1. That Plaintiffs filed an Application to Register Title to certain land in Scott County on April 7, 2006; Court File No. 70-Cv-06-8971.

2. That an Examiner Report was issued by Lee vickerman, Deputy Scott County Examiner of Titles, on September 27, 2006, instruct-ing Plaintiffs to serve, inter alios,

Defendant Paulette Hjelle-Ranta (hereinafter “Hjelle-Ranta”).

3. That Hjelle-Ranta was served, and interposed an Answer, dated January 10, 2007.

4. That Hjelle-Ranta’s Answer alleged that she was the fee owner of Lot 8, Ben’s Bay, Scott County, Minnesota (commonly known as 3141 Fairlawn Ln., Prior Lake, Minnesota, 55372; hereinafter “Lot 8”), having acquired the property by warranty deed on November 29, 2005.

5. That Plaintiffs’ Application to Register Title was withdrawn prior to registration completion.

6. That Hjelle-Ranta executed a first mortgage in favor of Irwin Mortgage Corporation, acting through its agent, Mortgage Electronic Registration Systems, Inc. (hereinafter “MERS”), Scott County Document Number 722952, on December 7, 2005 (here-inafter “First Mortgage”).

7. That Hjelle-Ranta defaulted per the terms of the First Mortgage, and a Foreclosure by Advertisement was commenced on Lot 8 by the Mortgage Assignee Nationstar Mortgage, LLC (hereinafter “Nationstar”), and com-pleted by Sheriff’s Sale on September 27, 2011. The Sheriff’s Certificate of Sale is recorded as Document No. 888344.

8. That Hjelle-Ranta did not redeem Lot 8 within the statutory redemption period, effectively extinguishing all of her rights in Lot 8.

9. That Nationstar conveyed Lot 8 to Federal National Mortgage Association (hereinafter “Fannie Mae”) by way of quit-claim deed on July 6, 2012. The deed is recorded as Document No. 909714.

10. That Plaintiffs Kristiana Haferman and Lawrence Haferman acquired fee title to the property from Fannie Mae by way of limited warranty deed on July 17, 2012. The deed was recorded on August 7, 2012; Document No. 912225.

11. That Plaintiffs intend to file an Amended Application to Register Title to include Lot 8.

12. That Hjelle-Ranta is no longer a proper party to the title registration proceeding due to the completed foreclosure proceeding.

13. That Hjelle-Ranta’s answer and counterclaim should be withdrawn

14. That Plaintiffs’ counsel offered Hjelle-Ranta a dismissal without costs from the proceeding.

15. That Hjelle-Ranta instructed her previous attorney to not grant Plaintiffs a dismissal, to not accept service on her behalf, and to not represent her in this matter.

Based on the above findings, and Rule 116 of the Minnesota Rules of Civil Procedure for District Court, IT IS HEREBY ORDERED THAT, Paulette Hjelle-Ranta appear before this Court on the 19th day of December, 2013, at 9:00 a.m., or as soon thereafter as the matter can be heard, at the Scott County Government Center, 200 Fourth Avenue West, Shakopee, MN 55379, to show cause, if any there be, why this Court should not enter an Order declaring:

1. By way of Declaratory Judgment:

a. Paulette Hjelle-Ranta has no interest in Lot 8;

b. Paulette Hjelle-Ranta is not a proper party to Plaintiffs’ title regis-tration action;

c. Paulette Hjelle-Ranta’s answer and counterclaim should be with-drawn; and

BOARD OF COMMISSIONERSCOUNTY OF SCOTTNOVEMBER 5, 2013

(1) The Board of Commissioners, in and for the County of Scott, Minnesota, met in the Courthouse Board Room in the City of Shakopee, Minnesota, and convened at 10:00 a.m., with the following members present: Commissioner Wolf, presiding, Commissioner Wagner, Commissioner Menden, Commissioner Marschall, and Commissioner Ulrich.

(2) Amendments to the AgendaChair Wolf announced that agenda

item 8.1 to adopt Resolution No. 2013-222 awarding the Contract to Cobalt Contracting Inc. for the Blakeley Trail ravine stabilization is being pulled from today’s agenda per staff’s request.

