what the Nationalist

Government believes to be the faults and failures of

the Communist regime on the Chinese mainland and

featured news of resistance and defections in that area.

A variety of propaganda literature published in

the People's Republic of China is disseminated by

Imported Publications and Products of New York, which

is registered as the agent of, among others, Mezhdunarodna

Kniga, Moscow; Guozi Shudian, Peking; and The China

Welfare Institute, Shanghai. An assortment of periodi-

cals reflected the news and trends in the political,

economic and cultural spheres of that country, and the

views of Communist China on world events. Particular

emphasis was placed on the increased industrial

production and the agricultural harvest produced through

mass effort. Considerable anti-American propaganda was

contained in articles dealing with the crisis over

possession of the islands in the Taiwan Straits.

Indonesia. The propaganda disseminated by the

Information Division of the Embassy of Indonesia is

generally in the form of news releases and bulletins.

Particular themes stressed included the campaign to

destroy the rebellion in Central Sumatra and the

continued dispute with the Government of The Netherlands

over the West Irian territory. Denials of communist

influence in the Government of Indonesia were made

frequently in the material disseminated by the Infor-

mation Division, while at the same time emphasis was

given to government by "guided democracy." According

to its propaganda, Indonesia is uncommitted in its

foreign relations and believes in peaceful coexistence

with its neighbors.

Japan. A number of public relations firms employed

by Japanese governmental agencies accented the twin

topics of tourism and trade promotion. Several booklets

were issued by the United States-Japan Trade Council

in an effort to counteract opposition to the importation

of Japanese cotton products with emphasis on the general

idea that unless Japan received support in improving her

trade balance with the United States, that country would

be unable to purchase the imports necessary to main-

tain her national existence, thereby endangering Japan's

strategic role in Asia as an ally of the free world..

Middle East. The Washington Arab Information Center .

of the League of Arab States was officially opened in

Washington, D.C., in June 1958. The Washington Center

is the latest addition to regional C enters previously

established in Chicago, San Francisco and Ottawa.

These Centers offer information services in conjunction

with the head office in New York and provide a variety

of information services including publications, docu-

ments, photos, films and film strips, information.

tapes, research aids, and speakers.

Featured among the publication services of the

Arab Information Center is a monthly magazine entitled.

"The Arab World." This magazine contained articles.

and photo essays about cultural, social, economic and

political developments in the Arab countries. A fort-

nightly newsletter, `Arab News and Views," contains the

Arab point of view on emergent area problems and briefs

on economic and social progress in the respective Arab

countries. A clipsheet, "The Bible Lands," appearing

six times a year, contained popular and informative.

features on travel, cultural aspects and social and

economic development. Aside from these three publications,

the Center disseminates booklets, basic documents,

press releases and reports.

Israel. One of the principal sources of propaganda

is "The Israel Digest of Press and Events in Israel

and the Middle East," published fortnightly in Jeru-

salem and disseminated by the Jewish Agency for

Israel. This publication contains the Israeli position

with respect to many controversies such as the Mount

Scofus dispute between Israel and Jordan, the Lake

Hula development scheme, Israel's alleged right to

free navigation to Eilat, and the Arab refugee problem.

In addition, this publication contains Israeli comments

regarding other important events in the Middle East

such as the Egyptian-Syrian Federation, the revolt in

Iraq and the situation in Lebanon and Jordan.

The Israel Office of Information disseminated

during this year press releases, the Israel Digest, a

Yiddish translation of the Israel Digest, and a new

monthly newsletter, entitled. "Land of the Bible."

This newsletter concerns religious events in Israel

of interest to all faiths. According to the dissemina-

tion reports filed by the Israel Office of Information,

about 16,000 individuals and organizations received

copies of the Israel Digest and. approximately 550 Jewish

and Anglo-Jewish newspapers and individuals received

the Yiddish translation.

Ghana. The information service of the Ilnbassy of

Ghana disseminated press releases and a bimonthly

pictorial magazine entitled "Ghana Today." This glossy

print magazine deals in vivid picture form with the

economic , social, cultural and political progress

of this country since its independence. Subjects

included. Ghana's role in Africa, the Conference of

African States; the signing of the Union Pact between

Ghana and Guinea; the development of Ghana's cocoa

industry; the expansion of Ghana's educational and .

medical facilities; and Ghana's cooperation with Great

Britain and. the United States.

Algeria. The Algerian Front of National Liberation

continued its propaganda campaign in the United States

for the liberation of Algeria from French rule. The

Front disseminated a news bulletin entitled "Free

Algeria," and numerous pamphlets dealing with the

Algerian question. According to this organization's

dissemination reports, it distributed approximately

five hundred copies of each publication issued during

the year. Circulation increased slightly during th

months of November and December, however, and reached

the highest level attained by this organization since

its beginning. Libraries, educational institutions,

press services, newspapers, and public officials received

the bulk of the material.

The Algerian National Movement issued early in

1958 a letter of Mr. El Abed Bouhafa, representative

of this Movement in the United States, setting forth

the proposals of the Algerian National Movement for

th solution to the Algerian war.

France. The French Government Tourist Office is the

principal source of information regarding tourist

attractions, transportation facilities and accommoda-

tions in France. "France Actuelle," which is a fort-

nightly report published by the Comite France Actuelle,

a private association of French businessmen, stressed

French economic and industrial advancement. Featured

among the successes of the French industrial development

was the increase in the production of steel, automobiles,

power, chemicals, cement and paper. Space in this

magazine was also devoted to current topics of interest

such as the European common market and European defense.

No new amendments to the Foreign Agents Registration

Act were suggested to the Congress during the year, but

the Department did again submit minor clarifying

amendments to Sections 1 and 3 of the Act. These

amendments would have the effect of defining a foreign

principal as including a domestic organization which

is substantially controlled or financed by a foreign

government or foreign political party. As the law

now reads , such a domestic organization is constituted.

a foreign principal by definition only in the event of

a subsidy from a foreign government or foreign politi-

cal party. The suggested amendment to Section 3 would

make clear the views of the Department that the so-

called commercial exemption from registration is

available only when the agent's activities in the

United States are in fact private as well as commercial

or financial.

Registration under the Act does not imply

recognition by the United States Government either of

the de jure existence or legality of the foreign

principal nor does registration indicate approval by

the United States Government of the propaganda material

disseminated by the registered agent.

The principal purpose of Congress in enacting the

Foreign Agents Registration Act was to require public

disclosure by persons engaging in propaganda activities

and other activities for or on behalf of foreign

governments, foreign political parties and other

foreign principals, so that the Government and the

people of the United States may be informed of the

identity of such persons and may appraise their

statements and actions in the light of their associa-

tions and activities. The emphasis of the Department

of Justice in its administration of the statute has

been toward the achievement of this purpose. In

performing its functions, the Department has continued

to rely upon its usual sources of information and

upon the investigative efforts of the Federal Bureau

of Investigation.
