    RESOLUTION NO. NYP-09-12-07Series 2012

    A RESOLUTION URGING THE DEPARTMENT OF LABOR AND EMPLOYMENT (DOLE) AND THEDEPARTMENT OF HEALTH (DOH) IN COORDINATION WITH THE BUSINESS PROCESSINGASSOCIATION OF THE PHILIPPINES (BPAP) AND BPO SERVICES ASSOCIATION (BSA) TOSUPPORT A LEGISLATION WHICH WILL MANDATE CALL CENTER COMPANIES TO PROVIDEHEALTH MAINTENANCE ORGANIZATIONS (HMO) SERVICES TO CALL CENTER EMPLOYEESPRIOR TO REGULARIZATION

    WHEREAS, data show that job generation in call center industries grew robustly from 99,000 workersin 2004 to 372,000 workers in 2008 to 640,000 workers up to date and 900,000 expected workers by2016 according to business processing association of the Philippines (BPAP);

    WHEREAS, the average age of call center agents is 25 years old which is clearly under youth agebracket as defined by Republic Act 8044 otherwise known as the Youth in Nation Building Actmanifesting therefore that more employees are coming from the youth sector;

    WHEREAS, call centers undeniably offer lured basic salary of Php15,000 in average, not to mentionsigning bonus, non taxable allowances per month, and incentives for good performance attracting moreand more applicants everyday;

    WHEREAS, Philippines has already surpassed India being the number one BPO country in the worldand recently ranked number one in yahoo news as business English country even putting USA behind,thus number of call center job vacancies is rapidly increasing;

    WHEREAS, call center industries saw 11 billion pesos in revenues last year which is expected to riseup to 13 billion this year because of the demand making it one of the major contributors to the rise ofthe Philippine economy;

    WHEREAS, call center agents work the phone for the entire duration of their night work shift and nochoice but to answer incoming calls, making them isolated unlike other jobs wherein you can have timeto read newspapers or chat with your officemates, thus graveyard schedules affect health issues;

    WHEREAS, Department of Health has warned that working in the graveyard shift are vulnerable tovarious diseases including hypertension, cardiovascular illnesses, tuberculosis and sexually transmitteddiseases;

    WHEREAS, DOLE has made separate studies on health risks associated call center works such asEyestrains symptoms, musculoskeletal symptoms, voice disorders, hearing problems since call centeragents only get an average time of ten minute per eight hour shift for their personal use;

    WHEREAS, most of the call center companies employ first time and young workers who are hesitant tocomplain, thus health problem may even be an underestimation of the true state of health amongworkers;

    WHEREAS, even call center agents get health care protection upon regularization, the need to protectthem is essential since the nature of work is entirely the same upon hiring and regularization;

    WHEREAS, it is stated in the Republic Act 10151 Article 155 that at their request the workers shallhave the right to undergo health assessment without charge; Paragraph C that if they experiencedhealth problems during such an assignment which are not caused other than the performance;

    WHEREAS, the law only extend the health assessment program to regular workers, but not to thoseunder the probationary period;

    WHEREAS, the health assessment program extends to those under probationary status as statedunder the equal protection clause of the Philippine Constitution

    NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED by the Chairperson andmembers of the ninth NYP to approved the resolution urging the Department of Labor and Employment(DOLE) and the Department of Health (DOH) to mandate call center companies to provide health

    services to call center employees prior to regularization.