(3) On a motion by Commissioner Wagner, seconded by Commissioner Ulrich, the Minutes of October 15, 2013 were approved.

(4) Consent Agenda:In response to Commissioner

Marschall’s question regarding agen-da item 5.6 to authorize a contract increase to the 2013 Crackseal-2 Project, Public Works Director/County Engineer Director Mitch Rasmussen explained the process for adding or deleting work on projects under contract.

On a motion by Commissioner Ulrich, seconded by Commissioner Marschall, the following actions were approved unanimously. All resolutions are available in the office of the County Administrator and are made a part of this record by refer-ence.

A. Approve the renewal of the Service Agreement with Custom CARE, LLC effective November 1, 2013 through October 31, 2015 for support services authorized by case managers for clients based on indi-vidual client needs, specifically home and community based services.

B. Approve the Service Agreement with Helping Hands Foster Care effective November 1, 2013 through October 31, 2015 for support ser-vices authorized by case managers for clients based on individual client needs, specifically home and com-munity based services.

C. Approve the request for rezoning (#771-R-5) for Robert Schoenbauer, applicant, of 80.45 acres from A-1, Agricultural Preservation District to A-3, Agricultural Preservation Density District in Section 21 of Helena Township. This action is in accordance with Chapters 2 and 27 of the Scott County Zoning Ordinance No. 3 based on the criteria listed for approval.

D. Approve the Grant Application to Minnesota Homeland Security Emergency Management for an Urban Area Security Initiative Grant in the amount of $55,000.

E. Adopt Resolution No. 2013-219; Authorizing Final Payment for the County Highway 21 Construction From County Highway 42 to County Highway 18 in the Cities of Prior Lake and Shakopee to Enebak Construction Co. in the Amount of $1,000.

F. Adopt Resolution No. 2013-220; Authorizing a Contract Increase to the 2013 Crackseal-2 Project in the Amount of $10,655.28.

G. Adopt Resolution No. 2013-221; Authorizing the Project to Restore the Runout Elevation of Clark’s Lake; and Awarding Contract for the Construction to Brunz Construction Company, Inc. in Accordance With Quote Dated February 26, 2013 in the Amount of $27,337.

H. Adopt Resolution No. 2013-224; Requesting Approval of the Basic Sale Price and Authorization of Public Sale of Five Tax-Forfeited Parcels of Land (PID 040540050; 230290020; 240770220; 261570510; 272000030) and Establish the Date of Public Sale of December 5, 2013 at 9:30 a.m.

I. Adopt Resolution No. 2013-225; Authorizing the Conveyance of a Tax-Forfeited Parcel of Land in the City of Shakopee (PID 273621370) to the City of Shakopee for an Authorized Public Purpose.

J. Approve the Contract with Next Chapter Technology, Inc. for CaseWorks implementation at a con-

tract cost of $258,080. K. Approve a Service Agreement

Contract with Avtex for the support and maintenance of the Microsoft Lync (voice-Over-IP) backend serv-ers and appliances.

L. Approve SQL database adminis-tration services from virteva, Inc. in an amount not to exceed $88,000.

M. Approve an Amendment to the Master Agreement with Endurant Business Solutions, Inc. to increase the not-to-exceed amount by $105,000.

O. Approve the appointment of Nick Mabee of Commissioner District 1 to a youth-at-large posi-tion on the Extension Committee for a term effective November 5, 2013 through August 31, 2014.

P. Adopt Resolution No. 2013-226; Authorizing Entering Into a Contract With the Board of Water and Soil Resources for the 2014 Natural Resources Block Grant in the Amount of $110,160.

Separation of employment for Shani Greene, FT Probationary Social Work Supervisor, Health and Human Services Division, effective 10/25/13. (5) Develop Strong Public Partnerships:Commissioner Wagner moved, seconded by Commissioner Ulrich to adopt Resolution No. 2013-223; Approving the Proclamation That November 15, 2013 is America Recycles Day in Scott County. Commissioner Wagner left the meeting at 10:25 a.m. and returned at 10:29 a.m.

