HOPE FAMILY SERVICES THANKSGIVING FOOD DRIVE

Many members of our community volunteer at the Hope Chest Thrift Store in downtown Braden-

ton at 1215 8th Avenue West. They are a part of Hope Family Services, serving Manatee county

families who have been affected by domestic violence. Families in need of their services are provid-

ed with safe housing, food, clothing, and other household necessities during their transition period.

Their phone is 941-745-2034 and the hours are 9-4 Mon thru Sat., 9-6 PM on Thursdays.

On behalf of Hope we will be running our annual Thanksgiving Food Drive. Bring your donations of

canned or packaged non perishable food to The Rec Center. The bin will be picked up on Friday,

November 18th. Remember HOPE Thrift Store for your gently used discards of clothing, furniture,

Helping Hands Celebrates 10th Birthday Sunday, November 13th from 1 to 3 pm at the Rec Center. Please come and join the fun!

In June of 2006 a group of 15 joined around a dining room table and decided to form Helping Hands

of Stoneybrook. We were a young community at that time that saw a need for helping each other.

Each of us had moved from somewhere else, our families were often far away, and when we needed

help we knew we had to depend on each other. And so we began. Today we have grown to 102

active members who volunteer to help. There are a number of ways we serve. Some help by pre-

paring meals for shut-ins or those who recently have had surgery. Others have items on our Lend-

er’s List that may be borrowed and returned. It includes baby equipment that grandparents often

don’t have room to store, or medical supplies like crutches and walkers that may be needed in an

emergency and the list goes on. We offer emotional support for the sick and infirm. Our Sunshine

group shares care and gifts to the recently hospitalized. However, we only can help if we know

about the need. Our information is in the monthly Stoneybrook Newsletter. We always welcome

new members to join at our meeting on the 2nd Monday of every odd numbered month, at 11 am in

the Rec Center.

“Stoneybrook Cooks” is now in its second volume of recipes shared by your neighbors. We invite

you to purchase one, some are beautifully gift wrapped, and they are available at the Rec Center.

Over the years we have worked hard to raise money for the gifts we share. We presented lovely Af-

ternoon Teas, and finally outgrew our facility at the Rec Center. We had homemade baked goods,

breakfast wraps, beverages and grilled hot dogs at several Community Yard Sales. Often we will

receive donations from those who benefit from our Lender’s List. We have always been blessed

with sufficient funding to provide for our needs. The ladies also gave back to our community by

purchasing an American flag, a podium and window shades for the sunny Rec Center. Our volun-

teers help with Breakfast with Santa each December. We joined hands with the Dining Out Club

and Harbour Hatties to present Fashion Shows for the community and shared proceeds with local

charities. Many of our members volunteer at the Hope Chest for Hope Family Services. So our car-

ing, sharing Helping Hands reach out to others also.

Now we reach out to you! Many of you have never had occasion to use our services. But you

are important to us too. We are all part of this community. So we want to CELEBRATE with

you by inviting you to share at our 10th Birthday Party with refreshments.

Motorcycles, golf carts & all other non-traditional passenger vehicles must be parked in enclosed garag-

es. There is no overnight parking permitted on the streets of Stoneybrook. Overnight parking passes are

BOARD NEWS & NOTES November 2016

Hello and welcome to November. Wow, this year is flying by! This is the start of the beautiful Florida Fall weather and a busy month for everyone. Many of our seasonal residents will be returning; the holiday season starts in earnest and besides a very important national election, our HOA has some very important business to conduct. Shortly after you read this you will be receiving 2 important mailings from your Board. The first is our annual budget projections for 2017 and the second one is the vitally important re-write of our governing documents. The Board and management has worked very hard to develop the 2017 budget with realistic projections based on research and historical data. We have kept the increase to a minimum while insuring that our amenities are improved, our reserves funded and our association financially protected from an unforeseen event or catastrophic storm. Overall we have taken a fiscally conservative approach to your HOA finances. The second mailing, which you should receive around the 7th of November, requires action on your part. The Declarations, the Articles of Incorporation and the Bylaws have been completely re-written. Known collectively as the "Governing Documents", these are the most important information you will receive this year. The existing documents were written over 10 years ago and were tailored for the benefit of the developer, Lennar. The residents now control the Association; many of the old sections are no longer applicable under the Florida statutes and could possibly be challenged in a court of law. Our legal team has worked hard to get a comprehensive set of documents that reflect what we do today and will do in the foreseeable future. Please read them. Please vote yes, sign and return the proxy in the pre-paid envelope as soon as possible. We will need to get over 66% to say yes in order for them to take effect. We have scheduled a General Membership meeting in January to officially tabulate the votes. In your mailing we have included a summary of the highlights of the changes that will take effect with the passage. Please don't wait. Vote now. This is a major and expensive undertaking and we need your cooperation. We already have volunteers waiting to go door-to-door to solicit proxys. We will be conducting town hall style meetings to explain the changes and answer questions. We have set up a special e-mail account to submit your questions and to answer them:

Letter to Stoneybrook homeowners from

the Board of Directors

Our CDD has been trying to determine how our roads will be repaired or repaved, and who should

pay for it. We commend them for that, and for discovering that because of some issues with

bonding, Manatee County may now have a part in this. However, the effort to compel Lennar to

come to the table AT THIS TIME is premature and could have negative consequences for all of us.

There is no need to develop an adversarial relationship with Lennar and the Master Association,

which is still under developer control. That is a mistake and here is why:

First, the history, which is important because Lennar has acted very consistently through the years.

There was a group of owners who were frustrated with the length of time Lennar had been here,

and undertook a series of actions, including the use of an attorney, which led to Lennar turning

Stoneybrook over before they planned to. They were successful. HOWEVER, that came with a cost.

Lennar’s stated intention all along was to do three things at turnover: forgive the debt owed, called

“due to developer”, of $282,000; change the governing documents to better reflect what the

community needs were, and third, cover Stoneybrook’s legal cost in regard to a Medallion lawsuit.

Once this group of owners mentioned attorneys, Lennar shut down, and of the three items, only the

debt forgiveness actually happened. Even before this Board was elected, we worked with Lennar to

help ensure that the debt forgiveness actually occurred.

Now, the facts:

1. The Master Association collected a capital resale contribution of $392,000 from the sale of the

Yacht Club apartments. That was considered as income to the Master, a windfall, and happened

because of the efforts of ICON Management with the cooperation of the developer. They ought to

be thanked for that, and credited for the effort.

2. The Master Association due to developer audited amount as of 12/31/2014 was $558,139. By

12/31/15, the amount was $1,209,759. That is money we owe to Lennar.

3. On May 25, 2016, the Master Association wrote a check to Lennar for $900,000, which left

$309,759 as the amount owed. That is the only check written to Lennar since ICON has managed

the property. That number will probably change based on the 2016 audit.

4. The capital resale contribution to the Master Association in 2016 was $203,000 in September.

That money always goes into the operating budget and is used for Master Association expenses

only.

5. One CDD supervisor questioned the money received from the baseball program, and said that the

CDD could not have that information. Not true; the amount was $13,498, and is not considered

income but is a pass through of expenses.

6. Every owner has the ability to get this information; you just have to ask and follow the process.

HOMEOWNERS NOTICE Our legal team has finished writing our new Declarations and Covenants and has provided the Board with a finished version after incorporating many changes and removing all the de-veloper friendly sections. This is a major undertaking and has already consumed copious man-hours in review and comment. It is a complete re-write of our documents and will re-quire a community-wide, every resident vote. On October 20th the Board authorized the distribution of the documents to every homeown-er of record as of 10/15/16 and the mailing will include a proxy & executive summary.

Facts matter and history matters.

Why should we all be concerned?

Because as of today, some current members of the CDD and some owners are creating an

adversarial relationship with Lennar and are not looking far enough ahead.

Because as of today, Lennar is in control of the Master, and, while they historically do not insist on

full payment of our debt, they could.

Because, as of today, Lennar controls Aquaterra, which is our only source of irrigation water, and

while there is a contract, there is also an expiration date to that contract, and we could see large

increases in the future.

Because, as of today, Lennar still has to act to remove Medallion’s parcel 35 from Heritage Harbour

Master, and while they will do that in a way that meets their needs, which might even include

turning it over to Medallion, if we are in an adversarial position, there is no chance that any of our

concerns might be considered.

