(A debt to the debtor includes both a debt payable to the debtor alone and a joint debt payable to the debtor and one or more co-owners.)

The garnishee has set out in the attached Garnishee’s Statement (Form 20F) that you are a co-owner of debt. Under the Notice of Garnishment, the garnishee has paid or will pay to the clerk of the Small Claims Court the appropriate share of the amount payable or such a percentage as the court may order.

IF YOU HAVE A CLAIM to the money being paid to the clerk of the Small Claims Court by the garnishee, you have 30 days from service of this notice to request a garnishment hearing by completing and serving a Notice of Garnishment Hearing (Form 20Q) on the creditor, debtor and garnishee, and filing it with the clerk. If you fail to do so, you are not entitled to dispute the enforcement of the creditor’s order for the payment or recovery of money and the funds may be paid out to the creditor unless the court orders otherwise.