(6) Emphasize Excellence in Customer Service:

A. veterans Services Director Todd Kubinski presented a review of veterans Services activities for the years 2012 and 2013.

B. Commissioner Menden moved, seconded by Commissioner Ulrich to adopt Resolution No. 2013-213; Entering Into a Grant Agreement With the Minnesota Department of veterans Affairs for Operational Improvement. A copy of the resolu-tion is available in the office of the County Administrator and is made a part of this record by reference. The motion carried unanimously.

(7) Manage Challenges and Create Opportunities:

Commissioner Menden moved, seconded by Commissioner Wagner to approve the Minnesota Family Investment Program Biennial Service Agreement for 2014-2015. The motion carried on a vote of four ayes with Commissioner Marschall abstaining.

On a motion by Commissioner Ulrich, seconded by Commissioner Marschall, the meeting adjourned at 11:15 a.m.

USDA Rural Development has funds available to help lo-cal homeowners finance home improvements through low-interest loans and grants.As winter weather is fast ap-

proaching, now is a good time for homeowners to evaluate the need for necessary repairs or replacement of items such as a roof, electrical, plumbing and siding. Energy efficiency im-provements through replacing windows and insulation also qualify. Funds can also be used to replace a furnace, sanitary disposal system and to make homes handicap accessible.Applicants must own and oc-

cupy the home, and their income may not exceed guidelines es-tablished by county and house-hold size. Income limits vary by county and average $24,700 for a one-person household and $28,250 for two-person house-holds. Income limits increase for larger sized households. Applicants should check with the local USDA Rural Develop-ment Office for income limits in a particular county.For loan eligibility, applicants

must also have an acceptable credit history, show repayment ability, be unable to afford a conventional loan and live in a community with a population of 20,000 or fewer. The maximum loan is $20,000, repayable over 20 years with a one percent in-terest rate.Grants are limited to elderly

homeowners over the age of 62, and can only be used to re-move health or safety hazards or remodel dwellings to make them accessible to household members with disabilities. The

maximum grant is $7,500.For assistance in the follow-

A Team EffortGreen Isle Community School students -- from left Abby Koch, Abby Bode, Sami Pollack, Skyler Koch, Shanise Bates, Lauren Menne, Lindsey Czarnecki of Belle Plaine, Johnny Gar-cia, Trevor Parrott and Rollie Spooner -- recently collected over 190 items to help people in need in just four days. The food drive is part of a service learning project at the charter school. Students learn interpersonal skills such as collaboration, civic engagement, and problem solv-ing in addition to other academic skills through reflecting upon the projects. This is done both whole-school and in a small group called the Service Learning Task Force. It allows stu-dents a voice in selecting the projects and provides them an opportunity for leadership in the school and community. Service learning has enabled students, parents, and staff to engage in extensive service projects that benefit the school, the Green Isle community, and other towns around the area.

St. Peter HS Marches out of South Central to Join New ConferenceAlmost two years after its

application to join the Min-nesota River Conference was declined, St. Peter High School has marched out of the South Central Conference to join a new conference, the Big South.In the fall of 2014, the new

conference is expected to in-clude some, but not all, of the schools in the South Central and Southwest conferences. Prospective members of the new conference are expected to be approving their individual applications for membership this week, the St. Peter Herald recently reported.The Big South is expected to

have 13 teams, possibly two di-visions, east and west.The South Central Conference

includes Waseca, St. James Area, Fairmont, New Ulm, Waseca and Blue Earth Area Schools. The Southwest Con-ference includes Jackson Coun-ty Central, Luverne, Marshall, Pipestone Area, Redwood val-ley, Windom Area and Wor-thington high schools.The Saints were a charter

member of the South Central Conference when it formed in 1945.St. Peter’s application to the

MRC was rejected in March of 2012 when conference activi-ties directors voted 4-4 to ac-cept the application. It needed five votes, or a two-thirds ma-jority to pass. Belle Plaine, Jor-dan, Le Sueur-Henderson and Watertown-Mayer supported St. Peter’s entrance into the MRC.