Consider the $900,000, and ask yourself why $900,000 and why in May? There are two messages in

there, especially when you look at the timing. One of Lennar’s consistent behaviors is that if they

believe that there might be a legal claim against them, they will protect their assets. Once the

money comes off the Master’s books, and goes into Lennar’s books, it is probably not coming back

without a legal battle that ultimately could cost more than what we might gain and that will take far

too long.

This Board has learned through our own experience at turnover that the opportunity to resolve any

substantial dispute with the developer actually comes AFTER the turnover date. It is the turnover of

the Master association that now is the key. Until that process occurs, it is not wise to do anything

other than try to cooperate with the developer as best we can, but it is smart to have a plan for

what we want the community to look like and how we want it to be governed when the developer

leaves, part of which should be a plan for road repairs, maintenance and repaving. That means

ongoing discussion with the Master, River Strand, the CDD and anyone else with an interest. That

effort should be encouraged, and more people should get involved.

Within a few weeks some of our lake areas will have native species plants planted along the shorelines. This is part of an ongoing program to provide a cleaner healthier wetland envi-ronment in our community. The biggest challenge we as a community face is understanding why it is necessary that some of our lakes need to have plantings around them. Some concerns I have heard are; “Why do I have to have “weeds” around my lake?” “I want to see down to the shoreline,” “They already cut out the “weeds, why plant new ones?” By defini-tion, a weed is a plant growing in an area where it is not wanted. (Even orchids and roses could be considered weeds.) The “weeds” that were removed from some of the lakes were invasive species plants. (see “Good and Bad Guy Plants” article 8/13)

Human impact is the biggest source of water pollution. It comes from a variety of sources. (1.) nutrient rich lawn water run-off, (2.) throw-ing waste vegetation into the water, (3.) trimming down to shorelines, (4.) encroachment by domesticated plants, (5.) modifying buffer zones by planting ornamental vegetation along property shorelines, (6.) storm drain water is not treated, so debris and oil residue is also transported into our ponds It has a huge impact on the eutrophication of our lakes by providing nutrients for opportunistic and invasive species as well as maturation complexity of species to proliferate.

Different types of pond systems have their own unique challeng-es and possible treatments. The man-made lakes within our community are broken down into two main categories. One group is the water “retention pond” system, these are most commonly found behind your house. They will have a gentle grassy slope surrounding the entire pond or most of it. Some might also contain a check dam or slope drain. Their purpose is to serve as recharged water supply areas.

The main function is to hold water that can be used by the community for the storage of run-off water for irrigation. These ponds are all interconnected and their levels are regulated by the pumping system. Our pumping system can obtain water for irriga-tion from these lakes and from the sub-terrarium aquafer when wa-ter levels run low. The amount of water drawn from the aquafer is regulated by the South West Florida Water Management District. If

our allotment is exceeded, for a given period of time, the system is shut off. If there has been an abundance of rain the system is also shut down when sprinkling is not required. This is regulated by determining the water content of the soil.

The function of a “littoral pond” is to remove excess nutri-ents from the water. In many cases they are also associated with wooded areas. They look similar to retention ponds. However they have a sub-terrarium shelf - “littoral zones” built around their perimeter. The shelf is planted with a variety of native aquatic plants that extract excess pollutants and nutrients from sediment

run off converting them into body tissue. This cleanses the water exiting from the pond back into the water supply. At the present time, I do not have the specifics of the planting. When this becomes available, the ponds, plant species and the number of plants will be shared with you in future articles.

ROVING PATROL IN OUR STONEYBROOK COMMUNITY

Since July of 2008 the Roving Patrol has been making rounds throughout Heritage

Harbour in Stoneybrook, River Strand and Lighthouse Cove 7 nights a week from

6pm to 6am. Between the Roving Patrol and Neighborhood Watch Committee our

community will continue to be a safe place to live. If at anytime between the hours

of 6pm and 6am you feel the need to contact the Roving Patrol Call Center to report

any happenings please call (941) 549-9637.

This service has been provided through the Heritage Harbour Master Association.

Please keep in mind that Heritage Harbour is a lot of ground to cover patrol, but

before you know it those yellow amber lights will be flashing up and down your

street keeping an eye out for your safety.
